UH, SO, UM, GOT A COUPLE ITEMS TONIGHT WANTING TO GIVE YOU AN UPDATE, UH, DOWN AT MANITA FIELD.

UH, THEY ARE GOING STRONG ON THE CONSTRUCTION OF THE PUMP TRACK AND THE BMX TRACK.

UH, SO THEY'RE DOING A LOT OF THE MOVING OF THE DIRT'S PUTTING IN ALL THE UNDER DRAINS, UH, ALL OF THAT KIND OF THING.

THE SKATE PARK, THE RAMPS, THOSE ARE NOW SCHEDULED FOR DELIVERY THIS COMING MONDAY.

UH, SO, UM, THAT WAS ABOUT A WEEK LATER THAN WHAT WE ORIGINALLY ANTICIPATED, BUT THEY ARE NOW SCHEDULED TO BE OUT THERE AND ON MONDAY TO BE WORKING.

SO THEY'LL HAVE ALL THREE PIECES BEING WORKED ON AT THE SAME TIME.

ALSO, UH, WE'VE GOT THE LEAF PICKUP IS COMING UP, STARTING ON NOVEMBER 1ST AND, UH, WE'LL GET THROUGH AT LEAST TWO PASSES.

IT'S WEATHER DEPENDENT ON WHETHER WE CAN DO ANY MORE.

IT'S A LITTLE BIT LATE IN THE SEASON OF LEAVES ARE NOT COMING OFF THE TREES AS EARLY AS SOME YEARS.

BUT, UH, SO WE'LL, WE'LL SEE HOW, UH, WINTER COMES IN AND IF THAT AFFECTS ANY OF THAT, UH, THAT PICKUP.

THEY HAD A LARGE CRANE OUT THERE TODAY, SETTING ALL THOSE IN PLACE, AND I THINK IT LOOKS AMAZING.

UM, THAT'S, UH, IT'S, THEY'RE ALL LINED UP CORRECTLY AND, UH, THEY, THEY DIDN'T HAVE ANY MAJOR ISSUES WITH SETTING THOSE IN PLACE.

SO NOTHING BROKE.

THREE B, WHICH IS A MONTGOMERY COUNTY SERVER FEE THROUGH THE POLICE DIVISION, SCOTT, UH, THAT ITEM A, THE POLICE CHIEF REQUESTED THAT THAT BE PULLED FROM THIS AGENDA.

THERE WAS A, UM, AN ITEM THAT'S STILL BEING DISCUSSED BETWEEN THE COUNTY AND ALL OF THE USERS THAT HASN'T BEEN COMPLETELY WORKED OUT YET.

SO, UM, UH, ABOUT, UH, PART OF THE DISCUSSION IS ABOUT,

UM, MIKE, MAKE SURE YOU GET YOUR MICROPHONE, MAKE SURE THAT'S TURNED ON, AND HE'S JUST NOT PICKING YOU UP.

YOU CAN COVER THE PODIUM TO, YES, BASICALLY THIS IS LEGISLATION TO AMEND THE AMOUNT TO NOT EXCEED FOR THE YEARLY CONTRACT THAT WE HAVE WITH CAPITAL ELECTRIC, FOR ELECTRICAL SERVICES.

THERE'S ALREADY BEEN PASSED, APPROVED BY COUNCIL, UM, TWO OR THREE YEARS AGO.

UM, AND BASICALLY THIS IS TO, UM, COVER FUNDS FOR AN ELECTRICAL BOX THAT HAS BEEN RAN OVER, UM, FOR THE FEES OF ABOUT $35,000.

UM, IS IT 2 0 2 AND POWELL ROAD? UM, SOMETIMES THESE THINGS HAPPEN, YOU KNOW, IN THE PAST 10 YEARS I'VE HAD, IT HAPPENED ABOUT THREE TIMES.

SO UNFORTUNATELY, SOMETIMES WE HAVE TO COME BACK TO COUNCIL TO ASK FOR ADDITIONAL ONES TO EXCEED THESE.

THESE FUNDS WILL ALSO BE WITH THE HOPE OF BEING REIMBURSED BY THE INSURERS, THE MOTORIST INSURANCE.

SO IS THERE JUST TO CONTINUE WITH THE CONTRACT AND RESOLUTION, IT'S JUST FORMALITY KIND OF THINGS.

SO JUST TO CLARIFY, THIS INCREASE IS JUST FOR THIS YEAR ONLY, NOT EACH YEAR OF THE CONTRACT.

