YOU READY, MARK?

[00:00:04]

GOOD EVENING EVERYONE.

[1. Call The Meeting To Order - Mayor Jeff Gore]

WELCOME TO THE CITY OF HEBREW HEIGHTS CITY COUNCIL MEETING.

THIS IS A REGULAR SESSION.

TODAY'S DATE IS OCTOBER 28TH, 2024.

WE'RE GETTING STARTED RIGHT AT 6:00 PM THIS MEETING IS OFFICIALLY CALLED TO ORDER.

AND NEXT WE HAVE OUR INVOCATION THIS

[2. Invocation - Pastor Randy Griffith Of The Free Methodist Church At 6875 Old Troy Pike, Huber Heights, Ohio]

EVENING BY PASTOR RANDY GRIFFITH OF THE FREE METHODIST CHURCH AT 68 75 OLD TROY PIKE HERE IN NEIGHBORHOOD.

IT'S PASTOR GRIFFITH.

GOOD TO SEE YOU, SIR.

YOU TOO.

FROM THE BOOK OF JEREMIAH, THIS IS WHAT THE LORD SAYS, LET NOT THE WISE BOAST OF THEIR WISDOM OR THE STRONG BOAST OF THEIR STRENGTH OR THE RICH BOAST OF THEIR RICHES WILL LET THOSE WHO BOAST, BOAST ABOUT THIS, THAT THEY UNDERSTAND AND KNOW ME, THAT I AM THE LORD WHO EXERCISES KINDNESS, JUSTICE, AND RIGHTEOUSNESS ON EARTH.

FOR IN THESE I DELIGHT DECLARES THE LORD.

WHY IS IT THAT AMONG ALL THE POLITICAL ADS THAT ARE BEING RUN TO BUILD UP ONE CANDIDATE AND TEAR DOWN ANOTHER, WE RARELY EVER SEE OR HEAR THEM SAY ANYTHING ABOUT WHAT THE LORD WANTS AND WHAT THE LORD DOESN'T WANT.

COULD IT BE THAT THE MAJORITY DO NOT REALIZE THAT THE LORD NEVER GAVE ANYONE, ANY PEOPLE OR POLITICIANS, OR GOVERNMENTS OR ANY NATION FOR THAT MATTER, THE PERMISSION TO IGNORE HIM IN HIS WORDS AND WHAT HAVE HISTORICALLY BEEN THE CONSEQUENCES OF THOSE WHO HAVE IGNORED HIM, NOT GOOD.

AND THAT IS NOT WHAT GOD WANTS FOR US AS INDIVIDUALS OR AS A NATION.

AND TO THIS IDEA, DAVID WROTE, LORD, WHO MAY DWELL IN YOUR PRESENCE, WHO MAY BE WHERE YOU ARE, THOSE WHOSE WALK IS BLAMELESS AND WHO DO WHAT IS RIGHTEOUS, WHO SPEAK THE TRUTH FROM THEIR HEART AND HAVE NO SLANDER ON THEIR TONGUE, WHO DO THEIR NEIGHBOR NO WRONG AND CAST NO SLUR ON THEIR FELLOW MAN WHO DESPISE WICKEDNESS, BUT HONOR THOSE WHO FEAR THE LORD, WHO KEEP THEIR PROMISES EVEN WHEN IT HURTS, WHO LEND MONEY WITHOUT EXCESSIVE FEES AND ACCEPT NO BRIBES.

THOSE WHO DO THESE THINGS WILL NEVER BE SHAKEN.

LET'S PRAY.

FATHER, HELP US TO BE A NATION AND A PEOPLE THAT ALIGN WITH YOU AND YOUR WILL BECAUSE IT'S PERFECT AND GOOD.

AND LORD, BY YOUR HOLY SPIRIT, WORK IN US TO MAKE THAT POSSIBLE THROUGH CHRIST.

IT'S IN, IN HIS NAME WE PRAY.

AMEN.

AMEN.

LORD.

[00:15:05]

LET'S SEE, OKAY, SO NEXT IS ITEM NUMBER EIGHT, WHICH IS CITIZEN COMMENTS FOR AGENDA ITEMS. I HAVE NONE THIS EVENING, MAYOR.

OKAY, THANK YOU.

