[00:00:03] OKAY. GOOD EVENING EVERYONE, AND WELCOME TO THE CITY OF HEBREW HEIGHTS CITY COUNCIL MEETING REGULAR SESSION. TODAY'S DATE IS JANUARY 9TH, 2023. WE'RE GETTING STARTED HERE RIGHT AT SIX O'CLOCK. UH, THIS MEETING [1. Call The Meeting To Order - Mayor Jeff Gore] IS OFFICIALLY CALLED TO ORDER. AND NEXT WE WOULD HAVE OUR INVOCATION [2. Invocation - Pastor Randy Griffith Of The Free Methodist Church At 6875 Old Troy Pike, Huber Heights, Ohio] THIS EVENING. AND THAT IS BY PASTOR RANDY GRIFFITH OF THE FREE METHODIST CHURCH AT 68 75 UL TROY PIKE. HERE IN HUB RIGHTS PASTOR GRIFFIN, THE WESTMINSTER SHORTER CATECHISM STATES, THE CHIEF END OF MANKIND IS TO GLORIFY GOD AND ENJOY HIM FOREVER. WHAT DOES THIS MEAN AND HOW DOES IT WORK? CS LEWIS WROTE TO GLORIFY AND ENJOY GOD ARE THE SAME THING. FULLY TO ENJOY IS TO GLORIFY AND THEN COMMANDING US TO GLORIFY HIM. GOD IS INVITING US TO ENJOY HIM. IF ADMIRATION IS DESERVED, THEN IT IS THE CORRECT, ADEQUATE AND APPROPRIATE RESPONSE. AND IF PAID WILL NOT BE THROWN AWAY. LIKE MANY OBJECTS IN BOTH NATURE AND ART MAY BE SAID TO DESERVE OR MERIT OR EVEN DEMAND ADMIRATION. IF WE DID NOT ADMIRE, WE WOULD BE STUPID INSENSIBLE AND GREAT LOSERS AND GREAT LOSERS AND WOULD HAVE MISSED SOMETHING. GOD HAS THAT OBJECT TO ADMIRE OR TO APPRECIATE, WHICH IS SIMPLY TO BE AWAKE. TO HAVE ENTERED THE REAL WORLD AND NOT TO APPRECIATE IS TO HAVE LOST THE GREATEST EXPERIENCE OF ALL. AND IN THE END, TO HAVE LOST ALL WHILE MY WIFE AND DENISE AND I WERE AWAY BETWEEN CHRISTMAS AND NEW YEAR'S, I BEGAN TO SEE MORE FULLY HOW GLORIFYING GOD AND ENJOYING HIM FOREVER IN ALL THINGS AND UPSTANDING FROM PARTICIPATING IN THAT WHICH DOES NOT GLORIFY HIM, IS A SECRET TO LIVING THE CHRISTIAN LIFE. AND THEN ANSWER TO HOW I CAN BEST LIVE MINE IN A REAL AND PRACTICAL SENSE. WHAT IF GLORIFYING AND ENJOYING GOD TRULY DOES SURPASS, GLORIFYING AND ENJOYING ANYTHING ELSE? AND WHEN GOD HAS THAT PLACE IN OUR LIVES, IT ONLY LEADS TO A BETTER AND MORE FULFILLING ENJOYMENT OF GOD. AND ALL THAT GOD HAS MADE AND GIVEN US TO ENJOY, TO GLORIFY AND ENJOY HIM, FIRST AND FOREMOST ENABLES US TO ENJOY ALL THAT GOD HAS MADE PEOPLE, PLACES AND THINGS WHILE PROTECTING US FROM TURNING THEM INTO IDOLS. IT KEEPS US LIVING ACCORDING TO THE REALITY OF THINGS, ACCORDING TO GOD'S KINGDOM, AND PROTECTS US FROM BECOMING DISTRACTED AND CONFUSED BY THE TEMPORARY THINGS OF THIS LIFE AND THE CORRUPTIBLE MANMADE. SO AS A GIFT, I BELIEVE THAT THE LORD GAVE ME THIS TREASURE TO LIVE BY, THAT I'M SHARING WITH YOU, WITH THE HELP OF THE HOLY SPIRIT, TO LIVE TO THE GLORY OF GOD AND ALL ASPECTS OF LIFE. AND TO LET THAT INTERPRET OUR THOUGHTS, OUR WORDS, AND OUR ACTIONS, SO THAT WE MAY HAVE THAT TREASURE OF ENJOYING GOD, THE GOD WHO LOVES YOU AND ME, AND GAVE HIS LIFE FOR YOU AND ME, AND WHO HAS GIVEN HIS HOLY SPIRIT TO HELP US LIVE BY THIS VALUABLE TREASURE THAT'S PRAY. MM-HMM. FATHER, HELP US IN OUR LIVES AND ALL THAT WE DO AND ALL THAT WE THINK AND SAY TO GLORIFY YOU, THAT WE MAY COME TO ENJOY YOU FOREVER, EVEN IN MATTERS OF BUSINESS LIKE ARE HAPPENING TONIGHT. LORD, MAY THEY GLORIFY YOU AND THAT WE MAY ENJOY YOU AND ONE ANOTHER IN THE DOING SO. IN CHRIST'S NAME WE PRAY. AMEN. AMEN. AMEN. [3. Pledge Of Allegiance] PLEDGE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INVISIBLE WITH LIBERTY, JUSTICE, FRAUD. [4. Roll Call] TONY, WOULD YOU CALL THE ROLL PLEASE? MR. SHAW? HERE. MS. BAKER. HERE. MS. MR. CAMPBELL. HERE. MRS. BURGE? HERE. MR. OTTO. HERE. MR. LYONS HERE. THIS IS KITCHEN. HERE. MR. WEBB. HERE. MAYOR GORE HERE. AND [5. Approval Of Minutes] NEXT IS ITEM NUMBER FIVE, WHICH IS APPROVAL OF MINUTES. ITEM FIVE A IS THE CITY COUNCIL'S [00:05:01] SPECIAL MEETING MINUTES FROM DECEMBER 15TH, 2022. THOSE HAVE BEEN DISTRIBUTED ALSO. ANY CORRECTIONS COMMENTS, IF NOT THOSE MINUTES WILL STAND AS APPROVED. OKAY. SAYING NONE OF THOSE MINUTES ARE [ Hu-Bear Book Presentation To The City Of Huber Heights And The Wayne Township/Huber Heights Historical Society - Mayor Jeff Gore And Mrs. Cindy Davidson, Peace And Tranquility Lake Corporation] APPROVED. NEXT EXCEPT IS ITEM NUMBER SIX, SPECIAL PRESENTATIONS. UH, SIX EIGHT, ITEM SIX, A HUBER BOOK PRESENTATION TO THE CITY OF HUBER HEIGHTS AND THE WAYNE TOWNSHIP, HUBER HEIGHTS HISTORICAL SOCIETY BY MAYOR JEFF GORE AND MRS. CINDY DAVIDSON, PEACE AND TRANQUILITY LIKE CORPORATION. OKAY. GET A COPY OF THE BOOK. SOME OF THE PAGES LIKE THE BOOK. PLEASE KNOW THERE'S A SECOND BOOK THAT YOU DON'T HAVE YET. THERE IS AN AUTHOR. HER NAME IS SASHA LANE. SHE'S A CHILDREN'S BOOK WRITER AND SHE HAS WRITTEN AN ACTUAL CHILDREN'S STORY. IT'S FINISHED. HOWEVER, SHE'S WAITING ON THE PUBLISHER TO ADD THE PICTURES. ONCE THAT'S DONE, IT'LL BE ON AMAZON AND I'LL LET GUYS KNOW I'M EXCITED ABOUT THAT. HI, CAN I HAVE THE HISTORICAL SOCIETY JOINING ME? AND I WANT TO THANK YOU SO MUCH FOR BEING HERE WITH US. THIS IS EXCITING ACTUALLY. THANKS FOR SITTING OFF YOUR MEETING TONIGHT. I'LL MAKE