SO THAT WAS THE QUESTION THAT WENT BACK AND FORTH TODAY, JUST TO MAKE SURE THAT WE'RE NOT ASKING FOR AN INCREASE ON A PER YEAR BASIS, BUT THIS IS JUST A ONE-TIME THING.

I WILL BE COMING BEFORE YOU IN THE NEXT COUPLE OF WEEKS FOR THE ADDITIONAL SERVICE FEE FOR THE NEXT FEW YEARS.

THIS IS JUST FOR THE CURRENT CONTRACT THAT WE HAVE WITH THEM TO COVER THE CURRENT COSTS WITH THE INTERSECTION THAT HAS BEEN, YOU KNOW, THIS HAD THE TROUBLES OF SAID, OKAY, OKAY.

AND THE DAMAGES.

WHICH IS THE OWW WATER REVENUE BOND REFINANCING.

MAYOR COUNCIL MEMBERS, OR YES, SIR.

I AM DOING WELL.

HOW ABOUT YOURSELF? VERY GOOD.

GOOD, GOOD.

I'VE GOT SEVERAL ITEMS HERE.

UM, THE, UM, WATER REVENUE BONDS, UH, FROM 2013 AND 2014, UH, CAN BE RENEWED.

I'M SORRY.

WE FINANCED.

AND, UM, WE FOUND THAT RATHER THAN GOING OUT INTO THE MARKET, UH, OHIO WATER DEVELOPMENT AUTHORITY, O WTA FOR SHORT, UM, HAS A NEW LOAN PROGRAM FOR REFINANCING.

SO WE'RE, I THINK THE FIRST OR SECOND CITY THAT'S GOING TO TAKE ADVANTAGE OF THIS.

AND I REMEMBER YOU TALKING ABOUT THAT IN ANOTHER MEETING PRAYER.

YES.

ANDY WAS HERE TALKING ABOUT OUR COMPLETE DEBT STRUCTURE AND, AND, UH, BROUGHT IT UP AT THAT TIME.

SO, UM, HERE COMES THE LEGISLATION, UM, IN ORDER, GET THIS ALL TAKEN CARE OF BY 12 ONE.

WE NEED TO GET THIS PAST MONDAY NIGHT.

AND SO THE FIRST ORDINANCE, UM, AS I DETAILED IN YOUR COUNCIL PACKETS, THE, UH, THE BONDS THAT WERE REFINANCING ARE, UH, HAVE AN AVERAGE COUPON RATE OF 4.7%.

AND THIS FIRST ONE, WE CAN GET AN ESTIMATED, UH, INTEREST RATE FROM OF 1.7%.

SO WE'RE SAVING 3% ON THOSE, AND THAT EQUATES TO A LITTLE OVER A MILLION AND A HALF DOLLARS OF SAVINGS JUST ON THIS ONE, WHICH COMES OUT TO BE ABOUT $90,000 PER YEAR AND OUR DEBT SERVICE IN THE WATER FUND.

SO THAT'S, UH, UH, EXCELLENT, UH, NEARLY UNHEARD OF, TO BE THAT, THAT MUCH OF A SAVINGS.

THE, UH, THE SECOND ONE, WHICH IS A SERIES 2013 B UH, THAT ONE, UH, WE HAVE A COUPON RATE ON THAT OF ABOUT 4.3%.

UH, WE, WE BELIEVE THE NEW ONES WILL COME IN AT ABOUT 1.5%.

SO THERE'S A 2.8% SAVINGS.

UH, THIS ONE'S A SMALLER ISSUE, ONLY 735,000.

SO THE SAVINGS THERE IS JUST $44,687, OR

ABOUT $9,000 PER YEAR.

THAT'S THE ONLY GOING TO BE A FIVE-YEAR ISSUE.

AND THEN THE THIRD ONE, OUR, UH, UM, UH, WATER REVENUE REFUNDING BONDS THAT WE DID IN 2014, THE PRINCIPAL AMOUNT OF THOSE WERE SET OVER $7.8 MILLION.

AND, UH, ONCE AGAIN, THE AVERAGE COUPON ON THOSE WAS 3.2, 3.2%, AND WE BELIEVE THE NEW RAVE WILL BE, UM, UH, 1.2%, OF COURSE, OBVIOUSLY, UM, AS SOON AS COUNCIL PASSES, THIS, THEN THEY'LL GO INTO THE MARKET.

THESE ESTIMATES WERE BASED ON A SEPTEMBER RATE.

SO, UM, THERE'S REALLY, HASN'T BEEN A WHOLE LOT OF FLUCTUATION, MAYBE CREEPING A LITTLE BIT HIGHER, BUT WE THINK THESE ARE GOOD ESTIMATES.