AND NEXT SAYS UP,

[9. City Manager Report]

UH, ITEM NUMBER NINE, WHICH IS THE CITY MANAGER REPORT.

SO JOHN, WE'LL NOW MOVE IT OVER TO YOU, SIR.

YES SIR.

MAYOR AND COUNCIL, I GOT A COUPLE THINGS HERE TONIGHT, UH, JUST AS REMINDERS.

UM, AND THEN I'M ACTUALLY GONNA TRY SOMETHING A LITTLE DIFFERENT.

MR. WEBB GONNA TRY AND SHOW YOU A VIDEO TOO HERE IN A MINUTE, SO WE'LL SEE IF THIS WORKS.

, UM, JUST A REMINDER THAT WE ARE GOING TO, UH, SHUT DOWN THE, UM, PUBLIC WORKS SITE, UM, THIS THURSDAY, SO IT'LL BE OPEN UNTIL THURSDAY.

WE DO HAVE THE, UH, DRIVEWAY IN FOR THE NEW SITE ALREADY.

I WAS DOWN THERE ON FRIDAY, CHECKING OUT THE NEW SITE.

UM, THE FENCE HAS BEEN MOVED AND WE'RE READY TO TRANSITION TO THAT, UH, NEW SITE HERE, FIRST, FIRST WEEK OF NOVEMBER FOR LEAF PICKUP.

SO ALSO JUST REMEMBER LEAF PICKUP DOES START, UH, NEXT MONDAY.

UH, WE ARE GONNA POST ON THE WEBSITE, WE'LL HAVE SOME POSTS OUT THAT SHOW WHAT SECTIONS WE'RE IN, WHERE WE'RE HEADED, UM, AND THEN THE HOPE IS FOR PUBLIC WORKS TO GET THROUGH, UH, TWO PASSES OF THE CITY, UM, UH, DURING LEAF SEASON HERE.

SO, UH, ACTUALLY BACK UP FOR JUST A SECOND.

SOMEONE ASKED LAST WEEK, THE GUIDELINES ARE ON THE WEBSITE.

THEY ARE ACCURATE AND CURRENT, SO JUST MAKE SURE IF ANYBODY'S GOT ANY QUESTIONS.

UM, THE GUIDELINES ARE ON THERE FOR THE LEAVES, ALSO THE FOOD TRUCK RALLY FOR NOVEMBER 2ND.

I KNOW WE HAD SOME, UH, QUESTIONS LAST TIME ABOUT WHAT FOOD TRUCKS WILL BE THERE.

UM, THIS IS THE CURRENT LIST THAT WE HAVE CURRENTLY.

UM, THIS WILL BE NOVEMBER 2ND AT, UH, CLOUD PARK FROM NOON TO SEVEN.

UM, AND, UM, LOOK FOR EVERYBODY TO BE OUT THERE, FOOD TRUCK RALLY AND HAVE SOME GOOD FOOD.

WE DO HAVE A MEETING NOTICE FOR TOMORROW, UH, THE 29TH.

THIS IS FOR THE CHARTER REVIEW COMMISSION.

UM, THIS IS JUST A, UM, INFORMATIONAL MEETING.

UH, WE'VE HAD A COUPLE OF THESE, THIS IS THE WEEK BEFORE THE ELECTION, SO WE'RE GONNA HAVE ONE MORE MEETING JUST TO TRY AND GET THE WORD OUT.

UM, ANSWER ANY QUESTIONS WE HAVE.

TONY AND I BOTH HAVE BEEN GETTING QUITE A FEW PHONE CALLS.

UM, SO WE THOUGHT IT WAS IMPORTANT TO JUST KIND OF, UH, PUT A LITTLE BIT OF, UM, INFORMATION OUT THERE.

SO PART OF THAT IS JUST, UH, PART OF MY REPORT IS JUST TO REMIND EVERYBODY WHAT THE AMENDMENTS ARE.

UM, SO A COUPLE JUST REVIEW POINTS.

THESE AREN'T IN DEPTH.

UH, THERE'S A LOT OF INFORMATION ON OUR WEBSITE.

