AND I LIVED HERE DURING THAT TIME AS MR. SEAN BURR WAS OUR FIRST MAYOR, DICK CHOMPER AND HIS SON, MATT AND I WERE EXTREMELY CLOSE FRIENDS IN HIGH SCHOOL. I DIDN'T KNOW MATT IN ELEMENTARY SCHOOL. UM, YOU KNOW, WHILE DICK BECAME THE MAYOR, I THINK MATT WENT TO MONTICELLO ELEMENTARY SCHOOL. THEY LIVED OVER OFF THE CITADEL, I BELIEVE. AND, UM, I REMEMBER BEING IN, YOU KNOW, UH, SEEING ALL THE CAMPAIGN SIGNS AND STUFF, YOU KNOW, FOR, FOR MR. SHOPPER. AND IT WAS JUST, THERE WAS JUST THIS WEIRD FEELING OF KNOWING HIM, BUT THEN HAVING THE OPPORTUNITY TO REALLY LEARN WHAT DICK SHOPPER AND, AND CHARLES HUBER AND, AND, UM, MR. MANITA, WHAT THEY DID FOR THIS CITY AT A TIME THAT WE WERE AT RISK OF BEING TAKEN OVER BY THE CITY OF DAYTON, UH, REALLY SEEMED TO BE KIND OF AN INSURMOUNTABLE TASK, BUT THEY, THEY WERE ABLE TO DO IT AND THEY, THEY PUT UP A FIGHT AND IT IS SOMETHING THAT I AM EXTREMELY PROUD OF. I'M EXTREMELY PROUD TO BE FRIENDS WITH MATT AND THE SHOPPER FAMILY AND KNOW THEM. AND I KNEW MR. SHOPPER BEFORE HE PASSED. AND I THINK ALL OF US TODAY IN THIS CITY ON THIS DAYAS IN THE AUDIENCE REALLY NEED TO THINK ABOUT WHAT THAT WAS LIKE FORMING A CITY. WE MIGHT STILL BE AT 40 YEARS OLD. I MEAN, THERE WERE LOTS OF DECISIONS. WE BECAME THE CITY AND ALL THESE RULES WE HAD TO ABIDE BY AND, AND LAWS AND ALL THIS LEGALITIES, WHAT ARE WE GOING TO DO? RIGHT. AND I'M JUST, I'M VERY HUMBLED TO BE HERE IN THIS SEAT, KNOWING WHAT OUR FORMER COUNCILS AND MAYORS HAVE DONE. AND, YOU KNOW, AGAIN, IT WAS, YOU KNOW, CHARLIE MANITA WAS JUST AN ADMINISTRATOR. THERE WAS NO CITY MANAGER THEN BECAUSE IT WASN'T THE CITY. HE WAS JUST AN ADMINISTRATOR FOR THE TOWNSHIP. THOSE GUYS REALLY PUT THE WORK INTO THIS PLACE AND WITH THE BACKING OF CHARLES SCHUMER, BUILDING HOUSES AND, AND, AND GROWING AND PEOPLE MOVING FROM DAYTON AND COMING TO THIS AREA REALLY SET, HE WRITES ON, ON A PATH OF SUCCESS AND IT WASN'T EASY. SO THE REQUEST IS TO REVISE THE BASIC DEVELOPMENT PLAN TO ALLOW FOR SINGLE FAMILY RESIDENTIAL, LOTS TO BE BUILT. THE ORIGINAL PLAN BACK IN 2003, HAD ALL JUST SINGLE FAMILY, RESIDENTIAL, UH, LOTS OF A COMBINATION OF YOUR STANDARD ONES. AND THEN UP AT THE NORTH, SOME ESTATE BOUGHT. SO THERE'S DIFFERENT SIZE, LOTS THAT WERE ORIGINALLY APPROVED. THE DEVELOPER CAME BACK THAT THERE WAS A REQUEST BY THE CHURCH TO BUY A PORTION OF THAT LAND. AND, UH, IN 2005, THE CITY COUNCIL APPROVED A NEW PLAN THAT SPLIT THIS PARCEL OFF THAT WOULD ALLOW FOR A CHURCH. AND THE REMAINDER OF THE DEVELOPMENT, UM, WAS FOR THAT SINGLE FAMILY, RESIDENTIAL. THIS WAS THE ORIGINAL RECORD PLUS TO THAT CAME FOR PLANNING, COMMISSION PLANNING COMMISSION. THEY