AND THE SAVINGS FOR THIS ONE WILL BE, UH, SLIGHTLY OVER $1 MILLION OR, UM, EQUATE THAT TO ANNUALLY A HUNDRED, $4,000 PER YEAR.

SO THE THREE COMBINED WOULD BE A SAVINGS OF $2.6 MILLION.

SO, UM, UH, LIKE I ALWAYS SAY, WHEN WE CAN'T EARN MONEY ON OUR INVESTMENTS RIGHT NOW, UH, YOU KNOW, VERY LOW INTEREST RATES, THEN TAKE TIME TO LOOK AT ALL OF YOUR DEBT.

AND THIS IS DEBT THAT DEFINITELY BY REFINANCING CAN SAVE THE CITY SIGNIFICANT DOLLARS ON AN ANNUAL BASIS.

SO WE THINK THIS IS A GOOD TO MOVE FORWARD.

AND, UH, THERE'S THREE DIFFERENT ONES.

I WAS HOPING TO BE ABLE TO COMBINE THEM ALL INTO ONE LOAN AT OWT EA, BUT THAT'S NOT HOW THEY WANTED TO HANDLE IT.

THEY WANTED TO HANDLE IT AS THREE SEPARATE ONES.

SO I'M GOING WITH THEIR RECOMMENDATION.

SO ALL THREE WERE ISSUED AS SEPARATE ORDINANCES IN YOUR PACKET.

THESE NEED TO BE A SECOND WAITING RAVED, SECOND READING WAIVED, OR YES, BECAUSE THEY'RE AN ORDINANCE, UH, IT WOULD HAVE, IT WOULD REQUIRE TWO READINGS, UM, AND THEY REQUEST WAIVED.

UH, YES, I AM ASKING FOR THE SECOND READING TO BE WAIVED.

UH, OH, WTA HAS SAID THAT, UH, THEY NEED ALL THIS, UH, THE CERTIFIED ORDINANCE, UH, GIVEN TO THEM BY THE 27TH.

AND I BELIEVE OUR COUNCIL MEETINGS ON THE 25TH.

THAT'S THAT ACTUALLY, TONY, YOU JUST MENTIONED THAT THAT'S THE REASON WHY IT'S EMERGENCY.

SO, UH, THAT, UH, REVENUE COMES INTO OUR FEMA FUND.

UH, WE NEED TO TRANSFER THAT MONEY OUT TO THE FIRE FUND TO PAY FOR THE OVERTIME THAT WAS EARNED ON THE, UM, UH, DEPLOYMENT, UH, FOR HURRICANE LAURA EARLIER THIS YEAR.

SO, UH, WE WANT TO BRING DOWN OUR EXPENSES THAT WE HAD ALREADY SPENT IN FIRE FOR THAT, UH, $14,700 FOR, UM, AN UNANTICIPATED RETIREMENT, UH, IN THE POLICE DEPARTMENT.

UH, THEN WE HAVE, UM, $156,472, UH, FOR OUR AQUATIC CENTER IMPROVEMENTS.

AND I BELIEVE THIS IS ON THE AGENDA FOR SCOTT TO DISCUSS LATER IN THIS MEETING.

UH, BUT, UH, WE HAD TALKED AND HE SAID, GO AHEAD AND PUT THAT ON, UH, BETTER TO, FOR COUNCIL TO SEE IT BEFORE WE DISCUSS IT.

AND IF THAT CHANGES LATER IN THE MEETING, LET ME KNOW.

AND I CAN AMEND THAT BEFORE MONDAY.

UM, THE NEXT ITEM IS $44,400, UH, FOR ANOTHER UNANTICIPATED RETIREMENT THAT'S OF AN ENGINEERING INSPECTOR.

AND, UH, YOU'LL SEE THAT SPREAD OVER THREE DIFFERENT FUNDS BECAUSE THAT'S HOW THAT PERSON'S SALARY IS PAID IN THREE SEPARATE FUNDS.

AND THEN, UM, THE REFINANCING THAT WE'RE DOING, UM, FOR THE 2013 AND 14 WATER BONDS THAT I JUST DISCUSSED, THAT WAS NOT, UH, IN OUR BUDGET.

SO WE NEED TO BUDGET FOR THAT, AND THAT'LL BE ON THE REVENUE SIDE AND THE EXPENSE SIDE.

