SO IF, UH, I WOULD, IF I COULD GET A MOTION AND A SECOND, WE'LL GO AND AMEND THE AGENDA AND WE WOULD MAKE THAT ITEM THREE G AT THE END OF THE CURRENT AGENDA THAT WE HAVE OUR MOTION TO AMEND MOTION.

UM, COULD I ASK THE CLERK OF COUNCIL? WHAT WAS THE REASON FOR THE DELAY IN GETTING THAT ITEM OUT TO COUNCIL BEFORE THE PACKET? WELL, THIS WAS SOMETHING THAT HAD BEEN ANTICIPATED, UM, THAT IT WOULD TAKE SOME MANEUVERING AND WRANGLING BETWEEN THE ATTORNEYS, UH, BOTH PARTIES TO HAVE READY.

AND SO IT WAS NOT PROJECTED TO BE ON UNTIL THE NEXT COUNCIL WORK SESSION.

AND, UM, MR. CHUCK KOSKI HAD CONTACTED ME AND LET ME KNOW THAT THEY WERE ABLE TO WORK THROUGH THE LEGAL, UH, TERMS MUCH QUICKER THAN ANTICIPATED AND THE INTEREST OF GETTING THIS CONTRACT MOVING FORWARD AS IT WOULD BE PLACED ON THE AGENDA FOR THIS EVENING.

AND THAT WAS, THAT TOOK PLACE AFTER THE PACKET HAD ALREADY BEEN DISTRIBUTED.

YOU NEED JUST A COUPLE OF BRIEF THINGS THIS EVENING, A QUICK UPDATE ON OUR CENSUS PROGRESS.

WE HAVE SURPASSED THE PERCENTAGE OF RETURN ON OUR 2010 CENSUS.

SO THE OUTREACH AND THE PUBLIC ENGAGEMENTS EFFORT EFFORTS HAVE HOPEFULLY PAID OFF NOT ONLY BY A BIAS LOCALLY, BUT REGIONALLY AND, AND, AND ALSO THROUGHOUT THE ENTIRE CENSUS CAMPAIGN.

SO THERE'S STILL TIME.

WE STILL ENCOURAGE PEOPLE TO GET OUT THERE AND, UH, MAKE THEIR, UM, MAKE THEIR POSITION, UM, UH, COUNT AND, UH, REGARDING THE CENSUS.

SO WE'RE REALLY APPRECIATIVE FOR ALL THE EFFORTS GONE INTO THAT.

UH, WE WE'VE HAD A NUMBER OF WATER MAIN BREAKS OCCUR, UH, THAT YOU MIGHT HAVE SEEN OR HEARD ABOUT MANY OF THEM HAVE NOT RESOLVED IN, IN BOIL ADVISORIES.

UH, BUT NONETHELESS, AS YOU CAN SEE THROUGHOUT THE REGION, UH, THERE ARE A NUMBER OF WATER MAIN BREAKS, AND, UM, MUCH OF THE, MANY OF THE EXPERTS IN THE FIELD SAY THAT IT IS ATTRIBUTED TO, UM, TWO, PERHAPS TEMPERATURES, ANY EXTREME TEMPERATURES, WHETHER IT BE HOT OR COLD CAN AFFECT.

UH, BUT WE'RE GOING TO GO THROUGH SOME DILIGENCE WORK WITH SUEZ AND POTENTIALLY AN OUTSIDE CONTRACTOR TO COME IN AND JUST EVALUATE, JUST TO MAKE SURE THAT WE HAVE EVERYTHING SET AND EVALUATE TO SEE IF THERE ARE ANY PARTICULAR AREAS THAT NEED SPECIAL CONCERN REGARDING OUR WATER UTILITY.

THE LAST THING THAT WE WANT IS TO HAVE A SYSTEM THAT IS IN NEED OF REPAIR UNKNOWING TO US.