IT PAST, I PROMISE. PROMISE. SO, UM, BASICALLY I JUST KIND OF WANTED TO ADD, AS YOU GUYS KNOW, WE HAD OUR 40TH BIRTHDAY HERE IN THE CITY OF HUBER HEIGHTS. AND WITH THAT THOUGHT, WE WANTED TO DO SOMETHING UNIQUE AND SPECIAL TO KIND OF COLLABORATE TOGETHER AS A COMMUNITY, UM, AND DO SOMETHING TO, UH, TO REMEMBER THAT WHICH KIND OF FELL THROUGH THE PANDEMIC, WHICH THEN MEANS THIS IS KIND OF LIKE OUR LITTLE TIME CAPSULE BECAUSE THIS WAS DURING THE PANDEMIC AND WE STILL PERSEVERED AND MADE IT THROUGH, WHICH WAS AWESOME. SO, UM, THERE'S A STORY BEHIND ALL OF THIS. THIS IS ACTUALLY CHARLES HUG BEAR. WE FONDLY, UH, REFERRED TO HIM AS HUG HIMSELF. AND THROUGH HIS STORY, HE STARTED HERE IN CITY HALL, UM, BACK THAT JANUARY. THERE'S A BEGINNING OF THIS BOOK. YOU'LL SEE HIM IN HERE AT CITY HALL BEING INTRODUCED TO EVERYONE FOR HIS BIRTHDAY CELEBRATION. AND FROM THAT HE THEN VISITED ALL THE COMMISSIONS. HE WENT TO THE 4TH OF JULY PARADE. HE KIND OF TRAVELED TO SCHOOLS. HE WAS EVERYWHERE. SO THIS BOOK WAS ACTUALLY MADE BY THE CITIZENS OF HUBER HEIGHTS BECAUSE THEY'RE THE ONES THAT BORROWED THE BEAR, UPLOADED THE PICTURES ONTO A FACEBOOK PAGE THAT ACTUALLY TOLD THE STORY AS TO WHERE HE TRAVELED THE WHOLE ENTIRE YEAR. SO THAT WAS PRETTY AWESOME. ANOTHER COOL THING THAT HAPPENED, I'LL SHARE IT WITH YOU QUICKLY. I'M SORRY. . MR. PARKER'S GONNA OFF PERMIT YOU. THANK YOU. THANK YOU, SIR. IS, UM, AS YOU CAN SEE, UH, GOVERNOR MIKE DEWINE AND FRAN WERE ACTUALLY A PART OF IT BECAUSE THEY ALSO SAW HUBER AND ACKNOWLEDGED OUR 40TH BIRTHDAY, WHICH WAS COOL. AND AS YOU TURN THE PAGES, YOU'LL SEE OTHER DIGNITARIES IN HERE, COUNTY COMMISSIONER DEBBIE LIEBERMAN. UM, WE ALSO HAD JUDY DODGE IN HERE, UM, CAROLYN RICE THERE. THERE'S SEVERAL THAT ACTUALLY ACKNOWLEDGED THE BEARFIELD PLUMBER AND SO ON. SO THAT WAS KIND OF COOL. BUT THE WAY THE STORY WORKED WAS HE HAD TO DO SERVICE IN THE CITY OF HUBER HEIGHTS TO BECOME REAL. AND THAT WAS HIS DREAM FROM HIS BIRTHDAY WISH WAS THAT HE WOULD BECOME A REAL BEAR. SO A FERRY, AN ACTUAL LITTLE GIRL WORE THIS. HER PICTURE'S IN HERE, THIS WAS SPECIAL MADE JUST FOR THE STORY. UM, SHE WORE IT AND SHE GRANTED HIS WISH, SO HE BECAME REAL. SO WE ACTUALLY HAVE A LIFE SIZE VERSION OF HIM, WHICH IS LIKE A COSTUME. AND RIGHT NOW, UM, IT'S BEING, IT HAS BEEN DONATED TO THE CITY OF HUBER HEIGHTS FOR OUR FIRE DEPARTMENT AND POLICE DEPARTMENT. SO HE BOUGHT YOU BEAR'S GONNA LIVE ON IT WITH THE KIDS, WHICH IS REALLY COOL. UM, BUT HE, HE DID GET TO BECOME REAL, WHICH HELPED HIM PARTICIPATE IN OUR PARADE FOR THE FIRST TIME. AND THAT WAS HIS CELEBRATION DAY. UM, AND THEN AFTER THAT HE WOULD BECOME THE STUFF BEAR AGAIN. AND THEN HE HAD TO DO DO ANOTHER GOOD BABE. LIKE HE HAD TO WORK IN OUR FISH PANTRY AND DIFFERENT THINGS LIKE THAT TO BECOME REAL AGAIN. SO AT THE END OF THIS YOU'LL SEE OUR CHRISTMAS TREE LIGHTING, SO IT ACTUALLY IS THE FULL YEAR. SO ON BEHALF OF PEACE AND TRANQUILITY POND AND THE DAVIDSON FAMILY, WE WOULD LOVE FOR YOU TO KEEP THIS BOOK. UM, AND ALSO PLACE THE ADDRESS AND BEAR HIMSELF. HE'S KIND OF HEAVY. I'M SORRY, TERRY . HE WOULD LIKE THAT. YES. AND UM, I WAS EXPLAINING THERE IS A SECOND PART TO THIS. THERE IS AN ACTUAL CHILDREN'S BOOK AND IT'S BEING WRITTEN BY THE AUTHOR OF SASHA BLA. SHE HAS WRITTEN MANY CHILDREN'S BOOKS THAT HAVE BEEN PUBLISHED. SHE'S WRITTEN A STORY ABOUT THIS, BUT SHE'S MADE IT INTO KIND OF LIKE A, A CHILDREN'S STORY, WHICH IS FUN CUZ A CHILD CAN READ IT. AND, UH, RIGHT NOW THE PUBLISHER HAS TO ADD THE PHOTOS TO IT AND THEN AMAZON WILL BE, UM, PUTTING IT UP ON THE, THEIR PAGES FOR YOU IF YOU WANNA LOOK AT IT. BUT THE OTHER COOL THING ABOUT THIS IS I'VE BEEN WORKING WITH THE LIBRARY, OUR NEW LIBRARY FOR OVER A YEAR, AND THEY HAVE APPROVED BOTH BOOKS. SO BOTH BOOKS ARE GONNA BE DEDICATED ALSO TO [00:10:01] OUR NEW LIBRARY HERE AND ALSO THE ONE IN DOWNTOWN DAYTON. SO THAT'S REALLY EXCITING. YOU BEAR ALL OVER THE, THE CITY OVER THAT, OVER THAT TIMEFRAME. AND, UM, YOU'RE GOING TO THE DIFFERENT EVENTS AND THINGS. WE HAVE A 40TH ANNIVERSARY CELEBRATION THAT THERE STEVE MAKER AT THAT TIME. AND IT WAS JUST, IT WAS JUST REALLY, UH, INTERESTING TO SEE HOW ALL THAT HAPPENED AND HOW EVERYBODY IN THE CITY INTERACTED AND ALL THIS THINGS. SO, UH, CERTAINLY WE'RE CELEBRATING 40 YEARS AND UM, HE'LL, HE'LL BE AROUND FOR, FOR A LONG TIME, FOR A LONG. SO THANK YOU VERY MUCH. APPRECIATE YOU, SIR. THANK YOU. APPRECIATE IT. THANK YOU. THANK YOU SO MUCH. THANK BEN. YOU'RE WELCOME. THANK YOU. WHAT DO I NEED TO GIVE HIM A BEER? LOOKS LIKE YOU WEREN'T. YEAH. ATTENTION. THOSE ARE EASY. YEAH. . HEY, [ Mayoral Proclamation Presentation To Huber Haunts - Mayor Jeff Gore] UH, NEXT UP WE HAVE ITEM SIX B A MARIAL PROCLAMATION PRESENTATION TO HUBER HANS BY MAYOR JEFF COR. ARE THERE ANY OTHER REPRESENTATIVES FROM HUBER? HANS HERE. I'M GONNA CALL YOU UP KAREN, CAUSE YOU'RE OH YES. YOU'RE MY HUGE SUPPORTER. THIS IS MY FRIEND MARY. I'M SO GLAD SHE CAME. SHE SURPRISED