UM, IT'S, IT'S, IT'S IMPRESSIVE HOW SOMETHING SO SMALL, UH, AND SEEMINGLY SO SLOW, CAN BE SO EXHAUSTING FOR SOMEONE.

UH, EVEN THOUGH I AM AT LEAST FOUR TIMES HER SIZE, UH, I, I, I STRUGGLE, UH, TO KEEP UP.

UH, THERE'S A FAMOUS PROVERB, UH, PROVERB 13 VERSE 22 THAT OFTEN GETS, UH, QUOTED IT.

IT SAYS, A WISE MAN, UH, LEAVES AN INHERITANCE TO HIS CHILDREN'S CHILDREN.

AND A LOT OF TIMES WHEN WE READ SOMETHING LIKE THAT, WE SEE INHERIT INHERITANCE, UH, AND WE THINK DOLLARS AND CENTS.

BUT THAT'S REALLY TO MINIMIZE WHAT I THINK THE SCRIPTURE IS TALKING ABOUT HERE, BECAUSE YOU SEE INHERITANCE GOES SO MUCH.

UH, THERE'S SO MUCH DEEPER THAN JUST DOLLARS AND CENTS.

SEE, THAT'S WHAT MY DAUGHTER IS TEACHING ME NOW.

SEE, LEADERSHIP.

UH, WHAT I'M LEARNING FROM HER NOW IS ABOUT THIS, THIS STEWARDING THIS, CARING FOR A LEGACY, FOR AN INHERITANCE AND, AND GROWING IT.

THE FIRST QUESTION I HAVE IS ON EXECUTIVE BOULEVARD, OUR ENTERTAINMENT DISTRICT.

, EXACTLY.

HOW MANY APARTMENTS ARE SLATED FOR THAT DEVELOPMENT? I THINK TOTAL BETWEEN, WELL, THE, WHAT'S BEEN APPROVED ALREADY IS SOMEWHERE AROUND 300.

AND THEN THERE'S ONE THAT HAS NOT BEEN APPROVED YET, WOULD BE ROUGHLY ANOTHER 300.

SO SOMEWHERE AROUND 600 TOTAL, I BELIEVE.

OKAY.

THE REASON WHY I ASK IS TRACING ALL OF THIS BACK WHEN HORIZON LINE FIRST CAME IN AND THEY WERE PROMOTING THEIR 197 HOUSES, AND THAT GOT TURNED DOWN BECAUSE IT WAS AN ENTERTAINMENT DISTRICT, THEY CAME BACK WITH A AGREEMENT THAT ALL OF YOU APPROVED FOR 500 PLUS OR MINUS 532 APARTMENTS.

THEN WE HEAR 320 COMING IN FROM RHM REAL ESTATE AND THEN 300 FROM METROPOLITAN HOLDINGS.

IT WASN'T ONLY UNTIL YOUR WORK SESSION LAST WEEK THAT I HEARD HORIZON LINE IS INTERMINGLED WITH THOSE TWO.

SO WE'RE UNDER THE IMPRESSION THERE WAS POSSIBLY GOING TO BE 1,152 APARTMENTS.

BUT YET THEN THE QUESTION WOULD STILL THEN COME OUT IS IF HORIZON LINE WAS ORIGINALLY PROPOSING FIVE TO 32, HOW DID THAT GET JUMPED UP TO 620 NOW, OR, YEAH, 620 OR 620 APARTMENTS.

SO THE NUMBER HAS INCREASED.

WELL, NO, THERE, THERE'S ONLY BEEN TWO PARCELS WE'VE EVER TALKED ABOUT.

AND ONE OF 'EM IS A PROJECT THAT WAS APPROVED BY, UH, LOUK'S METROPOLITAN HOLDINGS, AND THAT IS ROUGHLY 300, 300 UNITS.

THE RHM PROJECT IS THE SAME PROJECT, THAT HORIZON LINE OR THE SAME PARCEL OF LAND, THE SAME PARCEL THAT, UM, UH, THAT RHM IS NOW LOOKING AT.