CAME, UH, THE, THE APPLICANTS CAME BEFORE FOR A PRE-APPLICATION CONFERENCE. UM, GOT SOME FEEDBACK FROM PLANNING COMMISSION CAME BACK WITH AN ACTUAL SUBMITTAL PLANNING COMMISSION, UH, LISTENED TO THAT APPLICATION, HAD SOME QUESTIONS TABLE. THE MATTER THEY CAME BACK TO ANOTHER MEETING [00:45:01] AT PLANNING COMMISSION AND PLANNING COMMISSION RECOMMENDED APPROVAL FIVE TO ZERO INCENSE ON TO THE CITY COUNCIL PROCESS. CITY COUNCIL HAS HEARD THIS, UH, AT, UH, UH, TWO WORK SESSIONS NOW, AND THIS IS THE PUBLIC HEARING PORTION OF THE PROCESS, UH, TO BE ABLE TO MOVE FORWARD WITH, UH, THIS APPLICATION THROUGH THIS PROCESS FROM THE, UH, RECOMMENDATION FROM PLANNING COMMISSION WAS FOR THESE SINGLE FAMILY, LOTS WITH LANDSCAPES, MOUNDS, LANDSCAPE BUFFERS, COMPLETELY SURROUNDING THIS PROPERTY WITH PUBLIC SEWERS AND WATER THAT WOULD CONNECT INTO BELL FOUNTAIN ROAD AND FITCHBURG ROAD STORIES, WATER DRAINAGE, THAT THEY WILL BE CONSTRUCTING A NEW DETENTION BASIS, UM, AT THE NORTHEAST CORNER OF THE LOT THAT DETENTION BASIN IS ON A LOT THAT'S LARGER THAN THE DETENTION BASIN THAT IS DIRECTLY TO THE NORTH OF IT, THAT HAS MORE AREA GOING INTO IT FROM THE OAKS SUBDIVISION. SO THIS, UH, IT'S A, UM, WILL BE PROPERLY DESIGNED. IT'LL FOLLOW ALL OF THE CITY STANDARDS FOR DRAINAGE DESIGN. SOME OF THE CONCERNS BURNS THAT WERE BROUGHT UP ABOUT DRAINAGE IS THAT THIS PROPERTY ITSELF LET'S FLOW FROM WEST EAST AND DOES FLOW INTO THE REAR YARDS OF SOME OF THE NEIGHBORING PROPERTY WITH THAT MOUND THAT'S BEING PUT UP AND WITH THE STORM SEWER SYSTEM, THAT'S PUT INTO THE STREETS THAT DRAINAGE WILL NOW GO INTO THIS NEW DETENTION BASIN AND DIRECTED AWAY FROM THOSE RARE YARDS. SO THIS WILL IMPROVE THE OVERALL TRADING SITUATION IN THE WHOLE AREA. ALSO PART OF THIS IS FOR THE IMPROVEMENTS OF BELL FOUNTAIN AND FISH BURKE ROAD THAT, UH, THERE'LL BE WIDE INTO THE THIRD OR FAIR, UH, PLAN LIMITS OF THE FOUR CURBING AND SIDEWALK ALONG THOSE AREAS, AS PART OF IT, THE DISCUSSION IN THE WORK SESSIONS, UH, SOME OTHER CONCERNS THAT CAME UP, UM, WE'RE ABOUT MAINTENANCE OF THOSE MOUNDS, UM, THAT IS IN THE ORDINANCE ABOUT THE PROCESS OF, UH, CREATING THAT PUD AGREEMENT THAT WE'LL GO THROUGH, UH, FOR THE DETAILED DEVELOPMENT PLAN PHASE OF CREATING THAT DOCUMENT THAT GETS RECORDED, THAT DETAILS OUT A CONSERVATION EASEMENT AND, UH, HOW THAT GETS MAINTAINED TO MAKE SURE THAT THERE'S ALWAYS A MOUND WITH VEGETATION ON IT THROUGHOUT THE HISTORY, THREE OF THE DEVELOPMENT. YEAH. UM, SOME OTHER CONCERNS THAT ORIGINALLY THEY WERE TO GO FOR PRIVATE STREETS, BUT THEY HAVE, UH, UM, HEARD THE VOICES THAT WERE, UH, CONCERNED ABOUT THAT. AND THEY WILL BE DOING PUBLIC STREETS WITH