[00:00:04]

OKAY, I SHALL CALL THE MEETING OF THE CITY OF HUBER HEIGHTS PLANNING COMMISSION TO ORDER.

SECRETARY, WILL YOU PLEASE CALL THE ROLL? MR. JEFFRIES? HERE.

MS. THOMAS? HERE.

MS. VAGO? HERE.

MR. WALDEN HERE.

I HAVE NO OPENING REMARKS.

IS ANYONE ELSE ON THE DIOCESE? HAPPY NEW YEAR.

HAPPY NEW YEAR.

SAME TO YOU.

THANK YOU, MS. THOMAS .

UM, NEXT ON THE AGENDA, CITIZENS COMMENTS, THIS IS THE APPROPRIATE TIME FOR ANY CITIZENS COMMENTS NOT PERTAINING TO ITEMS ON THE AGENDA.

HEARING NONE.

WE'LL MOVE ON TO SWEARING OF WITNESSES.

I ANNOUNCE IN ACCORDANCE WITH THE RULES OF THE PLANNING COMMISSION.

ANYONE WHO MAY WISH TO SPEAK OR GIVE TESTIMONY REGARDING THE ITEMS ON THE AGENDA THIS EVENING NEEDS TO BE SWORN IN.

I ASK EVERYONE TO STAND IN, RAISE THEIR RIGHT HAND AND RESPOND.

I DO.

TO THE FOLLOWING OATH, DO YOU HEREBY TO SWEAR? DO YOU HEAR BY SWEAR OR AFFIRM WHEN THE THREAT OF PERJURY TO TELL THE TRUTH, THE WHOLE TRUTH, AND NOTHING BUT THE TRUTH, SO HELP YOU GOD? I DO.

THANK YOU.

MAY BE SEATED.

BE SEATED.

THANK YOU.

.

FIRST ITEM ON THE AGENDA, UM, IS NEW BUSINESS IS A LOT SPLIT REPLAT THE APPLICANT.

HOMESTEAD DEVELOPMENT IS REQUESTING APPROVAL OF A LOT SPLIT REPLAT OF 23.749 ACRES TO CREATE TWO LOTS TO FACILITATE THE REDEVELOPMENT OF THE FORMER MARION MEADOWS SHOPPING CENTER.

PROPERTY IS LOCATED WEST OF THE TERMINUS OF MIAMI VALLEY WAY, UH, LS 2301.

MR. CRELL.

OKAY, WELL, I APOLOGIZE FOR BRINGING YOU HERE FOR THIS ONE CASE.

UH, IF THE CITY WAS NOT A PARTY TO THIS, UH, AND THIS WOULD'VE BEEN TWO PRIVATE PARTIES, UH, I WOULD'VE APPROVED THIS ADMINISTRATIVELY BECAUSE IT MEETS THE DEFINITION OF A MINOR LOT SPLIT THAT CAN BE APPROVED, UH, ADMINISTRATIVELY UNDER OUR RULES.

SO, UH, THERE'S REALLY TWO APPLICA OR TWO, UM, UH, TRANSACTIONS THAT ARE OCCURRING IN THIS APPLICATION.

THE FIRST IS A, UH, TRANSFER OF PROPERTY BETWEEN THE CITY, UH, AND PREMIER HEALTH PARTNERS TO, UH, HELP WITH THE GEOMETRY OF, OF THE NEW ROADS.

THE SECOND THEN IS A LOT SPLIT, UH, FROM THE CITY OWNED PROPERTY INTO TWO LOTS.

14 HERITAGE COMMON APARTMENTS, UH, WHICH YOU APPROVED, UM, EARLIER THIS, OR EARLIER, LATE LAST YEAR.

UH, AND THEN THE SECOND IS FOR THE SENIOR, UM, THE SENIOR APARTMENTS.

SO THIS IS THE AREA IN QUESTION.

UM, THE LOT SPLIT IS TAKING PLACE ON, UH, ON THIS LOT.

UH, YOU CAN SEE KIND OF THE FATE, WELL, YOU CAN'T SEE IT FROM THERE, BUT BASICALLY THIS LITTLE, UH, TAIL IS GOING TO PREMIER HEALTH PARTNERS.

