[1. Call The Meeting To Order - Mayor Jeff Gore]
TO THE CITY OF FEVER HEIGHTS CITY COUNCIL MEETING.WE'RE GETTING STARTED, UH, RIGHT AT SIX O'CLOCK.
THIS MEETING IS OFFICIALLY CALLED TO ORDER.
[2. Invocation - Pastor Randy Griffith Of The Free Methodist Church At 6875 Old Troy Pike, Huber Heights, Ohio]
WE HAVE ITEM NUMBER TWO ON OUR AGENDA, WHICH IS OUR INVOCATION.AND TODAY WE HAVE PASTOR RANDY GRIFFITH OF THE FREE METHODIST CHURCH AT 68 75 OLD TROY PIKE HERE.
AND HE WRITES WITH US THIS EVENING.
JESUS SAID IN LUKE 6 47 TO 49, I WILL SHOW YOU WHAT HE IS LIKE.
WHO COMES TO ME AND HERE'S MY WORDS, AND PUTS THEM INTO PRACTICE.
HE IS LIKE A MAN BUILDING A HOUSE WHO DUG DOWN DEEP AND LAID THE FOUNDATION ON ROCK.
WHEN A FLOOD CAME, THE TORRENT STRUCK THAT HOUSE COULD NOT BE SHAKEN BECAUSE IT WAS WELL BUILT.
BUT THE ONE WHO HEARS MY WORDS AND DOES NOT PUT THEM INTO PRACTICE IS LIKE A MAN WHO BUILT A HOUSE ON THE GROUND WITHOUT A FOUNDATION.
THE MOMENT THE TORRENT STRUCK THAT HOUSE, IT COLLAPSED AND ITS DESTRUCTION WAS COMPLETE.
JESUS IS GIVING A SPIRITUAL LAW.
THE REALITY OF THINGS LIKE GRAVITY OR OUR NEED FOR OXYGEN, WATER, AND FOOD ARE NATURAL LAWS.
THESE NATURAL REALITIES ARE ALWAYS IN PLAY.
WE DEPEND ON THEM, AND IF WE GO AGAINST THEM OR CORRUPT THEM OR LACK THEM, THIS IS DETRIMENTAL TO HUMAN LIFE.
IN FACT, MANY MANMADE LAWS EXIST TO ENSURE THAT PEOPLE DO NOT BREAK NATURAL LAWS TO THE DETRIMENT OF OTHERS.
GOD HAS CREATED ALL THINGS AND ALL NATURAL LAWS AND IS THE ONE THAT HOLDS EVERYTHING TOGETHER.
HE IS THE SOURCE OF ALL AND KNOWS WHY HE MADE ALL THINGS AND HOW THEY ARE MEANT TO FUNCTION.
HIS NATURE AND CHARACTER ARE BEHIND ALL SPIRITUAL LAW AND ALL LAWS THAT ARE JUST IN FAIR AND TRUE ALIGN WITH THE SPIRITUAL LAW OF BIBLICAL TRUTH.
ALL AUTHORITY IN HEAVEN AND ON EARTH HAS BEEN GIVEN TO JESUS.
HIS WORDS ARE GIVEN TO HELP US AND CAN BE COMPLETELY TRUSTED.
AND INDIVIDUALS AND COMMUNITIES AND NATIONS THAT ARE WISE WILL DESIRE HIM AND HIS WORDS TO BE THE FOUNDATION FOR HOW THEY LIVE THEIR LIVES AND HOW THEY MAKE THEIR LAWS AND HOW THEY DECIDE WHAT THEY PROMOTE.
JESUS IS INVITING ALL PEOPLE TO COME TO HIM, TO LISTEN TO HIS WORDS THAT ARE TRUE AND TO PUT THEM INTO PRACTICE.
THEY APPLY HERE AND NOW AND FOREVER.
AND WHEN THEY'RE PUT INTO PRACTICE, HAVE A GOOD RESULT HERE AND FOREVER.
GOD IS ETERNAL, AS ARE HIS WORDS, AND THOSE WHO BELIEVE AND OBEY HIS WORDS ENDURE FOREVER.
BUT THOSE WHO IGNORE HIM AND HIS WORDS, WHO GO AGAINST THE REALITY OF THINGS AND GO THEIR OWN WAY AND BUILD IN WAYS THAT ARE NOT TRUE, WILL NOT BE ABLE TO WITHSTAND THE ONSLAUGHT WHEN IT COMES BECAUSE THEY HAVE NO TRUE FOUNDATION.
AND WITHOUT CHRIST AND BIBLICAL TRUTH, AS THE BASIS OF LIFE COLLAPSES, INEVITABLE AND DESTRUCTION COMPLETE, LIKE THOSE WHO BUILD BUILDINGS WITHOUT FOUNDATIONS OR ON UNSTABLE GROUND, SUCH BUILDINGS MAY STAND AS LONG AS CONDITIONS ARE FAVORABLE.
BUT WHEN CONDITIONS CHANGE AND BECOME DIFFICULT, WHEN THE RAIN COMES AND THE FLOODWATERS RISE, THEY COLLAPSE COMPLETELY LIKE THE ROMAN EMPIRE.
FATHER, I WANNA BE LIKE THE ONE WHO BUILDS A HOUSE ON SOLID ROCK AND LIVES ACCORDING TO THE TRUTH.
AND I WANT OUR NATION TO BE THE SAME.
SO BY YOUR HOLY SPIRIT, LORD, REVEAL YOURSELF, YOUR CHARACTER, YOUR NATURE, AND YOUR WILL AND YOUR TRUTH TO US ALL.
SO WE MAY FOLLOW IT AND AVOID THE CONSEQUENCES OF CHOOSING THE WRONG WAYS.
LORD, GUIDE THIS MEETING TONIGHT THAT YOU MIGHT BE GLORIFIED.
[3. Flag Ceremony - Wayne High School Junior ROTC Honor Guard]
AND ACTUALLY HAVE THE FLAG CEREMONY FROM THE WAYNE HIGH SCHOOL JUNIOR R OTC, HONOR GARDEN[4. Pledge Of Allegiance]
[00:05:07]
PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INVISIBLE WITH LIBERTY AND JUSTICE COLORS.[5. Roll Call]
MR. ROGERS, WOULD YOU CALL THE ROLL PLEASE? MR. SHAW? HERE.[6. Approval Of Minutes]
UP IS ITEM NUMBER SIX, WHICH IS APPROVAL OF MINUTES.THERE'S ONE SET OF MEETING MINUTES FROM JANUARY 9TH, 2023.
THOSE MINUTES HAVE BEEN DISTRIBUTED.
ARE THERE ANY QUESTIONS, CONCERNS, OR CORRECTIONS? CASE OKAYING? NONE OF THOSE MINUTES WILL STAND.
NEXT UP IS ITEM NUMBER SEVEN, SPECIAL PRESENTATIONS ANNOUNCEMENTS.
MR. ROGERS, OR THIS EVENING? DURING NONE THIS EVENING.
[8. Citizens Comments]
ITEM NUMBER EIGHT, CITIZEN COMMENTS.DO WE HAVE ANY? WE JUDGE COMMENTS? UH, WE HAVE FOUR.
SO WE'LL START WITH, UH, MR. JEFF MORFORD, IF YOU PLEASE COME TO THE PODIUM.
MY NAME'S JEFF MORFORD, MIAMI COUNTY, BETHEL TOWNSHIP.
I'M AGAINST THE PROPOSED ANNEXATION AND DEVELOPMENT OF THE 250 AGRICULTURALLY ZONED ACRES IN MIAMI COUNTY, BETHEL TOWNSHIP INTO HUBER HEIGHTS.
I WOULD LIKE TO CONTINUE MY COMMENTS ON HOW IMPORTANT LINES ARE WHILE WE DRIVE OUR CARS.
WITHOUT LINES, THERE WOULD BE CHAOS AND ACCIDENTS.
IF WE DIDN'T FOLLOW THE RULES FOR A DOUBLE YELLOW LINE AND PAST THE INTERSECTIONS AND HILLS, THE RESULTS WOULD BE A CATASTROPHE.
COUNTRY BORDERS NEED TO BE HONORED AND RESPECTED.
THE US BORDER WITH CANADA AND MEXICO, THE BORDER BETWEEN SPAIN AND FRANCE.
THE BORDER BETWEEN POLAND AND GERMANY.
THE BORDER BETWEEN NORTH AND SOUTH KOREA, THE BORDER BETWEEN RUSSIA AND UKRAINE.
AND YES, THE BORDER BETWEEN MIAMI COUNTY, BETHEL TOWNSHIP AND HUBER HEIGHTS.
WE HAVE OUR IDEAS OF LIFESTYLE AND HUBER HEIGHTS HAS THEIR IDEAS OF LIFESTYLE.
WE DO NOT TRY TO IMPOSE OUR WAY OF LIFE ON YOUR CITIZENS, AND I DON'T THINK YOUR CITIZENS MEAN TO IMPOSE THEIR LIFESTYLE ON US.
THERE NEEDS TO BE A BALANCE FOR THE CITIZENS WHO WANT TO LIVE IN A CITY.
THEY HAVE MANY CITIES TO CHOOSE FROM.
FOR THOSE WHO PREFER A RURAL COMMUNITY AND LIFESTYLE, THERE NEEDS TO BE CHOICES.
AGAIN, THE PROPERTY IN QUESTION IS NOT SOME ABANDONED, DERELICT, FORGOTTEN PROPERTY WITH TAX DELINQUENCIES WITHOUT CURRENT ZONING RULES.
JUST BECAUSE THE PROPERTY OWNERS WITH LEGAL GUIDANCE FROM DEVELOPERS DON'T LIKE THE ZONING RULES IN BETHEL TOWNSHIP, WHY WOULD THEY HAVE THE RIGHT TO JUST ASK YOUR PERMISSION TO GO BY YOUR RULES? AGAIN, HOW WOULD YOU LIKE IT? BETHEL TOWNSHIP HAS ZONING RULES THAT WOULD ALLOW BUILDING ON THIS PROPERTY.
BUT BECAUSE THE ZONING WON'T ALLOW FOR THE DENSITY AND THE PROFIT THEY WANT, THEY KNOCK ON YOUR DOOR.
THE OWNERS OF THIS PROPERTY IN QUESTION HAVE KNOWN THE ZONING RULES FOR MANY, MANY YEARS.