OF COURSE WE CAN'T CONTROL EXTREME CLIMATE CHANGES OR TEMPERATURE CHANGES, UM, OF THE LIGHT THAT WOULD AFFECT WATER MAINS, UM, UH, ESPECIALLY IN THE AREA AND ESPECIALLY SOME OF THE ORDER AREAS OF THE COMMUNITY, BUT NONETHELESS, WE'RE GOING TO CONTINUE TO MONITOR IT AND MAKE SURE THAT WE ARE ATTEMPTING TO STAY AHEAD OF POTENTIAL ISSUES AND DOING PREVENTATIVE MAINTENANCE, UH, BECAUSE AS WE'VE INDICATED, UM, OUR WATER SYSTEM AND UTILITY IS A VERY VALUABLE ASSET AND A VERY CRITICAL TO THE SUCCESS OF OUR COMMUNITY.

SO, UM, A BRIEF UPDATE ON THAT IF YOU HEAR ABOUT WATER MAIN BREAKS, UH, THEY, WE HAVE HAD SEVERAL AND, UH, SO HAS ALL THE OTHER MAJOR SYSTEMS IN THE REGION, UH, BUT WE'RE MAKING SURE THAT WHAT WE ARE DOING IS, IS CORRECT.

AND WE APPRECIATE THE WORK OF PAM AND SUEZ OF STAYING ON TOP OF IT AND BEING PROACTIVE IN GETTING THAT, UH, THEN THAT'S THING THAT I WANT TO DO SHOW REAL QUICK.

AND, UM, IF YOU WOULD ALLOW ME, I'LL SHARE A SCREEN BRIEFLY, WE HAVE THE, UH, VETERANS MEMORIAL, UH, UPDATE REGARDING, UH, OUR, OUR PROGRESS.

UH, AS YOU KNOW, WE HAD THE SUDDEN LOSS OF ONE OF THE KEY CONTRIBUTORS TO SOME OF THE COORDINATED EFFORTS, UH, AND, UM, UH, MESS SERGEANT LOU BROWN, WHO, UH, WHOSE SUE'S LIFE ENDED EARLIER IN THE YEAR.

UM, WE HAVE, UH, PICKED UP, UH, MAINLY IN HIS HONOR AND AS WELL, UH, IN HIS FOOTSTEPS OF SOME OF THE OUTREACH, UH, REGARDING SOME SPONSORS REGARDING SOME WORK, UH, RESEARCH, ET CETERA, THAT WAS ONGOING FOR THAT.

UH, AS A RESULT, OUR, UH, OUR ARCHITECT HAS COME UP WITH A COUPLE OF RENDERINGS, UH, THAT I'LL SHOW HERE THIS EVENING.

UH, WE'RE GOING TO MAKE, AFTER THE WORKING COMMITTEE MET, WE'RE GOING TO MAKE A ONE MODEST, MINOR MODIFICATION TO IT.

AND AS YOU CAN SEE THE RENDERING ON THE PAGE, NOW YOU SEE THAT THE MONUMENT ITSELF IS SQUARED WITH A PARKING LOT.

UH, WHAT WE'RE GOING TO DO IS WE'RE GOING TO TAKE, UH, THE MONUMENT AND MOVE IT TO WHERE IT IS MORE, UM, TRIANGULATED WITH THE TRIANGULAR SHAPE OF THE LOT ITSELF.

UH, THAT DOES TWO THINGS.

UM, NUMBER ONE, IT FALLS IN LINE WITH THE KIND OF NATURAL LANDSCAPE OF THE TREE AND THE SIDEWALK, AND ALSO FOR VISIBILITY OF COMING DOWN THE MAIN DRIVEWAY ENTRANCE OF THE MONUMENT ITSELF.

SO, UH, THE NEXT RENDERING HERE, YOU CAN SEE A BIT OF A DIFFERENT PERSPECTIVE, UM, FOR WHAT THE, WHAT THE GOAL IS.

THIS WOULD BE A MAIN THING, UM, UH, PROVIDING GENERAL MONUMENT TO ALL THOSE THAT HAVE, UH, THAT HAVE SERVED AND SACRIFICED.