WE ARE GETTING THE LITTLE CORNER, UH, OF THEIR LOT.

THE NEW ROADWAY WILL COME AROUND, KIND OF SWOOP THIS WAY TO CONNECT WITH THE SHOPPING CENTER TO THE NORTH.

THE TWO LOT SPLITS.

UM, THE FIRST ONE IS ROUGHLY RIGHT HERE FOR THE HERITAGE COMMON APARTMENTS.

THE MARKET RATE, THE SECOND LOT SPLIT IS HERE, COMES DOWN TO, UH, BRANT PIKE, UM, FOR THE SENIOR FACILITY, ALONG WITH THE CONNECTIONS TO WHERE DOGTOWN IS NOW.

UM, THE RETENTION POND, THE PARKLAND, THE SEN, THE POTENTIAL SENIOR BUILDING.

ALL OF THAT IS KIND OF IN LOT TWO.

UM, YOU'LL GET, YOU'LL SEE ANOTHER ACTION.

THE THIRD ACTION, WHICH WOULD BE THE DEDICATION OF THE ACTUAL ROADWAY, UH, AND RIGHT OF WAYS AT, AT A FUTURE MEETING, PROBABLY IN FEBRUARY.

BUT THIS NEEDED TO OCCUR NOW SO THAT WE COULD START MOVING FORWARD WITH, UH, WITH CLOSINGS.

HERE IS THE, UH, THE PROJECT THAT WAS APPROVED.

YOU CAN KIND OF SEE, UH, HOW THAT ROADWAY SWOS TO THE, TO THE NORTH.

UH, THIS IS THE MARKET RATE APARTMENT COMPLEX.

THE SENIOR FACILITY.

IF YOU DRAW A LINE FROM THIS LOT KIND OF STRAIGHT DOWN, UM, THIS WOULD BE ON THE, ON THE LOT ON THE REPLAT.

THIS WOULD BE LOT ONE.

THIS IS EFFECTIVELY LOT TWO.

SO IN THE ACTUAL DRAWINGS HERE IS THE, UH, LOT SPLIT.

UM, THE TRANSFER THAT OCCURS, WE'RE GIVING THIS LITTLE PIECE TO PREMIER HEALTH PARTNERS.

THEY'RE GIVING THIS CORNER TO US.

UH, THEY WILL HAVE THEN ONE CONTIGUOUS LOT THAT THEY CAN DEVELOP IN THE FUTURE IF THEY EXPAND THEIR FACILITY HERE.

UH, THIS WILL END UP BEING THE ROADWAY.

SORT OF THE ROUNDABOUT RIGHT HERE IS, IS HOW THAT'S GONNA WORK.

AS FAR AS THE, THE LOT SPLIT ITSELF, UM, THIS IS LOT NUMBER ONE.

YOU CAN KIND OF SEE HOW THE ROADWAY'S GONNA BEND AROUND TO THE

[00:05:01]

NORTH.

THIS IS THE SITE OF THE, THE APARTMENTS HERE.

THIS WILL BE A RETEN, A RETAINING POND.

UM, ANOTHER ROADWAY PARKING AREA.

THIS IS THE LIBRARY RIGHT HERE.

LOT TWO.

THIS IS THE SENIOR FACILITY.

THIS IS DOG TOWN.

UM, RIGHT NOW, WELL, IT IS DOG TOWN.

UM, THE ROAD, THE NEW ROADWAY WILL COME IN ROUGHLY ABOUT HERE, UH, AND THEN SWEEP ACROSS.

UM, THEY'RE STILL DESIGNING THE LOCATION OF THAT GEOMETRY, WHICH IS WHY YOU DON'T HAVE IT IN FRONT OF YOU YET.

THEY'RE STILL TWEAKING THAT A LITTLE BIT.

UM, SO, UH, THE PROPOSED REPLAT MEETS ALL OF THE SUBDIVISION REQUIREMENTS.