THE DEVELOPERS REMIND ME OF THE SCHOOLYARD BULLY.
BUT INSTEAD OF USING THEIR SIZE AND AGGRESSION WHEN THEY WERE YOUNG, NOW THEY USE THEIR LAWYERS AND MONEY TO IMPOSE THEIR WILL WITH THE MINDSET OF WHAT'S THE LITTLE GUY GONNA DO ABOUT IT? THEY ARE NOT RESPECTFUL OF THE COMMUNITY THEY PLAN TO DO BUSINESS IN.
THEY'RE MOTIVATED BY MONEY AND PROFITABILITY.
THEY ARE NOT CONCERNED ABOUT THE PEOPLE, THE LIFESTYLE, ZONING RULES, SCHOOL CONCERNS, RODENT TRAFFIC ISSUES.
SOMEONE ELSE WILL HAVE TO DEAL WITH IT IS MY OPINION.
IF YOU ALLOW THIS ANNEXATION DEVELOPMENT, THIS COUNCIL IS JUST AS GUILTY OF THAT DISRESPECT.
YOU ARE NOT OBLIGATED TO VOTE YES, PLEASE DO THE RIGHT THING, BE A GOOD NEIGHBOR, AND VOTE NO TO THE ANNEXATION AND ZONING CHANGES.
JUST BECAUSE IT'S LEGAL THAT DOESN'T MAKE IT RIGHT.
AS I HAVE SUGGESTED BEFORE, PUT THIS ISSUE ON THE BALLOT
[00:10:01]
AND LET YOUR CITIZENS VOTE ON THEIR FUTURE AS THEY VOTE ON OTHER THINGS.AS ALWAYS, I WOULD LIKE TO LEAVE YOU THE GOLDEN RULE.
DO UNTO OTHERS AS YOU WOULD HAVE THEM DO UNTO UNTO YOU.
NEXT UP, UH, JENNIFER D COULD YOU JUST STATE YOUR LAST NAME FOR THE RECORD? YES, STILL.
FOR YEARS, I'VE SUGGESTED CHANGE OCTOBER COMMUNITY GARAGE SALES.
I'VE ASKED FOR CHANGE, NOT FOR MYSELF BEFORE THE COMMUNITY.
THIS PAST OCTOBER, I'VE ACTUALLY COLLECTED OVER 70 SIGNATURES AND SUPPORT THAT DESIRE FOR THE CHANGE.
ONE SUCH CHANGE IS MOVING THE SALE FROM OCTOBER TO SEPTEMBER.
THIS ALLOWS A GREATER CHANCE OF WARMER WEATHER WITH LESS CHANCE OF RAIN BECAUSE WHO WANTS TO SIT OUTSIDE FOR HOURS AND DAYS IN THE COLD, WIND AND RAINY WEATHER? WHO WANTS TO GO SHOPPING IN OUR COMMUNITY OR DRIVE ALONG THE TWISTS AND TURNS HOPING THE INDIVIDUAL DID NOT CLOSE DUE TO WEATHER? ANOTHER CHANGE WOULD BE A SIMPLE EXCEL ATTACHMENT THAT ALLOWS FOR MORE INFORMATION, SIMPLE INFORMATION THAT IS VITAL OUT TO THOSE WHO INCREASE THE TRAFFIC ON THE HUBER HEIGHTS STREETS, TRYING TO FIND THAT SALE.
HAVING INFORMATION LIKE DATES, SALE HOURS, AND MAIN ITEMS ARE SELLING.
IT WOULD REDUCE THE TRAFFIC WASTED TIME AND FUEL THE POTENTIAL BUYERS.
AS I'VE CONTINUED RESEARCHING ABOUT GARAGE SALES, SOMETHING HAS BOTHERED ME DURING THE YEARS I'VE LIVED IN HUBER HEIGHTS.
THE NUMBERS OF UNPERMITTED SALES HAVE CHANGED AND I UNDERSTAND WHY.
WHAT I DON'T UNDERSTAND IS THE CITY ORDINANCE OF 1180 1.15, SECTION E, WHERE STATES NOT MORE THAN TWO OFF-PREMISE DIRECTIONAL SIGNS AND THAT THEY SHOULD BE ON PRIVATE PROPERTY, NOT THE STREET RIGHT AWAY.
THERE IS ACTUALLY A DIAGRAM ILLUSTRATING THIS POINT.
FIRST, LIMITING TWO DIRECTIONAL SIGNS RESTRICTS VISIBILITY TO THE SAIL FROM MAIN ROADS.
SECOND, IT'S IMPRACTICAL TO LIMIT TO TWO DIRECTIONAL SIGNS WHEN YOU HAVE MAIN NEIGHBORHOODS THAT HAVE SEVERAL TWISTS AND TURNS GETTING TO THEIR HOUSE.
THE OTHER ISSUE REGARDING THIS MATTER IS THE PUBLIC RIGHT OF WAY, WHICH THE ORDINANCE CLAIMS CANNOT BE USED, AND THAT IS WHERE EVERYBODY PUTS THEIR GARAGE SALE SIGNS AS A COMMUNITY SALE AND A PUBLIC RIGHT AWAY.
IT BELONGS TO THE PEOPLE, THE PUBLIC.
HOWEVER, IF YOU FOLLOW THE ORDINANCE, IT STATES THAT IT MUST BE ON PRIVATE PROPERTY AND THIS IN ITSELF CAN CAUSE ISSUES, WHICH I'M SURPRISED HASN'T BROUGHT UP THAN LEGAL REVIEW.
ONE, THE CITY CAN'T TELL A CITIZENS NOT TO PERMIT A GROSS SALE ASSIGN ON A PRIVATE PROPERTY.
TWO, THE GARAGE SALE OWNER WOULD NEED TO REQUEST THE PERMISSION FROM THE HOMEOWNER TO PLACE THEIR DIRECTIONAL SIGN IN ORDER FOR THIS PAYMENT PERMITTED, LEAVING A POTENTIAL CHANCE THAT THEY WON'T BE PERMITTED AT ALL.
NUMBER THREE, THE SIGN IN THE YARD WOULD ONLY ADD CONFUSION TO THE DRIVER TO FIGURE OUT IF THAT SIGN IS FOR THE WHOM OR A DIRECTIONAL SIGN.
SO INSTEAD OF THE COMMUNITY CONTINUE TO IGNORE CITY ORDINANCE WITH REGARDS TO DIRECTIONAL SIGN LIMITATIONS AND PLACEMENTS.
I REQUEST TO CHANGE THE ORDINANCE, REDUCE THE TRAFFIC DRIVING AIMLESSLY AROUND THE COMMUNITY, DR.
SALES FORCE PROVIDING MORE INFORMATION, AS WELL AS MOVING OCTOBER TO SEPTEMBER, UTILIZING THE MERICK GOLD FESTIVAL TO ADVERTISE A COMMUNITY SALE OR VICE VERSA.
THANK YOU FOR YOUR TIME AND CONSIDERATION MAKING THESE CHANGES.
QUICK QUESTION AND IF, IF WE NEED TO TALK ABOUT THIS LATER CERTAINLY, BUT IS THERE A REASON WHY THAT WE HAVE IT IN OCTOBER? IS THERE SOME, IS THERE, IS THERE A REASON THAT WE HAVE IT JUST IN OCTOBER AND NOT IN SEPTEMBER OR EARLIER? I MEAN, I KNOW SUMMERTIME IS CRAZY FOR GARAGE SALES, BUT COMMUNITY-WIDE IS THERE A REASON? RIGHT.
UH, TO THE BEST OF MY KNOWLEDGE, IT'S JUST, UH, UM, OUR PAST PRACTICE TO CONTINUE TO DO THAT.
SO HAPPY TO HAVE A CONVERSATION WITH STAFF ABOUT WHAT WE MIGHT BE ABLE TO DO TO, TO LOOK AT OTHER DATES EARLIER IN THE YEAR.
UH, AS FAR AS THE ORDINANCES IN TERMS OF LOOKING AT THAT, THAT'S SOMETHING THE COUNCIL CAN HAVE A DECISION ABOUT.
CUZ I MEAN, THOSE ARE LOCAL LAWS, LOOK ORDINANCES.
WE CAN LOOK AND SEE IF IT MAKES SENSE TO MAKE ANY OF THOSE CHANGES AROUND IT, BUT CERTAINLY, UH, I WOULDN'T DISAGREE WITH YOU ABOUT SEPTEMBER VERSUS OCTOBER, SO IF THAT'S A EASY CHANGE, THAT SHOULD BE AN EASY CHANGE.
I THINK LAST YEAR THEY TALKED ABOUT MOVING THE MIRACLE FESTIVAL OFF THE WEEKEND THAT THEY USUALLY HAD, SO THAT'S, THAT'S SOMETHING THAT COMMITTEE WILL HAVE TO DECIDE.
THAT WAS SUGGESTED LAST YEAR THAT IT NOT BE ON THAT WEEKEND CAUSE IT WAS SUCH A HEAVY FESTIVAL WEEKEND, BIG FESTIVAL WEEKEND, BUT WEEKEND.
SO LIKE COME BACK FOR OUR NUMERICAL FESTIVAL, COME BACK FOR OUR COMMUNITY, YOU'LL HAVE TO TALK TO THAT COMMISSION.
IT WAS WHETHER OR NOT THEY'RE HAVING IT AND WHEN THEY'RE HAVING IT.
SO THAT WAS HIS TALK LAST YEAR.
ANYTHING ELSE? ANY OTHER QUESTIONS JUST REGARDING THAT? YEAH, CLINT, I WOULD JUST CHIME IN TO SAY THAT I'M CERTAINLY UP FOR A CONVERSATION HOW WE CAN ADJUST IT.
I CERTAINLY AGREE WITH THE TIMING.
UH, I THINK SEPTEMBER EARLIER WOULD BE BACK IN OCTOBER, SEPTEMBER MAKES MORE SENSE.
ANYTHING ELSE? OKAY, THANK YOU.
NEXT UP WE HAVE STATE REPRESENTATIVE RODNEY COURAGE.
ARE YOU SERIOUS?
[00:15:01]
GOOD EVENING.GOOD EVENING MAYOR AND COUNSEL.