SIDEWALKS ON ONE SIDE OF THE STREET. AND, UH, THERE'S A PLAN HERE. THE YELLOW LINE SHOWS, UH, THE SIDEWALK ON THE SIDE OF THE, THE NORTH SIDE AND ALSO ON THE SIDE WHERE THE GREEN SPACES IN THE CENTER OF THE PROJECT ITSELF. IN ADDITION TO THIS, UM, THERE WAS A CONCERN ABOUT DENSITY. THEY HAVE REQUESTED 46, UH, HOME BLONDES WITH THIS WHILE THEY WOULD STILL LIKE TO REMAIN TO HAVE 46 HOME LOTS. THEY HAVE, UH, BEEN WILLING TO GO DOWN TO 41. SO THIS PLAN SHOWS BEFORE YOU HAS 41 HOME, LOTS ON IT. THE SETBACKS FOR THIS IS 25 FOOT FRONT YARDS ON THE YARDS THAT HAVE THE SIDEWALKS AND 20 FOOT FRONT YARDS WHERE YOU DO NOT HAVE SIDEWALKS. THAT WAS A CONCERN THAT WAS BROUGHT UP ABOUT PARKING IN THE DRIVEWAY, IF YOU HAD A SIDEWALK. SO THIS ANSWERS THAT QUESTION SIDE YARD, SETBACKS, 10 FOOT ON EACH SIDE THAT MATCHES THE SUBDIVISION OF SPACING IN BETWEEN HOUSES, THE REAR SETBACK ON THE LOTS THAT ARE ADJACENT TO EXISTING LOCKS. THERE IS A 40 FOOT REAR SETBACK THAT IS THE SAME SETBACK AS WHAT'S IN THE SUBDIVISION. OTHER AREAS WOULD HAVE SMALLER, UH, DEPENDING ON WHAT'S BEHIND IT, THE ONES THAT BACK UP TO THE OPEN SPACE AS A SMALLER REAR YARD, BUT THEY HAVE OPEN SPACE BEHIND THEM. THERE WILL BE MOUNTING AND LANDSCAPING ALONG FITCHBURG A, UM, UH, BELL FOUNTAIN AS WELL. NOW MOVE FORWARD. THIS IS AN EXAMPLE OF WHAT'S OUT IN FRONT OF THE OAKS CURRENTLY, AND THIS IS THE SAME PROPOSAL THAT THEY WOULD HAVE THE HOUSES THEMSELVES, UH, TH THAT THEY AREN'T PROPOSING. THESE ARE LARGER THAN THE MINIMUMS THAT ARE IN THE OAKS SUBDIVISION NOW. AND THEY ARE A, UH, LESS WIDE PRODUCT, BUT A DEEPER PRODUCT. AND THEY HAVE IT SET UP WHERE THE SIDE YARD, THE SIDE ENTRANCE IS WHERE PATIO WOULD GO. SO MOST OF THE, UH, GATHERING SPACE IS ON THE SIDE, EVEN THOUGH ON THOSE LOTS THAT ARE ADJACENT TO EXISTING, THEY STILL HAVE A 40 FOOT REAR YARD, UM, AS WELL, THE [00:50:01] BUILDING MATERIALS, UM, THEY'RE LOOKING TO DO THE MASONRY REQUIREMENT. IT'S JUST LIKE IN THE HOUSE, HERE'S JUST AN EXAMPLE OF A ON WHITE OAK WAY. SOME OF THE HOUSES THAT YOU SEE THAT HAS THAT MASONRY ON THE, AND THE SIDING ON THE SIDE AT PLANNING COMMISSION, UM, WE HAD RECEIVED, UH, QUITE A FEW EMAILS FROM NEIGHBORS, AND WE WANTED TO MAKE SURE THAT THE VOICES WERE HEARD AND WE WEREN'T HAVING THE IN-PERSON PUBLIC HEARING MEETINGS. THE FIRST THING THAT CAUGHT MY EYE WHEN WE STARTED DRIVING ARE THE NEIGHBORHOOD WASN'T FULLY DEVELOPED, BUT EVERYBODY WAVED. IT WAS LIKE, WHAT'S GOING ON DAY. HE WAVED EVERYBODY WELCOMED. BUT WHEN WE PICKED THE OAKS OF HUBER HEIGHTS, WE WERE LOOKING AT A COUNTRYSIDE SETTING WHERE OUR KIDS COULD GROW TOGETHER, WALK DOWN THE SIDEWALKS, PLAY IN THE STREETS, WALK