SO EVEN THOUGH IT'S A LARGE NUMBER, 12 MILLION, $914,000, UH, THERE'LL BE REVENUE PROCEEDS FROM THE, UH, FROM THE OWA LOAN THAT WILL COVER THE EXPENSES OF PAYING OFF THOSE OLD BONDS.

SO, UH, THAT'LL BE A WASH.

AND THEN THE NEW ITEMS TONIGHT, UH, WE'VE LOOKED AT THE, UM, WHERE WE'RE AT ON THE YEAR, UH, FOR LEGAL EXPENSES, UH, WITH PICKEREL, SCHAEFER AND EBELING.

AND, UM, I'VE BEEN DOING A LOT OF WORK FOR US AND IT LOOKS LIKE WE WILL NEED AN ADDITIONAL $60,000 TO GET THROUGH THE END OF THE YEAR.

SO I'M ASKING, UH, AS I TYPICALLY DO, USUALLY IN OCTOBER, NOVEMBER, EACH YEAR, UM, IF IT COMES TO THAT, UH, I BELIEVE WE WILL NEED AN ADDITIONAL 60.

WE MAY NOT SPEND ALL THAT, OBVIOUSLY WE DON'T KNOW, BUT I'M TRYING TO HAVE A GOOD ESTIMATE FOR GETTING THROUGH THE END OF THE YEAR FOR THAT.

AND THEN THE OTHER ITEM WHICH COUNCIL APPROVED TWO WEEKS AGO WAS A SUEZ MAINTENANCE ITEMS

THAT THEY BROUGHT.

I THINK RUSS BROUGHT THEM TO COUNCIL'S ATTENTION AND BETWEEN WATER AND SEWER, THE TOTAL, THERE IS $160,000, AND THAT WAS SOMETHING COUNCIL HAD APPROVED A TWO WEEKS AGO, BUT IT OBVIOUSLY WAS NOT PART OF AN INCREASE TO THE BUDGET.

SO I'M BRINGING IT TO YOU AT THIS TIME.

JERRY, IS THERE, COULD YOU GET US SOME DETAILS ON WHAT SOME OF THESE EXTRA EXPENSES ARE? I KNOW THAT THERE'S LOTS OF WORK THAT'S HAPPENING, BUT, UM, 60 GRAND'S A LOT.

THIS HAS BEEN DISCUSSED AT A COUPLE OF PREVIOUS MEETINGS ABOUT THE POSSIBILITY OF MOVING FORWARD WITH SOME LONG-TERM LEASES WITH SOME OF OUR FIELDS, THE, UH, GIRL'S SOFTBALL ASSOCIATION HAS REQUESTED.

UM, WE USUALLY HAVE BEEN GOING JUST A YEAR BY YEAR AND ACCORDING TO OUR PARKS AND REC MANUAL, UH, STAFF CAN ONLY APPROVE A ONE YEAR LEASE OF A FIELD.

SO THAT IS THE REQUEST IS TO MOVE FORWARD WITH A FIVE-YEAR LEASE, UH, FOR, UH, EACH OF THE FIELDS THAT THE GIRLS SOFTBALL ASSOCIATION WILL USE.

NOW, THIS WILL INCLUDE THE ONES THAT TOM CLOUD PARK, THE ONES THAT THEY CURRENTLY USE, UH, THAT ARE AROUND THE CONCESSION STANDS PLUS THE ADDITIONAL ONES THAT THEY'RE GOING TO START UP THE REC BASEBALL LEAGUE WITH, AND THEN THE ONES THAT MANITA AS WELL FOR A REC BASEBALL TYPE USE A PART OF A QUESTION THAT I HAD WAS WHAT IF THE LITTLE LEAGUE BASEBALL WHO CAME OUT AND SAID THAT, UH, THEY WOULD NOT BE USING OR WANTING TO USE THE FIELDS THIS YEAR, THAT THEY, UM, ARE ALL IN SUPPORT OF A REC BASEBALL LEAGUE BEING RUN BY GIRLS SOFTBALL.

SO WE CAN REWORD THAT.

SO THE SANITARY SEWER AND THE WATER FOR THE FRONT PIECE, THAT STAIN, THOSE HAVE BEEN RELOCATED FROM THE BACK PORTION AND SPLIT OFF, UM, THE BACK WHERE THE FIRE HYDRANTS, UH, WAS THAT'S BEEN DISCONNECTED BECAUSE THAT CAME INTO THE BUILDING TO THE SPRINKLERS IN THE BACK AND DIDN'T HAVE A VALVE SHUT OFF.

SO WE HAD TO DO SOME EXTRA WORK THERE TO BE ABLE TO SPLIT THAT OFF, TO BE ABLE TO TEAR DOWN THAT NEXT PORT, THAT BACK PORTION.