ME. OKAY, SO THIS IS THE, UH, FIRST OF I GUESS THREE PROCLAMATIONS WE HAVE. CORRECT. SO, UH, LOTS OF WHEREAS IS TONIGHT. SO THIS IS THE CITY OF HUBER HEIGHTS. HUBER HUNTS PAYROLL PROCLAMATION. WHEREAS HUBER HAUNS IS A CITIZEN-LED INITIATIVE STARTED IN 2017 IN RESPONSE TO BEAUTIFULLY DECORATED HOMES IN THE CITY OF HUBER HEIGHTS AND A DESIRE TO CELEBRATE AS A COMMUNITY. AND WEAS HUBER HUNTS IS A FAMILY-FRIENDLY EVENT THAT BRINGS THE COMMUNITY TOGETHER, ENCOURAGES, CREATE, AND BRINGS JOY TO CHILDREN AND FAMILIES OF HUB HEIGHTS IN THE SURROUNDING. AND WHEREAS HUB HUNTS PROVIDES A SAFE VENUE FOR LOCAL CHILDREN TO GET THE MOST UP CELEBRATING THE HALLOWEEN SEASON. AND WHEREAS THE CASH PRIZES FOR THE WINNERS AND THE HUB HUNT SCAVENGER HUNT GIVE DIRECT SUPPORT FOR LOCAL FAMILIES AND HOLIDAY EXPENSES. AND WHEREAS THE CITY HUB HUNTS TAKES PRIDE IN THE SPIRIT OF INNOVATION. AND HUB HUNTS IS A TERRIFIC EXAMPLE OF VOLUNTEERS AND INDIVIDUALS THAT SHAPED THE HEBREW RIGHTS COMMUNITY. NOW, THEREFORE, AYE. JEFF GORE MAYOR, THE CITY HUB HEIGHTS, OHIO, WHO HEREBY RECOGNIZE HUBER HUNTS AND THANK ALL THE VOLUNTEERS AND PARTICIPANTS INVOLVED IN HEBREW HUNTS FOR THE OUTSTANDING CONTRIBUTIONS AND CONTINUED COMMITMENT AND HELPING BRING NEW TRADITIONS TO THE CITY OF RIGHTS IN WITNESS ROAD. I APPEAR TO SET MY HAND AND CAUSE THE SEAL OF THE CITY OF RIGHTS. YOU FIXED THE TEENTH OF JANUARY, YOUR 2020. THANK YOU. THANK HEY, GREAT COMMENTS ABOUT HUB, RIGHT? MAYBE I'LL MAKE PASS LIKE WHERE WE STARTED. WE'RE KIND UP. THAT'S A GREAT, I THINK WE STARTED WITH 13 HOUSES. YEAH. MAYBE THAT FIRST MAP WE GOT 13 OR 14 PEOPLE INVOLVED. YEAH, WE HAVE LIKE 13 PEOPLE INVOLVED AND UM, SINCE THAT TIME WE'VE GROWN TO THE POINT WHERE SOMETIMES WE HAVE TO CUT THE MAP OFF CUZ WE HAVE WELL OVER A HUNDRED AND YOU CAN'T GET TO 'EM IN THREE WEEKS. UM, BUT WE, WE'VE REALLY SEEN OUR CITY JUST BOOM WITH HUB HOMES. WE REALLY HAVE. AND UH, WE DON'T JUST HAVE LIKE THE DISPLAYS OUT THERE JUST TO, TO SCARE YOU. THAT'S NOT WHAT IT'S ABOUT. IT'S ABOUT FAMILIES GETTING TOGETHER, GETTING A PIZZA AND ICE CREAM, GETTING IN THE CAR, TALKING TO EACH OTHER, REUNITING FAMILIES, RIGHT? BUT IN ADDITION TO THAT, WE'RE ALSO UNITING OUR NEIGHBORHOODS. AND I HEAR IT TIME AND TIME AGAIN AS WE'VE GROWN TO HUNDREDS AND HUNDREDS OF PEOPLE THAT ARE PARTICIPATING NOW. THEY'RE SAYING, YOU KNOW, I MOVED HERE THREE MONTHS AGO. THIS WAS RECENT. WE HEARD IT. THEY HERE MM-HMM , I MOVED HERE THREE MONTHS AGO AND UH, I I COME FROM WEST MILTON AND IT'S A SMALL TOWN AND I WAS SO SCARED, BUT I FOUND YOUR WEBSITE AND I STARTED SWALLOWING YOU GUYS AND IT'S REALLY A SMALL TOWN HERE CUZ YOU ALL KIND OF COLLABORATE, WHICH SHE'S RIGHT, WE DO. UM, SO IN ADDITION TO THAT, WE STARTED ZOMBIE WALK THIS LAST YEAR AND IT WAS A ZOMBIE, UH, TRUNK RETREAT AT THOMAS CLOUD. WE EXPECTED A COUPLE HUNDRED PEOPLE, WE HAD OVER 2000. THAT'S WONDERFUL. SO I ANTICIPATE THAT TO GROW EVEN THIS YEAR. SO I'M REALLY HOPING, UM, THAT, THAT WORKS OUT THIS YEAR. WE'RE ALREADY PLANNING IT. I'VE BEEN TALKING TO EVERYBODY TRYING TO MAKE SURE WE CAN SECURE OUR LOCATION. SO PLEASE, IF YOU GET A CHANCE, GO OUT AND SEE THE HOMES AND THANKS TO THE DECORATORS AT WEBSITE AND THE WEBSITE AT HUBER HANSON HOPPING IN THE HIKES IS WHAT IT'S CALLED. SO WE KNOW WE'VE GOT PEOPLE WHO COME HERE FROM OUT STATE WHO WHO'VE DRIVEN HERE FROM OTHER STATES TO COME, COME IOWA, FLORIDA, DRIVE THROUGH TO SEATTLE ONE. YEAH, THEY COME HERE EVERY YEAR AND STAY AT OUR HOTELS. AND THEN OUR HOTELS HAVE THE MAP AND THEN THEY TEST IT OUT WHEN THEY'RE IN THE, YOU KNOW, VISITING. [00:15:01] AND THEY'LL BE LIKE, IF YOU AIN'T GOT NOTHING TO DO TONIGHT, YOU GOTTA GO SEE THESE HOUSES. SO IT'S KIND OF COOL. THEN THEY UPLOAD THE PAGE AND THEY START COMMENTING ON HOW, HOW WONDERFUL HUBER HEIGHTS IS. SO IT'S KIND. COOL. THANK YOU SO MUCH. THANK YOU. THANK YOU. THANK YOU. [ Health For Humanity Yogathon Mayoral Proclamation Presentation To Mr. Sriram Kakani Of The Hindu Swayamsevak Sangh, USA Inc. - Mayor Jeff Gore] NEXT UP ITEM SIX C HELD FOR HUMANITY YOON MAYORAL PROCLAMATION PRESENTATION TO MR. THANK. AND [ Mayoral Proclamation Presentation To Mrs. Marva Colston – Mayor Jeff Gore] LAST BUT NOT LEAST, WE HAVE ITEM SIX D, ME, PROCLAMATION, PRESENTATION AND MRS. OLSON. AND I THANK YOU, THANK YOU SO MUCH FOR THIS BEAUTIFUL CITY AND IT IS THE CITY ON THE THANK YOU. THANK YOU SO MUCH. APPRECIATE EVERYTHING YOU'VE EVER DONE, PLEASE. I WANTED, I WANTED TO ALSO THE MICROPHONE, IT'S THE MICROPHONE WORKING. OKAY. UM, MS. THANK YOU. DONE. THANK YOU. OKAY, AND [7. Citizens Comments] THE NEXT UP IS THAT NUMBER SEVEN, WHICH IS CITIZEN'S COMMENTS. TONY, WE HAVE TWO THIS EVENING. UH, FIRST UP, MR. JEFF MORFORD, CAN YOU PLEASE COME TO THE PARTY? GOOD EVENING. MY NAME'S JEFF MORFORD, MIAMI COUNTY, THE TOWNSHIP, UH, TO START WITH AN UPDATE OF, UH, BETHEL TOWNSHIP NEWSLETTER. THREE PIECES OF INFORMATION. NUMBER ONE, CONSERVATION EASEMENT ON 