UM, JUST HAVE ONE BRIEF THING THIS EVENING IS, UH, AS I SENT OUT TO YOU IN AN EMAIL, OBVIOUSLY THERE HAVE BEEN SOME, UH, SOME CHANGES IN RECOMMENDATIONS AND, AND ADVISORY NOTICES, AS WELL AS THE, UH, INSTALLATION OF THE STATE ORDER WHERE THE CURFEW AND I KNOW THE COMMUNITY, I HAVING A COUPLE OF EVENTS GOING ON.

UH, I JUST THINK THAT IT WOULD BE, UM, UH, PRUDENTIAL AT LEAST HAVE A DISCUSSION TO SEE WHAT THE DESIRED OUTCOME OF OUR CURRENTLY SCHEDULED EVENTS, UH, BASED ON THE, UM, THE WISHING IN POLICY OF COUNCIL AND FOLLOWING, UH, THAT ADVISORY ORDER.

SO ROB, ARE WE HAVE THE DATE? I THINK IT'S DECEMBER THE FIFTH.

IS THAT THE DATE FOR OUR, UH, OUR OWN CHRISTMAS TREE LIGHTING? NOT THE ONE THAT YES, I BELIEVE SO.

AND THAT FALLS WITHIN THE CANCELED.

YEAH.

SO THAT ORDER GOES THROUGH DECEMBER 17TH.

SO WHAT IS, YEAH, WE KNOW WHAT THE RECOMMENDATIONS FROM THE GOVERNOR ARE.

WE KNOW THE, THE, THE CURFEWS, WE KNOW ALL THOSE THINGS ARE GOING ON.

UH, WHAT, WHAT ARE, WHAT ARE COUNCIL'S FEELINGS ON, UH, ON OUR CHRISTMAS TREE LIGHTING CEREMONY AT THE EICHELBERGER? YES.

OH, GLADLY GIVE MY OPINION.

UM, I THINK THAT, UH, I I'M A GO, UH, YOU KNOW, IF THE MAJORITY IS AGAINST THAT, THAT'S FINE.

UH, I, I PERSONALLY DON'T HAVE AN ISSUE WITH IT.

I MEAN, IT'S OUTDOORS.

UM, THERE'S PLENTY OF SPACE THERE FOR DISTANCING.

UM, I'M SURE WE CAN UTILIZE, YOU KNOW, DIFFERENT WAYS TO, UH, TO PROVIDE SAFETY TO RESIDENTS.

AND, UM, IF RESIDENTS WANTED TO GET OUT AND GET TO SOMETHING LIKE THAT DURING THE SEASON, THEY'D BE ABLE TO, UH, ON THE FLIP SIDE, IF IT WERE TO BE COLD, I'M OKAY WITH THAT.

I ASKED, SORRY, THAT'S KIND OF MIDDLE OF THE ROAD, I GUESS A LITTLE BIT, BUT I GUESS MY PREFERENCE WOULD BE TO KEEP IT, KEEP IT IN FULL SWING, BUT YOU KNOW, IT IS WHAT IT IS.

YOU'RE, YOU'RE WALKING THAT FINE LINE REALLY WELL REALLY WELL.

AGAIN, I IT'S MY PREFERENCE THAT WE HAVE IT FULL ON.

UM, I HAD AN OPPORTUNITY TO, UH, MEET, UH, WITH THE ANB COMMISSION.

UM, OBVIOUSLY BEFORE THESE ORDERS CAME OUT, UM, TODAY I'VE SPOKEN TO A COUPLE OF THEM, UH, VIA TELEPHONE, UM, AS WELL AS SOME OTHER COMMUNITY MEMBERS.

UH, AND I'M GOING TO BE HONEST WITH YOU.

UH, THE CONVERSATIONS HAVE GONE EVERY DIFFERENT DIRECTION, UH, UH, IMAGINABLE, UM, HAVING, UH, YOU KNOW, PLAYED AN INTEGRAL PART IN OUR, UH, UM, CHRISTMAS CELEBRATIONS EACH YEAR.