WE'VE HAD SOME REALLY GOOD SOCIAL MEDIA POSTS, BUT, UH, JUST REMEMBER THE CHARTER AMENDMENTS THAT EXIST RIGHT NOW, UM, FOR BOTH MONTGOMERY COUNTY AND MIAMI COUNTY.

UH, IT'S THE MAYOR'S VOTING RIGHTS AND THEN THE VETO REMOVAL OF THAT.

UM, WE HAVE LIMITING INCUMBENT CANDIDACIES THAT WOULD BE THAT, UH, SAFE SEAT, UM, UH, AMENDMENT THAT WAS ON THERE.

ATTENDANCE REQUIREMENTS, WHICH WOULD BE THE, UM, THREE UNEXCUSED ABSENCES, THE MODERN MODERNIZING OF PUBLIC NOTIFICATIONS FOR TONY SO HE COULD, UH, MAKE THINGS A LITTLE BIT QUICKER.

UH, GET NOTIFICATIONS OUT.

AND THEN CITY MAN, CITY MANAGER RESIDENCY IS ALSO ON THERE.

SO WITH THAT BEING SAID, UH, I DID THINK IT WAS IMPORTANT.

WE'VE GOT A VIDEO OUT THERE.

WE'VE SHOWN IT ON, IT'S ON OUR WEBSITE, IT'S ON FACEBOOK, SO I'M ACTUALLY HOPING THIS PLAYS.

SO WE'LL SEE.

YOUR LOCAL CHARTER IS REQUIRED TO BE REVIEWED AT MINIMUM EVERY 10 YEARS, MAKING IT OPEN TO AMENDMENTS.

NOVEMBER FIFTH'S BALLOT FEATURES FIVE ISSUES, ALL INTENDED TO ENSURE THAT YOUR LOCAL GOVERNMENT STAYS CURRENT, RESPONSIVE AND ACCOUNTABLE TO THE NEEDS OF THE COMMUNITY.

THIS YEAR, THERE ARE FIVE PROPOSED AMENDMENTS ON THE BALLOT.

EACH ONE OFFERS VOTERS LIKE YOU THE CHANCE TO REMAIN IN INFORMED AND EMPOWERED WITHIN YOUR LOCAL GOVERNMENT.

ISSUE NINE CHANGES THE MAYOR'S ROLE.

INSTEAD OF THE MAYOR HAVING VETO POWER AND ABSTAINING FROM REGULAR VOTES, THEY WILL NOW PARTICIPATE IN EVERY VOTE, JUST LIKE THE OTHER COUNCIL MEMBERS.

THIS STRENGTHENS THE ACCOUNTABILITY OF THE MAYOR'S OFFICE BY REMOVING THE VETO POWER AND INCORPORATING THE MAYOR INTO ALL DECISIONS.

ISSUE 10 STATES THAT NO COUNCIL MEMBER MAY RUN FOR A NEW SEAT WHILE HOLDING THEIR CURRENT ONE UNLESS THEY ARE IN THE FINAL YEAR OF THEIR TERM.

THIS IS DESIGNED TO ENSURE THAT YOUR ELECTED OFFICIALS REMAIN COMMITTED TO THE POSITION YOU VOTED THEM INTO.

ISSUE 11 INTRODUCES A RULE THAT ANY COUNCIL MEMBER WHO HAS THREE UNEXCUSED ABSENCES FROM COUNCIL MEETINGS COULD BE REMOVED FROM THEIR SEAT.

THIS FOSTERS ACCOUNTABILITY AND REINFORCES THE IMPORTANCE OF PARTICIPATION IN GOVERNMENT DUTIES.

ISSUE 12 AIMS TO MODERNIZE HOW YOUR LOCAL GOVERNMENT COMMUNICATES WITH YOU BY UPDATING INFORMATION SHARING METHODS, THE GOAL IS TO PROVIDE YOU WITH QUICKER AND MORE RELIABLE ACCESS TO IMPORTANT COMMUNITY UPDATES.

LASTLY, ISSUE 13 REMOVES THE RESIDENCY REQUIREMENT FOR THE CITY MANAGER POSITION.

THIS ALIGNS THE CITY'S POLICY WITH STATE LAW, ALLOWING HUBER HEIGHTS TO STAY UP TO DATE AND COMPETITIVE IN HIRING PRACTICES WHILE STILL MAINTAINING A PROFESSIONAL AND QUALIFIED LEADERSHIP TEAM.