AND THEN, UH, EACH SIDE, A BRANCH OF EACH DIVISION OF THE MILITARY, AS WELL AS A ONE PILLAR THAT COULD STAND FOR PATRON SPONSORS, UH, THAT WE, UH, THAT WE WILL ENGAGE IN WORK ON THE AREA THAT YOU SEE IN THE, IN THE PATHWAYS IS THE EDUCATIONAL OR WALK OF THE WARS, UM, AS, AS WOULD, UH, BE NOTED THAT WOULD INDICATE, UH, WARS AND CONFLICTS AND EDUCATIONAL COMPONENTS AND PIECES, UM, THAT WOULD ALLOW PEOPLE TO WALK THROUGH, UH, FIELD TRIPS FOR SCHOOLS, ET CETERA.

AND I KNOW WE'VE COVERED A LOT OF THIS BEFORE, BUT THIS IS THE POTENTIAL DESIGN AND RENDERING OF IT.

AND THEN A REFLECTION AREA, UH, OUT IN, IN THIS SPOT HERE THAT WOULD BE KIND OF OFFSET FOR QUIET REFLECTION.

UH, BUT LOOKING FOR ON A, ON A HIGH END OF, OF SOME THINGS, MANY OF THE SITE IMPROVEMENTS AND SITE ACQUISITION DOESN'T COUNT BECAUSE WE OBVIOUSLY OWN IT, UH, SO THAT THOSE FEES COULD CERTAINLY BE ADJUSTED.

AND, UH, WE WILL BEGIN TO DRILL THAT DOWN AND IDENTIFY MORE SHARPLY WHAT AN ACTUAL BUDGET WOULD BE AND BEGIN TO APPLY.

UH, THE NEXT PHASE OF ACTUAL DESIGN L WOULD BE THE NEXT STEP.

SO, UH, W OF COURSE HAD HAD A BIT OF A DELAY.

WE WERE WORKING ON SOME CONTACTS WITH SOME, UH, ORGANIZATIONS FOR SPONSORSHIP, UH, RIGHT AROUND THE MARCH TIMEFRAME.

AND OBVIOUSLY WE KNOW WHAT HAPPENED THEN, AND WE KNOW WHAT HAPPENED WITH A LOT OF FUNDS AND PROJECTS THAT PEOPLE WOULD GET BEHIND, UH, HAVE BEEN PUT KIND OF SOMEWHAT ON HOLD.

UM, AND ALSO THE LOSS OF, UM, OF, UH, OF LOU BROWN AS WELL.

UH, BUT NONETHELESS, THE GROUP, UH, THE MILITARY AND VETERANS COMMISSION, CITIZENS, UH, HUMAN RIGHTS, VETERAN MEMORIAL FOLKS, UH, ALL THOSE ARE STILL, UH, PASSIONATELY INVOLVED AND INTERESTED IN MAKING SURE THAT THIS PROJECT CONTINUES.

UM, I'VE GOT THE SAME PROBLEMS AND COMMUNICATION, UH, COUNCILMAN BERGE, UH, THAT THEY HAVE, UH, PULLED THE DATE BACK BY 30 DAYS.

I JUST GAVE HIM, JUST GOT INFORMATION FROM SARAH WHO, UH, IS, IS REALLY WORKING HARD TO KEEP US ON TRACK WITH THIS, UH, THAT THE IN-PERSON CENSUS WORKERS IS TAKING PLACE NOW, UH, THERE'S 3,980 HOMES THAT ARE UNACCOUNTED FOR AND THE NON-RESPONSE CATEGORY WITHIN THE COMMUNITY.

SO THERE'LL BE A, UH, UM, A BOOTS ON THE GROUND WORKERS GOING TO ATTEMPT TO COLLECT INFORMATION OF THOSE REMAINING HOMES.

AND THAT'S GOING TO GO UNTIL SEPTEMBER 30TH, WHEREAS PRIOR IT WAS OCTOBER 31ST.

SO THAT INFORMATION IS CORRECT.

MAYOR AND COUNCIL MEMBERS.

I HAVE JUST A COUPLE, BUT JUST SUPPLEMENTALS TONIGHT.

AND I'M VERY HAPPY TO SAY IN ADVANCE THAT THERE IS NO, UH, FISCAL IMPACT WITH THESE BUDGET CHANGES THAT I'M PRESENTING TONIGHT.