UM, IT IS MY PERSONAL OPINION AS ONE COUNCIL MEMBER THAT, UM,

THIS EVENT, UH, CONTINUES, UM, WITH THE FULL SUPPORT OF THE CITY COUNCIL AND CITY STAFF, ALONG WITH ACTIVE PARTICIPATION AT THAT EVENT.

UM, I DON'T THINK A VIRTUAL EVENT IS BENEFICIAL IN ANY WAY, SHAPE OR FORM.

I DON'T THINK CANCELING IT IN ANY WAY, SHAPE OR FORM IS BENEFICIAL.

UM, CHRISTMAS IS ONE OF MY FAVORITE TIMES OF THE YEAR.

UM, MY CHRISTMAS TREE IS ALREADY UP MY HOUSE OUTSIDE OF MY HOUSE, DECORATED THE WIND BUSTED TWO OF MY OUTDOOR CANDY CANES.

UM, IT'S MY FAVORITE TIME OF YEAR.

UM, AND IF THERE'S ANY WAY THAT, UH, UM, WITH THE, UM, PROVISIONS IN PLACE THAT WE CAN MAKE SURE THAT OUR COMMUNITY IS SAFE AND HAVING THIS EVENT THEN, UM, I THINK IT NEEDS TO CONTINUE NOW ON THE SECOND PART OF THE CITY MANAGERS, UH, CONVERSATION, WHICH WAS THE CURFEW THAT WAS, UH, UM, PUT IN PLACE BY THE GOVERNOR.

UM, IT WOULD BE MY RECOMMENDATION TO, UH, PLACE POLICY WITH OUR HEBREW HEIGHTS POLICE DEPARTMENT, UH, TO NOT ENFORCE THAT.

UM, I DON'T BELIEVE WE HAVE THE MANPOWER OR THE NECESSITY, AND I BELIEVE IT WOULD OPEN US UP GREATLY FOR, UM, UNNECESSARY, UM, UH, LITIGATION, UH, TO RANDOMLY STOP PEOPLE THAT WHO ARE NOT OUT DURING THAT TIME.

UM, SO, UM, THAT'S MY 2 CENTS AS YOUR CAMERA.

DOES YOU HAVE YOUR HAND RAISED OR YES.

YES.

UH, I'D LIKE TO SPEAK TO THE ISSUE AND I'M, I'M ON THE SIDE OF, UH, UH, MR. OTTO AND MR. SHAW, IF WE MAKE IT AVAILABLE, UM, AND FOLKS WANT TO ATTEND, I THINK THAT'S WHAT WE SHOULD DO, BUT I WOULD, UH, I WOULD SUPPORT THE, UH, DECISION OF COUNCIL, BUT I WOULD, I WOULD LIKE TO SEE THE EVENT GO ON.

YEAH, APPRECIATE THE COMMENTS, UH, FROM ME THREE.

SO LET ME CHIME IN HERE A LITTLE BIT.

I, YOU KNOW, I, UM, THIS, THIS COUNCIL AND THIS IN OUR, IN OUR STAFF SINCE COVID, YOU KNOW, BECAME A THING BACK IN MARCH AND ONCE LOCKDOWN STARTED AND CLOSURE STARTED HAPPENING, YOU KNOW, WE, UH, WE HAVE ALWAYS TAKEN THE POSITION THAT PEOPLE WILL PARTICIPATE IF THEY'RE COMFORTABLE PARTICIPATING.

I DON'T THINK THERE'S ANYTHING THAT WE'VE, THAT WE'VE DONE.

THAT'S KEPT ANYBODY FROM DOING THE THINGS THAT THEY WANT TO DO FROM OUR, UH, OUTDOOR EVENTS THAT WE HAD AT THE EICHELBERGER WHERE WE HELP WE HAVE MUSIC.