BY VOTING ON THESE AMENDMENTS, YOU'RE HELPING SHAPE THE FUTURE OF YOUR LOCAL GOVERNMENT AND ENSURING IT SERVES YOU MORE EFFECTIVELY.

[00:20:05]

AND WITH THAT, I'LL JUST SAY, UH, REALLY JUST STRONG WORK, I THINK BY THE COMMISSION.

UM, I WAS INVOLVED FROM THE BEGINNING, BUT, UH, OUR CITIZENS AND, AND THE MAKEUP THAT WE HAD FROM THAT COMMISSION, I JUST, I WANNA GIVE THEM A SHOUT OUT.

THEY DID A GREAT JOB.

SO THANKS SEAN.

I'LL TAKE ANY QUESTIONS.

ANY QUESTIONS FOR JOHN? YES, CHRIS? UH, IF I COULD ADD IN, IN INFORMATIVE PIECES LIKE THAT, IT'S REALLY IMPOSSIBLE TO GET EVERYTHING IN BUNDLED IN THERE.

SURE.

BUT ON THE ISSUE AS IT RELATES TO READ THE RESIDENCY REQUIREMENT, THAT'S CURRENTLY IN THE CHARTER, UH, THAT VIOLATES OHIO LAW, UH, AND IT'S CLEAR AND UNEQUIVOCAL, THE OHIO SUPREME COURT RULED THAT THERE CAN BE NO RESIDENCY REQUIREMENTS.

HOWEVER, A CITY OR COMMUNITY CAN CONTRACTUALLY OBLIGATE IF THE MANAGER AGREES TO LIVE HERE.

SO THERE ARE MEANS TO, TO ACCOMPLISH THE GOAL OF HAVING KEY MUNICIPAL EMPLOYEES STILL LIVE WITHIN THE, UH, CORPORATE LIMITS OF THAT MUNICIPALITY THROUGH CONTRACTS AND OTHER MEANS.

IT'S JUST, YOU CAN'T MANDATE IT BECAUSE THAT DOES VIOLATE LAW, BUT YOU ONE CAN CONTRACT.

SO I JUST WANTED TO MAKE THAT CLEAR.

THANKS CHRIS.

ANY OTHER QUESTIONS? COMMENTS? OKAY.

NEXT WE'LL MOVE TO ITEM NUMBER

[ An Ordinance Approving The Editing And Inclusion Of Certain Ordinances And/Or Resolutions As Parts Of The Various Component Codes Of The City Code Of Huber Heights, Ohio; Providing For The Adoption And Publication Of New Matter In The Updated And Revised City Code As Supplement 18; And Repealing Ordinances And Resolutions In Conflict Therewith. [12. Citizens Comments - General]

CITIZENS COMMENTS TO JUST HAVE ONE THIS EVENING.

MR. JEFF MORFORD, COULD YOU PLEASE COME TO THE VERDICT? UH, GOOD EVENING.

JEFF MORFORD, BETHEL TOWNSHIP, MIAMI COUNTY.

I'LL CALL FOR FREEDOM.

FREEDOM, FREEDOM.

IF I MAY CONTINUE MY COMMENTS FROM LAST MEETING, 20 YEARS INTO THE FUTURE WHEN MANY OF US WILL BE DEAD AND GONE, THE HUBER HEIGHTS CITY COUNCIL MEMBERS WILL BE QUESTIONED IN REGARDS TO THE PROBLEMS THESE ANNEXATION DEVELOPMENTS HAVE CREATED.

THE NEW CITY COUNCIL MEMBERS WILL ACKNOWLEDGE THE PROBLEMS, BUT LIKE MANY POLITICIANS, THEY WILL EXPLAIN THAT WAS MISTAKES MADE BY PAST LEADERSHIP.

WE CAN'T BE HELD RESPONSIBLE.

WE JUST LIKE THE 2024 LEADERSHIP, HAVE TO LOOK FOR SOLUTIONS AGAINST SOLUTIONS NEEDED BECAUSE OF PROBLEMS CREATED BY PAST LEADERSHIP.