UM, SO I'LL GO THROUGH THE DETAIL IS, UM, WE HAVE NEED IN THE DIVISION OF THE FINANCE DEPARTMENT, UH, FOR WE'VE GOT A TEMPORARY EMPLOYEE AND THE MONEY SET ASIDE FOR THAT EMPLOYEE AT THE BEGINNING OF THE YEAR IS ABOUT TO RUN OUT IN ABOUT ANOTHER WEEK OR TWO.

AND, UM, SO I'VE LOOKED AT THE BUDGET AND DETERMINED THAT THERE ARE, UM, WE HAVE SOME OPEN POSITIONS.

WE HAVE CURRENTLY THREE OPEN POSITIONS IN THE TAX DIVISION.

AND SO THERE IS MONEY SAVINGS FROM THOSE BUDGETED POSITIONS THAT COULD BE MOVED TO ALLOW FOR A TEMPORARY EMPLOYEE TO REMAIN WITH US UNTIL WE CAN GET THE POSITIONS FILLED.

AND SO MY RECOMMENDATION IS TO DECREASE, UM, THE, UH, PERSONNEL NUMBERS IN A GENERAL FUND BY 19,888 AND THE, UM, LOCAL STREET OPERATING FUND BY 5,007 74.

AND THOSE WOULD THEN BE MOVED TO THE OPERATIONAL SIDE OF THE TAX DIVISION, UH, IN ORDER TO HIRE, UM, A CONTRACT, A TEMPORARY EMPLOYEE.

THEN, UH, THE OTHER INCREASE THAT I'M ASKING FOR IS $64,000 IN THE LAW ENFORCEMENT FUND.

AND THE REASON FOR THAT IS SOME MONEY THAT WAS OBTAINED THROUGH A NARCOTICS SEARCH WARRANT.

UM, I WANNA SAY A MONTH OR TWO AGO, AND THIS IS THE AMOUNT OF MONEY AFTER MONEY IS SENT TO THE COUNTY FOR, I BELIEVE IT WAS CRIMESTOPPERS.

THIS IS THE NET AMOUNT THAT WE WOULD GET TO KEEP.

AND STEVE LIGHTNER HAS ASKED THAT WE INCREASE THE BUDGET TO ALLOW HIM TO SPEND THOSE FUNDS.

COOL.

GOOD.

AND OBVIOUSLY WITH THE NEED FOR, UM, UH, I'D LIKE THIS PASSED ON MONDAY NIGHT, IF POSSIBLE, BECAUSE OF THE NEED IMMEDIATE NEED TO EXTEND THE CONTRACT FOR THAT TEMPORARY EMPLOYEE.

UH, THIS WILL ALLOW US TO SEND OUT LETTERS TO ALL THE EFFECTED PEOPLE THAT ARE IN THE PROGRAM.

AND, UH, I THINK THERE'S A LOCATION MAP IN YOUR PACKET THERE.

UH, THIS, THIS AREA FOR NEXT YEAR, IT IS A ALTER HEMINGWAY AREA ALONG WITH TALEAH STREET AND, UH, STREETS AND EVERGREEN WOODS.

UM, AND THE LETTERS WILL INCLUDE THE ESTIMATED COST FOR THE REPAIRS AND, UH, FURTHER SIDEWALKS.

AND THE DRIVER.

UH, WE DO GIVE THE PROPERTY OWNERS UNTIL DECEMBER 31ST TO REPAIR THE SIDEWALKS THEMSELVES, HIRE THEIR OWN CONTRACTORS, OR THEY CAN WAIT UNTIL NEXT YEAR IN THE SPRING WHEN THE CITY DOES THE PROGRAM FOR THEM.

UM, IF THEY USE THE CITY'S CONTRACT, THAT THEY WILL BE SENT A BILL NEXT YEAR AROUND THIS TIME.

AND THEY CAN EITHER AT THAT TIME, PAY THE BILL OR PUT IT ON THEIR PROPERTY TAXES FOR FIVE YEARS.

UM, THIS LEGISLATION WILL BE ON THE AGENDA FOR MONDAY NIGHT.