UH, ONE OF THE THINGS I HAVE DONE IN THE INTERIM IS I HAD, UM, WORKED ON CONTACTING THE REFERENCES, UM, THAT HAD BEEN PROVIDED BY THE TWO FIRMS, UM, SLAVE AND MANAGEMENT CONSULTANTS, UH, PROVIDED A LIST OF SIX REFERENCES.

[ Ordinance Review Commission Recommendations - City Code Amendments * Part Five - General Offenses Code]

NEXT IS ITEM THREE IN WHICH IS THE ORDINANCE REVIEW COMMISSION RECOMMENDATIONS FOR, UH, CITY CODE AMENDMENTS.

UH, WE HAVE PART FIVE GENERAL OFFENSES CODE AND PART 15, WHICH IS THE FIRE PREVENTION CODE.

OKAY.

SO, LIKE I TALKED ABOUT AT THE LAST WORK SESSION, THESE ARE THE PIECES OF THE RECOMMENDATIONS THAT ARE COMING IN THE VARIOUS SECTIONS FROM THE ORDINANCE REVIEW COMMISSION.

UH, WE STARTED OUT, UH, SLOW SPEED THE LAST TIME WITH SOME MINOR RECOMMENDATIONS AND WORKING OUR WAY UP.

SO FOR THE REMAINING MEETINGS FOR THE REST OF THE YEAR, I'VE SCHEDULED THESE IN PIECES,

SO THAT WE'LL BE ABLE TO, UH, PUSH THESE FORWARD, UM, THROUGH, THROUGH, BY THE END OF THE YEAR.

AND, UH, HOPEFULLY BRING THIS PROCESS, UH, TO A CLOSE TOMORROW NIGHT WILL BE THE FINAL MEETING OF THE ORDINANCE REVIEW COMMISSION, UH, TO WRAP THAT UP.

UM, THE OTHER PIECE TO THE ORDINANCE REVIEW COMMISSION PROCESS, AS THEY DEVELOP A FINAL REPORT, THAT IS ALL INCLUSIVE OF ALL THE RECOMMENDATIONS THAT THEY'VE MADE.

SO, UH, AT A FUTURE COUNCIL MEETING THE NEXT MONTH OR SO I WILL BE INVITING THE ORDINANCE REVIEW COMMISSION TO THE COUNCIL MEETING TO FORMALLY PRESENT THEIR REPORT AND RECOMMENDATIONS TO THE CITY COUNCIL AND GIVE THE COUNCIL THE OPPORTUNITY TO ACKNOWLEDGE THAT, UH, MANY HOURS OF ARTWORK THAT, UH, THE, AS VOLUNTEERS DATA AS A PART OF THE, SO, UM, SO AS THE MAYOR MENTIONED, THE FIRST ONE IS PART FIVE, WHICH IS THE GENERAL OFFENSES CODE.

I'LL JUST BRIEFLY GO OVER THE CHANGES THAT ARE BEING RECOMMENDED AGAIN, AND BE HAPPY TO ENTERTAIN ANY QUESTIONS, UM, ON BOTH OF THESE SECTIONS TONIGHT, UM, UH, THAT ARE BEFORE YOU, I'M ASKING THAT THEY GO TO OUR FIRST READING ON MONDAY'S AGENDA AND THEN BE PASSED TO A SECOND READING, UH, TO ALLOW TIME FOR PUBLIC COMMENT, IF THERE IS ANY, UH, SINCE THESE ARE A LITTLE MORE SUBSTANTIAL IN NATURE IN TERMS OF THE RECOMMENDATIONS.

UM, SO FIRST WE HAVE SECTION 5 0 5 0.04, ABANDONING THE ANIMALS.

UM, AND THIS ONE IS JUST A MINOR CHANGE.

UH, THERE WERE INAPPROPRIATE, UM, UH, HIGH REVISED CODE SITE CITATIONS OR INCORRECT CITATIONS, UM, IN TWO SECTIONS OF THAT, UH, PART OF THE CODE SO THAT WE WOULD JUST BE, UH, WITH JERRY'S ASSISTANCE, MAKING THE PROPER CODE CITATIONS AND THAT THOSE AREAS, UM, AND CHAPTER 5 0 5, UH, 0.10, UM, WHICH DEALS WITH, UM, ANIMAL BITES AND, UM, REPORTS OF ANIMAL BITES AND QUARANTINE OF A DOG.