AND IF NOT FOR THE PROBLEMS CREATED BY HUBER HEIGHTS PAST LEADERSHIP, NO SOLUTION WOULD BE NEEDED.

I'LL REPEAT A COUPLE OF LINES FROM LAST WEEK'S COMMENTS 'CAUSE I BELIEVE THEY ARE VERY IMPORTANT.

HOWEVER, READ TO YOU FROM A SPEECH FROM THE UNITED STATES ATTORNEY GENERAL MERRICK GARLAND, DATED THURSDAY, SEPTEMBER 12TH, 2020 24.

I WILL ACKNOWLEDGE THAT HIS SPEECH WAS NOT DIRECTLY RELATING TO ANNEXATION, BUT ADDRESSES POLITICAL EVENTS.

BUT THE THEME IS RELEVANT.

QUOTE, THERE IS NOT ONE RULE FOR FRIENDS AND ANOTHER FOR FOES.

ONE RULE FOR THE POWERFUL AND ANOTHER FOR THE POWERLESS.

ONE RULE FOR THE RICH AND ANOTHER FOR THE POOR.

ONE RULE FOR THE DEMOCRATS AND ANOTHER FOR THE REPUBLICANS.

OR DIFFERENT RULES DEPENDING ON ONE'S RACE.

ITY END OF QUOTE.

IF I CAN ADD TO THAT TRAIN OF THOUGHT, NOT ONE RULE FOR THOSE LIVING IN CITIES AND ANOTHER FOR CITIZENS LIVING IN RURAL TOWNSHIPS.

NOT ONE RULE FOR THOSE WHO PREFER URBANIZATION.

AND ANOTHER RULE FOR THOSE WANTING TO PRESERVE, PROTECT THE RURAL WAY OF LIFE.

IN MY OPINION, THE UNITED STATES CONSTITUTION GIVES ALL CITIZENS THE RIGHT TO VOTE FOR CANDIDATES AND ON ISSUES THAT AFFECT THE INDIVIDUAL CITIZENS.

I WOULD HOPE THIS OPINION WOULD BE SHARED, SUPPORTED, AND PROTECTED BY ALL AMERICANS WHO BELIEVE IN DEMOCRACY.

BUT APPARENTLY I'M WRONG.

IN THIS INSTANCE, WHEN GREED AND INHIBITION ARE FACTORED IN THE RIGHTS OF CITIZENS, THE RIGHT TO BE REPRESENTED AND THE RIGHT TO VOTE BE DAMNED.

YOU HAVE ALIGNED YOURSELF WITH THIS BELIEF HIDING BEHIND THE THOUGHT THAT IT'S THE LAW.

WHILE THERE HAVE BEEN MANY LAWS OVER THE YEARS THAT HAVE BEEN PROVEN TO BE UNJUST, JUST BECAUSE IT'S THE LAW DOES NOT MAKE IT RIGHT.

YOU HAVE ENJOYED YOUR FREEDOM TO INVESTIGATE AT GREAT LENGTH AND VOTE TO ACCEPT ANNEXATION DEVELOPMENTS.

BUT YOUR FREEDOM TO VOTE HAS BEEN AT THE EXPENSE OF YOUR NEIGHBORS IN BETHEL TOWNSHIP WHO ARE NOT PROVIDED THE SAME FREEDOMS. WE ARE ALL US CITIZENS THAT SHOULD HAVE THE SAME BASIC RIGHTS SLASH FREEDOMS. BUT BECAUSE YOU HAVE SEEN THAT ANNEXATION DEVELOPMENTS IS PROFITABLE, YOU HAVE CHOSEN TO OVERLOOK THIS FACT BEING BLINDED BY GREED AND AMBITION.

YOU HAVE CHOSEN TO IGNORE THE TRUTH AND HAVE FAILED YOUR COMMUNITY.

YOU HAVE FAILED AS COMPASSIONATE HUMAN BEINGS.

THE CONSTITUTION OF THE UNITED STATES HAS SEVEN ARTICLES AND SUBSEQUENT SECTIONS FROM 1787.

THE CONSTITUTION HAS 27 AMENDMENTS.

THE SUBSEQUENT SECTIONS DATED 1791.