UH, YOU KNOW, I, I'VE BEEN LOOKING FORWARD TO THIS, UH, FOR ABOUT EIGHT OR NINE MONTHS.
I'VE BEEN ABLE TO, UH, BE A PART OF HUBER HEIGHTS NOW, UM, UH, WAITING ON JANUARY 1ST TO TAKE, TO TAKE THE LEAD AS YOUR STATE REP.
AND I CAN TELL YOU THAT, UH, OVER THE LAST EIGHT MONTHS, I'VE REALLY ENJOYED GETTING TO, TO KNOW YOU ALL AND, UH, BEEN ABLE TO ATTEND SOME EVENTS.
AND THANK YOU SO MUCH FOR THE INVITES.
UM, I WANNA BE A PART OF YOUR COMMUNITY.
I ALWAYS TELL PEOPLE, IF YOU'RE GONNA WORK FOR THE PEOPLE, YOU HAVE TO KNOW WHO THEY ARE.
AND SO YOU'VE ALLOWED ME TO DO THAT AND I APPRECIATE IT.
UM, FOR THOSE OF YOU THAT THAT MIGHT NOT KNOW, OR FOR THE PEOPLE THAT, THAT, THAT WATCH YOUR MEETINGS, YOU KNOW, UM, I I, YOU KNOW, I AM A STATE REPRESENTATIVE, BUT I STARTED OUT IN LOCAL GOVERNMENT AS A TOWNSHIP TRUSTEE.
MY GRANDFATHER WAS A TOWNSHIP TRUSTEE, SO I WANNA BE LIKE GRANDPA AND, UH, SPENT MY YEARS, SIX YEARS AS A TRUSTEE AND THEN MOVED ON TO A COUNTY COMMISSIONER.
AND THE ONE THING THAT I WANT TO TELL YOU IS, UH, THE THING THAT I LOVE MOST IS SERVING PEOPLE.
AND, UH, IT'S SOMETHING I HAVE A PASSION FOR.
UM, YOU KNOW, THE PEOPLE THAT ARE, ARE IN OUR SEATS.
WE LIKE TO BE PROBLEM SOLVERS.
UM, IF THERE'S A PROBLEM, WE LIKE TO SOLVE 'EM.
NOW THERE'S NO GUARANTEES IN THAT, AS YOU ALL KNOW, CUZ YOU'RE, YOU'RE, YOU'RE A PROBLEM SOLVER ALSO.
UM, BUT WHAT I TELL PEOPLE IS, YOU KNOW, 99% OF THE TIME WE'RE NOT GONNA HAVE AN ANSWER RIGHT AWAY, BUT 99% OF THE TIME WE'RE GONNA GET YOU ONE.
YOU MAY JUST NOT LIKE THE ANSWER.
AND SO, YOU KNOW, I WANNA, YOU KNOW, LET YOU KNOW THAT I'M HERE TO WORK FOR YOU.
UM, AND IF, IF YOU HAVE CONSTITUENTS THAT HAVE ISSUES, PLEASE GIVE THEM MY CELL PHONE NUMBER.
IF YOU DON'T HAVE MY CELL PHONE NUMBER, IT'S ON MY BUSINESS CARD, BUT I'LL GET YOU ONE.
UM, I WANNA TALK TO THE PEOPLE AND, UH, I DON'T WANNA MAKING FIVE OR SIX PHONE CALLS.
THEY CAN CALL ME AND WE'LL GET ON IT.
AND WE DO THAT EVERY DAY, AND I LOVE DOING THAT.
UM, TECHNICALLY, YOU KNOW, EVEN WHEN I WAS A A COUNTY COMMISSIONER, I NEVER REALLY KNEW WHAT A STATE REP DID.
UM, YOU KNOW, I WOULD TALK TO 'EM EVERY ONCE IN A WHILE ABOUT MINOR ISSUES.
BUT NOW THAT I'VE BEEN IN THE SEAT FOR TWO YEARS AND I'M STARTING MY SECOND TERM, THERE'S PRETTY MUCH TWO AVENUES.
ONE OF THEM'S LAWS, WHICH YOU KEPT TALKING ABOUT.
WE'RE ONE OF THOSE PEOPLE THAT MAKES THOSE DECISIONS.
AND SOMETIMES IT'S GOOD, SOMETIMES IT'S BAD.
UM, BUT WE HAVE THE POLICY AND LEGISLATION SIDE, AND THEN WE HAVE THE CONSTITUENT SERVICES SIDE.
UM, I ENJOY THE POLICY SIDE, BUT I LOVE THE CONSTITUENT SERVICES SIDE.
SO IF YOU HAVE ANY ISSUES, AGAIN, MAKE SURE AND SEND PEOPLE OUR WAY.
UM, I'M ALSO JUST SO PEOPLE DON'T LOOK AT ME LIKE I'M A POLITICIAN, I'M ALSO A FARMER.
THAT'S WHAT I DO FOR A LIVING.
I'M A GRAIN FARMER, FOUR GENERATION GRAIN FARMER AND A LOCAL BUSINESS OWNER.
SO I LIKE TO SAY I'M A POLITICIAN WITH COMMON SENSE
UM, I DON'T KNOW IF THERE'S SUCH A THING THAT COULD BE AN OXYMORON, I'M NOT SURE.
UM, BUT JUST, UH, JUST KNOW THAT I'M OUT IN THE REAL WORLD EVERY DAY, UM, FIGHTING THE SAME FIGHT AS EVERYBODY ELSE.
BUT THIS IS ONE OF MY FAVORITE THINGS TO DO IS GET OUT WITH THE PEOPLE AND APPRECIATE THE TIME THIS EVENING AND LOOK FORWARD TO WORKING WITH ALL OF YOU.
SO THANKS, RODNEY, WE APPRECIATE YOU BEING HERE.
I DON'T HAVE ANY QUESTIONS FOR RODNEY OR ANYTHING LIKE THAT.
THANK YOU MAYOR RODNEY, THIS IS NOT A QUESTION.
UH, THIS IS JUST TO THROW YOU IN ACCOLADE.
I HAVE TO TELL YOU, I'VE SEEN YOU AT SO MANY HUBER HEIGHTS EVENTS ON THE 4TH OF JULY PARADE TO GRAND OPENINGS FOR BUSINESSES TO OUR, UH, RECENT, UH, MLK PRESENTATION.
I LOOK UP AND THERE'S RODNEY CREACH, UM, MEETING WITH AND SPEAKING WITH THE PEOPLE OF HUBER HEIGHTS.
AND, UH, I'M VERY THANKFUL FOR IT.
LOOKING FORWARD TO WORKING WITH YOU.
ANY OTHER COMMENTS? ANY OTHER QUESTIONS? THANK YOU.
AND LAST TIME WE HAVE, UH, MRS. PAT STEVENS.
HOW ARE YOU? I'M GOOD, I THINK.
YEAH, IT'S GOOD TO SEE ALL OF YOU TOO.
UM, I HOPE I CAN MAKE IT THROUGH THIS.
UM, AS MANY OF YOU KNOW, UM, I'VE KIND OF BEEN OUT OF THE PICTURE FOR THE LAST YEAR OR A LITTLE LONGER.
UH, I'VE HAD A LOT OF PERSONAL ISSUES, HEALTH ISSUES AND SO FORTH.
AND WHEN A DOCTOR SAYS TO YOU, YOU HAVE TO STOP THIS, YOU HAVE TO STOP.
SO THAT'S WHY I HAVE BEEN MISSING AN ACTION FOR QUITE A WHILE.
AND, UM, I HAVE MISSED ALL OF YOU.
I'VE MISSED BEING OUT IN THE PUBLIC AND SO FORTH, UH, SINCE ALL OF THIS HAPPENED.
UH, I KNOW SOME OF YOU KNEW THAT MY HUSBAND HAD BEEN ILL.
AND, UH, WE DECIDED, WE HAD DECIDED TO SELL OUR HOUSE AND MOVED TO A SMALLER HOME BECAUSE WHERE THE HOUSE WE HAD HAD HERE, UM, WAS PRETTY GOOD SIZE.
[00:20:01]
AND LIVING ROOM, FAMILY ROOM, AND SO FORTH AND SO ON.AND WE DECIDED IT WAS A LITTLE BIT TOO MUCH FOR A COUPLE OF OLD PEOPLE TO TAKE CARE OF.
SO WE WOUND UP BUYING A HOME IN VANDALIA.
UM, AND, AND IT'S MUCH SMALLER, ALTHOUGH MY DAUGHTER WOULD PROBABLY DISAGREE WITH THAT COMMON, UH, BUT INSTEAD OF A HALF ACRE YARD, WE ONLY HAVE A QUARTER.
AND, UH, FOR ONCE WE HAVE A TWO AND A HALF CAR GARAGE THAT WE CAN ACTUALLY PUT A CAR IN.
AND, UM, I HAVE A DISHWASHER AT A GARBAGE DISPOSAL AND THINKS THAT I'VE NEVER HAD IN THE PAST.
BUT I HAVE HAD THE PRIVILEGE OF GROWING UP IN WAYNE TOWNSHIP.
AS SOME OF YOU ALREADY KNOW, MY PARENTS GREW UP IN WAYNE TOWNSHIP, MY GRANDPARENTS LIVED HERE, THEY FARMED HERE.
AND, UH, THIS HAS BEEN MY HOME FOR MORE YEARS THAN I WANNA TELL YOU, MA'AM.
UM, BUT, UH, AND MARK CAMPBELL, I CAN'T HELP EVERY TIME I RUN ALL THIS THROUGH MY MIND.
I THINK OF YOUR SISTER, WHO MY SISTER AND I WENT TO SCHOOL WITH, AND WE HAD SO MANY WONDERFUL MEMORIES AT THE OLD TIDA SCHOOL, WHICH IS NOW, UM, THE MAINTENANCE DEPARTMENT AND SO FORTH.
MY GRANDMOTHER WAS INSTRUMENTAL IN GETTING THAT BUILDING TO BE THE FIRST CENTRALIZED SCHOOL IN ALL OF MONTGOMERY COUNTY AND MONTGOMERY COUNTY AT THAT TIME.
HERE I GO WITH MY HISTORY, I'M SORRY, IT'S A, IT'S A CURSED.
UM, BUT AT THAT TIME, MONTGOMERY COUNTY AND WENT FROM JUST SOUTH OF DAYTON, CLEAR UP TO ALMOST LAKE ERIE.
