UH, THIS MEANS OFFICIALLY CALLED TO ORDER AND ITEM.

NUMBER TWO IN THE AGENDA IS THE INVOCATION BY PASTOR RANDY GRIFFITH OF THE FREE METHODIST CHURCH AT 60 AND 75 OLD TROY PIKE HERE IN UBERX FROM JEREMIAH SIX 16.

THIS IS WHAT THE LORD SAYS.

I'D ALREADY MADE MY DECISION, BUT I'M GLAD THAT THE LORD HAS REDIRECTED ME TO HIS WAY.

AND HE CONTINUES TO CORRECT ME.

I WANT HIM TO JEREMIAH WROTE, ASK FOR THE ANCIENT PATHS.

THIS IS NOT ABOUT GOING BACK IN TIME, BUT GOING BACK TO GOD AND THE PATHS THAT HAVE ALWAYS ORIGINATED IN HIM THAT HAVE ALWAYS BEEN THE RIGHT WAY TO GO.

THE GOOD WAY ONLY GOD IS GOOD.

SO YOU CAN KNOW THAT HIS WAY IS ALWAYS GOOD, FIND HIS WAY.

AND WHEN YOU FIND OUT WHAT HIS WAY IS, WALK IN IT, JESUS IS THAT WAY.

AT CERTAIN TIMES, WE MAY FACE CROSSROADS THAT DETERMINE OUR COURSE IN LIFE, EVEN DAILY, WE CAN FACE CROSSROADS WHERE WE MUST CHOOSE BETWEEN OPTIONS THAT AFFECT PEOPLE, PLACES, AND THINGS.

TEST YOUR MOTIVES, PRAYERFULLY, CONSIDER THE GOOD WAY GOD'S WAY AND WALK IN IT.

GOD IS LOVINGLY CONCERNED ABOUT EVERY ASPECT OF YOUR LIFE HE WANTS, WHAT IS BEST FOR YOU AND EVERYONE ELSE, AND WOULD NEVER LEAD YOU DOWN THE WRONG PATH.

LORD, YOU WILL FILL ME WITH JOY IN YOUR PRESENCE.

UM, I'M HERE IN REGARDS TO THE AGREEMENT THAT THE COUNCIL AND THE BUILDERS OF THE OXO HUBER, UH, HAD AGREED UPON AND UNFORTUNATE

OR Y'ALL CAN EXPLAIN WHY IT'S FORTUNATE THAT WE'RE NOT SEEING ANY BRICK IN THE FRONT OF THE WHOLE, UH, IT'S ALL VINYL.

AND WE HAD COME TO THAT AGREEMENT.

I WAS UNDER THE IMPRESSION WE HAD TO COME TO THAT AGREEMENT THAT THEY KNOW THAT HUBER DEALS WITH BRICK.

AND SO WE WANTED TO GET THAT TAKEN CARE OF BEFORE THEY HAVE ABOUT FOUR OR FIVE HOUSES BEING ERECTED AT THE SAME TIME.

SO THERE ARE IT'S MASONRY MATERIALS.

SO THE WHAT'S ALLOWED IS A, A MULTITUDE OF TYPES OF MATERIALS.

AND YOU'LL SEE THAT THROUGHOUT THE DEVELOPMENT OF SOME HAVE STONE, SOME HAVE BREAK, UM, WHAT IS ONE, ALL OF THOSE HOMES, ONE THEY'RE NOT COMPLETE YET.

THERE'S NONE THAT HAVE COME BACK FOR THE FINAL FOR OUR INSPECTION.

UM, BUT, UH, THE, WHAT IT IS NOT VINYL THAT'S BEING PUT UP.

IT'S, UH, THE FIBER CEMENT BOARD THAT HARDY PLANK THAT IS BEING PUT UP THAT IS A MASONRY PRODUCT.

SO, UM, AND THAT, THAT'S SOMETHING THAT HAS BEEN APPROVED FROM PRIOR TO MY TIME HERE THAT HAS BEEN AN ACCEPTABLE MASONRY MATERIAL, UM, WITHIN THE CITY FOR, UH, RESIDENTIAL HOUSES.