162 ACRES. BETHEL TOWNSHIP POPULATION, APPROXIMATELY 5,000, SPENT A MILLION DOLLARS, WHICH EQUALED 25% OF THE PROJECT. AND THROUGH A GRANT, OHIO TAX DOLLARS FROM THE OHIO PUBLIC WORKS COMMISSION, THE REMAINING 75%. THIS ACTIVITY WAS WHOLLY DIRECTED TO [00:25:01] STOPPING FURTHER UNWANTED ENCROACHMENT AND DEVELOPMENT. AGAIN, IF HUBER HEIGHTS WAS A GOOD NEIGHBOR AND VOTED NO TO ANNEXATION REQUESTS, THESE TAX DOLLARS COULD HAVE BEEN PUT TO BETTER USE. TWO, THE NEW CARLISLE ANNEX UPDATE. NEW CARLISLE CITY COUNCIL VOTED NO ONE MEMBER VOTED YES, FIVE MEMBERS VOTED NO TO AN ANNEXATION REQUEST. DEVELOP 115 ACRES OF PROPERTY WITH 300 HOUSES IN BETHEL TOWNSHIP. IN MY OPINION, THE NEW CARLISLE CITY COUNCIL CONSIDERED THE IMPACT ON THE COMMUNITY, THE SCHOOLS, THE TRAFFIC, AND THE ENVIRONMENT, AND DID THE RIGHT THING AND VOTED NO. SOMETIMES IT'S NOT ALWAYS ABOUT THE MONEY. THREE HUBER HEIGHTS ANNEX UPDATE, I'LL JUST READ A LITTLE BIT OF IT. ON NOVEMBER 29TH, THE MIAMI COUNTY COMMISSIONERS COMPLIED WITH THE W R OF MANDAMUS AND VOTED TO ACCEPT THE ANNEXATION PETITION FOR 260 ACRES TO THE CITY OF HUBER HEIGHTS. TWO OF THE THREE COMMISSIONERS WERE PRESENT AND BOTH STATED THEY ARE NOT IN AGREEMENT WITH THE ANNEXATION PETITION OR BUT COMPELLED TO FILE THE LAW. THE MIAMI, MIAMI COUNTY COMMISSIONERS REPRESENTING 110,000 RESIDENTS ARE AGAINST THE ANNEXATION. THEIR EFFORTS TO TRY TO DENY THE ANNEXATION PETITION WAS TO NO AVAIL. THE LAW STATES STATUTORILY THAT IF CERTAIN STEPS ARE DONE, THE COMMISSIONERS HAD TO FILE THE LAW AND ACCEPT THE PETITION. THE COMMISSIONERS FOLLOWING THE LAW STILL DO NOT AGREE WITH IT. AS IN THE CASE OF MIAMI COUNTY COMMISSIONERS WHO ARE COMPELLED TO FOLLOW THE LAW, YOU THE HUBER HEIGHTS CITY COUNCIL IS NOT OBLIGATED OR BOUND BY THIS LAW. YOU CAN AND SHOULD VOTE NO LOCALLY, THE BETH TOWNSHIP TRUSTEES REPRESENTING 5,000 OF THOSE MIAMI COUNTY RESIDENTS ARE AGAINST THE ANNEXATION. ALSO, IF YOU DRIVE AROUND THE BETHEL TOWNSHIP, THERE ARE NEW HOUSES BEING BUILT BY INDIVIDUALS WHO LIKE BETHEL TOWNSHIP HAS TO OFFER. THIS GROWTH IS CONTROLLABLE AND ALLOWS FOR THE TIME TO NEED TO ADJUST FOR THE INCREASED POPULATION. I'VE HEARD THE LOGIC THAT HUBER HEIGHTS IS NOT ACTIVELY PURSUING THESE PROPERTIES AND THE LANDOWNERS SHOULD BE ABLE TO DO WHAT THEY WANT WITH THESE PROPERTIES. I AGREE, AS LONG AS IT FOLLOWS WHAT THE LAW IS. AND ZONING PLAN OF MIAMI COUNTY ESTABLISHED IN 1803 AND BETHEL TOWNSHIP REGULATIONS PRESCRIBED JUST BECAUSE THEY DON'T LIKE THE LAWS, WHICH HAVE BEEN IN THE BOOKS FOR A VERY LONG TIME, I DON'T BELIEVE THEY HAVE THE RIGHT JUST TO SAY, I'LL JUST CON CONNECT WITH ANOTHER MUNICIPALITY BECAUSE I LIKE THEIR LAWS BETTER. IF BY CHANCE HUBER HEIGHTS OFFERED WHAT I THOUGHT WAS A GOOD PLACE TO LIVE AND RAISE MY FAMILY, WHICH APPROXIMATELY 43,000 PEOPLE THINK SO THINK THIS WAY. AND I BOUGHT A HOUSE ACROSS THE STREET, IN FACT, THE CITY OF HUBER HEIGHTS, AND I WOULD ENTER INTO A SORT OF CONTRACT. I WOULD ACCEPT THE RESPONSIBILITIES TO LIVE BY YOUR LAWS AND REGULATIONS. I WOULD ABIDE BY YOUR ZONING REGULATIONS, LAWS, ORDINANCES OF HUBER HEIGHTS. I WILL MAINTAIN MY HOUSE AND YARD AS PRESCRIBED, ACCEPTABLE BY THE CITY, DRIVE MY CO CAR ACCORDING TO LAW, BE RESPECTFUL TO MY NEIGHBORS AND NEIGHBORHOOD, AND OH YES, PAY MY PROPERTY, TAX, CITY TAX INCOME, TAX, SALES TAX, ET CETERA. IN RETURN, I EXPECT GOOD ROADS, GOOD SCHOOLS, POLICE AND FIRE PROTECTION, ANY FAIR CITY COUNCIL AND ADMINISTRATION WHO ARE ELECTED TO REPRESENT THE CITIZENS TO MAKE FAIR AND EQUITABLE DECISIONS ON MY BEHALF. NOW, ON THE OTHER HAND, LET'S SAY FOR A CONVERSATION, I DON'T AGREE WITH THE INCOME TAX SITUATION, BUT I LIKE NEW CARLISLE'S INCOME TAX PLAN BETTER. CAN I CALL UP NEW CARLISLE AND ASK BE CONSIDERED ONE OF THEIR RESIDENTS SO I CAN BENEFIT FROM THEIR TAX RATES? QUITE ABSURD, IN MY VIEW. JUST AS ABSURD AS BETHEL PROPERTY ONLY OWNERS WANTING TO CONNECT WITH HUBER HEIGHTS WITHOUT REGARD TO EXISTING LAWS AND REGULATIONS OF THEIR COMMUNITY. AS TO THE PROPERTY OWNERS, THE 260 ACRES IN QUESTION, IT SEEMS TO ME TO BE QUITE PECULIAR THAT JUST A FEW MONTHS AGO, JUNE 15TH, 2022, THESE PROPERTIES HAVE SOMEWHAT CHANGED HANDS. I WON'T ELABORATE AS TO MY CONCERNS, BUT G L J HOLDING IS NOW HOLDING PARCEL, 20 ACRES, 60 ACRES, AND 27 ACRES OF THE TWO 60 IN QUESTION. UH, LET'S SEE. THIS MIGHT LOOK LIKE A SIMPLE LINE. I ASSUME YOU ALL HAVE A HOME WITH PROPERTY LINES. AND ACCORDINGLY, YOU EXPECT THESE PROPER [00:30:01] LINES TO BE RESPECTED AND YOU MIGHT FEEL COMPELLED TO PROTECT WHAT IS YOURS. THESE LINES WILL EXTEND OUT TO YOUR CITY BOUNDARY LINES, WHICH EXTEND TO YOUR COUNTY LINES, WHICH EXTEND TO YOUR OHIO STATE LINES, WHICH EXTEND TO YOUR UNITED STATES BORDER LINES, WHICH I PERSONALLY BELIEVE ARE BEING ILLEGALLY BREACHED AND MASSED EVERY DAY. BUT WE CAN HAVE THAT CONVERSATION LATER, I BELIEVE, AND I HOPE YOU REALIZE THAT THESE LINES IN OUR COUNTRY, EUROPE, ASIA, ET CETERA, HAVE A HUGE IMPACT ON THE