WE, WE KNOW THAT WE WERE KIND OF THE FIRST OUT OF THE GATE TO KEEP OUR, UM, UH, TO GIVE YOU A QUICK CENTER OPEN.

WE WERE ONE OF THE ONLY PEOPLE WHO DECIDED TO MOVE FORWARD WITH OUR 4TH OF JULY PARADE.

SO I THINK THROUGH ALL OF THIS, SOME OF THESE CELEBRATIONS AND SOME OF THE THINGS THAT WE'VE DONE, UM, HAVE, HAVE BEEN GOOD FOR THE COMMUNITY HAS BEEN GOOD FOR THE PEOPLE IN THIS COMMUNITY.

ONE OF THE THINGS THAT PEOPLE DON'T REALLY TALK ABOUT ENOUGH IS, UH, AND I THINK ONE OF THE REASONS THAT WE DO NEED TO HAVE OUR CHRISTMAS TREE LIGHTING EVENT IS BECAUSE DURING THESE TIMES, ONE OF THE THINGS THAT PEOPLE HAVEN'T TALKED ENOUGH ABOUT IS JUST THE OVERALL MENTAL HEALTH OF PEOPLE.

AND I THINK THAT THE MENTAL HEALTH OF OUR COMMUNITY AND THE MENTALITY OF PEOPLE TO HAVE THE OPPORTUNITY, UH, TO CELEBRATE A CHRISTMAS TREE LIGHTING AS LITTLE AS THAT MIGHT SEEM, OR AS MINOR AS THAT MIGHT SEEM, THAT IS, I THINK THAT'S A BIG DEAL.

AND I THINK ANYTHING WE CAN DO THAT, THAT BRINGS, AGAIN, SOME NORMALCY TO PEOPLE'S, UH, JOYS OF PEOPLE THAT WE CAN ACTIVELY DO AS A COMMUNITY.

I THINK THAT'S GREAT.

THERE ARE PEOPLE WHO ARE SCARED AND WHO ARE WORRIED, UM, WHO PROBABLY WON'T COME AND THEY SHOULDN'T COME.

I THINK WE'VE ALL SAID, AND I'VE SAID MANY, MANY TIMES, YOU NEED TO DO WHAT YOU NEED TO DO TO MAKE SURE YOUR FAMILY'S TAKEN CARE OF, AND YOUR FAMILY IS SAFE AND YOU CAN ACT IN THAT MANNER THAT HELPS YOU TAKE CARE OF YOUR FAMILY.

AND IF, AND IF YOU BELIEVE THAT BEING OUT, IF IT'S OUTSIDE IN THE OPEN, THEN YOU CAN PARTICIPATE.

I WOULD ADD THOUGH, I BELIEVE ROB, IT ISN'T THE GOVERNOR'S NEW RESTRICTIONS WHERE THEY, HE DID MENTION OUT EVEN OUTDOOR CONGREGATE AREAS, AS FAR AS, UH, PEOPLE DON'T NEED TO BE UP AND CONGREGATING IF THEY WERE PEOPLE WERE OUTSIDE, KIND OF THE RECOMMENDATION WAS TO STAY SEATED.

I THINK THAT'S, I THINK THAT KIND OF WENT ALONG WITH THE WHOLE NOTE DANCING ORDER, YOU KNOW, BUT, UM, IF THAT'S THE CASE, THERE IS SEATING AT THE EICHELBERGER AMPHITHEATER.

SO I THINK THERE IS ROOM WHERE PEOPLE COULD SIT DOWN ON ALL THE BENCHES THAT ARE THERE.

UH, I THINK THERE'S AREAS PLENTY OF GRASS AREAS WHERE PEOPLE COULD BRING CHAIRS AND BLANKETS WHERE

SOCIAL DISTANCING REALLY COULD BE PRACTICED IN EVEN AN HOUR IN THAT OUTDOOR ENVIRONMENT.

