PSALM ONE, ONE TO THREE SAYS, BLESSED ARE THOSE WHO DO NOT WALK IN THE COUNCIL OF THE WICKED OR STAND IN THE WAY OF SINNERS OR SIT IN THE SEAT OF MOCKS, BUT THEIR DELIGHT IS IN THE WORD OF THE LORD AND HIS WORD.

THEY MEDITATE DAY AND NIGHT.

THEY'RE LIKE TREES PLANTED BY STREAMS OF WATER, WHICH YIELD THEIR FRUIT IN SEASON.

AND WHOSE LEAF DOES NOT WITHER? WHATEVER THEY DO PROSPERS.

I HEARD SOME ON THE RADIO, SOMEONE ON THE RADIO TODAY SAYING THAT SINCE NINE 11 WE'VE GOTTEN MUCH BETTER.

THOUGH WE STILL HAVE A WAYS TO GO IN DETECTING AND PROTECTING AGAINST TERRORIST TYPED ACTIVITIES, ESPECIALLY AT AIRPORTS.

IT'S IMPORTANT THAT WE UNDERSTAND THE NATURE OF OUR ENEMY AND HOW HE OPERATES, ESPECIALLY THE ENEMY OF OUR SOULS, SO THAT WE MAY RESIST HIM AND DO WHAT'S RIGHT.

IT TEACHES US TO SAY NO TO UNGODLINESS AND WORLDLY PASSIONS AND TO LIVE SELF-CONTROLLED, UPRIGHT, AND GODLY LIVES IN THIS PRESENT AGE, WHILE WE WAIT FOR THE BLESSED HOPE, THE GLORIOUS APPEARING OF OUR GREAT GOD AND SAVIOR, JESUS CHRIST, WHO GAVE HIMSELF FOR US TO REDEEM US FROM ALL WICKEDNESS AND TO PURIFY FOR HIMSELF OF PEOPLE THAT ARE HIS VERY OWN EAGER TO DO WHAT IS GOOD.

UH, THAT WOULD BE MR. PAUL SCHAFER.

GOOD EVENING.

WELCOME MR. ZICK.

UM, IN 2021, MAYOR GORE RAN FOR A SECOND TERM AS MAYOR AND THE DAYTON DAILY NEWS GUIDE.

HE SAID THE TOP THREE PRIORITIES WOULD BE INFRASTRUCTURE IMPROVEMENTS, WATER AND STREETS SOLUTIONS FOR TRAFFIC DESIGNS, WHICH ARE, UH, TRAFFIC DESIGNS WERE IN THE WORK AND PUBLIC SAFETY.

HE FURTHER SAID, I'LL BE ASKING OUR CITY COUNCIL TO APPROVE MORE APPROPRIATED DOLLARS FOR WATER MAINTENANCE STREET REPAIR.

I WILL CONTINUE TO KEEP PRESSING OUR CITY STAFF FOR DETAILED DESIGN WORK ON OUR TRAFFIC ISSUES AROUND ROUTE 2 0 2 AND I 70, ALONG WITH SOLUTIONS FOR MERRILY WAY I'VE ALWAYS SUPPORTED OUR POLICE AND FIRE DEPARTMENTS WITH THE FUNDING THEY NEED TO, TO BE ABLE TO PROVIDE THE BEST SERVICES POSSIBLE TO OUR RESIDENTS.

I SUPPORT A NEW TRAFFIC CONTROL UNIT WITH OUR POLICE DIVISION TO HELP STOP PEOPLE BREAKING OUR TRAFFIC LAWS.

AND I BELIEVE THE CITIZENS ARE DEMANDING IT, MR. MAYOR CITY COUNCIL.