TO THE FARMER'S MARKET AND HAVE A BEAUTIFUL NEIGHBORHOOD WHERE THE HOMES ARE FAIRLY SET, NOT TO BE SNOBBISH, BUT IN A CERTAIN WAY, WE WORKED OUR WHOLE LIVES. MY HUSBAND AND I, 20 YEARS ACTIVE DUTY HAS BEEN IN DAYTON. CHILDREN'S FOR 24 YEARS. I WORKED FOR PREMIER. WE HAVE ROOTS PLANTED TO GROW, BUT THERE WILL BE TIMES WHEN SOME OF OUR PEOPLE IN OUR COMMUNITY WANT TO MOVE OR HAVE TO MOVE. AND WHEN PEOPLE ARE DRIVING AROUND LOOKING FOR A NEIGHBORHOOD WITH THE SAME VISION THAT WE HAVE OF WHAT A NEIGHBORHOOD SHOULD LOOK LIKE, AND THEY SEE THIS CONDENSED VERSION OF A HOUSING AREA WHERE THE HOUSES ARE CLOSE TOGETHER. AND THERE'S NOT ALL OF THAT COMMUNITY AND AREA FOR FAMILIES TO GROW, THEY'RE GOING TO LOOK AT OURS AND SAY, YEAH, THAT WOULD BE GREAT. BUT, AND THAT'S WHY WE SAY OUR VALUES OF OUR HOMES WILL GO DOWN. IT'S NOT BECAUSE YOUR HOMES AREN'T BEAUTIFUL OR THAT THEY'RE NOT VALUABLE. THEY JUST DON'T MEET THE NEIGHBORHOOD SETTING THAT WE'VE GROWN TO HAVE, AND THAT WE'VE GROWN TO LOVE. MY PREVIOUS LETTER SUBMITTED TO THE COUNCIL AT THE WORK SESSION DETAILED THE OVER 54% INCREASE IN DENSITY THAT THIS PROPOSED PROJECT HAS OVER THE DENSITY OF THE REMAINDER OF OUR PLAN PRO DEVELOPMENT. I UNDERSTAND THEY'RE DOING A PRESENTATION NOW AND REDUCING THAT FROM 46 TO 41, WHICH, BECAUSE I'M A MATH GIRL, THAT'S STILL A 37% INCREASE IN DENSITY. SO THE EXAMPLE THAT I GAVE YOU OF MY LOVELY STREET WITH SIX HOUSES AND A 54% DENSITY WOULD INCREASE IT TO NINE, RATHER THAN SIX 37% WOULD INCREASE IT TO EIGHT, RATHER THAN THE SIX. IT'S STILL A HUGE INCREASE IN DENSITY. SO I WANT TO TALK TO WHAT I'VE SEEN AN INCREASE OF DENSITY DUE TO A CITY. WE'RE A MILITARY FAMILY, AND WE'VE MOVED MORE THAN 20 TIMES AND LIVED IN MANY DIFFERENT AREAS, IN MANY DIFFERENT KINDS OF LIVING SITUATIONS. THERE IS A CITY THAT WE'VE KNOWN FOR OVER 30 YEARS. THE FIRST TIME WE LIVED THERE, WE CHOSE IT DUE TO ITS OUTSTANDING SCHOOLS AND FAMILY-FRIENDLY REPUTATION. WHAT DOES THAT SOUND LIKE? THE CITY HAS ITS OWN SCHOOL DISTRICT AND PEOPLE FROM OTHER DISTRICTS WOULD LINE UP TO TRY TO GET THEIR CHILDREN AND OUT OF DISTRICT TRANSFER INTO OUR, INTO OUR SCHOOL DISTRICT. THERE'S GREAT [01:25:01] COMMUNITY INVOLVEMENT, A SCHOOL FOUNDATION THAT RAISED MONEY FOR THOSE EXTRAS THAT FEDERAL AND STATE MONIES DON'T COVER. AND WHEN THERE WAS A SCHOOL MILLAGE ON, ON THE VOTE, IT ALMOST ALWAYS PASSED. OR THE YEARS THINGS CHANGED AT FIRST, PEOPLE WERE BUILDING SMALL RENTAL UNITS OVER THE GARAGE. THEN THEY SPLIT BLOCK AND ACTUALLY BUILT A SECOND HOUSE. LATER, LOTS GOT SPLIT LENGTHWISE AND TWO HOUSES BUILT ON ONE LOT HUGE HOUSES THAT COVERED EVERY AVAILABLE INCH OF LAND GOING