UH, YOU'LL SEE FUTURE DEDICATED STREETS ALONG WITH THE RETENTION POND IN, UH, OPEN SPACE AREAS AND THOSE CONNECTIONS TO BRANT PIKE.

UH, AT A FUTURE MEETING, PROBABLY NEXT MONTH, UM, WE RECOMMEND APPROVAL AS SUBMITTED.

ARE THERE ANY QUESTIONS FOR STAFF MR. JEFFRIES? JUST ONE FOR CLARIFICATION.

AARON, ON THIS, THE SPLIT AND THE TRANSACTION WITH US IN PREMIER, DOES THIS TAKE CARE OF THE ROAD EASEMENTS AND STUFF THAT THE CITY NEEDS, OR WILL THAT BE AT THE REPLAT? SO THIS, THIS TRANSACTION GIVES US ALL OF THE LAND WE NEED FOR ALL OF THE ROADWAY, UM, EASEMENTS OR THE, THE ROADWAY WIDTHS.

UM, WHAT, SO THAT AGREEMENT'S IN PLACE ONCE THIS IS DONE, CORRECT.

OKAY.

YES.

THANK YOU.

ANY OTHER QUESTIONS FOR STAFF? THANK YOU, SIR.

OKAY.

WE'LL OPEN IT UP TO THE PUBLIC.

IS THERE ANYONE IN THE AUDIENCE WISHING TO SPEAK ON THIS ZONING CASE? AND HERE IN NOW ONE, WE WILL CLOSE THE PUBLIC PORTION.

ANYONE ELSE HAVE ANY OTHER COMMENTS, QUESTIONS? OKAY, I'LL MAKE A MOTION.

IS THERE A MOTION TO APPROVE THE REQUEST BY THE APPLICANT? HOMESTEAD DEVELOPMENT FOR APPROVAL OF A LOT SPLIT AND REPLAT OF 23.749 ACRES TO CR TO CREATE TWO LOTS TO FACILITATE THE REDEVELOPMENT OF THE FORMER MARION MEADOW.

SHOPPING CENTER.

PROPERTY IS LOCATED WEST OF THE TERMINUS OF MIAMI VALLEY WAY, CASE LS 2301 IN ACCORDANCE WITH THE RECOMMENDATIONS OF STAFF'S MEMORANDUM DATED JANUARY 4TH, 2023 AND THE PLANNING COMMISSION'S DECISION RECORD ATTACHED THERE TOO.

MOVED BY MR. JEFFRIES.

IS THERE SECOND SEGMENT BY MS. THOMAS? SECRETARY, WILL YOU PLEASE CALL THE ROLL? MS. VAGO? YES.

MS. THOMAS? YES.

MR. JEFFRIES? YES.

MR. WALDEN? YES.

MOTION PASSES FOUR TO ZERO.

WHAT IS NEXT FOR THE APPLICANT? .

SO THE APPLICANT WILL BE SUBMITTING, UM, ROADWAY, UM, SORRY, RIGHT AWAY.

UM, UH, RIGHT AWAY PLATS FOR US TO THEN APPROVE.

UM, SO I ANTICIPATE THAT I'LL GET THOSE PROBABLY LATE THIS MONTH, IF NOT EARLY.

UM, FEBRUARY.

THEY ARE TRYING TO, I BELIEVE, CLOSE BY MID-MARCH, UM, ON THE, ON THE PROJECT.

AND SO THAT NEED THAT NEXT, THAT PUBLIC LAND DEDICATION NEEDS TO OCCUR BEFORE THAT THAT HAPPENS.

OKAY.

THANK YOU.

NEXT ITEM ON THE AGENDA IS, UH, ELECTION OF OFFICERS.

THIS TIME I WILL, UH, IS, IS THERE ANY NOMINATIONS FOR THE CHAIR OF THE PLANNING COMMISSION? MS. VAGO? I'D LIKE TO NOMINATE TERRY WALTON.

TERRY WALTON.

WILL WE ACCEPT THAT NOMINATION? IS THERE ANY OTHER NOMINATIONS FOR CHAIR IN HEARING? SECOND CHANCE .