IT'S TWO YEARS LATER, AND I CAN TELL YOU AS CI CITIZEN OF HUBER HEIGHTS, I BELIEVE THOSE PROMISES ARE UNFULFILLED AND I AND MANY OTHERS ARE STILL DEMANDING THAT THESE GET DONE LOOK NO FURTHER THAN THE FREQUENT POSTS ON SOCIAL MEDIA CONCERNING INFRASTRUCTURE THROUGHOUT THE CITY, PARTICULARLY WITH REGARDS TO TRAFFIC AND DRIVERS BEHAVIORS TO GATES THE TEMPERATURE OF THE COMMUNITY ON THESE TOPICS.

ON TUESDAY 14 FEBRUARY, 2023, I WROTE MAYOR GORE AND I SAID, I HAVE SEEN NO COMPREHENSIVE TRAFFIC STUDY TO ACCOMMODATE THE TRAFFIC COMING WITH OUR NEW GROWTH.

I'VE SEEN NO PROFESSIONAL STUDY ON THE IMPACTS, UH, FOR THE EXISTING INFRASTRUCTURE FOR FIRE, POLICE, WATER, SEWER STORMS, WATER CITY STAFF, OR PUBLIC WORKS.

WITHOUT SUCH PLANS, I AND MANY OTHERS REMAIN CONCERNED THAT ISSUES SUCH AS THE ONE AT MERRILEE WAY

WILL BE REPEATED IN OTHER PARTS OF THE CITY.

NO RESPONSE TO MY EMAIL WAS RECEIVED AFTER THIS WEEK, I'M LEFT ASKING WHERE WAS THE PLAN THAT INCLUDED PUTTING UP SIGNS WARNING DRIVERS OF THE COMING TURN LANE TRAFFIC PATTERN CHANGES AT MERRILL WAY, AND WHY WEREN'T THOSE SIGNS INSTALLED PRIOR TO MAKING THE CHANGE? WHAT DOES IT MEAN WHEN SOMEONE SAYS, I TAKE OWNERSHIP FOR NOT HAVING OUR PLAN TO ADDRESS THOSE ISSUES? ON SUNDAY 25, FEBRUARY 23, I WROTE, MAYOR GORN SAID, I'VE GONE BACK LOOKING AT THE CITY MEETING RECORDS FROM 2021 REGARDING POLICE STAFFING INCREASES.

AS I FOLLOWED THE BUDGET PROCESS, I SAW WHERE CHIEF LIGHTNER AND DISCUSSED THE STAFFING OF THREE OFFICERS TO PROVIDE SOME INCREASED LEVEL OF FOCUS ON TRAFFIC.

IT SEEMS THESE DECISIONS GOT DEFERRED WAITING FOR THE OLD CITY MANAGER TO COMPLETE SOME ANALYSIS TO PRESENT.

AS PART OF THE BUDGET PROCESS COINCIDENT WITH LEAVING OF THE OLD CITY MANAGER AND THE APPOINTMENT OF THE INTERIM CITY MANAGER DISCUSSION ON POLICE STAFFING INCREASES SEEMED TO HAVE STOPPED IN MY EMAIL.

I ASKED WHAT HAPPENED TO THE POLICE DEPARTMENT, MANPOWER INCREASE IN ANALYSIS DISCUSSIONS TO SUPPORT ENHANCED TRAFFIC ENFORCEMENT.

AGAIN, NO RESPONSES WAS EVER RECEIVED.

ON NINE MARCH TWO 20, UH, 2023, I WROTE TO THE CITY COUNCIL WHEN I PROVIDED AN ANALYSIS OF TRAFFIC DATA IN HUBER HEIGHTS, COMPARING 20, UH, 2002 POLICY HUBER HEIGHTS REPORT TO 2022 HUBER HEIGHTS POLICE DATA THAT OFFERED, UH, WHAT WAS GOING ON WITH TICKETS.

IT OFFERED THAT THERE WERE AS MANY POSSIBLE FACTORS TO CONSIDER CONCERNING WHY THE CITATION RATES HAD DROPPED, BUT I OFFERED NO CONCLUSIONS AT THAT TIME.

SINCE THEN, ANECDOTAL INFORMATION HAS BEEN COLLECTED INDICATING THAT THE REASONS FOR THE DECLINE IN TICKETING ARE A RESULT OF OFFICERS WORKING THE BEAT, HAVING LESS TIME TO PERFORM TRAFFIC ENFORCEMENT DUTIES.