SO FOR THAT TO HAVE BEEN THE FIRST CENTRALIZED SCHOOL IN THAT LARGE OF AN AREA WAS QUITE A FEAT.
SO I HAVE DECIDED THAT I TAKE AFTER MY GRANDMOTHER IN A LOT OF WAYS.
UM, AND I FEEL LIKE I, DURING MY TIME SERVING AS, UH, THE CHAMBER OF COMMERCE, OWNING A BUSINESS HERE, UM, THE HISTORICAL SOCIETY AND, AND WORKING ON ALL THE, UH, UH, COMMITTEES AND COMMISSIONS AND SO FORTH, AND WORKING WITH THE COUNCIL ON SO MANY THINGS, UH, I'M SURE THAT MY GRANDMA'S UP THERE SAYING, WAIT TO GO GIRL, WAY TO GO, BECAUSE SHE WAS QUITE A CHARACTER.
UM, UH, I'M SORRY THAT I WASN'T HERE AT THE LAST COUNCIL MEETING WHEN THE HUG AIR WAS PRESENTED TO THE HISTORICAL SOCIETY, WHICH MOST OF YOU, I THINK ALL OF YOU KNOW, THE HISTORICAL SOCIETY IS VERY NEAR AND DEAR TO MY HEART.
I WAS ONE OF THE, UH, MEMBERS WHO GOT THAT ORGANIZATION STARTED AND MY HUSBAND HAS STEPPED INTO MY FOOTSTEPS, WHICH KIND OF IS OPPOSITE BECAUSE HE'S MUCH BIGGER THAN I AM, AS YOU ALL KNOW.
UM, BUT I JUST, I JUST WANTED TO THANK YOU ALL FOR PUTTING UP WITH ME, WORKING WITH ME, AND HELPING ME TO ACCOMPLISH THE THINGS THAT I WAS ABLE TO ACCOMPLISH WHILE BEING HERE IN HUBER EYES.
SO, UH, PAT, UH, THERE'S SO CERTAINLY YOU DON'T HAVE TO STAY, UH, I'M, I'LL JUST WANT TO SAY ONE THING AND THEN, UH, CERTAINLY WHEN THESE COUNCIL MEMBERS PROBABLY HAVE SOME THINGS THEY WANNA SAY, AND I DON'T KNOW IF THEY WANNA SAY IT NOW OR WAIT UNTIL THE, THE END UNDER OUR REPORTS AND COMMENTS, BUT I WOULD JUST SAY THAT CERTAINLY YOU ARE A TREASURER TO THIS CITY.
YOU ARE A TREASURER OF THE TOWNSHIP.
EVERYONE HERE KNOWS THE, THE WORK AND THE TIME AND THE EFFORT THAT YOU'VE PUT INTO WAYNE TOWNSHIP IN HUB HEIGHTS AND A, A TREASURE FOR THIS COMMUNITY IS THE
[00:25:01]
ONLY WORD THAT I CAN THINK OF THAT MATCHES WHAT YOU MEAN TO, TO HEBREW RIGHTS AND TO ALL OF US.I WANNA SAY ONE MORE THING JUST REAL QUICK.
WHEN WE, WHEN WE MOVED, UM, OF COURSE THE HOUSE IS SMALLER AND WE HAD MAKE CHANGES IN FURNITURE AND EVERYTHING AND I STARTED UNPACKING BOXES AND I RAN ACROSS SO MANY MEMENTOS AWARDS, THINGS THAT THE CITY COUNCIL HAS GIVEN ME, THE CHAMBER OF COMMERCE GAVE ME AND ALL THESE DIFFERENT THINGS.
AND SO MY DAUGHTER MARYANNE AND I DECIDED THAT IT WAS TIME THAT THEY WERE PUT OUT WHERE I COULD ENJOY 'EM.
SO MY ONE CHINA CABINET IS NOW FULL OF ALL THOSE AWARDS.
SO I THINK OF ALL OF YOU OFTEN WHEN I HAVE TO DUST
SO I WILL JUST, IF YOU HAD PLAN ON LEAVING, THEN YES, I CERTAINLY WANNA OPEN UP TO ANY ON COUNCIL, WANTS TO MAKE COMMENTS.
YOU CAN HEAR THEIR COMMENTS BEFORE YOU LEAVE.
UH, I'LL START WITH GLENN PAT, YOU HAVE JUST BEEN ABSOLUTELY INSTRUMENTAL IN THIS COMMUNITY.
I MEAN, OH MY GOSH, I DON'T KNOW HOW LONG AGO IT WAS.
WE MET, IT WAS FOR ME, IT WAS FOUR OFFICES AGO, IF THAT SAYS ANYTHING.
RIGHT? YOU THE BOYS PLAYING FOOTBALL, UHHUH,
YOU HAVE JUST BEEN AGAIN, ABSOLUTELY WONDERFUL.
YOU'VE BEEN INVOLVED IN SO MUCH.
YOU AND RALPH WILL BOTH BE SO SEVERELY MISSED, BUT I HAVE A FEELING THIS WON'T BE THE LAST TIME WE SEE EACH OTHER.
YOU'LL BE AROUND
THANK YOU SO MUCH, PAT, YOU'VE BEEN AWESOME.
UM, PAT, I'VE ONLY LIVED HERE ABOUT 21 YEARS, BUT IF IT HADN'T BEEN FOR YOU, I WOULD NOT KNOW THE HISTORY OF THE CITY AS THOROUGHLY AS I DO.
THE EFFORTS THAT YOU HAVE PUT INTO, UM, RESEARCHING AND SHARING AND, UM, PUTTING TOGETHER THE 40TH, UM, BIRTHDAY CELEBRATION, UM, AND TENDING TO THE CEMETERY, ALL THOSE THINGS ARE SO VALUABLE TO OUR COMMUNITY.
YOU HAVE MADE SUCH AN AWESOME CONTRIBUTION.
AND AS I SAID TO YOU A MINUTE AGO, NO MATTER WHERE YOU GO, YOU WILL ALWAYS BE A RESIDENT OF HUBER HEIGHTS CUZ WE LOVE YOU.
JUST SO YOU KNOW, MY GOAL IS TO FINISH WRITING HISTORY.
THE HISTORY WILL NEVER BE FINISHED AS, AS I THAT'S, THANK YOU ANITA.
I'VE LIVED HERE SINCE 89 AND THERE WAS A LOT OF TIMES UNTIL THE LAST FIVE YEARS.
I COULDN'T TELL YOU WHO WAS SITTING ON CITY COUNCIL, BUT I KNEW THE NAME PAT STEVENS,
SO YOU HAVE MADE A BIG IMPACT IN THIS CITY AND THANK YOU FOR IT.
ANYONE ELSE? THANK YOU, MAYOR.
WELL, PAT, I'D JUST LIKE TO TELL YOU YOU'RE NOT GETTING OFF THAT EASY.
UH, FOR OUR PEOPLE LISTENING IN OR WATCHING THE LIVESTREAM, THERE WOULD BE NO HUB HEIGHTS, WAYNE TOWNSHIP HISTORICAL SOCIETY, WHERE NOT FOR THE WORK OF PAT AND RALPH FOR HUSBAND.
AND IT IS A LITTLE KNOWN GEM IN THE HEART OF OUR CITY.
IT'S A, UH, STDA BAKER, BUT THE HISTORICAL SOCIETY HAS DOCUMENTED THE LONG HISTORY OF HUBER HEIGHTS AND IT'S ALL THERE FOR YOU, UH, TO TAKE IN AND TOUR AND SEE PAT, UM, THE CITY OWES YOU A DEBT THAT WE CAN'T REPAY, AND WE ARE SO THANKFUL THAT WE HAD PAT STEVENS COLLECTING, AMASSING, CATALOGING THE CITY'S HISTORY.
AND LIKE I SAID, DON'T THINK YOU'RE GETTING OFF EASY.
I WILL BE MAKING A PHONE CALL FROM TIME TO TIME WHEN I HAVE TO ASK YOU SOMETHING ABOUT OUR HISTORY.
ANY OTHER COMMENTS? YES, MARK, PAT STEVENS.
YOUER HEIGHTS IS BETTER BECAUSE OF YOU AND YOUR HUSBAND AND YOUR ENTIRE FAMILY.
UH, KATE AND RICHARD, AND I KNOW, UH, TONY ALSO HAS A COMMENT HE'D LIKE TO MEET TOO.
I REMEMBER IT WAS B BALDWIN HELP WRITE THROUGH WAYNE TOWNSHIP BOOK.
I REMEMBER GOING TO HER FARM AND SHE'S, SHE HAD ALL THE STUFF ON THE TABLE AND WE'D WORK AT IT.
OKAY, WELL, THIS NEVER WENT OUT TO PLAY
CAN WE THINK A LOT OF YOU, THANK
[00:30:01]
YOU MR. STEVENS.IT'S, UH, IT'S, IT'S BEEN AN HONOR TO WORK WITH YOU AND VERY EDUCATIONAL AT THE SAME TIME.
UH, I KNOW YOU AND I HAVE SPENT SEVERAL HOURS TALKING ABOUT THE HISTORY, UM, EVEN ST YOU KNOW, ATTEMPTING TO CREATE A, A VIDEO, UH, UM, LIBRARY.
UH, AT MANY TIMES WE STARTED THE, UH, THE CHARITY SOFTBALL GAME AND RAISED A LOT OF GREAT MONEY, UH, AND GOOD PARTNERSHIP FROM NONPROFITS IN THE COMMUNITY.
YOUR IMPACT ON THE SHEER CEMETERY HAS BEEN OVERWHELMING.
UM, EVEN, EVEN PHONE CALLS THAT YOU AND I HAVE SHARED REGARDING, YOU KNOW, EVEN ROCKS AND MONUMENTS IN THE COMMUNITY TO FIGURE OUT WHERE THEY THEY GO FROM.
I MEAN, IT'S JUST BEEN ABSOLUTELY AMAZING.
UM, AND, AND I THINK I AGREE WITH EVERY COUNCIL MEMBER HERE.
WE, WE'VE NOT SEEN THE LAST OF YOU.
YOU'VE, YOU, YOU HAVE A DEBT TO CITY CAN'T REPAY AS COUNCILMAN.