WHAT SECOND CHANCE IN, UM, UH, IN HEARING NONE, I WILL ACCEPT THE, UH, NOMINATION AND THE, I GOT A VOTE.

NO, WE GOTTA A VOTE.

UH, ALL IN FAVOR? NO.

I GOTTA TAKE A ROLL.

ROLL CALL.

PLEASE.

CAN MADE A MOTION.

DO I HAVE A SECOND? YES.

JAM A MOTION? YES.

CHERYL? SECOND.

YES.

CHERYL SECOND? YES.

MR. JEFFRIES? YES.

MS. THOMAS? YES.

MS. VAGO? YES.

MR. WALTON? OH, YES.

SO LET IT BE KNOWN, RIGHT? CONGRATULATIONS.

SORRY.

UH, NEXT IS, UH, VICE CHAIR.

I WOULD LIKE TO NOMINATE MS. JAN VAGO FOR VICE CHAIR.

UH, YES, I WILL ACCEPT THAT NOMINATION.

OKAY.

IS THERE ANY OTHER NOMINATIONS FOR VICE CHAIR IN HEARING NONE? UH, SECRETARY, WILL YOU PLEASE CALL THE RULE? I NEED A SECOND.

OH, I'M SORRY.

I NEED A SECOND.

A SECOND.

BY MS. THOMAS, WE ONLY DO THIS ONCE A YEAR.

, UM, SECRETARY, WILL YOU PLEASE CALL THE RULE? ALL RIGHT, MR. JEFFRIES? YES.

MS. THOMAS? YES.

MS. VAGO? YES.

MR. WALTON? YES.

CONGRATULATIONS, JAN.

[00:10:01]

THANK YOU, CONGRAT.

THANK YOU.

NEXT ITEM UNDER, UH, ON THE AGENDA AS APPROVAL OF THE MINUTES, THE, UH, MINUTES FOR THE PLANNING COMMISSION.

DECEMBER 13TH WILL BE APPROVED.

AND HEARING NO OPPOSITION AND IN HEARING NO OPPOSITION, THEY ARE APPROVED REPORTS AND CALENDAR REVIEW, MR. CLL.

UM, SO AT THIS TIME WE HAVE NO APPLICATIONS FOR, UM, NOTHING ON NEXT, ON THE NEXT MEETING IN JANUARY, THERE'S AGENDA.

UM, WE HAVE UNTIL I BELIEVE FRIDAY TO, UH, NEXT FRIDAY TO RECEIVE, UH, APPLICATIONS FOR THE 1ST OF FEBRUARY.

UM, I ANTICIPATE THE PUBLIC LAND EDUCATION FOR, UH, HERITAGE COMMONS, WHICH CASE PAD.

UM, AND WE MAY HAVE, UM, ANOTHER SHEETS, UM, DEVELOPMENT COMING IN AT EXECUTIVE AND BRANT.

UM, THAT'S, THAT'S TO BE DETERMINED AT THE MOMENT.

BUT OTHERWISE, UM, THE, AT THE MOMENT THERE IS NOTHING ON THE HORIZON.

SO THE JANUARY 24TH MEETING WILL BE CANCELED, WILL BE CANCELED.

COULD YOU SAY EXECUTIVE AND BRT? IS THAT WHERE THE BARGAINS WAS RIGHT NOW? OR POSSIBILITY? NO, THAT WE IS A STATEMENT.

UM, OR IS IT RIGHT ON THE PHONE? IT'S RIGHT ON THE CORNER OF THE, OF THE INTERSECTION ON THE, IT'LL BE ON THE SOUTH, UH, SOUTHWEST CORNER.

HUH.

OKAY.

IT'S DISAPPOINTING.

SO OTHER THAN THAT, UM, I, I THINK WE WILL HAVE LOTS OF INTERESTING CASES, UH, IN 2023.

UM, BUT UM, AT THE MOMENT, NOTHING IS CROSSED AT THE DESK.

THAT ALL WILL NEED TO GET ROLLING.

EXACTLY.

.

OKAY.