UM, AND WE PROVIDE SEATING THERE.

SO IF THERE WAS, UH, IF I'M MISTAKEN, THE WAY I UNDERSTOOD THAT ORDER, AND MAYBE THAT IS ONLY INSIDE, NOT OUTSIDE, BUT WHEN I HEAR CONGREGATE AREAS, I THINK ABOUT WHAT OUR TREE LIGHTING CEREMONY MIGHT BE.

BUT I THINK WE HAVE THE ROOM FOR PEOPLE TO BE SEATED IF THAT'S PART OF THE ORDER WHERE WE WOULDN'T BE OPENLY VIOLATING, UM, YOU KNOW, A, UH, WHAT I BELIEVE WITH THE GOVERNOR CALLED A SLOWDOWN, NOT A SHUTDOWN.

UM, ROB, DO YOU HAVE ANYTHING TO, I MEAN, IS THERE, AM I UNDERSTANDING THAT RIGHT? OR, UM, AND I GUESS, AND I WOULDN'T BE INTERESTED IN YOUR, IN YOUR OPINION TOO.

I MEAN, YOU'VE BEEN, UH, YOU KNOW, YOU AND I HAVE HAD ALL THOSE CONVERSATIONS ALL SUMMER ABOUT THE EVENTS THAT WE'RE DOING, THE AQUATIC CENTER, AND WE'VE ALWAYS BEEN ON THE SAME PAGE.

SO I'M ASSUMING THAT WE'RE ON THE SAME PAGE HERE FROM, FROM WHAT, FROM WHAT YOU BELIEVE IS AS THE MANAGER OF THE CITY, UM, WHO WORKS ALL OF OUR, YOU KNOW, VERY, VERY IN TUNE TO ALL OF OUR EMS SERVICES, UH, IS THAT STILL KIND OF THE RECOMMENDATION OF THE, OF THE CITY AS WELL, THAT, YOU KNOW, WE, WE OFFER THINGS THAT THE CITY CAN PARTICIPATE IN AND IF THEY DON'T WANT TO, THEY DON'T HAVE TO.

YEAH, I CERTAINLY WOULD, WOULD AGREE WITH THE SENTIMENTS THAT HAVE BEEN REFLECTED THUS FAR.

UM, WE'VE, YOU KNOW, THE COMMUNITY HAS RESPONDED WELL.

I THINK THAT, UH, YOU KNOW, THE, THE THINGS THAT WE HAVE DONE, UH, HAVE BEEN CHECKED OFF BY THE DEPARTMENT OF HEALTH AND THE MANNERS AND WAYS, I THINK THAT, UH, OUR STAFF, OUR VOLUNTEERS, OUR RESIDENTS ARE WELL-TRAINED AND INFORMED AS TO WHAT IT TAKES TO MAKE SURE THAT IF THEY MAKE DECISIONS TO DO THINGS, HOW TO DO THEM WITH CAUTION AND SAFETY.

AND, UM, AND I AGREE WITH YOU THAT THE ORDER DOESN'T, UM, EXPLICITLY PROHIBIT THE ABILITY TO MOVE THOSE THINGS ON.

UH, THE ONLY THING WOULD BE IS THAT THERE'S THE REASON I BRING IT UP IS BECAUSE, UM, AS NOTED MANY OTHER AREA EVENTS, WE, WE LIKELY WILL BE ONE OF THE ONLY COMMUNITIES HAVING SOMETHING.

AND, UM, WE JUST WANT TO MAKE SURE THAT WE'RE AWARE OF, UM, MAKING SURE THAT WE INFORM PEOPLE EXTRA ABOUT THE ADDITIONAL GUIDELINES.

AND IF WE CONTINUE TO GO ON WITH THE EVENT, UH, FROM A STAFF SIDE PERSPECTIVE, IF THAT'S WHAT COUNCIL WANTS, WE WILL MAKE SURE THAT WE WILL INFORM OUR VOLUNTEERS AND OUR STAFF AND ALL THE ATTENDEES HAVE ALL THE INFORMATION NECESSARY TO BE WITHIN COMPLIANCE OF THOSE GUIDELINES AND ORDERS.