UM, WE STATED IT'S JUST BEEN AN HONOR WORKING WITH YOU, UH, AN HONOR TO LEARN FROM YOU AND, AND TO REALLY SEE THE IMPACT THAT YOU'VE HAD, YOU KNOW, BEFORE MANY OF US ARRIVED TO THIS COUNCIL.
SO THANK YOU SO MUCH FOR ALL THAT YOU'VE DONE AND, AND, AND WE'LL, WE'LL, WE'LL BE IN CONVERSATIONS AGAINST TOO.
ANYONE ELSE BEFORE WE GO? YES, ED.
UH, PAT, JUST BECAUSE, UH, YOUR RESIDENCE HAS CHANGED, UH, DOES DOESN'T MEAN THAT, UH, ANYTHING ELSE HAS.
YOU'RE STILL EXTREMELY VALUED.
YOU'RE STILL WELL LOVED AND WELL RESPECTED, UM, WITH A SHARED LOVE OF HISTORY.
UM, THE PINNACLE FOR ME, UM, IS THE CEMETERY AND THE CHANGES THAT YOU'VE MADE THERE FOR THE BETTER IS JUST INCREDIBLE TO ME.
UM, I WAS FORTUNATE TO BE ON COUNCIL WHEN YOU CAME UP WITH THAT IDEA AND PRESENTED IT AND WITH, UH, UM, SUPPORT OF THE COUNCIL AND THE MAYORS THROUGH THAT TIME.
IT WAS JUST ABSOLUTELY EXQUISITE WHAT YOU'VE DONE.
UH, BUT THAT'S JUST ONE DETAIL.
IT'S A BIG ONE, BUT IT'S ONE DETAIL OF THE MANY SUCCESSES YOU'VE HAD.
SO YOU ALL MENTIONED THE CEMETERY.
REMEMBER THIS? I'M NOT THERE WORKING.
SO YOU, TO MAKE SURE THAT THAT CEMETERY WILL YOU PROMISE ME THAT? YES.
AND THANK YOU VERY MUCH, UH, IN HONOR TO, TO WORK ON THAT.
AND, UH, EVERY TIME I DO DRIVE BY, WELL, I DON'T DRIVE ANYTHING, BUT EVERY TIME I GO BY, UM, I THINK ABOUT THE TIMES THAT YOU'VE BEEN CELEBRATIONS AND THINGS.
THANK YOU ALL VERY MUCH, TONY.
AND I JUST WANTED TO SAY, WHEN I FIRST STARTED WORKING HERE AT HUBER HEIGHTS, UH, YOU WERE ONE OF THE FIRST TO REALLY WELCOME ME INTO THIS COMMUNITY, UM, THAT WAS GREATLY APPRECIATED AT THE TIME.
AND I'VE ENJOYED DOING SO MANY, UH, EVENTS AND PLANNING WITH YOU.
WE'VE, UH, WE WERE ALWAYS THE TWO THAT WERE IN THE WEEDS GETTING THE DETAILS TOGETHER FOR A LOT OF THESE THINGS.
AND, UM, IT'S BEEN A REALLY GREAT EXPERIENCE AND THE GREAT RIDE WITH YOU, HUBER HEIGHTS IS VERY THANKFUL TO OUR, AND I'M THANKFUL FOR OUR FRIENDSHIP OVER THESE YEARS.
IT'S BEEN A PLEASURE WORKING WITH EVERYBODY IN THE CITY.
AND EXCEPT ON OUR AGENDA IS I NUMBER NINE, WHICH IS CITIZENS REGISTERED TO SPEAK ON SPECIFIC AGENDA ITEMS. OKAY.
SO WE HAD, UH, MR. JOHN COJACK, UH, YOU'RE REGISTERED TO SPEAK, BUT I WE CAN DO THAT DURING THE PUBLIC HEARING.
YOU DON'T NEED TO SIGN UP FOR THAT THOUGH.
IT CAN BE AN OPPORTUNITY FOR AN INTERVIEW WANTS TO STATE.
AND WHICH PARTICULAR ITEM, JUST SO WE HAVE A, WILL BE, UH, THE PUBLIC HEARING.

HAPPY TO ANSWER ANY QUESTIONS OR CONCERNS, COUNSEL ON BEHALF, SIR, ANY QUESTIONS FOR BRIAN REGARDING ITEMS IN HIS CITY MANAGER? OKAY, SO NONE, MOVE ON TO ITEM 11, WHICH IS PENDING BUSINESS.
THERE IS NOT A EVENING, EVENING MAYOR.
OKAY, WE'LL MOVE ON TO ITEM 12, WHICH IS NEW BUSINESS UNDER CITY COUNCIL.
[ A Motion To Approve The 2023 Huber Heights Rules Of Council Effective January 23, 2023.]
ITEM 12 A.A MOTION TO APPROVE THE 2023 HUBER HEIGHTS RULES OF COUNSEL, EFFECTIVE JANUARY 23RD, 2023.
TONY, YOU HAVE ANY ADDITIONAL COMMENTS? UH, JUST, UH, AS DISCUSSED AT THE WORK SESSION, THE ONLY CHANGE TO THE RULES OF COUNSEL FROM 2022 TO 2023 WAS THE, UH, REWORDING OF THE SECTION ON PUBLIC PARTICIPATION AT MEETINGS.
UM, AS DISCUSSED, WE OUTLINED IT A LITTLE BIT MORE TO ELABORATE ON SOME OF THE OPPORTUNITIES THERE ARE FOR PUBLIC PARTICIPATION IN THE DECISION MAKING PROCESS OF CITY COUNCIL.
AND, UM, WITH THAT, I WOULD JUST, UH, REQUIRE APPROVAL OF THE MOTION TONIGHT TO ADOPT THOSE AND, AND TO EFFECT FOR 2023.
IS THERE A MOTION, NANCY, I MOVE TO ADOPT FOR A SECOND, DON? YES.
YOUR, I WILL SECOND THE MOTION IN A SECOND.
IS THERE A DISCUSSION? TONY? MS. BAKER? YES.
MOTION CARRIES EIGHT TO ZERO AND NEXT
[ A Public Hearing Scheduled For January 23, 2023 By The Huber Heights City Council For Case RZ 22-41. The Applicants Are Richard Baumer And Staci Carre. The Applicants Are Requesting Approval Of A Rezoning From Light Industrial (I-1) To Residential (R-1) For Properties Located At 7677 And 7777 Wildcat Road And Further Described As Parcel Numbers P70 04009 0024 And P70 04009 0028 On The Montgomery County Auditor's Map.]
UP IS ITEM 12 B.ITEM 12 B, A PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUBER HEIGHTS CITY COUNCIL FOR CASE RZ 22 DASH 41.
THE APPLICANTS ARE RICHARD BOMBER AND STACY CARR.
THE APPLICANTS ARE REQUESTING APPROVAL OF REZONING FROM WHITE INDUSTRIAL I ONE TO RESIDENTIAL R ONE FOR PROPERTIES LOCATED AT 76 77 AND 77 77 WILDCAT ROAD, AND FURTHER DESCRIBED AS PARCEL NUMBER P 7 0 0 4 0 0 9 0 0 24 AND P 7 0 0 4 0 0 9 28 ON THE MONTGOMERY COUNTY AUDITOR'S MAP.
AND IT'S, UH, BEEN WHILE WE'VE HAD SOME PUBLIC HEARINGS, WE HAVE, UH, QUITE A FEW THIS EVENING.
THE PUBLIC HEARINGS SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUMAN RIGHTS CITY COUNCIL FOR CASE RZ.
AND WITH THAT BEING SAID, I WOULD CALL ON CITY STAFF TO MAKE THE INITIAL PRESENTATION.
AARON, HOW ARE YOU SIR? I'M WELL, MAYOR.
UH, SO THIS IS RZ 2022 DASH 41.
UH, THERE ARE TWO SINGLE FAMILY HOMES THAT ARE PART OF THIS REZONING, TOTALLY FOUR ACRES.
IT'S CURRENTLY ZONED I ONE, THE APPLICANT, UH, REQUEST TO REZONE THIS TO R ONE TO FACILITATE THE FUTURE EX, UH, EXPANSION OF, UH, ONE OF THEIR, UH, RESIDENTS.
SO, UM, WE'LL BRIEF HISTORY AROUND 1994, MUCH OF THIS AREA WAS REZONED.
TWO INDUSTRIAL FACILITATE, UH, DEVELOPMENT INCLUDING, UH, TWO OF THE THREE OF THE PROPERTIES ON THE WEST SIDE OF WILDCAT.
UM, THE CURRENT APPLICANT IS LOOKING TO EXPAND THEIR PROPERTY, UM, FOR MEDICAL PURPOSES, UH, BUT THE ZONING CODE PRECLUDES THE EXPANSION OF A NONCONFORMING USE.
UH, SO THEREFORE WE'VE, UH, HAVE SUGGESTED THAT THEY REZONE THE APPLIC, UH, THE PROPERTY TO R ONE.
WE ALSO THEN REACHED OUT TO OWNERS OF THE ADJACENT PROPERTIES THAT ARE ALSO RESIDENTIAL,
[00:40:01]
BUT ZONE ZONED.I ONE, UM, THE OWNER OF, UH, 77 77 WILDCAT ROAD ALSO RESPONDED AND WANTED TO BE INCLUDED IN THIS REZONING REQUEST.
BEST WE HAVE TWO PARCELS AND GOING THE WRONG WAY HERE IS THE, UH, THE SITE.
THERE ARE THE, THE TWO PROPERTIES IN QUESTION, UH, BOTH SINGLE FAMILY HOMES.
UM, THE BOTH PROPERTIES MEET THE R ONE DISTRICT STANDARDS.
THEY ARE CURRENTLY NE LEGAL NONCONFORMING, UH, USES THIS CHANGE WILL BE, UH, ALLOW THEM TO BECOME LEGAL CONFORMING USES.
UH, AND THE ALSO WE BELIEVE THAT THIS REZONING WILL FACILITATE A SMOOTHER REAL ESTATE TRANSACTION IF THEY DECIDE TO SELL IN THE FUTURE.
ADDITIONALLY, IT PROBABLY PROTECTS, UH, THE PROPERTIES OF THE RESIDENTIAL PROPERTIES TO THE WEST A LITTLE BIT BETTER THAN HAVING FOUR ACRES ZONED.