THAT'S THE PROJECT THAT IS ON THE TABLE THAT WE HAVE NOT APPROVED YET.

SO IT'S JUST THE 300 FROM ONE AND THE 300 FROM THE OTHER, BUT IT'S ONLY BEEN TWO PARCELS EVERY RIGHT.

THREE HUNDRED'S BEEN APPROVED BY AN ADDITIONAL THREE 20 IS PENDING, YES.

OKAY.

ALL RIGHT.

BECAUSE I, I SAW TRYING TO PIECE ALL THAT TOGETHER.

HORIZON LINE SAYS THEIR DEVELOPMENT'S AT THE CORNER OF EXECUTIVE AND BRANT, AND THEN YOU HEAR SPECIFIC ADDRESSES FOR THE OTHER TWO.

SO THAT MAKES ONE THINK THAT THERE'S THREE.

SO I WAS JUST TRYING TO GET SOME CLARITY AS TO WHAT WE COULD ACTUALLY EXPECT THERE NEXT TO THAT PARCEL FROM WHAT WAS UNDER THE HORIZON LINE.

THAT IS A, A LOT OF THAT IS A COMMERCIAL PIECE OR COMMERCIAL ELEMENT THAT WE'RE HOPING FOR THAT WOULD RUN EAST UP EXECUTIVE BOULEVARD ON THAT SAME SIDE ACROSS FROM THE ROADS.

THAT'S, THAT'S ALL RIGHT.

I'M JUST TRYING TO GET SOME CLARITY.

CAUSE I KNOW SOME PEOPLE HAVE ALSO BEEN ASKING, ASKING ME, AND I'VE BEEN OUT ON THE PAGES POSTING, SAYING, THIS IS WHAT I'M SAYING.

SO YOU, YOU MENTIONED ONE THING, SO I JUST WANNA OFFER A QUICK CORRECTION.

SO THE, I DON'T KNOW THAT WE EVER TALKED PUBLICLY WHY I THINK EVERYBODY HAD THEIR REASONS FOR VOTING NO ON THAT ORIGINAL PROPOSAL.

BUT FROM WHAT I'VE GATHERED, IT WASN'T BECAUSE IT WAS AN ENTERTAINMENT DISTRICT.

IT WAS THAT WHAT WAS PROPOSED SEEMED TO BE MORE FOR, UH, A 50 OR 55 AND OLDER CROWD.

SO WE HAD SOMEONE FROM, UH, HORIZON LINE AT THAT TIME ACTUALLY COME TO THE PODIUM AND SPOKE TO THAT, THAT THE, THE PROJECT THEY HAD PROPOSED, THEY'D HAD A LOT OF SUCCESS IN THE MORE SENIOR MARKET.

SO I THINK WHEN THEY PROPOSED THAT IT WAS ONLY 197 UNITS, BUT THEY WERE JUST ONE STORY, RIGHT? IT LOOKED MORE LIKE A TYPICAL RESIDENTIAL, MORE OF A SENIOR COMMUNITY.

THAT PROJECT SPECIFICALLY DOESN'T WORK OR FIT INTO WHAT WE WOULD CONSIDER MULTI-FAMILY HOUSING FOR AN ENTERTAINMENT DISTRICT ACROSS THE STREET FROM A MUSIC CENTER THAT'S SEVEN MONTHS OUTTA THE YEAR, SIX MONTHS OUTTA THE YEAR, GONNA BE PROVIDING LOUD MUSIC.

SO, SO THAT PARTICULAR

PROJECT, I THINK THE REASON IT WAS VOTED DOWN WASN'T BECAUSE IT WAS AN ENTERTAINMENT DISTRICT AND NO MULTI-FAMILY, OR NO RESIDENTIAL HOUSING SHOULD BE THERE.

IT WAS BECAUSE OF THE TYPE, OKAY.