THE CITY HAS INCREASED THE NUMBER OF OFFICERS PERFORMING ADMINISTRATIVE OR DETECTIVE FUNCTIONS AND NOT INCREASE THE SIZE OF THE FORCE TO OFFSET THOSE CHANGES.

FURTHER COMPLEX AND COMPLICATED TECHNOLOGY THAT WAS ONCE THOUGHT TO BE A FORCE MULTIPLIER IS NOW CONSUMING MORE OF THE OFFICER'S TIME THAN EVER BEFORE.

THIS INCLUDES IMPLEMENTATION OF AN AUTOMATED REPORTING SYSTEM THAT HAS NUMEROUS DOCUMENTED ISSUES AND A SIGNIFICANT MOVE TOWARDS IN-CAR HEADS DOWN, COMPUTER-BASED TRAINING.

FINALLY, THE CITY IS SUPPORTING MORE JOINT TASK FORCE EFFORTS THAN EVER BEFORE AND REQUIRES MORE TRAINING PER YEAR FOR EACH OFFICER THAN EVER BEFORE TO SUPPORT PERFORMING A MORE DIVERSE SET OF ACTIVITIES.

TRAFFIC ENFORCEMENT SIMPLY ISN'T THE PRIORITY IT ONCE WAS OF THE EXPANDING NUMBER OF ACTIVITIES BEING PERFORMED BY CONSTRAINED NUMBER OF BEAT OFFICERS.

THE COMMENTS OF THE FRATERNAL ORDER OF POLICE ON 28 AUGUST, 2023 AT THE HUBER HEIGHTS CITY COUNCIL MEETING, AGAIN HIGHLIGHTED OF THE POLICE DIVISION STAFFING ISSUES THAT PLAGUE OUR CITY.

THE MORALE OF THE POLICE FORCE IS IN DECLINE.

THERE IS A CURRENT 10% OFFICER VACANCY RATE.

NUMEROUS RETIREMENTS ARE ANTICIPATED.

THE CANDIDATE AND FILL PROCESS IS ANTIQUATED AND SLOW.

AND THE APPARENT LACK OF PRIORITY ADDRESSING THIS ISSUE IN ANY MEANINGFUL WAY, COMBINED WITH THE LACK OF PROGRESS, RESPONDING TO LONGSTANDING QUESTIONS FROM VARIOUS COUNCIL MEMBERS IN THE PUBLIC IS DISTRESSING TO BETTER.

THIS WOULD BE AN ADDITION TO WHAT WE CURRENTLY HAVE, UM, FUNDED.

AND I WOULD LIKE TO SEE, I WOULD HOPE TO HAVE SOME SUPPORT WITH THAT.

WE'VE GOT A BUDGET, WE HAVE A BUDGET EXERCISE COMING UP IN THE NEXT MONTH, AND THAT'S WHEN IT WOULD BE APPROPRIATE TO DISCUSS.

IF WE LOOK AT THE TOTAL POPULATION OF, UH, TOWNS, UH, AND, UM, CITIES, UM, IN COMPARISON TO HUBER HEIGHTS, SUCH AS, UM, UH, GROWING, UM, WHEN YOU LOOK AT, UH, SPRINGFIELD, KETTERING, HAMILTON, LAKEWOOD, UM, AND SEVERAL OTHERS, UM, WE ARE AT THE VERY BOTTOM PER CAPITA WHEN IT COMES TO OFFICERS PER POPULATION.

UH, AGAIN, THIS INFORMATION WAS SUPPLIED, UM, ACCORDING TO THE FBI.GOV IN 2022.

UH, AND THE NATIONWIDE, UM, RESULTS.

CURRENTLY, WE HAVE 55 SWORN POSITIONS, UM, UH, FUNDED.

UH, WE HAVE 50 AS WE'RE LOOKING TO, UH, TO, UM, PHIL FIVE.

