UH, THIS MEETING IS OFFICIALLY CALLED TO ORDER AND I'M NUMBER 200 AGENDA IS OUR INVOCATION AND TONIGHT'S INVOCATION WILL BE BY OUR SPEAKER OUT WORD FOR COUNSELOR MS. RAINS AGAIN, THANK YOU.

GOOD EVENING, MAYOR COUNCIL, A FEW THINGS FOR THIS EVENING.

UH, I WANTED TO START OFF WITH, UM, UH, AN UPDATE REGARDING THE, UH, THE KROGER AQUATIC CENTER.

I KNOW THERE WAS AN EMAIL THAT WAS, UH, THAT WE'LL SEND OUT LAST WEEK, UH, WHERE THERE WAS, UM, SOME QUESTIONS AND SOME, UH, SOME DISAPPOINTMENT THAT WAS NOTED REGARDING, UH, INFORMATION, UH, THAT WAS, UH, STILL DEVELOPING AND TO BE, UH, TO BE PUT OUT AND, UH, AND RELEASED TO THE COUNCIL.

SO I KNOW THERE WAS ADDITIONALLY, A, A SERIES OF QUESTIONS SUBMITTED BY, UH, COUNCIL MEMBER BERGE.

UH, MR. WEBB IS THE ONE THAT SENT THE INITIAL, UH, UH, EMAIL.

AND NONETHELESS, I WANTED TO REVIEW THE SITUATION, FIRST OF ALL, UH, UNDERSTANDING AND EXPLAINING THAT, UH, I WAS OUT OF TOWN, UH, HAD TO LEAVE VERY QUICKLY ON MONDAY, UH, AND GO UP TO, UH, MY SON GOT NOTICED VERY SHORT NOTICE, UH, OF HIS DEPLOYMENT TO JAPAN.

UH, SO LUCKILY WE WERE CLOSE ENOUGH THAT WE COULD GET THERE WITHIN THE 12 HOURS NECESSARY TO, UH, TO AT LEAST SEE HIM OFF AND HELP GETTING PACKED UP.

CAUSE HE WAS IN STANDBY SINCE MARCH 17TH, OF COURSE.

AND THEY SUDDENLY IN LESS THAN 24 HOURS TIME RELEASED THE STANDBY AND, AND, UH, GOT HIM A PLANE TICKET AND TOLD HIM TO, TO SHIP ON OFF.

SO, UH, KIND OF A QUICK TURNAROUND, UH, ALTHOUGH HE WAS PREPARED, HE WASN'T IMMEDIATELY PREPARED, UH, NEITHER WAS THE FAMILY.

SO, UH, I DID NOT GET BACK UNTIL, UH, TIL THURSDAY AND, UH, FOUND OUT THE RESULTS OF SOME, SOME INFORMATION NOT, UH, AND ALSO NOT WITHSTANDING A VARIETY OF OTHER THINGS

THAT, UH, THAT OBVIOUSLY I'LL GO ON DAY TO DAY AND THE, UH, IN THE OFFICE AND CONDUCT THE DAY TO DAY BUSINESS OF THE CITY.

SO IN AN HOUR OR SO WORTH OF TIME BETWEEN, UH, INFORMATION THAT GOES OUT ON SOCIAL MEDIA, UH, IF ANYBODY ON COUNCIL EXPECTS ME TO BEAT FACEBOOK, SORRY, IT'S NOT GONNA HAPPEN.

UM, IF ANYBODY ON, ON COUNCIL EXPECTS ME TO BEAT THE KEYBOARD OF SOME REPORTERS, SORRY, I'M NOT SURE THAT IT'S GOING TO HAPPEN.

UH, WHEN INFORMATION IS SOUGHT AND PASSED AROUND ON SOCIAL MEDIA AND INFORMAL CHANNELS, UH, I ALWAYS LIKED TO PROVIDE FACTUAL INFORMATION AND GET THE, GET THE INFORMATION IN DETAIL.

SO, UM, YOU KNOW, TO ME, THAT LEVEL OF, UH, OF MISUNDERSTANDING IS DISAPPOINTMENT AS DISAPPOINTING AS WELL.