CAUSE, AND I THINK, UH, YEAH, SOME OF THESE EVENTS ARE JUST KIND OF, YOU KNOW, THEY'RE, THEY'RE DROPPING OFF.

AND, UM, I THINK I JUST SAW WHERE WASHINGTON TOWNSHIP WAS LIKE THE LATEST ONE TO, TO CLOSE OR CANCEL THEIR, THEIR TREE LIGHTING EVENT.

SO, UM, AS YOU SAID, WE'VE, WE'VE KIND OF BEEN A LEADER IN STILL ALLOWING THINGS TO GO ON AND IN THE WHOLE REGION.

AND WE PROBABLY DO GET PEOPLE FROM OTHER AREAS THAT COME HERE TO ENJOY SOME OF THE THINGS THAT WE DO.

SO, SO CERTAINLY APPRECIATE THAT.

UM, MS. BURCH, UH, YES.

UM, WHILE WE CONTINUED TO, UM, RUN OUR EVENTS, THIS SUMMER THINGS HAVE CHANGED DRAMATICALLY SINCE THEN.

THEY'RE PROJECTING THAT TOMORROW, IF NOT TOMORROW, THE NEXT DAY, THE NUMBER OF CASES PER DAY IN OHIO ARE GONNA RISE TO 10,000.

UM, THERE'S A, UH, PUBLIC HEALTH, UH, MONTGOMERY COUNTY ORDER FOR PEOPLE TO STAY AT HOME.

OUR SCHOOLS ARE GOING REMOTE.

THE KIDS THAT ARE COMING HOME FROM COLLEGE ARE GOING TO STAY HOME, MANY OF THEM THROUGH THE REST OF THE YEAR AND, AND DO, UH, REMOTE STUDYING.

UM, I, I, I DON'T HAVE A PROBLEM WITH HAVING A TREE LIGHTING EVENT FOR ANYBODY THAT WANTS TO GO OUT THERE AND STAND IN THE OPEN, BUT I DO HAVE A PROBLEM WITH OUR NORMAL, UM, KIDS' ACTIVITIES AND THINGS, AND, AND, OR ENCOURAGING THE KIDS TO COME OUT BECAUSE, YOU KNOW, THEY WILL NOT BE SOCIALLY DISTANCED, UH, WHILE THEY'RE DOING THEIR ACTIVITIES OR WHILE THEY'RE DRINKING THEIR COCOA OR WHATEVER ELSE.

AND CERTAINLY NOT TO, UM, TO TALK TO SANTA.

I, I THINK THAT IT'S, IT'S NOT WISE BECAUSE OF THE CURRENT CORONAVIRUS NUMBERS THAT WE TAKE THE RISKS NOW.

AND, AND THE IDEA OF US TAKING THE LEAD IS ONE THING, BUT THIS VIRUS HAS HIT A CRITICAL POINT AND WE HAVE TO RECOGNIZE THAT IT'S HIT A CRITICAL POINT.

AND I WOULD MUCH RATHER FOCUS ON AN ACTIVITY, AN ALTERNATE ACTIVITY, LIKE ENCOURAGING OUR BUSINESSES IN OUR HOUSE, OUR HOMEOWNERS, TO, TO, UH, OUR RESIDENTS, TO LIGHT UP THE CITY AND TO CREATE THE CHRISTMAS, CHEER THAT WAY AND TO PUT UP THEIR CHRISTMAS DECORATIONS AND, AND TRY TO TRY TO FEEL SOME NORMALCY, UH, DURING THIS REALLY CRAZY HOLIDAY SEASON.