SO THERE WILL BE NO, UM, NO MEETING ON JANUARY THE 24TH ON VALENTINE'S DAY.

THAT'S RIGHT.

ABSOLUTELY.

OKAY.

UH, NEXT ITEM ON THE AGENDA IS A APPROVAL OF THE 2023 MEETING SCHEDULE.

DO YOU BELIEVE EVERYBODY HAS THAT IN FRONT OF THEM OR HAS HAD THAT IN FRONT OF THEM? IS THERE ANY OPPOSITION OR ANYTHING CHANGES THAT ANYBODY NEEDS? OR ANY COMMENTS? AARON, DID YOU WANNA TALK ABOUT THAT? TALK ABOUT IT? UM, YEAH, SO THE CHANGE FOR OF WHAT WE'RE PROPOSING, UM, THIS YEAR IS TO MOVE TO ONE MEETING A MONTH, BEGINNING IN APRIL.

UM, OF THE JURISDICTIONS IN ESSENTIALLY A THREE COUNTY AREA.

WERE ONE OF THREE THAT, UH, HAS MULTI, UH, BIMONTHLY, UH, MEETINGS OR, YEAH.

UM, OR SEMI-MONTHLY, I SHOULD SAY SEMI-MONTHLY, UH, MEETINGS.

UM, SO I WOULD, WE WOULD LIKE TO GO TO ONE MEETING A MONTH.

IT GIVES US A LITTLE BIT MORE TIME TO WORK WITH THE, THE APPLICANTS TO, UM, FLESH OUT BETTER PROJECTS, DO A LITTLE BIT BETTER PLANNING WORK BEFORE, UM, IT COMES TO, TO YOU SO THAT YOU HAVE A MORE FULLY BAKED, UH, AND WELL THOUGHT OUT PRODUCT BEF AND, AND WE'RE NOT, UM, BEING CRUNCHED FROM MEETING TO MEETING, WE ACTUALLY CAN DO SOME LONG-RANGE PLANNING, UH, WORK AS WELL.

SO THAT'S WHY WE ARE PROPOSING TO GO TO MONTHLY INSTEAD OF, UH, SEMI-MONTHLY.

AND YOU SAY PROPOSING, SO IF WE ALL ACCEPT, WE'RE IN, RIGHT? YEP.

OKAY.

DO WE NEED TO VOTE ON THAT? SECRETARY, WILL YOU PLEASE CALL THE RULE? I NEED A MOTION.

I, I NEED, OKAY.

I, I, I HAVE A, I HAVE A QUICK QUESTION.

SURE.

WHY DO WE HAVE TO WAIT TILL APRIL? UH, BECAUSE THERE ARE A COUPLE PROJECTS LIKE, UH, HERITAGE COMMONS AND A COUPLE THAT, THAT I KNOW, UM, HAVE FIRST QUARTER CLOSING DATES GOTCHA.

THAT STILL HAVE A LITTLE BIT UNFINISHED BUSINESS.

SO I WANTED TO GIVE THEM TWO BITES OF THE APPLE EVERY MONTH.

OKAY.

UM, SO YEAH, IT WAS TO ACCOMMODATE WHAT I KNOW IS ON THE HORIZON.

GOTCHA.

OKAY.

MAKES SENSE.

MM-HMM.

.

THANK YOU.

I'LL MAKE A MOTION TO ACCEPT THE, UH, CALENDAR IS WRITTEN.

SECOND MS. FARGO SECONDS.

SECRETARY, PLEASE CALL THE ROLL.

MR. JEFFRIES? YES.

MS. THOMAS? YES.

MS. FARGO? YES.

MR. WALDEN? YES.

THE ACCEPTANCE OF THE CALENDAR IS PASSES FOUR TO ZERO.

ALL RIGHT.

THANK YOU.

THANK YOU.

SIX 15.

UH, YEAH.

NEXT ITEM, UH, WAS, UH, UPCOMING, WHICH YOU'VE ALREADY DISCUSSED.

MM-HMM.

, DOES ANYONE HAVE ANYTHING ELSE TO BRING BEFORE? YES, MS. BARGO? I JUST HAVE A COUPLE OF QUESTIONS.