CURRENTLY THE 2002, UH, INTERNATIONAL ASSOCIATION, UH, CHIEFS OF POLICE REPORT, UM, RECOMMENDS I BELIEVE 63 SWORN PERSONNEL.

UH, WE ARE BEHIND ON THAT.

ADDITIONALLY, UM, WHEN MY QUESTION AND COMMENTS WERE, UM, UH, RAISED, UH, REGARDING, UH, THE I C M A C P S M REPORT, UM, FOR, FOR PUBLIC SAFETY MANAGEMENT, UH, REGARDING THE RULE OF 60 AND IN FURTHER DETAILS, UM, OF THE SWORN OFFICERS, UM, UH, FOR THE CITY OF HUBER HEIGHTS, UM, IT IS, IT IS MY UNDERSTANDING, UH, THAT, UH, THAT NUMBER, UM, IS SOMEWHERE IN THE BALLPARK OF 72.

UM, I THINK WE NEED TO ENGAGE, UH, FURTHER CONVERSATIONS WITH OUR SCHOOL DISTRICT WHEN IT COMES TO LAW ENFORCEMENT AND PUBLIC SAFETY.

I THINK WE NEED TO HAVE THOSE CONVERSATIONS WITH OUR BUSINESS OWNERS, AND WE DEFINITELY NEED TO SHOW OUR RESIDENTS THAT WE ARE PUTTING OUR BEST FOOT FORWARD AND THAT WE ARE MAKING SURE THAT WE ARE GETTING THE BEST BANG FOR OUR BUCK WHEN IT COMES TO WHAT WE ARE RESPONSIBLE FOR AS THIS COUNCIL, AS POLICY MAKERS.

SO WE SPECIFICALLY PASSED LEGISLATION WHILE MR. SCHOMER WAS THE CITY MANAGER TO ADDRESS THAT SPECIFIC ISSUE.

SO WE NEED TO MAKE SURE THAT WE'RE NOT PASSING LEGISLATION NOW THAT CONTRADICTS LEGISLATION THAT WE ALREADY PASSED PREVIOUSLY.

SO IF THAT'S THE CASE, THAT ORG CHART NEEDS TO BE UPDATED, THOSE POSITIONS NEED TO BE FUNDED TO MAKE SURE WE'RE IN OUR COMPLIANCE OF THE OWN LEGISLATION THAT WE PASSED.

SO I THINK THAT NEEDS TO BE DEALT WITH AS WELL.

UH, IT IS IN THE ESTATE DEVELOPMENT PATTERN AREA, WHICH TY TYPICALLY RECOGNIZES WHERE A LARGE SCALE DEVELOPMENT IS UNLIKELY TO OCCUR.

AND LARGE LOT RESIDENTIAL IS MORE IMPORTANT.

DISTRICT IS NOT SUBJECT TO FLOODING ISSUES, UH, GIVEN THE LOCATION OF THE SITE, ITS CONTEXT WITHIN THE ESTATE LOT.

UH, STAFF FEELS THAT THE REZONING FROM OH ONE TO PLAN COMMERCIAL IS CONSISTENT WITH THE COMPREHENSIVE PLAN.

AS FAR AS THE BASIC DEVELOPMENT PLAN, UM, ANALYSIS, THE APPLICANT'S HAS SUBMITTED ALL OF THEIR REQUIRED DOCUMENTATIONS.

UH, THE RETAIL USE, UH, AND FILLING STATIONS ARE PRINCIPALLY PERMITTED IN THE PLANNED COMMERCIAL DISTRICT.

UH, THE SITE PLAN MEETS ALL OF THE PARKING, UH, BUILDINGS, SETBACK AND YARD REQUIREMENTS I MENTIONED.

UH, SO THERE ARE 19 STREET TREES REQUIRED.

WE WANNA WORK DURING THE DETAILED DEVELOPMENT, UH, PLAN PHASE WITH THE APPLICANT TO, UH, REALLY WORK ON PLACEMENT, UM, MORE APPROPRIATE PLACEMENT.