UH, THE RESOLUTION OF THE CITY IN THE ORDINANCE PROCEEDING ARE COMPANION PIECES OF LEGISLATION, UH, REGARDING THE, UM, UM, UH, THE SPECIAL ASSESSMENTS IS YOU'RE CALLING OUT, SOLD THE WINDBROOK PROPERTY TO, UM, UH, CARRIAGE TO, TO DEVELOP DIVISION.

UH, WE'VE ALSO UNDERWENT

TWO AMENDMENTS TO THAT ORIGINAL AGREEMENT UNLESS WE CAN SEE THERE IS BUILD OUT CURRENTLY ONGOING AND THAT PARTICULAR AREA AND THE REQUEST OF THE PROPERTY OWNER IS TO PETITION FOR THOSE ASSESSMENTS.

UH, THIS IS THE SAME PROCESS THAT WE'VE USED FOR THE CARE TRAILS SUBDIVISION ADJACENT TO WINDBROOK.

UH, WE WOULD CONSIDER THIS IN EXTENSION WITHIN, BUT IT IS A SEPARATE HOA, UH, UP IN THAT PARTICULAR DIVISION.

SO, UM, WE WOULD ASK THAT THE RESOLUTION OF NECESSARY BE CONSIDERED, UH, AS WELL AS THE NOTICE TO PROCEED AS WELL.

THERE'S THE CONVENIENCE TO PUT TOGETHER THE PROCESS NEEDED TO PLACE THOSE ASSESSMENTS ON THE PARTICULAR PROPERTY.

IT'S BEEN BROUGHT TO OUR ATTENTION THAT IN THE NOW THEREFORE BE IT RESOLVED PROVISION IN THE RESOLUTION, IT HAS A, UM, SOME OLD LANGUAGE FROM BACK WHEN THESE WERE PASSED AS AN EMERGENCY SAYING THAT IT'S BEING PASSED BY THREE FOURTHS OF THE COUNCIL MEMBERS.

UH, IT DOES NOT REQUIRE THREE FOURTHS OF THE COUNCIL MEMBERS THAT IS ONLY IF ONE IT'S AN EMERGENCY OR TWO, IF WE'RE DEALING WITH LESS THAN 100% OF THE PROPERTY.

SO IT'S THAT PARTICULAR LANGUAGE WILL NOT APPEAR IN THE RESOLUTION ON MONDAY.

AND, UH, THAT IS THE, THE CURRENT ACTION IS THAT IT'S BEEN, UH, INTRODUCED TO THE, UH, HOUSE COMMITTEE ON OVERSIGHT AND REFORM, UH, IN JUNE, I BELIEVE THAT'S WHERE IT STILL REMAINS.

SO THIS RESOLUTION WOULD SHOW OUR SUPPORT FOR, THERE ARE TWO ADDITIONAL, UH, HOUSE RESOLUTIONS THAT ARE, UH, IN THE SAME COMMITTEE UNDER CONSIDERATION.

THAT WOULD BE, UH, THOUGHT OF AS COMPANION PIECES ARE RELATED TO THIS ONE.

SO I THINK THAT, UM, UH, IT CAME DOWN AS A REQUEST THROUGH VARIOUS ORGANIZATIONS TO SHOW OUR SUPPORT FOR THESE THINGS TO ALLOW FOR THIS PARTICULAR, UH, ONE BEING THE FLEXIBILITY FOR STATES AND LOCAL LOCALITIES ACT, UH, TO ALLOW FOR, UM, UH, MORE, UM, MORE USE OF AVAILABLE FUNDS

UH, WE HAVE A GOOD WORKING RELATIONSHIP WITH CONGRESSMAN DAVIDSON, UM, WHO DOES REPRESENT THE NORTHERN PART OF OUR COMMUNITY, UH, THE CARRIAGE TRAILS AREA, UM, PER SE, UM, MIAMI COUNTY.

UM, SO THIS HAD COME ACROSS THROUGH AN OML BULLETIN, AS WELL AS COMPANION WITH THE NATIONAL LEAGUE OF CITIES BULLETIN.

UM, IT WAS ASKED THAT COMMUNITY HAS PASSED A RESOLUTION TO SUPPORT THAT, UM, AND SEND THAT OFF TO, UH, THE CONGRESSMAN'S OFFICE, UM, UH, TO GARNER SUPPORT AND FURTHER MOVEMENT, UM, UH, WITHIN THE BILL.

