UH, I SERVE ON CITY COUNCIL FOR ABOUT 10 YEARS UP UNTIL THE END OF 2011.

UM, I WAS ON THIS COMMISSION TWICE BEFORE, UH, ONCE PRIOR TO HIS BEING ON COUNCIL AND ONCE AS A LIAISON BETWEEN COUNCIL AND THE COMMISSION.

AND, UH, I AM A, UH, AN ATTORNEY IN PRIVATE PRACTICE.

MY OFFICE IS DOWNTOWN DAYTON AND, UH, I CAN, UH, EITHER THANK OR BLAME GLENN FOR GETTING ME ON INVOLVED IN THIS COMMISSION.

AND, UM, THE DECISION WAS MADE TO HAVE TWO COUNCIL REPRESENTATIVES, BE MEMBERS OF THE ORDINANCE REVIEW COMMISSION AND THEN FIVE CITIZEN MEMBERS.

UM, I'M NOT A VOTING MEMBER OF THE COMMISSION.

I AM HERE AS YOUR STAFF LIAISON AND FOR, UH, YOU KNOW, SUPPORT, UH, STAFF SUPPORT IN TERMS OF, UH, CARRYING ON SOME OF THE FUNCTIONS AND WORK THAT'S GOING TO NEED TO TAKE PLACE IN BETWEEN THE MEETINGS OF THE ORDINANCE REVIEW COMMISSION.

AND, UM, THAT WAS A ROLE I PERFORMED 10 YEARS AGO AS WELL.

TWO C UH, IT WAS JUST TO GIVE YOU A LITTLE BIT OF BACKGROUND INFORMATION ON THE ORDINANCE REVIEW COMMISSION.

UM, FOR THOSE OF YOU WHO ARE NOT AWARE, THE ORDINANCE REVIEW COMMISSION IS ESTABLISHED AS PART OF A PROCESS OUTLINED IN THE HUMAN RIGHTS CITY CHARTER, UH, SECTION FIVE OH EIGHT D.

AND IT SAYS WITHIN TWO YEARS AFTER THE ADOPTION OF THIS CHARTER, AND AT LEAST EVERY 10 YEARS THEREAFTER, THE COUNCIL SHALL APPOINT AN ORDINANCE REVIEW COMMISSION OF NOT LESS THAN SEVEN ELECTORS OF THE CITY.

IT SHALL BE THE DUTY OF THE COMMISSION TO REVIEW THE CITY CODE IF ONE EXISTS AND OTHER ORDINANCES OR RESOLUTIONS OF THE CITY, AND TO MAKE RECOMMENDATIONS TO COUNCIL FOR THE ELIMINATION OR REVISION OF PROVISIONS OF THE CITY CODES AND OTHER ORDINANCES AND RESOLUTIONS, WHICH MAY IN THE OPINION OF THE COMMISSION HAVE OUTLIVED THEIR USEFULNESS OR PRACTICALITY.

THE COMMISSION SHALL SUBMIT ITS REPORT TO COUNCIL WITHIN YEAR AFTER ITS APPOINTMENT.

COUNCIL MAY TAKE ANY ACTION AT ITS DISCRETION AS A DEEMS WARRANTED WITH RESPECT TO THE RECOMMENDATIONS OF THE COMMISSION.

SO IN A NUTSHELL, THAT KIND OF SPELLS OUT THE PROCESS.

THIS IS BASICALLY UP TO A ONE-YEAR PROCESS.

UM, YOU GUYS WILL BE GOING THROUGH AN EXHAUSTIVE REVIEW OF THE CODES AS WELL AS CITY ORDINANCES AND RESOLUTIONS AND, UH, YOU KNOW, EVALUATING THOSE RECOMMENDATIONS FOR CHANGES, ADDITIONS, OR DELETIONS, UH, TO, TO THOSE, UM, DOCUMENTS, UM, AND MAKING THOSE RECOMMENDATIONS IN A FINAL REPORT, UM, ON BEHALF OF THE COMMISSION TO THE CITY COUNCIL.

SO, UM, AS WAS MENTIONED BY A COUPLE OF OUR MEMBERS, THE LAST, UH, ORDINANCE REVIEW COMMISSION 10 YEARS AGO WAS INAUGURATED IN 2010 ABOUT THIS TIME OF THE YEAR.

AND, UH, WENT UNTIL NOVEMBER OF 2011.

UM, AS WE INDICATED, WE HAVE TWO MEMBERS ON THIS COMMISSION THAT SERVED ON THE LAST ORDINANCE REVIEW COMMISSION.

MOVING ON NEXT TO THE, THE ACTUAL PROCESS DISCUSSION.

UM, AS I MENTIONED, I'VE BEEN ON, I'VE SERVED ON TWO AND THE METHODOLOGY THAT WAS USED, UH, THE FIRST GO ROUND WAS WHERE THE VARIOUS SECTIONS OF THE CODE AS WE WORKED OUR WAY THROUGH, IT WERE DIVIDED UP SO THAT, UM, CERTAIN PERSONS ON THE COMMITTEE REVIEWED CERTAIN SECTIONS AND THEN BROUGHT BACK REPORTS.

THE LAST TIME WE DID THIS, THE COMMITTEE AS A WHOLE REVIEWED ALL THE SECTION SECTIONS AS WE WENT THROUGH.