BALANCE AND STRUCTURE OF HUMANITY. THESE LINES ALWAYS NEED RESPECT AND PROTECTION. I WOULD LIKE TO READ ONE OF THE 10 COMMANDMENTS. UH, IT SAYS, YOU SHALL NOT COVET YOUR NEIGHBOR'S WIFE AND YOU SHALL NOT DESIRE YOUR NEIGHBOR'S HOUSE, HIS FIELD, HIS MALE SERVANT, HIS FEMALE SERVANT, HIS OX, HIS DONKEY, OR ANYTHING THAT IS YOUR NEIGHBORS. WHAT SERVES DICTIONARIES, SAY COVET IS TO WISH FOR IN EARNEST TO DESIRE WHAT BELONGS TO ANOTHER. IN MY OPINION, IF YOU ARE IN ANY WAY INVOLVED, IS TO ALLOW THIS ANNEXATION, YOU ARE IN VIOLATION OF THIS COMP COMMANDMENT. AS ALWAYS, I'D LIKE TO LEAVE YOU AT THE GOLDEN RULE, DO UNTO OTHERS AS YOU WOULD HAVE THEM DOING UNTO UNTO YOU. THANKS FOR YOUR TIME. NEXT UP WE HAVE MS. BETH VAN HEREON, IF YOU PLEASE COME. HI, BETH VAN HERRON, BETHEL TOWNSHIP TRUSTEE. ALSO GONNA TALK ABOUT ANNEXATION. BUT FIRST I WANNA SAY, WOW, WHAT A GREAT COMMUNITY YOU HAVE. THOSE WERE SOME AMAZING ME PROCLAMATIONS AND YOU'VE GOT A LOT OF PEOPLE WHO ARE DEDICATED TO MAKING YOUR COMMUNITY BETTER, WHICH IS AWESOME, REALLY. IT IT IS. AND UM, IN REGARDS TO THE ANNEXATION YOU HEARD FROM JEFF, AND YOU PROBABLY ALL KNOW THAT THE MIAMI COUNTY COMMISSIONERS DID GET THE RID OF MANDAMUS AND HAD TO PASS THAT NOVEMBER 29TH. I DON'T KNOW WHAT YOUR STATUTORY CODE IS. I'VE BEEN LOOKING AT YOUR MEETING MINUTES, BUT I'M SURE YOU'RE GOING TO VOTE ON IT SOON. AND I WOULD LOVE IT. ALL OF BETHEL TOWNSHIP WOULD LOVE IT IF YOU WOULD SAY NO. UM, I REALIZE THAT THAT IS WHERE YOUR GROWTH IS COMING FROM. IF YOU LOOK AT THE 2020 SENTENCES, ALMOST 95% OF YOUR GROWTH CAME FROM CARRIAGE TRAILS PARK TOWN AREA SINCE 2010. I THINK HE HAD, I DON'T KNOW, 753 AND THE REST OF, UM, HUBER HEIGHTS. BUT MOST OF IT CAME FROM THAT AREA. AND I KNOW THAT YOU GUYS DO WANT TO GROW, UM, BUT WE WOULD LOVE IT IF YOU DID NOT GROW NORTHWARDS IF YOU TOOK A DIFFERENT DIRECTION. SO, UM, I DON'T HAVE ANY VOTE IN THIS ANNEXATION BECAUSE IT IS AN EXPEDITED TYPE TWO, AND I AM A TOWNSHIP TRUSTEES AND WE DON'T GET A SAY YOU GUYS DO. SO I AM RESPECTFULLY ASKING YOU TO PLEASE CONSIDER WHEN IT COMES UP FOR A VOTE TO VOTE. NO THANK YOU. OKAY, [8. Citizens Registered To Speak On Agenda Items] NUMBER EIGHT, CITIZENS REGISTER TO SPEAK ONE. AGENDA ITEMS. I HAVE, UH, TWO TO SPEAK ON ITEM 10 A THIS EVENING, MA'AM, ITEM 10 A. OKAY, THANK YOU. [9. City Manager Report] NEXT UP IS IT NUMBER NINE, WHICH IS THE CITY MANAGER REPORT. BRIAN, SIR, HOW ARE YOU? I'M GOOD. HOW ABOUT YOURSELF, SIR? VERY WELL, THANK YOU. A COUPLE OF ITEMS FOR, UH, COUNSEL AND COMMUNITY CONSIDERATION, UH, THIS EVENING. UM, IN A SHOW OF, UH, GOVERNMENTAL COOPERATION AND, UH, SPIRIT FOR THE BEST INTEREST OF THEIR CITIZENS, UH, MEMBERS OF THE, UH, CITY STAFF BETHEL TOWNSHIP AND MIAMI COUNTY. WILL, I SHOULD BE MEETING LATER THIS WEEK, UH, TO DISCUSS THE, UH, POTENTIAL OF A TRAFFIC SIGNAL AT THE INTERSECTION OF CARRIAGE TRAILS BOULEVARD IN BRANT PIKE. SO WE ARE CONTINUING TO, UH, TO WORK FORWARD ON THAT. UH, A LONG STANDING REQUEST FROM CITY COUNCIL. UH, ALSO WANNA BRING TO EVERYONE'S ATTENTION THAT, UH, MONDAY, JANUARY 16TH IS MARTIN LUTHER KING JR. DAY. UH, THE CULTURAL DIVERSITY COMMISSION WILL BE HOSTING AN MLK WALK AT THE WAYNE HIGH SCHOOL, UH, TRACK. UH, AND THAT'LL BE IN THE MORNING AT NINE 30. THERE'S A FORMAL PROGRAMMED EVENT, UH, AFTER THAT AT 11:00 AM IN THE PERFORMING ARTS CENTER. ALSO AT THE HIGH SCHOOL, UH, SPEAKING OF MLK DAY, CITY OFFICES WILL BE CLOSED. UH, SO MOST OF, UH, CITY STAFF ON NON-ESSENTIAL STAFF WILL BE OFF THAT DAY, BUT FOR THE RECORD, YOUR TRASHMAN WILL NOT, UH, WASTE COLLECTION SERVICE WILL NOT BE DELAYED, UH, DUE TO THE MLK HOLIDAY. SO, UH, IN LIGHT OF SOME CONFUSION OVER THE CHRISTMAS AND NEW YEAR HOLIDAY, I WANNA MAKE SURE THAT EVERYBODY IS AWARE THAT, UH, IF YOUR SCHEDULED COLLECTION DAY IS INDEED MONDAY THE 16TH, HAVE YOUR WASTE OUT FOR COLLECTION. UH, LAST BUT CERTAINLY NOT LEAST, UH, THE DEADLINE IS APPROACHING FOR [00:35:01] THE COMMUNITY ART EXHIBITION. SO FOR THOSE WHO ARE INTERESTED IN, UH, HAVING THEIR ART PRESENTED AT THE EXHIBITION ON SATURDAY, FEBRUARY 11TH, UH, THEY NEED TO, UH, MAKE SURE THAT THEY SUBMIT THEIR REQUEST TO PARTICIPATE IN THAT SHOW BY JANUARY 27TH. UH, INFORMATION CAN BE OBTAINED ON OUR WEBSITE, HH O H.ORG, UH, OR BY CALLING OUR COMMUNITY ENGAGEMENT SPECIALIST, SARAH WILLIAMS AT 2 3 7 5 8 0 2. THAT IS ALL I HAVE FOR COUNSEL, SIR, UNLESS THERE'S ANYTHING FOR ME. THANKS, BRIAN. YOU DON'T HAVE ANY QUESTIONS FOR RYAN? YES, PAT. THANK YOU, MAYOR. UH, BRIAN, AT OUR WORK SESSION, THE FIRE CHIEF MENTIONED ABOUT, UH, FOUR FIREFIGHTERS THAT HE IS, UH, POTENTIAL APPLICANTS TO BE HIRED. YES, SIR. ARE GOING TO, UH, THROUGH A BACKGROUND CHECK. YES, SIR. DO YOU HAVE APPROXIMATE AMES, UH, ESTIMATION HOW LONG IT WILL TAKE, UH, TO HIRE THEM FULL-TIME? UH, I, THEY GO THROUGH THE PROPER PROCESS, SORRY. UM, I DO NOT, NOT KNOWING WHERE THESE INDIVIDUAL, UM, BACKGROUND CHECKS ARE, SIR, BUT I'M HAPPY TO FOLLOW UP