UM, SO THERE WAS A LIGHTING PLAN, UH, IT WAS SUBMITTED THAT MEETS ALL OF THE REQUIREMENTS.

UM, BUILDING DESIGN ALSO SUBSTANTIALLY MEETS THE EXTERIOR BUILDING RECOMMENDATIONS.

UH, IT'S ABOUT 60%, 68% MASONRY.

UH, THE, THE FRONT FACADE IS ABOUT 78%, UH, MASONRY AND GLAZING.

UH, AND THEN THE, THE BALANCE IS A KIND OF A WOOD COMPOSITE SIDING MIX.

UH, ALL UTILITIES WILL BE PLACED BELOW, BELOW GRADE.

THE APPLICANT IS PROVIDING, UH, MORE SPACES THAN ARE REQUIRED.

THE LANDSCAPING PLAN APPEARS TO MEET THE, UM, THE REQUIREMENTS, BUT WILL BE VERIFIED DURING THE DETAILED DEVELOPMENT SUBMISSION.

UH, THE SECOND WAS THE VISIBILITY OF TRUCKS TURNING, UH, REALLY FUELING TRUCKS TURNING, UH, ONTO OLD TROY PIKE FROM THIS SITE.

UH, AND THEN CONCERN FROM THE WEST NEIGHBOR ABOUT NOISE AND LIGHT FROM THE SITE.

SO, ADDRESSING CHAMBERSBURG ROAD, UM, IN 2022, THE CITY WAS AWARDED APPROXIMATELY, UH, $2.2 MILLION TO WIDEN CHAMBERSBURG AND ADDRESS THE ROAD GEOMETRY.

THERE IS KIND OF A HUMP AS YOU HEAD WEST, UH, THAT WILL BE LOWERED BETWEEN FOUR TO FIVE FEET.

UH, AND SO A LOT OF THE, THAT VISIBILITY CONCERNS WILL, WILL BE ADDRESSED.

RIGHT NOW WE'RE IN THE ENVIRONMENTAL REVIEW AND STAGE ONE DESIGN PHASE, UH, AND WE ANTICIPATE CONSTRUCTION WILL START IN MID, UH, 2026.

SO A LOT OF THE VISIBILITY CONCERNS THAT ARE THERE NOW, UH, WILL BE MITIGATED, UH, THROUGH THAT, THAT WIDENING.

AND ALSO THE, THE CHANGE OF THE GEOMETER GEOMETRY OF, UH, CHAMBERSBURG.

THE WAWA IS COORDINATING THEIR, UM, SITE ENTRANCE, UH, WITH CHOICE ONE, WHO WAS OUR ENGINEER DOING ALL THE DESIGN, UH, ON CHAMBERSBURG.

UH, ADDITIONALLY, WHEN YOU LOOK AT THE TRAFFIC STUDY, THERE

UH, THE REAL DRIVER OF TRAFFIC ON CHAMBERSBURG IS GONNA BE THE, UM, VILLAGES OF, UM, WEST, UH, WESTPORT, WHICH WAS APPROVED A COUPLE YEARS AGO.

UH, ABOUT 200 UNITS ON OLD TROY PIKE.

THERE WAS ALSO CONCERNS ABOUT VISIBILITY AS YOU HEAD SOUTHBOUND, UM, AND CONCERNS ABOUT TRUCKS KIND OF PULLING IN AND FOLKS ARE PULLING OUT ONTO OLD TROY PIKE AND NOT BEING ABLE TO, UH, SEE THEM.

UH, FROM THIS SITE, AS I MENTIONED, IT DOES SIT ABOUT 21 FEET, UH, BELOW GRADE FROM, UH, IF YOU WERE STANDING AT THE, UH, THE BACK OF THE GARAGE HERE, UM, WHAT YOU WOULD SEE IS PROBABLY THIS, UM, IF THERE WERE NO TREES, UH, IT DOES SIT SIGNIFICANTLY BELOW GRADE.