UM, I WOULD ASK COUNCIL FOR APPROVAL OF THAT ON MONDAY.

SO, UH, I KNOW, UH, US AND SOME OTHER COMMUNITIES IN THE REGION ARE UTILIZING THAT DEFINITION THROUGH THE STATE AUDITOR'S OFFICE REGARDING, UH, THE CARES ACT AND USE OF IT.

AND IF THAT IS THE CASE, UH, FACTORING IN THE PERCENTAGE ALLOTTED FOR, UH, EMS RESPONSE THAT WILL ACTUALLY TAKE US BEYOND, UH, WHAT OUR LAMA WOULD BE.

UM, THE, UM, FROM WHAT I UNDERSTAND AS A LEGISLATION STANDS RIGHT NOW, THERE'S GOING TO BE NO MORE CARES, ACT FUNDS ALLOCATED, UH, TO THE CITIES.

IF IT WERE TO COME FROM ANYWHERE, IT WOULD COME UNDER THE HEROES ACT.

AND AS THAT STANDS RIGHT NOW, THERE AREN'T GOING TO BE ANY ADDITIONAL FUNDS UNDER THE HERO'S ZACK FOR, UM, FOR CITIES AND VILLAGES.

UM, I GUESS THAT, UH, BECAUSE NUMBER ONE, THIS IS SIMPLY A, A SYMBOLIC RESOLUTION AND, AND I'VE HAD SOME SERIOUS CONCERNS WITH THE, UM, IF YOU WANT TO CALL IT THE BREADTH OF WHERE THESE FUNDS HAVE GONE THE FIRST TIME, BECAUSE IF YOU READ THE CARES ACT, A LOT OF, UH, A SUBSTANTIAL AMOUNT OF THE MONEY HAS BEEN USED TO PROP UP CEO SALARIES AND TO PROVIDE LOANS TO PARENTS, UH, BUSINESSES WITH FOREIGN FOREIGN PARENT COMPANIES.

UH, WELL, A LOT OF OUR, UM, AMERICAN SMALL BUSINESSES MISSED OUT ON THOSE LOANS BECAUSE THE MONEY RAN OUT TOO QUICK.

SO I GUESS I WOULD LIKE TO HAVE A BETTER, UH, JUSTIFICATION FOR MR. SHAW, OTHER THAN IT'S, IT'S, UH, SUPPORTED BY THE NLC AND OML AS TO WHY THIS, THIS BODY SHOULD EVEN INDICATE THAT THEY'RE BEHIND LOOSENING THOSE REINS TO OPEN IT UP TO MORE, UM, POSSIBLE MISCHIEF.

I JUST, I THINK IF THE GUIDELINES RIGHT NOW ARE CLEAR ENOUGH, IF THEY PROVIDE US MORE MONEY THAN WE'RE READY TO TAKE ADVANTAGE OF IT, IF THEY DON'T PROVIDE MORE MONEY, THIS RESOLUTION DOESN'T DO WELL.

NOT ONLY IS IT A, IS IT A CONGRESSMAN THAT REPRESENTS OUR AREA? UM, BUT IT'S DIRECT LEGISLATION THAT IF THE FUNDING IS MOVED FORWARD OR OTHER COMMUNITIES, UM, COUNTIES AND VILLAGES IN THE STATE OF OHIO DO NOT USE ALL OF THEIR MONIES, UM, AND MR. SCHOMER OR JEN BELKIN, CORRECT ME IF I'M WRONG.

UM, WE WOULD HAVE THE OPPORTUNITY TO, TO GATHER SOME OF THOSE FUNDS, UM, AND DISTRIBUTE THOSE THROUGHOUT THE COMMUNITY, UM, THROUGH THE, UH, UH, OMB AND THE STATE OF OHIO.

UM, IN ADDITION TO, UM, I DO AGREE A LOT OF THOSE FUNDS WERE MISMANAGED.