NOW THAT THEY'VE REPRESENTED A DIFFERENT TYPE OF MULTI-FAMILY THAT WOULD ATTRACT A YOUNGER CROWD, A MORE URBAN CROWD, SOMEONE WHO WANTS TO RESIDE IN THAT ATMOSPHERE OF AN ENTERTAINMENT DISTRICT, THAT'S A DIFFERENT TYPE OF LIVING EXPERIENCE THAN SOMEONE WHO'S IN THEIR FIFTIES OR OR SIXTIES WHO'S DOWNSIZING, WHO'S LOOKING FOR MORE PEACE OF QUIET.

OKAY? THAT'S THE REASON THAT PROJECT, IN MY OPINION, AND IF ANYBODY ELSE WOULD LIKE TO CHIME IN, PLEASE DO.

THAT'S WHY I BELIEVE THAT PROJECT WAS VOTED DOWN ZERO TO EIGHT, WHILE SOME PEOPLE WHO DID SUPPORT REDEVELOPMENT OF THAT PROJECT AND THE REZONING DIDN'T SUPPORT THE PRODUCT TYPE.

OKAY.

AND THAT'S PART OF THE DISCUSSION THAT YOU HEARD IF YOU WATCHED THE WORK SESSION LAST TIME, WHAT WE WERE LOOKING FOR, RIGHT? SO, SO THAT'S KIND OF WHERE WE STARTED TO WHERE WE ARE NOW.

BUT IT WASN'T BECAUSE IT WAS AN ENTERTAINMENT DISTRICT.

IT WAS BECAUSE THE PRODUCT THAT WAS PRESENTED.

I THINK IF THAT WAS ALLOWED, WE MIGHT HAVE A LOT MORE CLARITY NOW AS YOU'RE STARTING TO GET INTO THE FORMAL VOTING, AND IT TAKES AWAY A LOT OF QUESTIONS, BUT IT HA IT ALSO STILL PROVIDES CLARITY FOR EVERYBODY.

SO IF THAT'S SOMETHING THAT YOU ALL COULD POSSIBLY CONSIDER, MAYBE OPENING UP SOME WORK SESSIONS WHEN DEVELOPMENTS LIKE THIS COME INTO PLAY, LET THE PEOPLE COME IN AND VOICE AT THAT TIME, THAT WOULD BE APPRECIATED.

CERTAINLY 1800 CONSIDERATION.

THE OTHER ITEM I WANTED TO SPEAK TO IS THE CAMPGROUND.

I THINK THE CAMPGROUND, EVEN THOUGH IT'S UP FOR A DISCUSSION TONIGHT, I THINK IT'S, IT'S A GREAT IDEA.

IT LOOKS NICE.

I LOVE CAMPING.

MY ONLY PROBLEM WITH IT IS LOCATION, THE TRAFFIC ON OLD TROY PIKE RIGHT NOW.

AND THEN IF WE ADD IN WHAT THESE 620 APARTMENTS ARE GOING TO BRING, IF ANYONE HAS NEVER BEEN OUT TO THE OUTER BANKS ON A SATURDAY OR SUNDAY TO CHECK IN WHERE IT TAKES YOU A COUPLE OF HOURS TO DRIVE JUST TWO OR THREE MILES WHEN WE START TALKING, WHAT CAUGHT MY ATTENTION ON THIS IS THAT WHEN I FIRST HEARD THAT THIS CAMPGROUND WAS PROPOSED, THEY WERE TALKING 125 SLOTS FOR TRAILERS, ROUGHLY 10, 15 CABINS, SOME, UH, TENT CAMPING SPOTS WHEN HE SPOKE TO IT IN YOUR WORK SESSION.

NOW IT'S 250 TRAILER SLOTS PLUS THE TENT PARKING PLUS NOW IT'S 30, MAYBE MORE CABINS.

THEY'RE GONNA WAIT AND SEE WHAT FITS, AND THEN MAYBE EVEN BUILD MORE.