UM, WE CURRENTLY HAD SOME SPECIFIC SECTIONS IN OUR CODE, BUT, UH, THE CODE SECTIONS IN THE HUBER HEIGHTS CODE WERE AT ODDS WITH, UH, THE CHANGES THAT HAVE BEEN MADE AT THE STATE LEVEL, UH, AS IT RELATES TO, UH, DOG BITES AND DANGEROUS DOGS.

SO, UH, WITH JERRY'S HELP, WHAT WE DID IS, UH, PULLED THE RELEVANT SECTIONS, THEY'LL HIRE REVISE CODE THAT DEAL WITH THESE ISSUES, UH, DOWN INTO A RECOMMENDED SECTION 5 0 5 0.10 ENTITLED DUTIES AFTER DOG BITES PERSON, UM, AND, UH, PRETTY STRAIGHT FORWARD OUTLINES, WHAT YOU NEED TO DO AS FAR AS YOUR LEGAL OBLIGATIONS TO, UH, TO ADDRESS, UH, A DOG BITE ISSUE.

AND, UH, IN THIS REGARD, WE WOULD PARALLEL THE OHIO REVISED CODE, UH, USING THE SAME LANGUAGE, UH, SIMILARLY AND SECTION 5 0 5 0.14, WHICH IS A DANGEROUS DOGS, UH, SECTION IN OUR CURRENT CODE.

WE'D RECOMMEND KEEPING THAT TITLE, DANGEROUS DOGS.

UM, BUT AGAIN, UH, DRAWING DOWN ALL OF THE INFORMATION FROM THE OHIO REVISED CODE THAT HAS RELEVANCE TO THIS SECTION, UH, DEALS WITH, UH, DANGEROUS DOGS, MENACING DOGS, UH, DEFINED SERIOUS INJURY FROM A DOG BITE, UM, AND THE PENALTIES ASSOCIATED WITH, UM, MAINTAINING A DANGEROUS DOG OR ALLOWING A DANGEROUS DOG, UM, TO, UH, DO HARM TO ANOTHER INDIVIDUAL.

THEN A SECTION 5 0 5 0.1, ONE, ONE, UM, HAS TO DO WITH OUTDOOR FEEDING.

THIS IS, UM, A RECOMMENDATION TO ADD A NEW SECTION TO THE CODE THAT DOESN'T CURRENTLY EXIST.

AND SO, UM, WHAT THIS SECTION OF THE CODE DOES IS TO FIND ANIMALS THAT ARE RUNNING AT LARGE, IT DIVIDES WHAT IS CONSIDERED A WILD ANIMAL, AND, UM, IT SETS OUT GUIDELINES FOR WHAT PEOPLE ARE ALLOWED TO DO IN TERMS OF, WELL, REALLY WHAT THEY'RE NOT ALLOWED TO DO IN TERMS OF LEAVING OUT FOOD OR PROVIDING OUTDOOR FEEDING TO, UH, ANIMALS THAT ARE CONSIDERED WILD OR RUNNING AT LARGE AND ESTABLISHES PENALTY FOR ANYONE WHO VIOLATES, UH, THAT SECTION.

SO, UM, WILD ANIMALS WOULD BE DEFINED TO INCLUDE, BUT NOT LIMITED TO FERAL CATS, SQUIRRELS, CHIPMUNKS, GROUNDHOGS, RACCOONS, SKUNKS, POSSUMS, MUSKRATS, DEER, FOXES, AND COYOTES.

SO, UM, THAT, SO DOES THIS, IS THAT THE CODE THAT, UH, INDICATES THAT IF YOU FEED A FERAL CAT OR ANIMAL FOR A CERTAIN TIME, YOU BECOME THE OWNER OF THAT? WELL, IT PROHIBITS YOU DOING THAT.

YEAH, BUT I THOUGHT THERE WAS A CODE IN THERE.

THERE IS A SECTION THAT TALKS ABOUT, UM, YOU ESTABLISH OWNERSHIP OF AN ANIMAL BY PROVIDING CHARACTER, AND I THINK IT'S CALLED HARBOR.

UM, AND THAT SECTION STILL IN THE CODE, WE ARE NOT CHANGING THAT THIS IS AN ADDITION TO THIS, BUT IT WOULD BE A DIRECT PROHIBITION ON OUTDOOR FEEDING, UH, WITH FERAL CATS OR OTHER WILD.

OKAY.

SO YEAH.

SO UNDER DOGS OR UNDER THAT 5 0 5 11 IS PRESUMPTION OF ANIMAL OWNER KEEPER OR HARBOR.

SO THAT SECTION LOOKS LIKE IT'S STILL IN THE CODE YET.