UH, NONETHELESS, I WANTED TO REVIEW THE SITUATION.

UH, THE SITUATION IS THAT THERE WAS A, UH, AN INDIVIDUAL THAT CARES FOR A, FOR THEIR PARENT, THEIR PARENT HAD A TEST DONE AND SHOWED THAT THEY TESTED POSITIVE FOR THE VIRUS AT THE TWO PRECAUTIONARY MEASURES, UH, WAS NOT NECESSARILY A DISPLAY.

UH, UM, THE SYMPTOMS OF THOSE THAT WOULD BE TYPICALLY LISTED, GOT TESTED AND FOUND OUT THAT, UH, THEY, UH, THEY HAD THE VIRUS, UH, THAT PERSON HAS A SIBLING THAT ALSO WORKS WITH THEM.

UH, THAT SIBLING WAS ALSO TESTED, BUT STILL YET TODAY, UH, THEY'RE WAITING RESULTS TO SEE THAT TEST, THAT ORIGINAL INDIVIDUAL, UH, HAS SINCE THEN BEEN CLEARED TO RETURN BACK TO THEIR FULL TIME EMPLOYMENT.

HOWEVER, BASED ON, UH, THE YMCA AND OUR PROTOCOL, UH, FOLLOWING, UH, THEY WILL NOT BE RETURNING TO, UH, TO THE WORKPLACE UNTIL, UH, TWO WEEKS IS UP, UH, FROM THOSE, FROM THOSE SYMPTOMATIC TIMES.

AND THAT WILL BE, UH, I BELIEVE, UH, HERE, HERE SHORTLY.

UH, ADDITIONALLY THERE WAS ANOTHER INDIVIDUAL, UH, AGAIN WITH NO KNOWN, UH, CONTACT TRACING OR KNOWLEDGE, UH, THAT EXPERIENCED SOME SYMPTOMS GOT TESTED, TESTED NEGATIVE, STAYED HOME A QUARANTINED ANYWAYS, STILL DIDN'T RECOVER AND EXPERIENCED IN ADDITIONAL SYMPTOM AND, UH, WENT AND GOT TESTED A SECOND TIME.

AND THAT TIME IT TESTED POSITIVE, UH, THAT INDIVIDUAL OF COURSE, IS, UH, IS UNDER SELF, UM, UH, UM, SELF ISOLATION AS WELL.

UH, ANYBODY THAT WAS MADE AWARE OF THE LETTER THAT WAS PUT OUT ON SOCIAL MEDIA, UM, THE YMCA IN FACT, DID FOLLOW WHAT I FEEL TO BE A VERY GOOD PROCESS AND NOTIFYING EMPLOYEES, UH, AND ALSO MAKING SURE THAT THEY ARE AWARE OF THE SAFETY CONCERNS AROUND THAT.

UH, ANY EMPLOYEES THAT THOUGHT THAT THEY POSSIBLY WERE IN CONTACT WITH THAT INDIVIDUAL, UH, WERE SENT FOR TESTS.

UH, NONE OF THOSE TESTS HAVE RETURNED POSITIVE RESULTS.

UH, HOWEVER, AS PRECAUTIONARY MEASURE, UH, THOSE EMPLOYEES WERE, UM, WERE VOLUNTARILY STAYING, UH, IN GOING THROUGH A PERIOD, UM, OF, OF SELF QUARANTINE TO MAKE SURE TO, UH, TO ENGAGE IN ALL PRACTICES AS RECOMMENDED, UM, AND, UH, TO JUST DATE, THERE WAS ONE ADDITIONAL PERSON THAT THEY JUST FOUND OUT TODAY, UM, A, A, AN INDIVIDUAL THAT, UM, UH, EXPERIENCED A SYMPTOM OVER THE WEEKEND, UH, AGAIN, NOT NECESSARILY DIRECTLY RELATED TO, UH, AND DURING THE TIME OF THE TASK WAS NOT WORKING, UH, AT THE, UH, AT THE AQUATIC CENTER.