SO IT DOES FIT THE REQUIREMENTS AND HIS MACERATE.

YES, IT IS.

I DIDN'T GO UP ONTO THE PROPERTY, BUT JUST FROM THE STREET, IT LOOKS LIKE VINE ALL THE WAY AROUND AND WHERE WE DIDN'T HAVE MAITRI AND I THOUGHT THAT'S WHAT WE HAD TO AGREE TO.

WELL, YOU'RE EXACTLY RIGHT.

THE WHOLE BLOODY THING IS VINYL, BUT EVIDENTLY S IT IS HARDY BOARD, BUT DON'T YOU THINK WE ARE COMING DOWN A BIT OF A SLIPPERY SLOPE HERE.

UM, THE FOUNDING FATHERS ARE THOSE FOLKS WHO SET THE PARAMETERS FOR HUBER HEIGHTS HOMES, UH, MADE A CERTAIN AMOUNT OF PERCENTAGE.

I DON'T KNOW WHAT THE ORIGINAL PERCENTAGE WAS BACK IN THE FIFTIES WHEN THEY, THAT THAT SHOULD BE BRICK OR STONE OR, OR CEMENT, BUT EVER SINCE THEN, WE SEEM TO BE COMING DOWN A LITTLE BIT LESS THAN A LITTLE BIT LESS.

AND NOW WE'RE AT HARDY BOARD, THE APPEARANCE OF IT, CERTAINLY DOESN'T GO WITH HUBER HEIGHTS, THE MAJORITY OF THE HOMES.

AND SO THAT'S THE ONLY COMMENT I WOULD MAKE THAT WHAT'S GOING TO BE NEXT.

ARE WE GOING TO MIX A LITTLE OF CONCRETE AND CEMENT AND SMEARED ON PLYWOOD AND PUT IT UP? KNOW, NO, THIS IS, I'M A BIT CONCERNED ABOUT IT THOUGH.

IT MIGHT'VE BEEN APPROVED.

UM, THERE'S BEEN A LOT OF DISCUSSION RECENTLY IN THE US REGARDING SILVER OAKS CONSTRUCTION AND DISAPPOINTMENT IN WHAT THE

CITY SEEMS TO BE ALIVE.

I HAD WRITTEN A LETTER WHEN THE FIRST HOUSE WAS VINYL SIDED AND IT LOOKED LIKE THEY WERE NOT COMPLYING WITH THE 25% BRICK STONE OR MASONRY.

I WAS ASSURED THAT THE CITY WOULD NOT GIVE ANY FINAL PERMIT TO ANY NON-COMPLIANT CONSTRUCTION ON THAT HOUSE.

THEN ALL THE VINYL WAS PULLED OFF AND IT WAS COMPLETELY COVERED IN HARDY BOARD.

I UNDERSTAND THAT CODE ENFORCEMENT IN THE CITY MANAGER'S OFFICE HAS COMMUNICATED TO DR.

HORTON, THAT HARDY BOARD IS AN ACCEPTABLE MASONRY PRODUCT.

MY QUESTION ON THIS IS WHY HARDY BOARD IS COMPOSED OF CEMENT AND WOOD WOOD PULP.

GENERALLY IT IS NOT A 100% MASONRY PRODUCT.

IT IS A PRODUCT THAT IS CHEAPER THAN BRICK OR STONE, AND DOING FURTHER RESEARCH WITH THE NOD MR. SHAW, I TURNED TO THE CITY ORDINANCES ORDINANCE 11 81, 20 D THREE STATES THAT OTHER APPROVED MASONRY TYPES OF MATERIAL MEANS MASONRY MATERIAL APPROVED IN ADVANCE BY THE PLANNING COMMISSION.

SO AS TO BE HARMONIOUS AND APPROPRIATE IN APPEARANCE WITH THE EXISTING OR INTENDED CHARACTER OF THE GENERAL FACILITY VICINITY, SO THAT SUCH USE WILL NOT CHANGE THE ESSENTIAL CHARACTER OF THE SAME AREA.