UM, YOU KNOW, IT'S, I AM TEMPTED TO SAY, I'M NOT, I DON'T GO OUT BECAUSE I'M SCARED AT FIRST IT WAS FOR AN ABUNDANCE OF CAUTION, BUT NOW I'M SCARED.

I REALLY AM.

WHEN THE NUMBERS STARTED HITTING ABOUT 10,000 A DAY AND THE HOSPITALS ARE GETTING FULLER AND EVERYTHING.

UM, I, I DON'T THINK THAT THAT HAVING THE, UH, EVENT AT THE, UH, EICHELBERGER IS THIS A SARAH REALLY THE RIGHT WAY TO APPROACH THIS, THIS HOLIDAY SEASON WITH RESPECT TO LOOKING OUT FOR OUR, UM, OUR RESIDENTS.

UM, AND THERE ARE SO MANY PEOPLE, I KNOW MY SON-IN-LAW STARTING MONDAY, THE, HIS COMPANY, UH, WHEN HE WORKS AT SPEEDWAY, THEY'RE ALL SENDING EVERYBODY HOME TO WORK REMOTELY THE REST OF THE YEAR.

AND YOU'RE SEEING MORE AND MORE OF THAT.

SO I JUST, I DON'T KNOW.

I JUST, I THINK THAT BECAUSE OF PUBLIC HEALTH ORDER IS TO STAY AT HOME, THEN WE NEED TO STAY AT HOME.

WE DON'T NEED TO HAVE ACTIVITIES FOR PEOPLE TO DRAW THEM BACK OUT OF THEIR HOUSES.

THAT'S MY INPUT.

SO I APPRECIATE THAT INPUT AND EASY.

AND I THINK THAT'S PROBABLY SOMETHING THAT EVERYONE NEEDS TO TAKE INTO CONSIDERATION.

AND I DON'T KNOW IF IT'S, IF IT'S A MODIFIED, YOU KNOW, IF, IF IT'S ANY TYPE OF MODIFIED, UH, EVENT IN LIGHTING THE TREE, MAYBE IT ISN'T THE, YOU KNOW, THE WHOLE BIG GATHERING THAT, THAT WE HAD BEFORE.

BUT I TELL YOU ONE OF THE THINGS THAT, YOU KNOW, W WE'RE NOT THINKING ABOUT, I DO THINK THAT IF, UM, I THINK WE'RE ON THE VERGE, WE KNOW THAT MONTGOMERY COUNTY IS ONE OF THE THREE COUNTIES ON THE WATCH LIST FOR THE CODE.

I GUESS THE LEVEL FOUR OF THE, OF THE REAL STATE OF EMERGENCY WITH THIS THING.

UM, THE WAY I UNDERSTAND IT IS THE, THE COUNTY HAS BEEN, HAS HIT THOSE SIX OUT OF THE EIGHT INDICATORS A COUPLE OF TIMES, BUT THE, TO ADVANCE TO THAT NEXT LEVEL OF LEVEL FOUR, YOU HAVE TO BE, YOU HAVE TO MEET SIX OF THE EIGHT INDICATORS IN, IN CONSECUTIVE WEEKS.

AND I THINK THAT'S, WHAT'S PUT US ON THE WATCH LIST NOW IS THAT, UH, IF WE, IF WE HIT ONE MORE WEEK, UH, CONSECUTIVELY WHERE WE'VE HIT THOSE SIX INDICATORS, THEN, THEN WE WOULD END UP BEING A PURPLE COUNTY AS WELL.

SO I THINK WE HAVE TO BE PREPARED TO THINK IF WE, YOU KNOW, IF IT'S STILL AT A RED LEVEL OR REALIZED THE NUMBERS ARE GETTING WORSE, BUT IF IT'S A RED LEVEL, I THINK I WOULD BE OKAY WITH SOME TYPE OF A MODIFIED EVENT, UH, AT THE EICHELBERGER.

I CERTAINLY, AS A PUBLIC SAFETY DIRECTOR WOULD NOT ADVOCATE THAT.