WITH, UH, THE CHIEF AND WITH THE HR DIRECTOR AND, UH, COMMUNICATE THAT INFORMATION BACK TO COUNSEL. YEAH. AND JUST IN ADDITION TO THAT, HOW MUCH LONGER AND WHAT PROCESS DOESN'T HAVE TO BE A GREAT DE DETAIL BY JUST AN IDEA OF A TARGET. SURE. UM, ALSO WITH THE THREE FIREFIGHTERS THAT HAVE BEEN HIRED RECENTLY, UH, WILL WE GET AN OPPORTUNITY TO WELCOME THEM TO THE CITY OF THE CITY COUNCIL MEETING SOON? UM, I KNOW THAT THERE IS A PARTICULAR PROTOCOL THAT EACH ONE OF THOSE DIVISIONS TAKE WHEN THEY INTRODUCE, UH, PERSONNEL. UH, THERE WAS, UH, I THINK IT WAS CHIEF LEER WHO LAST, UH, MADE PRESENTATION TO COUNCIL ABOUT NEW PERSONNEL, AND THAT WAS DELAYED, OBVIOUSLY BECAUSE OF, UH, THE PANDEMIC. UH, SO WHATEVER THE APPROPRIATE PROTOCOL IS FOR THE FIRE DIVISION TO INTRODUCE THEIR STAFF, WHENEVER THAT, UH, PROTOCOL NECESSITATES THEIR INTRODUCTION TO CITY COUNCIL, THEY'LL BE HERE FOR THAT, UH, FOR THAT INTRODUCTION. OKAY. I LOOK FORWARD TO SEEING THAT. SURE. THANK YOU, BRIAN. THANK YOU, MAYOR. ANYTHING ELSE? YES, I NEED BRIAN, JUST TO FOLLOW UP, DID THE PIPE GET ORDERED FOR THIS YEAR? UH, YES. THAT WAS, UM, AN ITEM THAT THE, UH, ENGINEER AND I DID DISCUSS AFTER THE LAST MEETING. UH, THEY WERE WAITING ON, UH, THE FINAL, UH, MEASURE OF LENGTH FROM THE ENGINEER'S OFFICE. SO I'LL HAVE A, A MORE DETAILED UPDATE ON THAT FROM THE ENGINEER TOMORROW AT THE STAFF MEETING. BUT THAT WAS SOMETHING THAT, UH, THE, UH, ENGINEER WAS TASKED TO DO. OKAY, THANK YOU. ANYTHING ELSE? [ An Ordinance To Approve A Rezoning From Agricultural (A) To Planned Industrial (PI) And A Lot Split For The Property Located At 9416 Taylorsville Road And Further Identified As Parcel Number P70 03902 0018 On The Montgomery County Auditor’s Map And To Not Accept The Recommendation Of The Planning Commission (Case RZ 22-17). (fourth reading)] OKAY, NEXT UP IS ITEM NUMBER 10. ITEM 10 A ITEM 10 A, AN ORDINANCE TO APPROVE A REZONING FROM AGRICULTURAL A TO PLAN INDUSTRIAL PI, AND A LOT SPLIT FOR THE PROPERTY LOCATED AT 94 16 TAYLORSVILLE ROAD AND FURTHER IDENTIFIED AS PARCEL NUMBER P 7 0 0 3 902 0 18 ON THE MONTGOMERY COUNTY AUDITOR'S MAP. AND TO NOT ACCEPT THE RECOMMENDATION OF THE PLANNING COMMISSION IN CASE RZ 22 DASH 17 AT THE FOURTH READING. OKAY. SO, UH, JUST HOW I'D CALL ON, UH, BRIAN FOR COMMENTS. UH, HOWEVER, I JUST WANT TO ALSO MAKE EVERYONE AWARE THIS IS THE ITEM TODAY THAT WE HAD TWO, UH, ASSISTANTS S TO SPEAK. SO KIND OF OUR PROTOCOL WAY WILL HANDLE THIS IS ONCE, UM, THE CITY MANAGER'S GIVEN HIS COMMENTARY ON THIS. I'LL ASK FOR A MOTION AND A SECOND, AND ONCE THERE IS A MOTION, AND SECOND, THEN WE'LL OPEN IT UP FOR DISCUSSION, UH, FOR COUNSEL. AND DURING THAT DISCUSSION TIME AS WHEN WE'LL HAVE, UH, THE TWO CITIZENS WHO ARE REGISTERED TO SPEAK COME FORWARD TO THE PODIUM AND, AND SPEAK THEN. SO COMMENTS, MOTION, SECOND, UH, AND THEN DISCUSSION IN THE, AND COMMENTARY FROM THE RESIDENTS. SO BRIGHT, UH, THANK YOU, SIR. UH, AS WAS NOTED IN THE LEGISLATION, UM, IT IS, UH, STAFF'S RECOMMENDATION TO COUNSEL TO VOTE, UH, THIS PARTICULAR MATTER DOWN, UH, THE REZONING OF THIS PARTICULAR PROPERTY. UH, THIS WAS A MATTER THAT CAME TO COUNSEL'S ATTENTION, UH, AS A RESULT OF, UM, A, UH, NONCONFORMING BUSINESS BEING IDENTIFIED, UH, THROUGH THE COURSE OF THE LAST SEVERAL MONTHS IN WORKING WITH, UH, THE CITY PLANNER, UH, MR. SORELL, UH, A, UH, SERIES OF RECOMMENDATIONS FOR TEXT AMENDMENTS WILL BE COMING FORWARD, UH, FROM, UH, THE PLANNING COMMISSION TO CITY COUNCIL FOR CONSIDERATION. UH, AND IT IS, UH, MR. SORRELL'S RECOMMENDATION THAT, UH, ADDRESSING ANY NONCONFORMING, ANY NONCONFORMITY ISSUES WITH THIS PROPERTY, UH, UTILIZED THAT, UH, PROCESS. SO AS A RESULT, IT IS, UH, AGAIN, STAFF'S RECOMMENDATION, UH, TO VOTE IN OPPOSITION TO, UH, THE PLANNING COMMISSION'S RECOMMENDATION. UH, I WOULD LIKE TO NOTE, I'M NOT SURE IF COUNSEL WAS MADE AWARE, UH, BUT, UH, THE ACTUAL PROPERTY OWNER, UH, MR. MRS. GILES, UH, THEY DID HAVE A CONFLICT THIS EVENING, SO THEY DID AT LEAST REACH OUT TO MY OFFICE, UH, AND NOTIFY US THAT, UH, THEY WOULD NOT BE IN ATTENDANCE TONIGHT. THEY ARE AWARE OF STAFF'S RECOMMENDATION ON THIS PARTICULAR MATTER, UH, AND ARE SUPPORTIVE OF THAT RECOMMENDATION AND OF THE PATH FORWARD. SO, UH, THOSE ARE THE COMMENTS I HAVE FOR COUNSEL TONIGHT, SIR. OKAY, THANKS BRIAN. UH, SO I WOULD, UH, ALSO, UH, SAY THAT AT THE WORK SESSION, THE RECOMMENDATION AT THE WORK SESSION THAT WE HAD WAS DENIAL OF THIS ITEM. SO FROM A VOTE PERSPECTIVE, THE VOTE IS WRITTEN IN THE AFFIRMATIVE, [00:40:01] UM, THE LEGISLATION IS WRITTEN IN THE AFFIRMATIVE. SO THE VOTE TONIGHT TO DENIAL WOULD ACTUALLY BE A NO VOTE. UH, ON THE ACTUAL RECOMMENDATION, THE WAY THE LEGISLATION IS WRITTEN, IS THERE A MOTION AND YOUK MOVE TO, UM, VOTE NO. THERE WOULD ACTUALLY BE A, A MOTION TO, UH, ADOPT ORDINANCE. OKAY. A MOTION TO ADOPT A RECOMMENDATION. OKAY. IS THERE A SECOND, NANCY? SECOND. WE HAVE A MOTION AND A SECOND. SO THIS TIME I WOULD OPEN UP FOR ANY