UH, BUT AS AN EMPLOYEE THERE, AND THAT, THAT EMPLOYEE SINCE HAS TESTED, UH, WILL ALSO REMAIN, UM, YOU KNOW, ON, ON QUARANTINE UNTIL THEIR HEALTHCARE PRACTITIONERS IN EVERYTHING, UM, UH, RELEASED THEM FOR, UH, UM, YOU KNOW, FOR BACK TO WORK OR, OR DUTY, UM, A COUPLE OF THE QUESTIONS THAT, OR I'LL JUST RUN THROUGH THE QUESTIONS REAL QUICK.

I KNOW THAT THERE WAS A, UH, AN ASK TO HAVE THEM IN WRITING.

ALTHOUGH I DO HAVE THAT, I DIDN'T GET A CHANCE TO SEND THAT OUT YET.

UH, IF YOU SAW THE ANNOUNCEMENT ABOUT A POPUP TEST SITE AND SOME OTHER THINGS, UH, IT KIND OF OCCUPIED MUCH OF THE AFTERNOON, NONETHELESS.

UM, THE FIRST QUESTION WAS, WAS THE PROTOCOL FOR THE Y TO INFORM CITY WHEN AN URGENT MATTER SERVICES ACCIDENT, DROWNING, CONTAGIOUS DISEASE, ET CETERA.

WELL, THE PROTOCOL IS FOR THE Y TO INFORM SYDNEY STAFF.

SO, UH, THE, THE QUESTION BEING ANSWERED RIGHT IN, AND OF THE STATEMENT OF ITSELF THAT IS IN FACT, THE PROTOCOL, BUT YMCA DOES NOTIFY US.

THEY DO KEEP IN CONTACT WITH US.

UM, THEY HAVE, UH, UNNECESSARY PHONE NUMBERS.

OF COURSE, IF IT'S AN EMERGENCY SITUATION, MUCH LIKE ANY OTHER BUSINESS, ANY OTHER ORGANIZATION IN THE CITY, THEY WOULD, UH, OBVIOUSLY CONTACT EMERGENCY SERVICES PERSONNEL, AND NOT ONLY THROUGH THEIR OWN NOTIFICATION PROTOCOL, OUR OWN INTERNAL NOTIFICATION PROTOCOL WOULD ACTIVATE THEN AS WELL, IF THERE WAS SOMETHING SIGNIFICANT.

SECOND QUESTION BEING A LETTER STATES, THE EMPLOYEE EXHIBITED SYMPTOMS ON JULY 3RD, WHICH WERE CONFIRMED ON JULY 6TH, WHY WASN'T CITY STAFF COUNCIL AND THE PUBLIC NOTIFIED IMMEDIATELY? UH, QUITE FRANKLY, THAT'S NOT THE PROTOCOL, UH, MANY ORGANIZATIONS, MANY PEOPLE, UH, IT MAY HAVE CONTACT WITH A VARIETY OF THINGS, UH, AND, UH, MAY HAVE DIAGNOSES OR TESTS.

UH, HOWEVER, BASED ON THE INFORMATION, UH, THE PERSON WAS WEARING THEIR, UM, THEIR PROTECTIVE GEAR.

UH, THERE WAS NO KNOWLEDGE INFORMATION THAT THEY HAD EXTENDED CONTACT.

THERE WAS NO

OTHER KNOWLEDGE OF ANY KNOWN SYMPTOMS AT THE TIME, SO IT REALLY WASN'T NECESSARY.

AND WE WOULD NOT ENGAGE IN PRACTICE THAT WE WOULD NOTIFY THE GENERAL PUBLIC AND OR MANY OTHER MEMBERS OF STAFF OR COUNCIL OF AN INDIVIDUAL'S HEALTH STATUS.

UM, IF, OF COURSE THERE WAS AN OUTBREAK, THEN THAT WOULD BE SOMETHING THAT WOULD BE HANDLED AND CONTROLLED THROUGH THE PROTOCOLS ESTABLISHED THROUGH THE DEPARTMENT OF HEALTH AND THE PUBLIC HEALTH DISTRICT.