UH, I ONE IMMEDIATELY A BUDDING THEM.
UH, IT'S OUR RECOMMENDATION TO REZONE THE PROPERTY FROM I ONE TO R ONE.
UM, IT IS APPROPRIATE THESE STRUCTURES ARE, UH, CURRENTLY OCCUPIED AND THE OWNERS PLAN TO MAINTAIN THEM AS RESIDENTIAL USES.
THE PLANNING COMMISSION VOTED THREE TO ZERO TO RECOMMEND THIS REZONING QUESTIONS OF ME.
UH, NEXT WE WILL CALL ON, UH, YOUR REPRESENT.
SO MR. BAER OR MS. CARR HERE TO MAKE ANY COMMENTS OR TO PROVIDE ANY ADDITIONAL INFORMATION THIS EVENING DOES, IT DOESN'T APPEAR THAT THEY'RE HERE.
NEXT I WOULD CALL ON OUR LAW DIRECTOR TO MAKE ANY COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION IF THERE IS ANY.
NO ADDITIONAL COMMENTS, MR. MARY.
NEXT, IS THERE ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF THE APPROVAL OF THIS PARTICULAR ZONING ISSUE? OKAY.
IS THERE ANYONE PRESENT WHO WISHES TO SPEAK AGAINST THE APPROVAL OF THIS ZONING ISSUE? OKAY, NEXT, I'D CALL ANY MEMBERS OF COUNSEL, UH, TO MAKE ANY KIND OF COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION THAT ANY OF YOU MAY HAVE.
AND I WOULD ASK ONE LAST TIME IS EVERYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF OR AGAINST THIS ZONING ISSUE? OKAY.
SO BARRING ANY FURTHER COMMENTS, THE PUBLIC HEARING, BUT THE CITY COUNCIL FOR CASE RZ 22 DASH 41, HEREBY CLOSED, CLOSED, AND
[ A Public Hearing Scheduled For January 23, 2023 By The Huber Heights City Council For Case MJC 22-43. The Applicant Is John Kopilchack. The Applicant Is Requesting Approval Of A Major Change To The Basic And Detailed Development Plan For Property Located At 8501 Old Troy Pike And Further Described As Parcel Number P70 04006 0156 On The Montgomery County Auditor's Map.]
NEXT UP IS ITEM 12 C.ITEM 12 C, A PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUBER HEIGHTS CITY COUNCIL FOR CASE MJC 22 DASH 43.
CHECK THE APPLICANT IS REQUESTING APPROVAL OF A MAJOR CHANGE TO THE BASIC AND DETAILED DEVELOPMENT PLAN FOR PROPERTY LOCATED AT 8,501 OLD TROY PIKE, FURTHER DESCRIBED AS PARCEL NUMBER P 70 0 4 0 0 6 0 1 56 ON THE MONTGOMERY COUNTY AUDITOR'S MAP.
IN THE PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE KEEP RIGHTS CITY COUNCIL FOR CASE MJC.
22 DASH 43 IS NOW OPEN AND I WOULD CALL ON CITY STAFF MR. SHERELL TO MAKE THE INITIAL PRESENTATION.
UH, SO THIS CASE IS ESSENTIALLY A AR REAR ADDITION TO AN EXISTING, UH, DEVELOPMENT.
SO THIS IS A MAJOR CHANGE TO ADD, UH, ROUGHLY 11,000 SQUARE FEET TO THE EXISTING DAYTON CHILDREN'S MEDICAL CENTER, UH, BUILDING THE, UH, CITUS VIEWPOINT, EIGHT ACRES CURRENTLY ZONED PLANNED COMMERCIAL.
UH, IT IS A MEDICAL FACILITY IN CURRENT OPERATION.
THE ORIGINAL REZONING AND BASIC DEVELOPMENT PLAN WAS APPROVED IN 2014.
THEY'RE LOOKING TO EXPAND THIS USE, UH, BECAUSE IT'S BEEN SUCCESSFUL.
THERE IS A MINOR EIGHT SPACE, UH, PARKING REDUCTION WITH STAFF DEALS IS, IS FAIRLY INCONSEQUENTIAL TO THIS DEVELOPMENT.
UH, HERE IS THE SITE, UM, JUST NORTH OF US, UH, ON OLD TROY PIKE.
UH, THIS IS A RENDERING OF WHAT THE REAR ION WILL LOOK LIKE.
THEY WILL BE CARRYING THE SAME MATERIAL PATTERN.
UM, LANDSCAPING, UH, THIS IS BASICALLY THE BREAK.
THIS IS THE EXISTING BUILDING.
THIS IS ANOTHER PERSPECTIVE LOOKING TO THE EAST.
UH, HERE IS THE, UH, SITE PLAN, UH, SHOWING THE ADDITION.
IT REMOVES ABOUT EIGHT PARKING SPACES, BUT THE LANDSCAPING THEME IS MAINTAINED AND, UH, AND EXPANDED THE, THE PROPOSED USE CONFORMS TO THE DISTRICT REQUIREMENTS AND THE EXISTING, UM, PLANNED USE DEVELOPMENT.
UM, AS I SAID, WE FEEL THAT THE IMPACT ON PARKING IS NEGLIGIBLE.
THE APPLICANT HAS, UH, INDICATED US THAT IN SIMILAR FACILITIES THAT THEY HAVE BUILT AROUND THE REGION, UH, THE, THE AVERAGE NUMBER OF PARKING SPACES AROUND 140.
SO WE FEEL THAT THEY HAVE AMPLE PARKING TO, UM, TO PROVIDE TO THEIR, UH, CUSTOMERS.
LANDSCAPE MATERIALS ARE SIMILAR TO THE EXISTING FACILITY.
UM, THE EXPANSION WILL ADD 12 ADDITIONAL
[00:45:01]
EXAM ROOMS BRINGING TOTAL TO ABOUT 40, UH, AND THEN THE TOTAL SIZE TO JUST UNDER 35,000 SQUARE FEET.AS I MENTIONED, WE DO FEEL THAT THIS, UH, PARKING, UH, LOSS IS MINIMAL.
UH, STAFF FEELS THAT THE GENERAL STANDARDS, UH, UNDER CHAPTER 1170 1.06 CAN BE SATISFIED AND WE RECOMMEND APPROVAL.
PLANNING COMMISSION VOTED THREE TO ZERO TO RECOMMEND APPROVAL.
UH, THE APPLICANT IS HERE IF YOU HAVE QUESTIONS OF HIM.
UH, NEXT, I, SO MR. KOBOCHA WAS HERE TO SPEAK EARLIER, SO WE'D GO AHEAD AND INVITE HIM TO COME TO THE PODIUM AND MAKE ANY, UH, QUESTIONS OR, UH, OR MAKE ANY COMMENTS, UH, THAT HE HAS.
MY NAME IS JOHN COPPEL, CHECK WITH SYNERGY BUILDING SYSTEMS AT 3,500 PENTAGON BOULEVARD AND BEAVER CREEK.
UM, REALLY NOTHING ADDITIONAL FROM WHAT AARON PRESENTED, UNLESS THERE IS A QUESTION SPECIFIC OF ME.
I DO, UH, WANNA REITERATE THE REQUEST OF POTENTIALLY VOTING TONIGHT AND WAIVING THE, THE SECOND MEETING IF THAT IS POSSIBLE.
UM, BUT OTHER THAN THAT, IF YOU HAVE ANY QUESTIONS, I'M, I'M HERE TO ANSWER THAT.
UH, AND ACTUALLY CALL THE LAW DIRECTOR IF HE HAS ANY OTHER COMMENTS, UH, OR ANY ADDITIONAL INFORMATION.
IS THERE ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF THIS PARTICULAR ZONING ISSUE? IS THERE ANYONE PRESENT WHO WISHES TO SPEAK AGAINST THE APPROVAL OF THIS ISSUE? ANYONE FROM CITY COUNCIL WISH TO MAKE ANY COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION? RICHARD, THANK YOU MAYOR AARON, THIS QUESTION'S GONNA BE FOR YOU DURING THE, UH, DISCUSSIONS OF PLANNING COMMISSION AND, UM, AND THE LAST WORK SESSION OR MAYBE EVEN ANY MEETINGS THAT YOU'VE HAD, UH, REGARDING THIS MATTER.
HAS THERE BEEN ANY CONVERSATIONS AS TO, UM, UH, ROADWAY INFRASTRUCTURE UPGRADES, UH, TO THE AMOUNT OF WE'RE INCLUDING, UH, AN UPGRADE OF 40 EXAM ROOMS? I ASSUME THAT'S GOING TO BRING, BRING IN AN INCREASED TRAFFIC FLOW.
WOULD I BE CORRECT IN THAT? UH, YEAH.
UH, THE, WE WOULD ANTICIPATE, UM, A MINOR INCREASE IN, IN TRAFFIC FLOW HERE.
SO, UM, IS THE APPLICANT, UH, WILLING TO, UM, PROVIDE, UM, OR UPDATE ANY TYPE OF, UM, IN, OUT, UH, SIGNAGE, UM, AND OR INFRASTRUCTURE UPGRADES TO THE PROPERTY AS THAT IS VERY CLOSE TO LOWE'S AND SHARES A MAIN DRAG NEXT TO LOWE'S? UM, I KNOW VISITING THERE, UH, WITH THE INCREASED TRAFFIC WE ALREADY HAVE IS, YOU KNOW, STARTING TO BOTTLENECK THAT INTERSECTION BECAUSE EVERYBODY IS NOW SKIPPING THE EXECUTIVE, UH, LIGHT AND THEY WILL GO ALL THE WAY UP TO THE SHAW LIGHT TO TURN IN JUST TO ACCESS THAT ENTIRE PLAZA.
SO THIS DISCUSSION DID NOT COME UP, UM, WITH, UH, DURING THE PLANNING COMMISSION MEETING ABOUT THE NEED FOR, UH, ADDITIONAL INFRASTRUCTURE OR ACCESS, UM, TO THIS SITE.
UM, DURING THE DETAIL DEVELOPMENT PLAN PHASE, WE CAN TALK TO THE APPLICANT, UH, ABOUT ADDITIONAL SIGNAGE.
UM, BUT IT, THAT ISSUE WAS NOT RAISED BY STAFF.