OF THE DISCUSSION ROOM COUNSEL, AND IF THERE'S NO FURTHER DISCUSSION FROM COUNSEL, THEN WE WOULD, UH, INVITE OUR, UH, RESIDENT WHO REGISTER TO SPEAK. NANCY, UH, BRIAN, DO WE KNOW WHEN THIS WILL MOVE TO COUNCIL, UH, TO, UH, DECLINING COMMISSION? UH, THE TEXT AMENDMENTS? MM-HMM. , UH, THE TEXT AMENDMENTS WILL ACTUALLY BE ON THE, UH, NEXT WORK SESSION. UM, AND THEN THE PUBLIC HEARING FOR THAT WILL BE THE FINAL MEETING IN JANUARY. SO THOSE AMENDMENTS ARE COMING TO COUNCIL'S ATTENTION IN THE, UH, YET THIS MONTH. THANK YOU. SURE. ANY OTHER DISCUSSION FROM COUNCIL? OKAY. SING NONE. TONY, IF YOU'D INVITE OUR RESIDENTS UP TO SPEAK, PLEASE. THAT'S, UH, FIRST WE HAVE MS. RACHEL GOT GOOD SPEED. UH, GOOD EVENING COUNCIL MEMBERS. UH, MY NAME IS RACHEL. GOOD SPEED. UM, I WAS HERE BACK IN JULY, BUT AS A REMINDER, MY HUSBAND, CHILDREN AND OUR FARM ARE LOCATED AT 94 54 TAYLORSVILLE ROAD, AND WE'RE THE IMMEDIATE NEIGHBOR OF THE PROPERTY IN QUESTION, UM, FOR THIS CASE. UM, AND WE, AGAIN, RESPECTFULLY FOR THE RECORD, WANTED TO URGE THE COUNCIL TO DISAPPROVE THIS REQUEST. UM, MYSELF AND MY NEIGHBORS ON MULTIPLE VACATIONS HAVE BROUGHT THIS, UM, AND THE PLANNING COMMISSION'S ATTENTION TO OUR CONCERNS ABOUT SAFETY, HEALTH, LAND QUALITY, PROPERTY VALUES, AND NOISE. SO I WILL ONLY MENTION THEM TO REITERATE THEM ON THE RECORD IN CASE THIS ISSUE CONTINUES BEYOND, UH, THE CASE. THIS CASE IN PARTICULAR, UM, I'VE WATCHED THE CITY EFFORTS, UM, TO AMEND THE SPECIAL USES WITHIN AGRICULTURE DISTRICT CODE TO SUPPORT THE EXPANSION OF PERSONAL BUSINESSES WITH THE TIMES AND APPLAUD THE EFFORT. UM, ALTHOUGH FOR THE RECORD, OUR BUSINESS IS NOT A BED AND BREAKFAST, IT IS TRULY A FARM THAT WAS A FALSE CLAIM MADE BY OUR NEIGHBORS WITHOUT ANY PROOF, ALONG WITH OTHER FALSE CLAIMS. THEY'VE UNFORTUNATELY MADE, UH, I'M A SMALL BUT GRAIN FARM THAT SELLS FARM PROJECTS, UH, PRODUCTS. HOPEFULLY I'LL BE AT THE FARMER'S MARKET AGAIN THIS YEAR, UH, IF MY REQUEST IS NOT DENIED. UH, SO, UH, IT SHOULD BE NOTED THAT EVEN THE AMENDMENTS THAT WERE PROPOSED TO INCORPORATE AUTOMOTIVE AND VEHICLE REPAIR, UM, DID NOT PASS THE PLANNING COMMISSION AS WELL. SO EVEN IF IT DID, THE BUILDING WHERE OUR NEIGHBORS DO THEIR REPAIR WORK IS LESS THAN 30 FEET FROM OUR PROPERTY LINE. UM, AND EVEN IF WE ESTIMATED AT 30, IT WOULDN'T BE AT THE PROPOSED 40 FEET NOR THE COMMERCIAL SETBACK OF 50 FEET. UM, I WOULD ALSO ADD THAT THERE ARE LOTS OF EXISTING COMMERCIAL AND SEMI TRUCK REPAIR BUSINESSES LEGALLY OPERATING WITHIN THE CITY'S BORDERS. UM, SEVERAL, UH, THAT I WON'T MENTION, BUT THERE IS ANOTHER ONE THAT IS REQUESTING A PLANNED INDUSTRIAL REZONING PRIOR TO BUILDING AND OPERATING A TRUCK REPAIR FACILITY AND A TRUCK TRAILER STOP BUSINESS AT AN APPROPRIATE LOCATION AND GIVING THE PLANNING COMMISSION AND THE CITY ENOUGH TIME TO ASK QUESTIONS AND MAKE REQUESTS THAT ARE APPROPRIATE WITH THE TONE AND THE LOOK OF THE CITY, UM, THAT IT WANTS TO SET FOR THE REGION. SO I'LL LASTLY REITERATE, I HAVE NO PERSONAL ISSUES WITH OUR NEIGHBORS, ALTHOUGH THIS IS NOT HELPING. UM, THIS IS ABOUT OUR HOME, OUR FARM, AND OUR ZONING. UH, WE BELIEVE APPROVING THIS, UH, SETS A BAD PRECEDENCE FOR OTHERS WHO MAY BE LOOKING FOR THE SAME VARIANCES, THE SAME REQUESTS FOR ZONING CHANGES TO ACCOMMODATE THEIR MISTAKES, INTENTIONAL OR NOT. AND WHAT WOULD WE TELL THEM THEN? UM, SO I WOULD ALSO URGE YOU TO CONSIDER THAT IF THIS WAS A CHANGE THAT YOU, THAT WOULD AFFECT YOUR HOME, UM, I'M SURE THIS WOULD ALSO BE A DIFFERENT CONVERSATION. UM, SO, UM, THANK YOU VERY MUCH FOR YOUR TIME. I HOPE YOU WILL NOT APPROVE THIS REQUEST. UM, THANK YOU. THANK YOU. OKAY. AND LAST STOP. WE HAVE MS. CYNTHIA ROSENGARDEN, IF YOU PLEASE COME TO THE PODIUM. THANK YOU FOR THE OPPORTUNITY TO ADDRESS YOU. I'M CYNTHIA ROSENGARDEN AND MY SPOUSE IS TODD WALTER. UH, WE RESIDE AT 93 78 TAYLORSVILLE ROAD ON THE OTHER SIDE FROM RACHEL, UH, FROM THE PROPERTY. UM, I'M SPEAKING TO CONTINUE OUR STRONG OBJECTION TO THE PROPOSED REZONING AND LOT SPLIT OF THE SKILLY, UH, OUR NEIGHBORS ON TAYLORSVILLE. UM, FIRST I'D LIKE TO GO ON RECORD THAT WE ARE THE NEWEST RESIDENTS. WE MOVED IN IN JULY OF 2021. WE ARE NOT THE ONES WHO FILED THE COMPLAINT. YOU KNOW, IT'S BEEN A LOT OF HATFIELD MCCOY STUFF GOING BACK AND FORTH, BUT I WANNA GO ON RECORD THAT WE ARE NOT THE ONES THAT FILED, FILED THIS COMPLAINT. UM, AT A PREVIOUS CITY COUNCIL MEETING AS, UH, RACHEL ALLUDED, MRS. GILLEY'S [00:45:01] MADE THE FALSE ACCUSATION THAT WE WERE OPERATING A WOODWORKING BUSINESS OUT OF OUR RESIDENCE. UH, MY HUSBAND, TODD WALTER, IS A, UH, OPERATES A TOOL, A MAC TOOL TRUCK, AND HIS ROUTE IS WILMINGTON HILLSBOROUGH JEFFERSONVILLE. UM, HE LEAVES ABOUT 5 45 TO SIX 30 EVERY MORNING AND TURNS FROM HIS ROUTE ABOUT SIX TO SEVEN 15. UM, I TEACH AT THE UNIVERSITY OF DAYTON, SO I'M NOT HOME ALL DAY EITHER. UM, MRS. GILLEY'S ALSO MADE THE STATEMENT THAT THE NEIGHBORS, UH, THE GOOD SPEEDS WE'RE OPERATING A BED AND BREAKFAST. THIS IS ALSO A FALSE