UM, AND MRS. BERG, I WOULD BE MORE THAN HAPPY TO STAND WITH YOU AND SUPPORT SOME, UH, SOME COMMUNICATION TO OUR FEDERAL PARTNERS, UM, ON HOW WE FIX THAT IN A FUTURE, UH, MR. SCHOMER OR MAYBE IF YOU HAVE ANYTHING TO ADD TO THAT.

SO THAT, THAT DOES SEEM TO BE THE SENTIMENT I'D LIKE TO RESPOND TO MR. SHAW BECAUSE, UM, NUMBER ONE, THE ISSUE I ADDRESS IS NOT WITH THE TREASURY.

THIS IS, AS IT IS SPELLED OUT IN THE CARES ACT, LIKEWISE, THE MONEY THAT WENT TO THE CEOS TO PAY, TO MAKE WHOLE THEIR, THEIR SALARIES AND TO PAY, UM, AND TO PROVIDE LOANS TO BUSINESSES WITH FOREIGN PARENT COMPANIES, THAT'S ALL SPELLED OUT IN THE CARE ACT.

IT'S NOT MISAPPROPRIATION, IT WAS ALLOWED THERE.

UM, UH, SO, UM, I JUST WANT TO MAKE THAT CLEAR THAT, UM, SOME MAJOR ENTITIES THROUGHOUT THE STATE OF OHIO ARE SUPPORTING AND ENDORSING, UM, CONGRESSMAN DAVIDSON DOCTRINES.

UM, I WOULD WISH THAT, UH, THE VICE MAYOR WOULD, UM, ALTER HER DECISION, BUT IT IS HERS TO HAVE.

SO IT EXPANDS THE ABILITY FOR THE, THE LOCALITIES AND IMMENSE CAPACITIES TO BE ABLE TO UTILIZE, UM, YOU KNOW, THOSE FUNDS FOR THAT.

SO I WOULD ENCOURAGE, UH, TO EDUCATE ON THE CONTEXT OF THE BILL, UM, TO MAKE SURE, BECAUSE I'VE HEARD A COUPLE OF DISCUSSIONS THAT CERTAINLY 0.1 DIRECTION, THE OTHER, BUT, UH, THE ENTIRE TEXT AND THE INTERPRETATION OF THE BILL AND ITS RELATED COMPANION BILLS ARE EASILY AVAILABLE ON, UH, ON CONGRESS.GOV.

AND I WOULD ENCOURAGE EVERYBODY TO TAKE A LOOK AT THAT.

UM, MY APOLOGIES FOR THE LATE ADDITION TO THIS ITEM, BUT AS THE CLERK DID ELUDE, UM, I WAS PLEASANTLY SURPRISED THAT, UH, OUR ATTORNEY AND THEIR ATTORNEY WERE ABLE TO SEE EYE TO EYE ON THIS IN TWO DAYS INSTEAD OF TWO WEEKS.

UM, AND THERE'S SOME, UH, ADDITIONAL BACKGROUND TO THAT AS WELL.

UM, SO, UH, WHERE WE ARE AS PROCESS, IF YOU REMEMBER, WE CAME TO EARLIER IN THE YEAR AND TALKED ABOUT, UH, UTILIZING ENERGY PERFORMANCE AS A WAY TO FUND SEVERAL CAPITAL IMPROVEMENTS THAT EXIST IN OUR FIVE YEAR PLAN, UH, KIND OF IN, IN ONE LUMP PACKAGE, UH, THAT WOULD GIVE US A STEADY, UH, EQUAL PAYMENTS OVER A 15 YEAR PERIOD.

SO WE WENT THROUGH THE PROCESS OF, UH, IDENTIFYING A QUALIFIED VENDOR, UH, AND, UH, THE INTERVIEW COMMITTEE HAD SELECTED ESG, UH, ENERGY SOLUTIONS GROUP, AND THEY'RE A SUBSIDIARY OF VECTREN.

AND SO WE IDENTIFIED THEM AS THE BEST QUALIFIED VENDOR TO PERFORM THIS TASK AND TO MOVE TO THE NEXT PHASE.

SO, UM, IF YOU THINK OF THIS KIND OF LIKE A, IT'S LIKE BUYING A CAR.

SO, UH, ESG CAME IN AND, AND THEY DID

A QUICK LOOK AROUND, THEY KIND OF POP THE HOOD AND LOOKED AT WHAT THEY SAW.