I CAN'T IMAGINE WITH ALL THESE TRAVELERS COMING IN ON 70 ON THE OFF RAMPS, TURNING ONTO OLD TROY PIKE TO TRY AND GET TO THAT FACILITY OF WHAT THE TRAFFIC'S GOING TO BE LIKE.

IT'S GONNA BE LIKE TRYING TO GET OUT TO YOUR RENTAL SPOT ON THE OUTER BANKS.

I WISH EVERYONE REALLY GIVE THAT DEEP THOUGHT.

I THINK OUR TRAFFIC STUDY THAT WE'RE HAVING COMPLETED ON OLD TROY PIKE RIGHT NOW, WE NEED TO GET THAT FINISHED AND VENTED AND DISCUSSED BEFORE WE LOOK AT ADDING MU EVEN MORE.

AGAIN, THE TRAFFIC STUDIES THAT THE VARIOUS DEVELOPMENTS ARE PUTTING OUT.

THEY'RE OLD TRAFFIC STUDIES WITH MASSAGE NUMBERS TO MAKE THEM LOOK ACCEPTABLE.

THAT COMPARED TO REALITY ARE TWO ENTIRELY DIFFERENT THINGS.

AND I HOPE THAT YOU GUYS GIVE CONSIDERATION TO THAT.

THE OTHER THING I WANTED TO QUICKLY DISCUSS WAS WATER INFRASTRUCTURE.

I WAS QUITE SURPRISED TO HEAR THAT THE PERK TEST OR SOIL SAMPLES HADN'T APPARENTLY BEEN COMPLETED YET.

IN ADDITION, WE STILL AREN'T SEEING CLARITY.

ONE OF THE QUESTIONS THAT I HAD TO, UM, THE CITY ENGINEER WAS THE SERVICE LINES.

WHAT'S HAPPENING WITH THE SERVICE LINES? ARE YOU GUYS REPLACING THEM? WHAT'S GONNA HAPPEN? ONE MINUTE? I HEAR, YEAH, WE'RE GONNA REPLACE EACH ONE OF 'EM ANOTHER TIME.

I HEAR, WE'LL REPLACE AS NEEDED.

BUT YET HERE RECENTLY, WE'VE HAD THREE SERVICE LINES BROKEN, TWO BY CONTRACTORS INSTALLING NEW PIPES.

THAT MAKES ONE QUESTION, WHAT ARE THESE ENGINEERING STUDIES THAT WE'RE HAVING COMPLETED? ARE THEY SHOWING WHERE ALL THESE CONNECTIONS ARE AT TO PREVENT THESE KIND OF PROBLEMS? WE ALSO STILL CAN'T FOR FORGO THE PROBLEMS THAT WE'RE HAVING WITH THE BRAKES.

I HEAR CONCERNS ABOUT FLYING ACE ON HOW MUCH WATER THEY USE.

THEY'RE, THEY'RE HIGH CONSUMPTION OF WATER, BUT YET FROM MY RESEARCH ON FLYING ACE, THEY'VE RECYCLED MORE WATER.

SO ARE THEY USING MORE WATER THAN WHAT 620 APARTMENTS ARE GONNA BE BRINGING OUT? I THINK THAT NEEDS TO BE GIVEN CONSIDERATION.

THAT, AND THAT WAS ADDRESSED BY THE ACTUAL ENGINEERING FIRM WHO

PUT THAT STUDY TOGETHER, THAT THE, UM, THE LEVEL OF GROWTH WAS NOT GONNA ADD ANY ADDITIONAL STRAIN IN THE PRESSURIZED SYSTEM.

I MEAN, THAT WAS, UH, OKAY, THAT'S BASED OFF HIS STUDY.

BUT THEN AGAIN, WE'RE, WE'RE BACK TO WHERE I WANT YOU TO MAKE COMMENTS, BUT, UM, WE'RE UNDER THE TIME.