WE'RE RETAINING THAT CORRECT.

THEN IN SECTION 5 0 9 0.10, UM, MOTOR VEHICLE NOISE CONTROL.

UM, THESE ARE MONITORED BY A PUBLICATION OF STANDARDS CALLED THE AMERICAN NATIONAL STANDARDS INSTITUTE.

UM, SOME OF THE DEFINITIONS AND SOME OF THE WAYS THEY MEASURE THESE, UH, NOISE CONTROL STANDARDS HAVE CHANGED AND HAVE BEEN UPDATED SINCE THE CODE WAS LAST WRITTEN.

SO, UH, WE'VE MADE THE MODIFICATIONS IN THAT TO BRING IT CURRENT TO THE CURRENT, A N S I STANDARDS, UH, FOR MOTOR VEHICLE NOISE CONTROL.

THE NEXT IS, UM, FIVE, 1.06 DUTY TO KEEP SIDEWALKS AND REPAIR AND CLEAN AND A REMEDY BY THE CITY FOR NONCOMPLIANCE AND DOING SO, UH, THIS IS, UH, A CURRENT SECTION OF THE CODE WHERE THERE'S BEEN SOME SUBSTANTIAL ADDITION OF INFORMATION BASED ON THE RECOMMENDATION OF CITY STAFF.

UM, JERRY, I DON'T KNOW.

DO YOU WANT TO SPEAK TO THAT IN ANY REGARD SIX MONTHS AGO? OKAY.

SO, UM, IT BASICALLY DEFINES THE PROCESS THAT IF YOU HAVE A SIDEWALK THAT'S NOT IMPROPER REPAIR OR CLEAN, THEN, UH, UPON A FINDING BY THE CITY ENGINEER OR HIS DESIGNEE, UH, YOU CAN BE SERVED NOTICE OF THE NONCOMPLIANCE WITH THIS SECTION OF THE CODE, UH, AND BE DIRECTED TO MAKE THOSE REPAIRS.

IF YOU FAIL TO MAKE THOSE REPAIRS, THEN THE CITY CAN, UM, AFFECT THE REPAIR BEING, UH, TAKEN CARE OF AND REMEDIED, AND THEN THE PROPERTY OWNER BEING ASSESSED THAT THE COSTS OF THOSE REPAIRS, UM, HAVE THERE BEEN ANY CHANGES IN THERE? UH, ONE OF THE BIGGEST COMPLAINTS OR CONCERNS THAT I'VE HEARD IS THAT THERE IS CURRENTLY A PROVISION IN THERE.

I BELIEVE THAT SAYS THAT THEY HAVE TO USE THE CITY APPROVED CONTRACTOR IN ORDER TO MAKE THOSE REPAIRS.

AND PEOPLE ARE SAYING, IF I GET SOMEBODY ELSE TO DO IT AND MAYBE COULD DO IT CHEAPER OR WHATEVER, AND THEY STILL MEET THE STANDARDS.

WHY CAN'T I DO THAT? YEAH.

THAT, THAT, UH, THEY WOULD BE INCORRECT TONIGHT.

THEY ARE ALLOWED TO USE THEIR OWN PROVIDER TO DO A REPAIR FOR, UH, SIDEWALKS AND DRIVEWAYS WHEN THEY'RE REQUIRED TO DO SO.

UM, THEY'RE GIVEN AN ESTIMATE, AN ENGINEER'S ESTIMATE AND STOCK COULD PROBABLY TALK TO US ABOUT IT OR JUST DOING WORK IN THE RIGHT OF WAY.

THEY HAVE TO BE BONDED WITH THE CITY.

SO THAT'S MIGHT BE WHAT YOU'RE TALKING ABOUT SO THEY CAN CHOOSE WHOEVER THEY WANT.

BUT THEN THAT CONTRACTOR DOES HAVE TO COME HERE AND BE BONDED SINCE IT'S IN THE PUBLIC RIGHT-OF-WAY.

SO THAT MIGHT BE THE, WHENEVER YOU'VE HEARD SOME PEOPLE SAY, HEY, I WANT TO BE ABLE TO DIG UP THE CURB MYSELF AND POUR IT MYSELF.

BUT THEY CAN CHOOSE A PROVIDER, THEY GET AN ENGINEER'S ESTIMATE AND THEY CAN EITHER GO WITH THAT OR THEY CAN SEEK SOMEONE OUT, BUT THAT'S KIND OF SAYING IT WOULD HAVE TO BE A BONDED, BONDED PERSON.

YEAH.