AND OF COURSE THERE WOULD BE PROTOCOLS AND NOTIFICATION, UH, STATUSES WITH THAT.

UH, NUMBER THREE, WHY WASN'T THE AQUATIC CENTER CLOSED ON JULY 3RD AS A PRECAUTIONARY MEASURE, PENDING A FINAL DIAGNOSIS.

AGAIN, UH, THAT INDIVIDUAL HAD HAD, WE HAD NO INFORMATION OR CONCERN THAT THE INDIVIDUAL, UH, WHILE, UH, AT THE TIME WORKPLACE HAD SIGNIFICANT CONTACT OR THAT THERE WAS OTHER CASES OR AN ADMISSION OF THAT.

UH, AND ON TOP OF THAT, THE PUBLIC HEALTH DEPARTMENT DID NOT INDICATE THAT THERE WAS A NEED TO, UH, TO CLOSE DOWN MUCH LIKE ANY OTHER EMPLOYER.

LET'S SAY LOWE'S, IF THEY HAD A CASHIER THAT HAD, UM, YOU KNOW, UH, THE, THE VIRUS AND WOULD HAVE TESTS, THEY DON'T, UM, YOU KNOW, THEY'RE NOT NECESSARILY GOING TO CLOSE THE STORE DOWN BECAUSE OF, UM, UM, BECAUSE OF ONE CASE, UM, NUMBER FOUR, WHAT INFORMATION WAS SENT TO THE, HOW THE DEPARTMENT OF HEALTH AND WHAT IS, ODH HIS RESPONSE? AND I'LL FOLLOW IT UP WITH WHAT STEPS WERE TAKEN TO MEET ODH GUIDELINE GUIDELINES.

FIRST OF ALL, ANY, UH, DEPARTMENT OF HEALTH GUIDELINES HAVE TO BE MET.

OTHERWISE WE WOULD HAVE NEVER BEEN AUTHORIZED TO OPEN, UH, THE PUBLIC HEALTH DEPARTMENT, WHICH WORKS THROUGH THE DEPARTMENT OF HEALTH AND ALL GUIDELINES SET OUT BY THE, BY THE STATE AND ALSO INTERPRETED INTO PROCEDURES AND PROTOCOLS LOCALLY WITH THE PUBLIC HEALTH DISTRICT.

UH, WE'RE WORKING WITH VERY CLOSE HAND IN HAND WITH YMC STAFF, UH, IN THEIR FIELD, UH, IN INVESTIGATORS AND INSPECTORS THROUGH PUBLIC HEALTH, A GREAT GROUP OF FOLKS WORKED HARD, UH, WORK QUICK AND MADE SURE TO GIVE US SOME REALLY GOOD GUIDANCE.

AND, UH, AND I THINK THAT THINGS STILL TO THIS DAY REMAIN WELL, WHAT INFORMATION WAS SENT TO THE DEPARTMENT HEALTH? UH, WELL, TECHNICALLY UPON OUR NOTIFICATION OF THEM, THEY INDICATED WE ARE NOT A MANDATORY REPORT ORGANIZATION.

HOWEVER, THEY CERTAINLY APPRECIATED THAT NOTIFICATION.

SO PROTOCOL IS THAT IT'S NOT REQUIRED TO NOTIFY IF AN EMPLOYEE MUCH LIKE LOWE'S OR SOMETHING ELSE, UH, WOULD NOT BECAUSE OF THE, UM, UM, THE, THE, UH, THE LIMITED CONTACT AND THE ABILITY TO STAY DISTANCE, UH, WITH THE POSSIBILITY THAT THAT NECESSARILY ISN'T THE SPOT IN AN ADVERSE SITUATION WHERE THEY COULD HAVE GOT THE VIRUS, UH, IN THIS PARTICULAR CASE, WE KNEW THAT IT EXISTED FROM WITHIN, UH, WITHIN THE HOME, UH, ON TOP OF THAT, UH, ODH UH, THROUGH THE LOCAL HEALTH DISTRICT, UH, HAS SINCE THEN, UH, REACHED OUT, CONTACTED, UH, REVIEWED EVERYTHING, UH, AND, UH, IN THEIR WORDS, UM, WE'RE DOING A GOOD JOB, UH, THAT IS THEIR WORDS, NOT OURS.