RIGHT? AND YOU KNOW, WHEN, WHEN YOU BRING UP SOMETHING LIKE THAT, I, I MEAN, I DO FEEL IT'S, I NEED TO RESPOND BECAUSE THAT IS INFORMATION THAT HAS ALREADY BEEN VETTED, THAT THE ENGINEER WHO PUT TOGETHER THAT STUDY TALKED ABOUT GROWTH AND HAS SAID PUBLICLY ON THE RECORD THAT THAT'S NOT SOMETHING THAT WOULD STRESS THE SYSTEM.

WELL, AND THAT WAS HIS VIEWPOINT.

BUT MODELS CAN BE MISLEAD.

A RECENT ACTION BY THE CITY COUNCIL WHEN THE COMMUNITY DOES NOT THINK THE CITY COUNCIL VOTERS IN THE BEST INTEREST OF THE CITIZENS IN GENERAL, DISAGREES WITH THE ACTION OF THE CITY COUNCIL.

THE REFERENDUM PROCESSES START OF THE DAY AFTER THE COUNCIL VOTES ON AN ORDINANCE OR RESOLUTION, FILING A CERTIFIED COPY WITH CONTESTED ORDINANCE, CIRCULATING THE REFERENDUM PETITION THROUGHOUT THE COMMUNITY, COLLECTING SIGNATURES OF VOTERS WHO DISAGREE WITH A CITY COUNCIL VOTE.

AFTER COLLECTING THE CORRECT NUMBER OF SIGNATURES, WHICH WILL BE CERTIFIED BY THE MONTGOMERY COUNTY BOARD OF ELECTIONS, THE ISSUE WILL BE PUT ON THE BALLOT FOR THE ENTIRE HUBER HEIGHTS VOTING POPULATION TO VOTE YES OR NO.

IF THE PETITION IS SUCCESSFUL AND AN ELECTION DATE IS IN PLACE, THE ACTION OF THE CITY COUNCIL ON THE SUBJECT WILL BE PUT ON HOLD UNTIL AFTER THE ELECTION.

AFTER THE ELECTION, DEPENDING ON THE GENERAL ELECTION VOTE, THE PROJECT ORDINANCE RESOLUTION WILL GO FORWARD OR BE REVERSED.

LAST FALL, NEW CARLISLE CLARK COUNTY HAD A REQUEST FOR ANNEXATION OF APPROXIMATELY A HUNDRED ACRES OF AGRICULTURAL LAND IN BETHEL TOWNSHIP, MIAMI COUNTY, AND A DEVELOPER'S PLAN TO BUILD 300 HOUSES.

I BELIEVE NEW CARLISLE LOOKED AT ALL THE FACTORS, POSITIVE AND NEGATIVE.

THE ADDITION OF 300 HOUSES WOULD EQUAL INCOME TAX REVENUES, THE RESIDENTS OF THE HOMES, DEPENDING SPENDING MONEY AT LOCAL BUSINESSES, EXPANSION OF GROWTH.

BUT I BELIEVE THE NEW CARLISLE CITY COUNCIL DECIDED TO BE A GOOD NEIGHBOR AND TAKE INTO CONSIDERATION THE NEGATIVE EFFECT ON BETHEL TOWNSHIP'S, CITIZENS LIFESTYLE, THE TRAFFIC, AND LARGELY THE EFFECT ON THE BETHEL SCHOOLS.

I BELIEVE THE NEW CARLISLE CITY COUNCIL CONSIDERED THE BORDERLINE OF SIGNIFICANT IMPORTANCE, REALIZING ANY GROWTH OR EXPANSION OF NEW CARLISLE SHOULD BE RESPONSIBLY OF NEW CARLISLE PROPER AND NOT PUSHED ONTO THE CITIZENS

OF BETHEL TOWNSHIP.

THE NEW CARLISLE CITY COUNCIL HAS SEVEN MEMBERS.

WHEN IT CAME TIME TO VOTE ON THE ANNEXATION, ONE MEMBER WAS ABSENT FOR MEDICAL REASONS.