THE PLANNING COMMISSION OR THE APPLICANT AT THE, UH, BASIC DEVELOPMENT PLAN SI THE MAJOR CHANGE HEARING.
THAT WOULD BE THE, UH, THE ONLY CONCERN THAT I HAVE WOULD HAVE MOVING THIS FORWARD.
UM, AS, AS WE ARE HAVING INCREASED BUSINESS DEVELOPMENT IN THAT PLAZA, UM, WE ARE HAVING, YOU KNOW, WE'RE ASKING FOR INCREASED TRAFFIC AT THAT INTERSECTION, UH, WITHOUT ANY PROPOSED.
I MEAN, EVEN IF YOU GO THERE RIGHT NOW, THERE'S NOT EVEN ANY MORE LANES.
IT IS LITERALLY A FREE FOR ALL.
UM, SO AT THE VERY BEST, WE NEED TO RE-MARK THE LANES.
WE NEED TO WORK WITH THE APPLICANT, UM, OR THE PROPERTY OWNER TO, UH, TO INCREASE SOME TRAFFIC FLOW, UH, SIGNAGE IN THAT AREA.
UM, BECAUSE AGAIN, EVERYBODY'S STARTING TO USE THAT PARTICULAR LIGHT TO ACCESS THAT AREA.
UM, AND WITH AN INCREASE OF 40 ROOMS AND WITH SOME ADDITIONAL BUSINESS DEVELOPMENT IN THAT AREA, UM, THAT, THAT DOES CAUSE ME A BETTER PAUSE.
SO WE WILL, UH, WORK WITH THE APPLICANT AND I'LL TALK TO ENGINEERING AND WE WILL, WE'LL DISCUSS ADDITIONAL, UH, ROADWAY MARKINGS AND ADDITIONAL SIGNAGE AS WELL.
MAYOR, WITH THOSE, UH, WITH THOSE ITEMS BEING ADDRESSED BY STAFF, I'VE GOT NO ISSUES MOVING UP FORWARD.
ANY OTHER QUESTIONS? ANY OTHER QUESTIONS FROM COUNSEL? OKAY.
IS THERE ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF OR AGAINST THE APPROVAL OF THIS PARTICULAR ZENNING CASE? OKAY.
THE PUBLIC HEARING BY CITY COUNCIL FOR CASE MJC 22 DASH 43.
[ A Public Hearing Scheduled For January 23, 2023 By The Huber Heights City Council For Case TA 22-42.1. The Applicant Is The City Of Huber Heights. The Applicant Is Requesting Approval Of An Amendment To Section 1123.53 Of The Huber Heights City Code To Permit Home Occupations.]
NEXT WE HAVE ITEM 12 D, ITEM 12 D A PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUBER HEIGHTS CITY COUNCIL FOR CASE TA 22 DASH 42.1.THE APPLICANT IS THE CITY OF HUBER HEIGHTS.
THE APPLICANT IS REQUESTING APPROVAL OF AN AMENDMENT
[00:50:01]
TO SECTION 1 1 23 0.53 OF THE HUBER HEIGHTS CITY CODE TO PERMIT HOME OCCUPATIONS.AND THE PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUMAN RIGHTS CITY COUNCIL FOR CASE TA 22 DASH 42.
ONE IS OPEN AND WE WOULD FIRST CALL ON CITY STAFF MR. SORELL TO MAKE THE INITIAL PRESENTATION.
SO THIS PROPOSED TEXT AMENDMENT, UM, EXPANDS THE, UM, THE CURRENT HOME OCCUPATION DEFINITION AND, AND ALLOWABLE USES.
UH, PEOPLE ARE WORKING FOR HOME A LITTLE BIT MORE.
UH, WE FEEL THAT THERE'S AN OPPORTUNITY TO, UM, ALLOW PEOPLE TO HAVE, UM, A LITTLE BIT MORE FREEDOM ON WHAT IS CONSIDERED A HOME OCCUPATION, UH, AND EXPAND THOSE REGULATIONS.
UH, I'LL JUST HIGHLIGHT SOME OF THE CHANGES FROM THE EXISTING, UH, CODE.
UM, THIS WOULD ALLOW THE HOME OCCUPATION TO BE, UH, IN AN ACCESSORY BUILDING AS WELL AS THE DWELLING.
SO THERE ARE A NUMBER OF PEOPLE WHO HAVE DETACHED GARAGES THAT HAVE BUILT, UH, THAT COULD BUILD OUT AN OFFICE, UH, OR A BARN IN THE AGRICULTURAL AREAS.
UM, SO IT WOULD ALLOW HOME OCCUPATION THERE.
IT WOULD ALSO ALLOW, UH, ONE ADDITIONAL PERSON WHO DOES NOT RESIDE AT THE HOME, UH, AS PART OF THE OCCUPATION.
SO, UH, THINK OF AN ACCOUNTANT WHO, UH, ADDS ADDITIONAL HELP DURING TAX TIME, WHO IS WORKING OUT OF THEIR HOME.
UH, ALSO ALLOWS ONE NON ILLUMINATED, UM, BUILDING SIGN TO BE PLACED ON THE, THE DWELLING OR THE ACCESSORY BUILDING.
UM, AS PART OF THAT HOME OCCUPATION.
CURRENTLY, WE DO NOT ALLOW ANY SIGNAGE FOR A HOME OCCUPATION.
SECONDLY, UM, IT DOES ALLOW, UH, SERVICES, UH, AS PART OF A HOME OCCUPATION AND WOULD SPECIFY THAT, UH, NO MORE THAN TWO CUSTOMERS, UH, INCLUDING THOSE ARE ARRIVING, UH, CAN BE, UH, SERVICED AT ANY ONE TIME.
UH, THEN WE LIST OUT THE EXAMPLES OF, UH, PERMITTED TYPES OF HOME OCCUPATIONS, AND THEN ALLOW, UH, CITY STAFF TO, UH, DETERMINE IF A, UH, PARTICULAR USE THAT IS NOT ENUMERATED HERE, UM, WOULD FIT UNDER THE, UH, HOME, UH, OCCUPATION.
IF THERE ARE QUESTIONS, WE WOULD SEND IT TO THE, UH, BZA FOR INTERPRETATION.
AND NEXT I'D CALL THE WATER RECORD OR MAKE ANY COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION.
AND NEXT, I WOULD ASK IF THERE'S ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF APPROVAL OF THIS PARTICULAR ZONING CASE.
IS THERE ANYONE PRESENT WHO WISHES TO SPEAK AGAINST THE APPROVAL OF THIS PARTICULAR ZONING ISSUE? ANYONE FROM COUNSEL HAVE ANY COMMENTS THEY WOULD LIKE TO MAKE? ONE LAST TIME.
IS THERE ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF OR AGAINST THIS PARTICULARS IN CASE? OKAY.
THE PUBLIC HEARING BY CITY COUNCIL FOR CASE TA 22 DASH 42.
[ A Public Hearing Scheduled For January 23, 2023 By The Huber Heights City Council For Case TA 22-42.2. The Applicant Is The City Of Huber Heights. The Applicant Is Requesting Approval Of An Amendment To Sections 1123 And 1142 Of The Huber Heights City Code Regarding Bed And Breakfast Establishments.]
NEXT UP WE HAVE ITEM 12, D E E, I'M SORRY, ITEM 12 E, A PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUBER HEIGHTS CITY COUNCIL FOR CASE TA 22 DASH 42.2.THE APPLICANT IS THE CITY OF HUBER HEIGHTS.
THE APPLICANT IS REQUESTING APPROVAL OF AN AMENDMENT TO SECTION 1123 AND 1142 OF THE HUBER HEIGHTS CITY CODE REGARDING BED AND BREAKFAST ESTABLISHMENTS.
AND THE PUBLIC HEARING IS SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUBER HEIGHTS CITY COUNCIL FOR CASE TA.
22 DASH 42 2 IS NOW OPEN, AND AS PREVIOUSLY, WE WOULD CALL ON MR. CLL, OUR STAFF TO MAKE THE INITIAL PRESENTATION.
UM, SO THIS TEXT AMENDMENT WOULD, UM, PERMIT, UH, BED AND BREAKFAST ESTABLISHMENTS AS A SPECIAL USE IN THE AGRICULTURAL DISTRICT.
WE'RE ONE OF THE FEW JURISDICTIONS THAT DOESN'T, UH, DEFINE OR PERMIT BED AND BREAKFAST, UH, ANYWHERE IN THE CODE.
SO BED AND BREAKFAST IS ANY, UH, PLACE OF LODGING THAT PROVIDES FOR FOUR FEWER ROOMS FOR RENT ON A TEMPORARY BASIS IN THE OWNER'S PERSONAL RESIDENCE, UH, AND IS ALSO OCCUPIED BY THE OWNER, UH, DURING THE TIME OF RENTAL.
AND WHEREBY MEALS ARE ONLY SERVED TO GUESTS, THAT IS A PRETTY STANDARD DEFINITION OF A BED AND REAKFAST, UH, USED THROUGHOUT THE COUNTRY.
UM, WE WOULD HAVE A SET OF STANDARDS THAT, UH, WOULD APPLY TO ALL BED AND BREAKFAST ESTABLISHMENTS.
THEY WOULD ONLY BE ALLOWED WITHIN A SINGLE FAMILY, UH, DETACHED DWELLING OR ACCESSORY STRUCTURE UNLESS THE BZA WOULD, UH, GRANT OTHERWISE THE OWNER WOULD LIVE FULL-TIME ON THE DWELLING.
UH, NO MORE THAN, UH, FIVE BEDROOMS IN NEED.
DWELLING WOULD BE USED FOR THE BED AND BREAKFAST LODGING.
THERE WOULD BE, UH, ONE BATHROOM, AT LEAST ONE BATHROOM DEDICATED TO, UH, GUEST USE OFF STREET.
UM, PARKING WOULD BE PROVIDED FOR EACH BEDROOM USED AS GUEST LODGING IN ADDITION TO WHATEVER IS REQUIRED, UH, FOR THE NORMAL SINGLE FAMILY, UH, DWELLING U UH, COSTS, OR EXCUSE ME, DWELLING UNITS.