UM, AND NOW WHAT THEY WANT TO DO IS THEY WOULD KIND OF WANT TO TAKE, TAKE THE CAR FOR A, FOR A TEST DRIVE IF YOU WILL.

SO IN ORDER TO DO THAT, THEY NEED TO DO A MORE DEEP DIVE INTO OUR FACILITIES, INTO OUR EQUIPMENT, UM, INTO ALL OF THE THINGS THAT WE'VE ASKED THEM TO PREVIOUSLY LOOK AT, THEY NEED TO DO A DEEPER DIVE.

SO TO DO THAT, UH, UM, THEY, UM, HAVE ASKED THAT THE CITY ENTER INTO, UM, AN AGREEMENT AND I, WHICH IS A PROJECT DEVELOPMENT AGREEMENT.

SO THIS IS WHERE THEY'LL GO THROUGH AND DO THAT MORE DETAILED LOOK, UM, TO DETERMINE WHAT SHOULD OR SHOULD NOT BE INCLUDED IN A PROJECT AND WHAT THE ACTUAL COSTS WOULD BE.

REMEMBER, WE'RE WORKING ON A GENERAL ESTIMATE RIGHT NOW ABOUT 1.6 MILLION, THIS WORK HERE THAT THEY'RE ABOUT READY TO DO, WE'LL DIAL IN AND TELL US MORE SPECIFICALLY, UH, WHAT THAT VALUE WILL BE.

SO, UM, PURSUANT TO, UH, THE LEGISLATION THAT WAS LAST ADOPTED BY COUNCIL, THIS AGREEMENT HAS BEEN NEGOTIATED, UM, AND IS NOW BEING BROUGHT FORTH FOR YOUR CONSIDERATION.

UH, RIGHT NOW THERE IS NO POTENTIAL.

THERE IS NO, WE DO NOT BELIEVE THERE WILL BE A FEE ASSOCIATED WITH THIS AGREEMENT.

UM, ALL THE WORK THAT IS BEING DONE AND WILL CONTINUE TO BE DONE IF THE CITY FOLLOWS THROUGH WITH A FORMALIZED PROJECT, UH, ALL OF THOSE COSTS AND WHATNOT WILL BE WRAPPED INTO A FINAL PROJECT TOTAL AT THAT TIME.

AND THE EVENT ESG DOES DO THIS WORK, THIS, UH, THIS DEVELOPMENT AGREEMENT, AND THEY DO THAT DEEP DIVE INTO OUR FACILITIES.

UH, THERE IS, UH, THERE IS A COST, THE CITY OF POTENTIAL COST OF THE CITY OF APPROXIMATELY $44,000.

AND THAT NUMBER IS LOCATED IN THIS DOCUMENT THAT WE PROVIDED TO YOU.

UH, AGAIN, MY APOLOGIES FOR THE SHORT NOTICE, BUT I DID WANT TO DISCLOSE TO EVERYONE EXACTLY WHAT THE POTENTIAL OBLIGATION MIGHT BE.

UM, SO THAT IS THE DOCUMENT IN AND OF ITSELF.

UH, THERE ARE TWO MASTER ARMS THAT WE'D LIKE TO INCLUDE IN THIS PROJECT, AND THERE ARE SOME TRAFFIC CONTROLLING UNITS, OR THAT NEED TO BE UPDATED AND UPGRADED AS PART OF THIS PROJECT.

AND, UH, ESG WOULD LIKE TO BEGIN THAT PROCESS, UH, AS QUICKLY AS POSSIBLE SO THAT THEY CAN MAKE SURE THAT THEY CAN HAVE ENGINEERED DRAWINGS READY TO GO, UH, FOR THIS PARTICULAR WORK, AS WE GET LATER INTO THE YEAR.

SO WE CAN HAVE A BID PACKAGE FOR A WINTER EARLY SPRING, UH, FOR THIS WORK.

SO THAT'S THE OTHER REASON FOR THE, UH, THE QUICK ADD TO THIS AGENDA RATHER THAN WAITING UNTIL THE LAST MEETING OF THIS MONTH.