ONE MEMBER VOTED FOR THE ANNEXATION, AND FIVE MEMBERS VOTED NO.

NOW, HUBER HEIGHTS WILL CONSIDER THE ANNEXATION OF 265 ACRES LOCATED IN MIAMI COUNTY, BETH TOWNSHIP, AND THE DEVELOPMENT OF UP TO A THOUSAND HOUSES.

I AM SURE YOUR REVIEW OF THE DEVELOPMENT COMES WITH SOME MATHEMATICAL FORMULA THAT CALCULATES THE POTENTIAL TAX REVENUE OVER THE NEXT 50 YEARS.

IF THIS DEVELOPMENT WAS WITHIN YOUR CITY BOUNDARIES, THAT WOULD BE AN ISSUE BETWEEN YOU AND YOUR CITIZENS.

BUT WHEN YOU CAN ACCEPT A HIGH DENSITY DEVELOPMENT THAT IS IN BETHEL TOWNSHIP, REAP WHAT YOU CONSIDER REWARDS AND PLACE A BURDEN ON BETHEL ROADS, AND MOST IMPORTANTLY, PUTTING THE STUDENT BURDEN ON BETHEL SCHOOLS.

AGAIN, HOW WOULD YOU COMMUNITY, LIKE IF 1000 NEW STUDENTS SHOWED UP AT YOUR DOORS, YOUR COMMUNITY HAS A POPULATION OF OVER 40,000 AND A NUMBER OF SCHOOLS THAT COULD ABSORB THIS INFLUX.

WE AND BETHEL TOWNSHIP HAVE ONE SCHOOL AND A POPULATION OF 5,000.

THESE NUMBERS ARE OVERWHELMING.

IT IS OBVIOUS THE MIAMI COUNTY COMMISSIONERS REPRESENT 110,000 RESIDENTS ARE AGAINST THIS ANNEXATION.

THE BETHEL TOWNSHIP TRUSTEES WHO REPRESENT 5,000 RESIDENTS ARE ADAMANTLY AGAINST THIS ANNEXATION DEVELOPMENT.

BETHEL TOWNSHIP HAS EVEN GONE AS FAR AS SPENDING A MILLION TAX DOLLARS, ALONG WITH MATCHING STATE FUNDS TO PURCHASE PROPERTY NEAR 2 0 1 AND SINGER ROADS AS A MEANS TO BLOCK ANNEXATION AND DEVELOPMENT.

THIS IS YET ANOTHER EXAMPLE, HOW STRONGLY WE OPPOSE THESE HIGH DENSITY DEVELOPMENTS.

YOU ARE UNDER NO LEGAL OBLIGATION TO VOTE FOR THIS ANNEXATION.

PLEASE BE A GOOD NEIGHBOR AND VOTE NO.

UM, WE DID EX, UH, REQUEST SOME PEDESTRIAN ACCESS, UH, AT LOBLAW DRIVE TO CONNECT THE NEIGHBORHOOD TO THE WEST AND THE NORTH WITH THE COMMERCIAL, UH, PROPOSED COMMERCIAL SITES TO THE SOUTH SO THAT THERE IS A PEDESTRIAN CONNECTION AND WE CAN REDUCE THE AMOUNT OF, UH, NEEDLESS, UH, VEHICULAR TRAVEL IF YOU COULD ONLY ONLY NEED TO WALK, UH, A QUARTER MILE.

UM, THE APPLICANT IS PROPOSING A 10 FOOT WIDE MULTI-USE PATH ALONG EXECUTIVE BOULEVARD THAT'S CARRIED OVER FROM, UH, THE NEWBAUER, UH, PROPOSAL AS WELL.

UH, RIGHT NOW, UH, WHAT IS BEING PROPOSED IS 531 RESIDENTIAL PARKING SPACES, WHICH IS 1.7 SPACES PER UNIT, WHICH IS MORE THAN WHAT WE HAVE, UH, BEEN APPROVING, UH, FOR OTHER, UM, HIGHER DENSITY MULTI-FAMILY DEVELOPMENTS.