AND BASICALLY WHAT WE WOULD DO IS WE DIVIDE UP THE, UH, THE, THE, THE CODE ORDINANCES AND SAY, OKAY, THIS NEXT MEETING, WE'D BE PREPARED TO TALK ABOUT THESE SECTIONS, YOU KNOW, FROM CODE SEXUAL 1.01 TO WHATEVER.

UM, AND, UH, I PERSONALLY, I FOUND THAT TO BE A LITTLE BIT BETTER BECAUSE I THINK WE GOT MORE INPUT FROM ALL THE MEMBERS, UH, SINCE THEY, WE WERE ALL LOOKING AT THE SAME THINGS AT THE SAME TIME, UM, CLAN, YOU WERE INVOLVED IN THAT, WHAT'S YOUR TAKE ON THAT? I WASN'T THERE FOR THE FIRST GO ROUND, BUT I THOUGHT IT WENT PRETTY SMOOTH LAST TIME.

IT DID GIVE EVERYBODY AN OPPORTUNITY TO READ THROUGH ALL OF IT AND BRING WHATEVER COMMENTS THAT THEY MIGHT HAVE OR SUGGESTIONS.

UM, I ALSO LIKE HOW IT WAS KIND OF BROKEN DOWN BY THE WEIGHTINESS OF EACH SUBJECT.

WE KIND OF PUT A WHOLE LOT IN A BASKET WHEN WE HAD LIGHTER SUBJECTS.

AND THEN WHEN WE GOT TO THE HEAVIER ONES, WE SHRUNK THOSE DOWN TO GIVE US MORE TIME TO, TO PULL DETAILS.

SO I THOUGHT IT WORKED OUT VERY OKAY.

YEAH, I DID TOO.

AND, UH, IF I RECALL CORRECTLY, GLEN, WHEN WE WOULD GET INTO THE VARIOUS SUBSTANTIVE AREAS OF THE CODE, WE WOULD, A LOT OF TIMES HAVE REPRESENTATIVES FROM STAFF WHO WOULD BE PRESENT TO HELP, UM, BRING THE STAFF'S PERSPECTIVE TO THE VARIOUS ORDINANCES.

YEAH.

I, I RECALL WE HAD REPRESENTATIVES FROM POLICE FIRE, UH, THE, THE WATER COMPANY, UH, WE HAD PRETTY MUCH EVERY DEPARTMENT HEAD CAME IN WHEN THEIR SECTION CAME INTO PLAY FOR WHATEVER REASON, AND THEY WOULD GIVE THEIR OPINION ON IT.

AND AGAIN, I THOUGHT THAT WORKED OUT WELL, CAUSE THEY, THEY, I DO RECALL THERE WERE SOME THINGS THAT WERE PICKED UP AND POINTED OUT FROM THEM THAT WE DIDN'T THINK ABOUT.

SO YEAH, WITH THEM BEING, HAVING THEIR FEET ON THE GROUND AND IT, THEY BROUGHT A PERSPECTIVE THAT WE WOULD NOT HAVE.

RIGHT.

AND I HAVE DISCUSSED ALREADY WITH, UH, THE CITY MANAGER AND CITY STAFF ABOUT THIS PROCESS AND THE LIKELIHOOD THAT THEY WOULD BE ENGAGED IN THEIR RESPECTIVE AREAS OF, OF THE CODE REVIEW.

UM, AS WELL AS WITH THE LAW DIRECTOR, UH, BEING AVAILABLE TO RUN ISSUES OF LEGALITY AND, UH, SUCH BY, UM, IN TERMS OF INTERPRETATIONS OF THE CODE OR REWRITINGS OF THE CODE THAT THE LAW DIRECTOR WOULD BE INVOLVED IN THAT PROCESS AS WELL.

AND THEN, YOU KNOW, ON THE, ON THE, THE OUTSIDE END OR THE, THE END OF IT.

UM, AS TONY MENTIONED EARLY ON THE, ONE OF THE, UM, THE END PROCESS WILL BE A REPORT ISSUED BY THE COMMISSION, UM, AFTER WE'VE GONE THROUGH ALL OF THE ORDINANCES.

UM, AND THEN WITH RECOMMENDATIONS TO COUNCIL, UH, FOR THEIR REVIEW TO DETERMINE THOSE THINGS THAT WE FELT THAT, UH, MIGHT BECOME, YOU KNOW, W WARREN, UH, LOOK BY THEM FROM A LEGISLATIVE POINT OF VIEW.

AND, UM, IN THE PACKET THAT EVERYBODY GOT TODAY, I NOTICED THAT THERE WAS THE SUMMARY OF ALL THE VARIOUS ORDINANCES THAT WERE REVIEWED, WHAT THE RECOMMENDATIONS WERE.

UH, SOME OF THE THINGS REQUIRED TO GO TO THE CITY ATTORNEY BECAUSE THERE WERE LIKE TONY MENTIONED LEGALITY INVOLVED.

AND SO WE WANTED THE CITY ATTORNEYS TO LOOK AT IT BEFORE IT WENT TO COUNCIL, AND THEN IT TALKS ABOUT, AND THEN ALL THE VARIOUS THINGS WHERE THE STATUS WAS COMPLETED.

AND TONY, DOES THAT MEAN THAT THE, WHEN IT SAYS STATUS COMPLETED, DOES THAT MEAN THAT IT WAS ACTED UPON BY COUNCIL OR JUST OUT OF COMMITTEE? YES.