UH, ONE OF 'EM IS ABOUT TACO BELL.

THEY HAVE BEEN CLO ONE OF 'EM, UM, RAMP PIPE.

OKAY.

THEY'RE CLOSED.

AND THEY HAD A, DID THEY HAVE A FIRE OR SOMETHING? THEY NO IDEA.

CLIFF? THEY DID, YES.

OH, IS THAT IT? YEAH.

YEAH, I THINK, UM, NEVER HEARD ABOUT THAT.

THEY HAD A, UH, A KITCHEN FIRE.

THERE SHOULD HAVE BEEN LIKE SIX OF, SO I THINK THEY WERE REPAIRS AT THE MOMENT.

OKAY.

BECAUSE I KNOW THEY HAD A THING OUT THERE FOR A LONG TIME AND THEN NOBODY WAS WORKING THERE AND YEAH.

OKAY.

AND THE OTHER QUESTION I HAVE IS, IT'S

[00:15:01]

ABOUT THE SECOND OR THIRD TIME I'VE MENTIONED IT, THE WENDY SIGN IS STILL THERE.

AND I WAS TOLD THAT WE ZONING, THE PEOPLE HAD CITED THEM AND IT WAS BEING TAKEN CARE OF, BUT IT'S STILL THERE.

WE'VE TAKEN THEM TO COURT AND IT'S JUST A SLOW PROCESS.

IS THERE A COURT DATE? I PERSONALLY DON'T KNOW WHAT THAT IS, BUT ZONING IS IN TOUCH WITH THE PROSECUTOR AND THAT'S BEEN ON THE DOCKET.

IT JUST MOVES REALLY, REALLY SLOW.

IT JUST, JUST, IT'S SUCH AN ICEO AND IT'S BEEN THERE FOR SO LONG TO THE POINT THAT, UM, OTHER PEOPLE ARE NOW I THINK BEGINNING TO NOTICE HOW NEEDS TO BE THERE.

I, I WILL LOOK UP, UH, TO SEE IF HE'S, IF THE COURT DATE'S BEEN, UM, ESTABLISHED.

I CAN, I CAN LOOK IT UP AND I'LL EMAIL YOU.

OKAY.

AND THEN MY THIRD QUESTION IS, HAVE WE HAD ANY APPLICATIONS FOR ANOTHER MEMBER FOR THIS GROUP? I BELIEVE WE HAVE ONE.

UM, I DON'T KNOW WHO IT IS, BUT I WAS TOLD WE HAVE ONE APPLICATION AND IT'S OPEN UNTIL FRIDAY.

IT'S OPEN UNTIL FRIDAY IF OTHERS THAT'S RIGHT.

AND IT IS OPEN UNTIL FRIDAY IF OTHERS WANT TO APPLY.

MM-HMM.

.

OKAY.

I THOUGHT WE HAD QUITE A FEW HERE A MONTH AGO.

I GUESS NOT.

I WAS TOLD ONE SANDY WAS STILL ON IT A MONTH AGO.

MAYBE.

WHAT? SANDY WAS STILL PART OF IT A MONTH AGO.

OH, NEVERMIND.

I THOUGHT IT WAS OPEN BECAUSE WE KNEW, I DON'T, I DON'T KNOW HOW THIS STUFF WORKS.

I JUST SHOW UP.

DO WHAT YOU'RE TOLD.

WELL, I QUIT DOING THAT.

GAVE UP ON THAT.

DID YOU EVER? YEAH, I DID AT THE BEGINNING.

OTHER THAN THAT, ANYBODY ELSE HAVE ANYTHING ELSE TO BRING BEFORE, UH, THE PLANNING COMMISSION? ONCE AGAIN, EVERYBODY.

HAPPY NEW YEAR.

LET'S MAKE THIS MOST SOUGHT AFTER YEAR.

WE'VE EVER HAD BUSY A BUSY ONE.

I'D LIKE ONE TO BE A BUSY ONE.

AND FUN.

ONE.

WE TURN, STARTING OFF BUSY.