THE ACTUAL LIGHT POSTS THEMSELVES SHOULD SIT BELOW YOUR VISUAL GRADE.

UM, BUT YOU WOULD SEE A LITTLE BIT OF THIS PARAPET WALL THAT'S, UH, THAT'S HERE.

BUT WITH, UM, WITH THE ADDITIONAL LANDSCAPING, UM, THAT SHOULD BE MITIGATED.

SO AS FAR AS THE BASIC DEVELOPMENT PLAN ANALYSIS, I'LL KIND OF SKIP THROUGH EACH OF THESE FAIRLY QUICKLY.

UM, WE HAVEN'T HAD, AS FAR AS TIMELINE, WE HAVEN'T HAD A, A SIGNIFICANT DISCUSSION ABOUT TIMELINE WITH THE APPLICANT.

BUT, UH, GIVEN THE, THE, THE NATURE OF THE CORPORATION, WE HAVE NO CONCERNS, UH, ABOUT THEIR DIFFICULTY FINANCING OR CONSTRUCTING, UM, THIS PROJECT IN A REASONABLE TIME.

UH, AS FAR AS ITEM C, WHICH IS, UH, ACCESSIBILITY OR THE ADEQUACY OF OUR, UH, INFRASTRUCTURE, UM, WE DO HAVE ADEQUATE INFRASTRUCTURE, UM, SERVING IT BOTH, UH, FOR TRAFFIC, UM, AND ALSO OUR PUBLIC UTILITIES.

THE TRAFFIC STUDY ESTIMATES THAT, UH, THE NET PEAK HOUR TRIPS, SO THO THOSE TRIPS THAT ARE GENERATED BY THIS USE ARE BETWEEN 120, WELL, 129 IN THE MORNING AND 179, UH, IN THE EVENING.

UH, AS I MENTIONED, OF THOSE 1 29 AND 1 79 RESPECTIVELY, ABOUT 16, UH, ARE ESTIMATED TO HEAD DOWN CHAMBERSBURG, AND THOSE ARE PROBABLY RESIDENTS WHO LIVE DOWN CHAMBERSBURG ON THE WEST SIDE.

UM, THE STUDY INDICATES THAT THERE ARE NO DROP OR TURN LANES REQUIRED OFF OF ROY PIKE.

I MENTIONED THAT WE, THE APPLICANT IS DEDICATING ADDITIONAL RIGHT OF WAY A ALONG CHAMBERSBURG FOR THAT THREE LANE, UM, WIDENING AS WELL AS THE EIGHT FOOT, UH, OR NOW I THINK IT'S NOW UP TO 10 FOOT, UM, BIKE PATH.

THAT IS A MULTI-USE PATH THAT WE'LL HEAD FROM OLD TROY PIKE TO THE CORPORATE LIMIT.

WELL CLOSE TO THE CORPORATE LIMIT.

UM, AS FAR AS ITEM D, AS FAR AS UNDUE BURDEN, WE DO NOT ANTICIPATE UNDUE BURDEN ON PUBLIC SERVICES.

UM, SO, UH, AS FAR AS PRE PRESERVATION OF THE NATURAL FEATURES, UH, THIS SITE, UNLIKE MANY WILL REMAIN, UH, MAINTAIN THAT SIGNIFICANT WOODED AREA TO THE WEST AND THE NORTH.

UH, AS FAR AND AS THE, UH, THE DECORATIVE RETAINING WALL IS, UH, RIGHT NOW EXPECTED TO, TO REMAIN, UM, THE SITE DOES HAVE, UH, SIGNIFICANT TOPOGRAPHICAL FEATURES.

UM, IT'S GOING TO TAKE ADVANTAGE OF THOSE EXISTING LAND CONTOURS, UH, WHERE POSSIBLE.

THE GRADING, UH, TO THE WEST FOR THAT RE KIND OF SEMI RETAINING WALL, UH, IS A THREE TO ONE SLOPE, WHICH MEETS OUR STANDARDS.