TO WHAT THE CITY RESTRICTIONS WERE. IF IT WAS FIVE FEET, YOU CAN BET IT WAS EXACTLY ON FIVE FEET. IT WAS HIGHLY DESIRABLE. AND ONCE YOU COULD BUILD TWO HOUSES ON ONE, ONE LOT INVESTORS MOVED IN. AND WHAT WAS THE RESULT OF CHANGING FROM A MAINLY OWNER OCCUPIED ONE SINGLE HOME PRO, LOT MOVING TO A HIGHER DENSITY WITH RENTALS, MORE INVESTORS, WELL INVESTORS MAY OR MAY NOT LIVE IN YOUR CITY, AND THEY'RE NOT INTERESTED IN ANYTHING THAT WOULD AFFECT THEIR BOTTOM LINE, LIKE INCREASED TAXES TO IMPROVE YOUR SCHOOLS OR ANY OTHER CITY SERVICES RENDERED. HELLO, RENTERS. SEE THOSE THINGS AS, AS SOMETHING THAT WILL BE PASSED ALONG AS INCREASED RENT, THE CITY BECAME MORE RENTALS AND, AND OFTEN VACATION HOMES. AGAIN, NOT PEOPLE INTERESTED IN IMPROVING THE CITY. IF YOU LOOK AT A SATELLITE VIEW OF THAT CITY TODAY, ONE SECTION, YOU SEE TWO BOXES ON EVERY LOT. THAT'S AN ALLEY HOUSE. AND THE OTHER SECTION WHERE THEY DIVIDED LENGTHWISE WILL THAT LOOKS LIKE SHIPPING CONTAINERS LINED UP AS TIGHTLY AS POSSIBLE. WE VISITED JUST THREE YEARS AGO AND IT WAS TOTALLY ALIEN FROM WHAT WE KNEW. THERE WAS NO WALKING DOWN THE STREET, WAVING AT PEOPLE. THERE WAS TRAFFIC CONGESTION. THERE WAS RESTRICTED PARKING AND RESIDENTIAL STREETS AND HOUSES AS CLOSE TOGETHER AS POSSIBLE UNRECOGNIZABLE. AND THAT SUPERIOR SCHOOL DISTRICT THAT I MENTIONED EARLIER, WHERE THE MILLAGES GOT VOTED IN THE FOUNDATION WORK THAT WAS DONE. THAT'S NOW WHAT IT WAS. THAT'S NO LONGER WHAT IT USED TO BE. EITHER NOBODY'S TRYING TO GET IN. NOW, THEY DON'T EVEN HAVE ENOUGH STUDENTS TO GET THE MAXIMUM FEDERAL MONIES AS A SCHOOL ISN'T RATED AS HIGHLY AS IT WAS. MANY OF THE FAMILIES SEND THEIR CHILDREN TO PRIVATE SCHOOLS AND THOSE CITIZENS DON'T VOTE TO RAISE TAXES FOR SCHOOLS, EITHER IN SHORT, THE IDENTITY OF WHAT IT WAS IS GONE AND WHAT CAUSED THE CHANGE. I SUBMIT THAT IT WAS NOT HAVING A LONG-TERM VISION OF WHAT INCREASES IN DENSITY CAN DO. SOME OF MY OTHER CONCERNS ARE UNFORTUNATELY, WHEN YOU CHANGE OR MAKE AN ASSUMPTION TO A STANDARD, IT'S NOT REALLY A ONE-TIME THING. THE PRECEDENT WILL BE USED TO FURTHER ERODE THAT ORIGINAL STANDARD. WE SEE THAT WITH MR. KOHLER AND MRS. WANG'S REPEATED COMPARISON TO ARTISAN WALK IN AN ATTEMPT TO JUSTIFY THEIR PROJECT. I TRULY HOPE THE COUNCIL WILL LISTEN TO THE PLEAS OF THE CITIZENS NOT TO ALLOW THIS PROJECT. AS IT STANDS WITH ITS SPIRIT DENSITY OF THIS PARCEL. IT IS WITHIN OUR PLAN DEVELOPMENT. THIS IS NOT AN A BUDDING PROPERTY LIKE ARTISTS AND WALKS IS TO KILL MIRROR FARMS. WHEN OUR PLAN DEVELOPMENT WAS DESIGNED, IT MAINTAINED A VISION OF A CONSTANT DENSITY THROUGHOUT THAT INTENT IS FIRMLY DEMONSTRATED BY THE ORIGINAL MASTER PLAN.