UM, AND IF I CAN, JUST TO CLARIFY, AS WE WERE DISCUSSING IT AND UNDERSTOOD, THIS IS PRETTY MUCH JUST, UM, CLARIFY AS THE PROCESS THAT WE ALREADY HAVE WITH THE CURB AND SIDEWALK PROGRAM.

ANYWAY, THIS IS PRETTY MUCH HOW IT RUNS.

SO THIS JUST DEFINES IT WITHIN THE, OR SEE RIGHT NOW THAT'S CORRECT.

I THINK THEY WERE, UH, STAFF WAS RECOMMENDING A LITTLE MORE IN CLARIFICATION ON THE PROCESS.

SO SOME OF THOSE QUESTIONS THAT COME UP MIGHT BE ABLE TO BE BETTER ANSWERED THROUGH THE GUT.

AND WE HAVE A SECTION FIVE TO 1.081 PARAGRAPH H AND M.

THIS IS JUST TO ADD THE PHRASE AND WHOEVER VIOLATES THIS SECTION SHALL, AND WE'RE ADDING THE TERMS IN ADDITION TO THE ABOVE THE GUILTY OF A MINOR MISDEMEANOR.

SO THERE'S OTHER, UM, PENALTIES IN TERMS OF, UH, ASSESSMENTS OR FINES, UH, FOR CLEANUP WORK OF GARBAGE AND TRASH, IF IT'S NOT REMEDIED BY THE, THE TENANT OR THE PROPERTY OWNER.

BUT IN ADDITION TO THOSE, THEY COULD POTENTIALLY FACE, UM, A MINOR MISDEMEANOR CHARGE, UH, FROM THAT TYPE OF BEHAVIOR, WITH LETTERING OR DEPOSIT OF GARBAGE AND TRASH, UM, SECTION 5 21 0.08, TWO RESIDENTIAL SOLID WASTE COLLECTION AND DISPOSAL.

THIS IS JUST A GRAMMATICAL ERROR CORRECTION.

UM, IT CURRENTLY SAYS TO REMOVE WASTER MATERIAL AT RESIDENTIAL DWELLINGS, IT'S SUPPOSED TO SAY TO REMOVE WASTE MATERIAL.

SO WE'RE JUST DROPPING THAT ARE FROM THE CODE IN SECTION 5 21 0.10, PARAGRAPH E UM, DUTY TO CUT WEEDS AND GRASS AND REMEDY BY CITY FOR NON-COMPLIANCE.

UM, JUST ADDING A PHRASE THAT ANYONE WHO'S IN VIOLATION OF THE SECTION, UH, WAS LEFT OUT SO THAT IT CLEARLY LINKS, UH, THE DUTY AND THE RESPONSIBILITY TO CUT THE WEEDS AND GRASS AND THE NONCOMPLIANCE WITH THAT, TO THE POTENTIAL FOR, UM, UH, UM, A PENALTY SHOULD THE, THAT'D BE APPROPRIATE TO THAT CIRCUMSTANCE.

SO, UH, THAT IS ALL IN SECTION FIVE.

THE ONLINE CODE WOULD BE UPDATED AND ALL THOSE CHANGES WOULD BE REFLECTED AVAILABLE TO THE PUBLIC.

IF THEY SEARCH THE CODE, KEEPS THOSE, UH, PART 15, THE FIRE PREVENTION COULD PART 15.

WE HAVE ONE CHANGE IN HERE.

UM, SECTION 1, 5, 1 7 0.09, RIGHT OF APPEAL.

AND, UM, CURRENTLY, UM, IF A PERSON, UH, WISHES TO APPEAL A DECISION OR INTERPRETATION BY A FIRE OFFICIAL UNDER PROVISIONS OF THE OHIO FIRE CODE, IT SAYS, UM, IF THE OWNER FILES FOR AN APPEAL, UM, THIS IS KIND OF INCORRECT LANGUAGE BECAUSE, UM, IT COULD POTENTIALLY BE THE TENANT AND NOT THE OWNER WHO IS THE PERSON FACING THE, UH, THE VIOLATION.

AND SO THEY WOULD HAVE THE RIGHT OF APPEAL.

SO WE'RE JUST CHANGING, UH, THE TERM OWNER TO PERSON AGGRIEVED BY A DECISION OR INTERPRETATION, UH, OF THE, UH, OHIO FIRE CODE SO THAT IT WOULD ALLOW FOR THE TENANT TO HAVE THE RIGHT TO APPEAL IF THEY'RE THE SUBJECT OF THE VIOLATION.