STAFF RECOMMENDED APPROVAL OF THE REZONING AND THE BASIC DEVELOPMENT PLAN TO CONSTRUCT 300 RESIDENTIAL UNITS AS WELL AS FOUR COMMERCIAL OUTLETS.

UH, WE RECOMMENDED THE FOLLOWING CONDITIONS FOR APPROVAL.

ONE THAT THE PERMITTED USES BE THOSE OUTLINED IN CHAPTER 1179, EXCLUDING ON THESE 22 ACRES, UH, FILLING STATIONS, SWEEPSTAKES, CAFES, CONVENIENCE STORES, SELF STORAGE FACILITIES, CAR WASHES OR OTHER, UH, USES THAT WE FEEL ARE INCOMPATIBLE WITH THE COMMUNITY ENTERTAINMENT DISTRICT.

SECONDLY, THAT THE APPLICANT WILL COMPLY WITH ALL FIRE CODE REQUIREMENTS.

THE BASIC DEVELOPMENT PLAN THAT'S BEEN RECOMMENDED BY THE PLANNING COMMISSION, UH, IS REALLY REFLECTIVE OF, UM, I BELIEVE IT WAS, UH, THE ACCESS POINTS, THE, UH, THE ZONING AS WELL AS, UH, SOME BUFFERING CONDITIONS AND, UH, INGRESS IN EGRESS, THE ELEVATIONS.

AND SOME OF THE OTHER MATERIALS THAT'S PRESENTED AS PART OF THIS APPLICATION ARE REALLY CONCEPTUAL IN NATURE AND ARE NOT, UH, SUBJECT TO THE RECOMMENDATION THAT CAME OUT OF THE PLANNING COMMISSION, RECOGNIZING THAT COUNCIL HAS A DESIRE TO MAKE SURE THAT, UM, IN THIS INSTANCE, UM, THERE IS A, A, A REPRESENTATION THAT THEY WANT FROM THAT THE CITY WANTS FROM THIS PROJECT.

UM, THE CITY DOES HAVE AN ABILITY, THE CITY COUNCIL DOES HAVE AN ABILITY TO ENDORSE, UM, A CONCEPT PLAN, OR, EXCUSE ME, NOT A CONCEPT PLAN TO ENDORSE, UH, ELEVATIONS, UH, UM, PRIOR TO, UH, TO THIS ITEM.

MOVING ON TO THE DETAILED DEVELOPMENT PLAN WHERE THOSE ELEVATIONS WOULD, WOULD BE FINALIZED AND FORMALIZED THROUGH THE APPROVAL PROCESS, UH, TO MAKE SURE THAT THE CITY'S INTERESTS, UM, AS THE LANDOWNER, UM, IN, IN RELATION TO, UH, RH M'S INTEREST TO DEVELOP THE LAND, UM, AS, AS THE, UH, PURCHASING PARTY, UM, GOING FORWARD WITHOUT HAVING TO AMEND, UH, OR WITHOUT HAVING TO CONSIDER THIS AN AMENDMENT TO THE PLANNING COMMISSION'S RECOMMENDATION.

SO, UM, AGAIN, THE CITY COUNCIL HAS AN ABILITY AT THE NEXT, UH, COUNCIL MEETING, UH, IF THIS DOES MOVE TO A SECOND READING TO PROVIDE AN ENDORSEMENT OR FOR SUPPORT OF A SPECIFIC SET OF, UM, ELEVATION DRAWINGS, THAT WOULD THEN BE THE FOCUS OF THE DETAIL DEVELOPMENT PLAN AND SUCH ENDORSEMENT WOULD NOT REQUIRE A SUPER MAJORITY VOTE OF THIS BODY BECAUSE YOU ARE NOT AMENDING ANY RECOMMENDATION THAT HAS COME FORWARD FROM THE PLANNING COMMISSION TO THIS POINT.