I DON'T THINK MY NEIGHBORS AND I WOULD BE HERE BEFORE YOU, IF THIS PROJECT COMPLIED WITH THAT ORDINANCE, I'VE DONE EXTENSIVE RESEARCH ON THE OAKS REVIEWING MANY DOCUMENTS AND MINUTES, EVEN PRIOR TO THE FAMOUS ORDINANCE, 1405 OF 2003, I CAN SAY WITH CONFIDENCE THAT I'VE NEVER READ ANYTHING ABOUT HARDY BOARD, NOR HAVE I SEEN EVIDENCE OF USE IN THE OAKS NOR HAVE I SEEN THE TERM FIBER CEMENT BOARD IN CONNECTION WITH ANY EXTERIOR USE IN OUR COMMUNITY, TO THE BEST OF MY KNOWLEDGE, IT WAS NOT APPROVED IN ADVANCED BY THE PLANNING COMMISSION FOR USE IN THE OAKS.

MY BELIEF IS THAT THE INTENT OF HAVING OUR 2050 OR A 100%, UM, OF BRICK STONE OR MASONRY REQUIREMENT WAS TO PROHIBIT THE USE OF A FULLY CITING HOUSE, WHETHER IT'S VINYL OR IT'S HARDY BOARD, HUBER HEIGHTS HAS A REPUTATION OR A BRAND IN TODAY'S WORLD OF BEING A SOLID COMMUNITY, BUILT A BRICK OR STONE.

IT WOULD BE A SHAME TO DEVALUE THAT REPUTATION SO THAT BUILDERS CAN USE LESS COSTLY MATERIAL.

AT THIS TIME, I ASKED THE COUNCIL TO CONSIDER AN ORDINANCE THAT CLEARLY STATES THAT THE USE OF, FOR MY A FIBER CEMENT BOARD OR SIDING NOT BE ALLOWED TO BE COUNTED TOWARD ANY MASONRY REQUIREMENT.

IT'S NOT FULL MASONRY.

IT HAS WOOD IN IT.

I ALSO ASK THAT ANY MASONRY MATERIAL USED IN THE OAKS FOLLOW THE ORDINANCE 11 81, 20 D THREE, AND BE APPROVED ONLY IF IT IS HARMONIOUS AND APPROPRIATE IN THE APPEAL AND ITS APPEARANCE WITH THE ESSENTIAL CHARACTER OF THE OAKS.

UH, OBVIOUSLY THE CITY ATTORNEY COULD GIVE IT TO YOU, OR YOU COULD LOOK IT UP, UH, UNDER THE MICA MURRAY COUNTY PRO V2, UH, WEBSITE.

UH, AND THERE, I, UH, I KNOW THAT EIGHT VIOLATIONS AND ONE THREATENED VIOLATION OVER THERE.

AND, UH, ACTUALLY THE REASON THAT I CAME OVER HERE THOUGH, IS THAT BECAUSE I, UH, RECENTLY FILED ANOTHER DOCUMENT WHERE I WAS REFERENCING SOME OLD VIOLATIONS THAT OCCURRED PRIOR TO ONES THAT ARE WITHIN THE STATUTE OF LIMITATIONS.

AND, UH, THAT PROMPTED ME TO THINK ABOUT, UH, YOU KNOW, WHEN I WAS SKIPPING, UH, EXECUTIVE SESSIONS, BECAUSE I DIDN'T THINK THEY WERE APPROPRIATE THAT I WOULD HAVE PROBABLY JOINED A LAWSUIT IF SOMEBODY HAD FILED ONE, UH, AT THAT TIME TO HELP, UH, COMPEL COMPLIANCE.

THERE'S BEEN A LOT OF DISCUSSION OVER THE LAST COUPLE OF WEEKS ABOUT VARIOUS PROJECTS AND DEVELOPMENTS AROUND THE CITY TAKING ALMOST 11 OR 12 HOURS AT A TIME.