LIKE ACCUSATION THAT HAS NO BASIS. IN FACT, WE RESENT THE FACT THAT MS. GILLEY'S MADE UP THESE LIES TO CAUSE MORE GRIEF IN AN ALREADY STRESSFUL SITUATION. UM, THE, THE TRUCK REPAIR BUSINESS HAS BEEN OPERATING IN THE CURRENT LOCATION FOR OVER 10 YEARS OUT OF COMPLIANCE WITH THE HUBER HEIGHT ZONING REQUIREMENTS. UM, IN ADDITION, THEY HAVE A PREVIOUS HISTORY OF OPERATING THEIR BUSINESS IN VIOLATION OF LOCAL ORDINANCES IN RIVERSIDE. UM, IF SOME AGREEMENT OR JUDGMENT WAS MADE APPROVING THIS BY THE CONS, THIS WOULD PUT US IN THE DUBIOUS POSITION OF HAVING TO MONITOR WHAT'S GOING ON. OUR LOT HAS THE FULL VIEW OF THE TRUCK BUSINESS OVER THERE. SO, UH, WE CONTINUE TO BE CONCERNED ABOUT POTENTIAL ENVIRONMENTAL CONTAMINATION AS WELL AS THE POTENTIALLY DECREASED PROPERTY VALUE THAT WOULD RESULT FROM LIVING NEXT TO A, A LOT ZONED PLANNED INDUSTRIAL. THANK YOU. THANK YOU. AND THAT WAS IT FOR CITIZENS TREASURER TO SPEAK, CORRECT? YES, SIR. OKAY. WE HAVE A MOTION AND A SECOND AND WE'VE HAD OUR DISCUSSION. TONY, WOULD YOU CALL THE ROLL PLEASE? MS. THIS IS TO ACCOMMODATE, UH, OUR OBLIGATIONS UNDER OUR STORMWATER MANAGEMENT PERMIT, UH, TO BE ABLE TO MAINTAIN OUR STORMWATER COLLECTION INFRASTRUCTURE. IT WAS THE RECOMMENDATION THAT THIS ITEM BE ADOPTED TONIGHT. OKAY. SO ONCE MORE. ANY OTHER DISCUSSION AFTER BRIAN'S COMMENTS? OKAY. MR. RED? YES. MR. SHAW? YES. MS. BAKER? YES. MR. CAMPBELL? YES. YEAH, I WOULD JUST LIKE TO TAKE A MOMENT TO, UM, TO ASK EVERYONE TO CONSIDER, UM, UM, RESTARTING OUR CITY MANAGER SEARCH. I THINK WE'VE HAD A, A GOOD, DECENT, COOL DOWN PERIOD. AND, UM, I THINK WE NEED TO GET AT THE BUSINESS OF THE CITY AND, AND GET A GOOD, UH, PERMANENT CITY MANAGER IN PLACE. SO I WOULD ENCOURAGE EVERYONE TO, UH, SUPPORT ME AND, AND MOVING FORWARD WITH OUR CITY MANAGER SEARCH SO WE CAN GET THIS COMPLETED. ANYONE ELSE? OTHER REPORTS? YES, BRIAN. THERE IS A, UM, NEW DEVELOPMENT OVER IN HEATHER MEER. UM, SM D H HOLDINGS, UM, RECENTLY CAME AS BELL FOUNTAIN IN BRENTWOOD. UM, THEY'VE DONE SOME EXCESSIVE CLEARING THERE. I'M WONDERING IF THE, UM, PRESERVATION ZONE OR THE BUFFER THAT WAS THERE HAS BEEN EXCEEDED, AND I JUST ASK THAT WE TAKE A LOOK AT IT, PLEASE. SURE. THANK YOU MUCH. ANY OTHER REPORTS OR COMMENTS? DONE? THANK YOU, MAYOR. UM, SOMETIMES IN THE NOISE, UH, WE FORGET ABOUT ALL THE REALLY GREAT THINGS THAT ARE HAPPENING IN OUR CITY BY NOISE. I'M IN THE COMPLAINTS THAT POP UP ON SOCIAL MEDIA AND ELSEWHERE, BUT WE, WE TEND TO OVERLOOK ALL THE GREAT THINGS THAT ARE HAPPENING. WE STARTED OFF TONIGHT'S MEETING WITH FOUR PRESENTATIONS THAT REALLY SHOWCASE WHAT THIS CITY IS CAPABLE OF AND WHAT A GREAT PLACE IT IS TO LIVE. UM, NOW ENTERING 50 PLUS YEARS OF LIVING HERE, I CAN TELL YOU THAT YOU HAVE YOUR CHOICE OF LIVING WHEREVER YOU WANT TO. I CHOOSE HUBER HEIGHTS, AS DO MY FELLOW COUNCIL MEMBERS UP HERE. THERE ARE SO MANY GOOD THINGS GOING ON IN HUBER. SOMETIMES IT JUST TAKES ONE PERSON. AND, UH, I SEE SCOTT DAVIDSON HERE. I JUST WANT TO THANK CINDY DAVIDSON AND, UM, FOR THINGS LIKE HUBER HAUNTS AND THIS GIANT PANDA THAT WAS UP BEFORE US, BECAUSE IT REALLY DOES HELP TO DEVELOP A SENSE OF COMMUNITY AND COMMUNITY IS WHAT IT'S ALL ABOUT. SO, AGAIN, I, I JUST WOULD LIKE TO SEE MORE FOCUS ON THE GOOD, A LITTLE LESS FOCUS ON THE NEGATIVE. NOT THAT WE DON'T HAVE OUR PROBLEMS, BUT HUBER IS A GREAT PLACE TO LIVE. THANK YOU. THANKS DON. ANYONE ELSE? RICHARD? THANK YOU, MAYOR. I JUST WANTED TO QUICKLY, UM, UH, THANK MY COLLEAGUES FOR, UH, THEIR OBJECTION ON THE LIQUOR PERMIT, UH, THIS EVENING. I KNOW IT SEEMS LIKE WE HAVE BEEN, UH, DEALING WITH THIS FOR FAR TOO LONG AND, UH, I'M FRANKLY TIRED ABOUT TALKING ABOUT LIQUOR, UM, PERMITS. UM, HOWEVER, UH, WE, WE STILL DO HAVE A, A, ANOTHER, UH, ENTITY THAT, UH, NEEDS DEALING WITH AND I'M HOPING THIS COUNCIL, CITY ADMINISTRATION AND LEGAL DEPARTMENT, UH, WE'RE ABLE TO COME UP TO A CONCLUSION, UM, UH, NOT ONLY FOR US, BUT FOR OUR COMMUNITY AS WELL, UH, SO THAT WE CAN BE PROACTIVE INSTEAD OF REACTIVE. AND, UM, I KNOW WE'RE NOT THE ONLY COMMUNITY WITHIN MONTGOMERY COUNTY AND SOUTHWESTERN [01:05:01] OHIO THAT'S DEALING WITH THIS. UM, THIS ALMOST SEEMS LIKE A SITUATION THAT NEEDS TO BE TAKEN TO THE GENERAL ASSEMBLY THROUGH OUR STATE REPRESENTATIVE, UM, FOR THE, UM, UH, DETAILS AND AMENDMENTS, UH, WITHIN THE STATE TO BE, UH, CHANGED. UM, I KNOW WE TALKED ABOUT THE ZONING AND WE TALKED ABOUT, UH, THE REGULATIONS PUT FORTH BY THESE LIQUOR PERMITS ARE ABSOLUTELY LUDICROUS IN THE ITEMS, UH, THAT IT LISTS OUT. UM, SO, UH, SO THAT IS MY REQUEST THAT EITHER THIS COUNCIL START WORKING ON THE BIGGER PICTURE, UH, WITH THE GENERAL ASSEMBLY AND MAKING THIS CHANGE, UM, OR, UH, WE REALLY, UH, BUCKLE IN OUR SHOES, UM, AND, UH, FIND OUT A WAY TO TAKE CARE OF THESE HERE AT OUR HOMETOWN. THANK YOU, MAYOR. THANKS, RICHARD. ANYONE ELSE? OKAY, THAT CONCLUDES YOUR REPORTS AND COMMENTS. NEXT UP IS M 13 EXECUTIVE SESSION. UH, DO NOT BELIEVE WE NEED ONE THIS EVENING.