THE FIRST AMENDMENT CONGRESS SHALL MAKE NO LAW OF RESPECTING AN ESTABLISHMENT OR RELIGION OR PROHIBITING THE FREE EXERCISE THEREOF OR ABRIDGE THE FREEDOM OF SPEECH OR OF THE PRESS OR THE RIGHT OF PEOPLE TO PEACEFULLY ASSEMBLE AND TO PETITION THE GOVERNMENT FOR A REDRESS OF GRIEVANCES.

TODAY, OVER 200 YEARS LATER, CITIZENS TAKE THESE RIGHTS FOR GRANTED.

IF YOU ASK THE AVERAGE CITIZEN ABOUT THE FIRST AMENDMENT AS IT RELATES TO RELIGION, MOST WILL SUGGEST THAT THE INDIVIDUAL IS FREE TO BELIEVE IN THE RELIGION OF THEIR CHOICE, GO TO A PLACE OF WORSHIP OF THEIR CHOICE TO GATHER WITH LIKE-MINDED INDIVIDUALS TO WORSHIP AND PRACTICE THEIR RELIGION.

EVEN TO THE POINT OF NOT BELIEVING IN A RELIGION

[00:35:02]

IS YOUR CHOICE AND ACCEPTABLE IS CALLED FREEDOM.

BUT BACK WHEN THE CONSTITUTION WAS RATIFIED THAT NEW AMERICAN CITIZENS WERE WELL ACQUAINTED WITH MANY EUROPEAN COUNTRIES WHERE THE GOVERNMENT DICTATED HOW AND WHAT YOUR RELIGIOUS BELIEFS WOULD BE.

YOU HAD NO CHOICE.

IF YOU DISAGREED OR OBJECTED, YOU WOULD BE PERSECUTED.

SO THE REAL AND ORIGINAL THOUGHT WAS THAT THE GOVERNMENT WOULD NOT BE ALLOWED TO DICTATE INDIVIDUAL'S RELIGIOUS DIRECTION.

AN IDEA WHICH HAS SERVED AMERICA'S AMERICANS WILL, I WILL LOOK AND RELATE TO THE ANNEXATION LAWS OF SIMILAR LIGHT.

AMERICAN CITIZENS SHOULD NOT BE DICTATED TO AS WHAT YOUR LIFESTYLE SHOULD BE.

THERE SHOULD BE NO LAW OR PROCESS WHICH DICTATES WHAT TYPE OF LIFESTYLE CITIZENS SHOULD ALIGN THEMSELVES WITH OR THE LACK OF RIGHTS THAT PROTECT THE INDIVIDUAL CITIZENS TO BE ABLE TO LIVE WHERE AND IN THE STYLE THAT THEY BELIEVE WILL BE THE THE ENVIRONMENT WHERE THEIR FAMILY IS SAFE AND CAN BEST ENJOY LIFE.

MR. MORFORD FIVE MINUTES IS UP FOR THIS EVENING.

APPRECIATE YOU BEING HERE SIR.

NEXT UP,

[13. City Official Reports And Comments]

NUMBER 13, STATE OFFICIAL REPORTS AND COMMENTS.

OKAY, DO HAVE ONE COMMENT.

WANNA MAKE SURE EVERYONE KNOWS THAT.

SO NEXT TUESDAY, WHICH WOULD BE OUR NORMAL WORK SESSION IS ELECTION DAY.

SO WE DO NOT HAVE A WORK SESSION THEN, WHICH MEANS THERE'LL BE NO REASON FOR A COUNCIL MEETING THE FOLLOWING WEEK.

SO THE NEXT TIME WE WILL CONVENE WOULD BE ON TUESDAY, NOVEMBER THE 19TH.

THAT WILL BE THE WORK SESSION IN ORDER FOR THE FOLLOWING COUNCIL MEETING.

I BELIEVE IT IS ON MONDAY THE 25TH.

THAT'S CORRECT, ON MONDAY, NOVEMBER 25TH.

SO THAT SAID, WE'LL SEE EVERYBODY ON NOVEMBER THE 19TH.

THERE IS NO REASON FOR AN EXECUTIVE SESSION THIS EVENING.

IF THERE ARE NO OTHER COMMENTS IT IS NOW 6 36 AND THIS MEETING IS ADJOURNED.