UH, THEY UNDERSTAND THAT IT CAN BE DIFFICULT, UH, BUT THEY APPRECIATE ALL THE EFFORTS THAT HAVE BEEN TAKEN TO MAINTAIN THE SAFETY OF THE PATRONS, ALL THE WILDFIRES AND, AND QUITE FRANKLY, BEING A GOOD EXAMPLE OF, UH, OF HOW TO, HOW TO OPERATE A, UH, A VENUE SUCH AS THAT NUMBER FIVE, WHAT IS THE Y DOING TO PROTECT VISITORS SINCE AT LEAST ONE MORE EMPLOYEES TESTED POSITIVE.

I YMCAS FOLLOWING ALL PROVISIONS, UH, AND GOING ABOVE AND BEYOND IN MY, IN MY OPINION, UH, OF WHAT WAS SET FORTH BASED ON QUESTION FIVE, WHAT THOSE ODH GUIDELINES ARE.

OTHERWISE THE PUBLIC HEALTH WOULD HAVE SHUT DOWN.

UH, THE PUBLIC HEALTH WOULD HAVE NOTED, UH, CONCERNS, BUT AGAIN, AS I NOTED, THEY HAVE NOT.

IN FACT, THEY SAID THAT THINGS ARE GOING GOING WELL.

UH, WHEN THEY GET ISSUES OR COMPLAINTS, WHETHER ANONYMOUSLY OR, OR OTHERWISE, UH, THEY DO SEND AN INSPECTOR OUT AND ALL OCCASIONS THERE HAVE BEEN NO ISSUES FOUND TRUE.

WE HAVE MADE SOME ADJUSTMENTS, ESPECIALLY SINCE ADDITIONAL ORDERS REGARDING SOME MASKS AND SOME OTHER THINGS HAVE COME OUT AND THE YMCA HAS COME UP WITH GOOD OPERATIONAL PLANS, AGAIN, WITH A PROTOCOL OF REVIEWING WITH THE CITY, KEEPING US UP TO DATE AND INFORMED REGULARLY ON, ON THE, ON THE THINGS THAT HAVE GONE ON THERE.

NUMBER SEVEN, WHY CITY COUNCIL AND THE PUBLIC GETTING THEIR INFORMATION ON THIS MATTER FROM THE NEWS MEDIA INSTEAD OF FROM CITY STAFF, AS INDICATED BEFORE, UH, I CAN'T BEAT FACEBOOK.

AND, UH, AS I INDICATED ALSO WHEN THE, UH, WHO HAD SENT AN EMAIL INQUIRING IT, UH, I WANTED TO GIVE THEM A VERY QUICK BIT OF INFORMATION THAT SAYS, HEY, HERE'S THE BASIS.

I'M GATHERING MORE INFORMATION TO CONFIRM EXACTLY.

THIS IS WHAT I'M BEING TOLD.

UM, YOU KNOW, TO, TO BE ABLE TO ANSWER THAT QUESTION, UH, I'M NOT SURE WHAT THE LIABILITY WAS, UH, YOU KNOW, INDIVIDUALS THAT, UH, YOU KNOW, CONTRACT A VIRUS, I'M NOT SURE THAT THE CITY WOULD HAVE LIABILITY IN THAT, UH, AGAIN, WERE CHECKED OFF AND, AND, UM, UH, AND AUTHORIZED THROUGH THE, UH, PUBLIC HEALTH DISTRICT, UM, DAYTON, MONTGOMERY COUNTY ON HOW DEPARTMENT OF HEALTH FOR THE LICENSED OPERATE THE POOL UNDER THE ADDITIONAL RESTRICTIONS THAT WERE PUT IN, UH, FOR SAFEGUARDS AND PRECAUTIONS FOR, UH, FOR COVID-19 FOR THIS YEAR.

AND WE STILL WORK ON OPERATE UNDER THAT.