THE LAST TWO WORK SESSIONS ALONE FOCUSED ON, ON PARKS IN PARTICULAR.

BUT MY QUESTION IS THAT WE HAVE A PRETTY DEDICATED CITY STAFF OF PROFESSIONALS THAT ARE HIRED FOR THEIR WORKING KNOWLEDGE.

WE HAVE BOARDS AND COMMISSIONS THAT ARE USED TO ADVISE THAT ARE SUPPOSED TO BE, ESPECIALLY THE HIGHER STAFF LIKE THE PARKS AND REC DIRECTOR WENT TO SCHOOL FOR THAT WHO ARE ADVISING VARIOUS THINGS ALONG THE WAY FOR THE PROJECTS THAT DON'T SEEM TO BE GIVEN FULL CONSIDERATION.

AND I'M WONDERING KIND OF EXACTLY WHY, I MEAN, YOU TALKED ABOUT THINGS LIKE ELEVATION AND DRAINAGE AND FLOODING AND PROBLEMS THAT YET THE RESPONSE IS LET'S GO BIGGER IN AN AREA THAT THERE ALREADY IS A CONCERN ABOUT IF WE GO SMALLER, THERE'S GOING TO BE A PROBLEM.

SO SPECIFICALLY IN THE MANITA PARK LOCATION, THE CHURCH OVER THERE ALREADY HAD TO DIG A RETENTION POND BEFORE ANYTHING WAS EVER THOUGHT ABOUT, UM, BY THE, ANY OF THE PROJECTS THAT ARE CURRENTLY STARTED OR ANY POTENTIAL FUTURE ONES, HAS ANYBODY CONTACTED THE CHURCH TO FIND OUT WHAT THE STRESS ON THEIR NEW POND THAT THEY PUT IN THEMSELVES TO PREVENT FLOODING IS GOING TO BE, OR IF THEY HAVE ANY CONCERNS ABOUT ADDITIONAL RUNOFF SCOTT, UH, THE PARKS MANAGER HAS DISCUSSED, UH, THE PROJECT WITH THE NEIGHBORING, UH, CHURCH AND ANY FUTURE PLANS WILL INCLUDE A DRAINAGE PLAN BECAUSE I KNOW THAT WORD LIKE FLOODING FISHBIRD ROAD WAS BROUGHT UP AT THE LAST MEETING AS A POTENTIAL ISSUE.

AND WE'RE TALKING ABOUT GOING UP INTO THE HILL KIND OF FURTHER POSSIBLY IF THAT PROJECT GOES FORWARD, WHICH BRINGS ME TO MY NEXT QUESTION.

IS, IS THERE A PARTICULAR REASON WHY THERE'S A FOCUS ON REMOVING LITERALLY BASEBALL FIELDS FROM MANITA FIELD? I BRING THIS FROM A PERSONAL POINT.

I GREW UP IN LITTLE LEAGUE BASEBALL.

I STARTED WHEN I WAS VERY SMALL AND T-BALL WHEN ALL THE WAY UP THROUGH HIGH SCHOOL BALL.

AND I KNOW THERE'S DISCUSSION ABOUT UTILIZATION, BUT THE LAST TWO YEARS PROBABLY ARE NOT THE BEST TO KIND OF BE DISCUSSING WHETHER OR NOT OUR FIELD AREAS IN GENERAL ARE BEING UTILIZED VERY WELL.

AND I KNOW CURRENT PLANNING IS TALKING ABOUT REMOVING AT LEAST ONE FIELD, AND I'M GUESSING PROBABLY THE SECOND ONE IS ON THE TABLE AS WELL FOR, FOR SOMETHING ELSE.

MAYBE I DON'T KNOW, BUT IF YOU TAKE OUT ONE FIELD, WHY NOT GO FOR THE OTHER ONE? RIGHT.

BUT WHAT IS IT ABOUT LITERALLY BALL THAT IS ABLE TO BE PUT ON THE CHOPPING BLOCK RIGHT NOW?