[00:55:01]
ARE THREE ROOMS, WE CURRENTLY REQUIRE THREE, UM, OFF-STREET PARKING SPACES FOR A SINGLE FAMILY DWELLING THE BED AND BREAKFAST WOULD HAVE TO PROVIDE SIX, UH, OFF STREETE UH, SPACES.UM, WE WOULD STIPULATE THAT THERE IS NO EXTERIOR, UH, OR OUTWARD APPEARANCE OF, OF CHANGE TO THE BUILDING OR PREMISE THAT THIS FUNCTIONS OR LOOKS.
I GET FUNCTIONS AS A SINGLE FAMILY.
UH, USE MEALS WILL BE PROVIDED FOR THE GUESTS ONLY SO THAT WE'RE NOT OPERATING A LUNCH OR DINNER RESTAURANT.
THIS IS FOR THE, UH, THE GUESTS ONLY.
UH, AND THEN WE SPECIFY THAT THE GUESTS WOULD ONLY BE ABLE TO, UM, RESIDE THERE FOR NO MORE THAN THREE CON, UH, CONTINUOUS WEEKS PLANNING COMMISSION VOTED THREE TO ZERO TO RECOMMEND APPROVAL.
THANKS, AARON, APPRECIATE THAT INFORMATION.
AND NEXT I WOULD CALL ON, UH, A LAW DIRECTOR, UH, TO MAKE ANY COMMENTS TO PROVIDE ANY ADDITIONAL INFORMATION.
NEXT I WOULD ASK, IS THERE, IS ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF THE APPROVAL OF THIS ISSUE? IS THERE ANYONE PRESENT WHO WISHES TO SPEAK AGAINST THE APPROVAL OF THIS ISSUE? HERE WE HAVE A GENTLE BEHIND, OH, I'M SORRY, PAUL SHAFFER.
UH, AND, AND I PROBABLY SHOULD COUCH MY, UH, COMMENTS HERE WITH REGARDS TO THIS, UH, AS APPLYING TO ALL OF THE TA 22 DASH 42, UM, PUBLIC HEARINGS.
AND THAT IS THAT, UH, AS A HOMEOWNER AND AS A MEMBER OF MY HOMEOWNER'S ASSOCIATION, I'M CONCERNED ABOUT THE ABILITY OF THE CITY TO ACTUALLY, UH, MONITOR, EXAMINE, UH, AND, AND, UH, ENFORCE THESE NEW ORDINANCES.
GIVEN THAT WE ALREADY HAVE A PROBLEM ENFORCING THE ORDINANCES THAT WE HAVE IN PLACE, UH, PARTICULARLY FROM HOMEOWNER'S PERSPECTIVE, HOMEOWNER'S ASSOCIATION PERSPECTIVE.
UM, THE HOMEOWNER'S ASSOCIATION MUST DEFER TO THE CITY ORDINANCE IS WHAT CITY TO SUPPLY.
AND, UH, WE'RE CONCERNED THAT THESE ORDINANCES ACTUALLY BE ABLE TO BE ENFORCED.
NEXT, I WOULD ASK ANYONE ON CITY COUNCIL HAVE ANY COMMENTS, UH, TO MAKE OR PROVIDE ANY ADDITIONAL INFORMATION? UH, YES, DON.
ON THIS PARTICULAR TEXT AMENDMENT, AARON, THE, UM, LANGUAGE STATES THAT, UH, THE BED AND BREAKFAST ESTABLISHMENTS SHALL ONLY BE PERMITTED WITHIN A SINGLE FAMILY DETACHED, DWELLING OR ACCESSORY STRUCTURE, AND, BUT THEN FOLLOWS UP WITH, UM, THE OWNER OF THE PREMISES, UH, SHALL RESIDE FULL-TIME IN THE DWELLING.
WAS THERE ANY DISCUSSION DURING PLANNING COMMISSION, UH, OR, UH, IN GOING OVER THIS THAT TO ME, IT, IT APPEARS TO BE A CONFLICT.
HOW DO YOU HAVE AN ACCESSORY BUILDING, UM, IN AN AG DISTRICT THAT WOULD QUALIFY AS A BED AND BREAKFAST? SO THE IDEA BEHIND THAT WAS THAT THERE COULD BE, UM, SO LET ME BACK UP.
I THINK WHEN I SURVEY THE COMMUNITY, UH, AND, AND, AND THINKING ABOUT HOW BEN BREAKFAST TYPICALLY, UM, OPERATE, THERE ARE PROBABLY A HANDFUL OF STRUCTURES THAT WOULD MAKE GOOD CANDIDATES.
UH, AND THOSE ARE THE OLDER FARM HOUSES THAT ARE ON CHAMBERSBURG OR TAYLORSVILLE OR POSSIBLY ON, UH, OLD TROY PIKE.
UM, IN, IN THOSE INSTANCES, THERE ARE, UM, SOME CARRIAGE HOUSES THAT COULD BE CONVERTED TO AN UPSTAIRS OR UPPER LOFT AREA AS PART OF A BED AND BREAKFAST.
THE RESIDENT WOULD STILL BE IN THE BUILDING.
UH, THERE WOULD LIKELY BE MAYBE ONE OR TWO, UH, ROOMS THERE, BUT THIS WOULD GIVE THEM THE OPPORTUNITY TO CREATE A UNIQUE UPPER LEVEL IN THE CARRIAGE HOUSE ROOM.
THAT'S, THAT WAS THAT PURPOSE.
JUST, AGAIN, I DON'T THINK THERE'S A LOT, BUT WE WANTED TO PROVIDE THAT OPPORTUNITY IN THE CODE IF, IF SOMEBODY DID WANT TO PURSUE THIS, UH, TYPE OF USE.
ANY OTHER QUESTIONS, COUNSEL? RICHARD? YES.
UH, AARON, UH, WALK ME THROUGH A SCENARIO HERE.
IF YOU DON'T MIND, INDULGE ME FOR JUST A MOMENT.
MAYOR, IF I CAN HAVE SOME LEEWAY ON THIS, PLEASE.
UM, AARON, UH, JOE, UH, DOWN ON CHAMBERSBURG, UH, WANTS TO, UH, BECOME A BED AND BREAKFAST AFTER COUNCIL MAY POTENTIALLY PASS THIS.
UM, WHAT WOULD JOE HAVE TO DO, UM, YOU KNOW, UH, ONCE THIS IS PASSED, ONCE THE 30 DAYS WOULD, WOULD MOVE FORWARD? WHAT'S THAT PROCESS LOOK LIKE FOR HIM? SO THE PROCESS WOULD BE, UM, EXTENSIVE.
UM, IF, FIRST FOR OUR, FOR OUR PURPOSES, UM, THEY WOULD APPLY TO THE BZA AS
[01:00:01]
A, FOR A SPECIAL USE TO CREATE THE, THE BED AND BREAKFAST USE.UM, THE APPLICATION, WHICH WE WOULD PUT TO, WE HAVEN'T PUT TOGETHER THE APPLICATION.
WE WILL IF THIS, UH, GOES FORWARD, BUT THE APPLICATION WOULD DELINEATE HOW MANY BEDROOMS, PARKING, THERE WOULD BE A SITE PLAN ASSOCIATED WITH THAT.
SO THERE WOULD BE, UM, FIRE INSPECTIONS AS WELL.
UM, IF THERE WAS A KITCHEN, THEY WOULD HAVE TO THEN GO TO THE, UM, COUNTY FOR, UH, COMMERCIAL KITCHEN HEALTH DEPARTMENT PERMITS.
SO OUR PART IS FAIRLY, IT'S IMPORTANT I WOULD SAY IN THE GRAND SCHEME OF THINGS OF, OF GETTING ALL OF THEIR PERMITS BETWEEN US, FIRE HEALTH DEPARTMENT, UH, AND COUNTY BUILDING.
IT WOULD TAKE AN INVESTMENT OF TIME.
SO THIS IS NOT PROBABLY SOMETHING THAT A CASUAL USER WOULD, UM, WOULD, UH, WOULD HEAD DOWN THAT PATH.
THIS IS SOMEBODY WHO IS RUNNING A BED AND BREAKFAST AS A, AS A, ESSENTIALLY AS AN OCCUPATION.
AND FOR THOSE WHO ARE MAYBE PAYING ATTENTION OR THOSE WITHIN THE REGION THAT ARE LOOKING AT SOME OF OUR ORDINANCE CHANGES, HOW IS THIS DIFFERENT FROM A, UH, A, A VRBO OR AN AIRBNB? UM, SO THE, THE, THE MOST STRIKING DIFFERENCE IS THE, THE RESIDENT, THE OWNER HAS TO LIVE ON SITE, WHEREAS YOUR VACATION BY OWNER OR YOUR AIRBNB IS SIMPLY A HOME THAT IS FOR SAY OR FOR RENT FOR WHATEVER PERIOD OF TIME THEY SO CHOOSE.
SO, SO YOU HAVE AN ACTIVE OWNER WHO IS THERE ALL THE TIME, WHICH IS COMPLETELY DIFFERENT THAN US.
YOUR TYPICAL AIRBNB OR, UH, VBR, R O.
SO IN THE, IN THE TEXT AMENDMENT, UH, THAT, UH, WAS SHOWN ON THE SCREEN, IT SAYS THE OWNER MUST LIVE THERE FULL-TIME.
BECAUSE WHEN YOU SAY FULL-TIME FOR ME, I LOOK AT WHAT I DON'T KNOW, THE IRS REGULATES AS A FULL-TIME RESIDENT WITHIN THE STATE, WHICH IS MORE THAN A MAJORITY OF THE YEAR, THAT WOULD CONSTITUTE US A FULL-TIME RESIDENT.
IT WOULD BE OUR, THE INTENT IS THAT THE PERSON LIVES HERE FULL-TIME.
WELL, NO, AND I, AND I GET THE INTENT.
I THINK EVERYBODY ON THIS COUNCIL GETS THE INTENT.
HOWEVER, WHAT I'M WORRIED ABOUT IS IF JOE COMES IN TO BZA AND THE INTENT IS NOT SPELLED OUT VERY CLEARLY IN BLACK AND WHITE, WHICH I KNOW I'VE HAD MULTIPLE CONVERSATIONS WITH THE CITY MANAGER AND, AND I BELIEVE WE AS A COMMUNITY ARE MISSING OUT ON FUNDING BECAUSE OF THE INCREASE OF AIRBNBS AND VERBOS, NOT ONLY IN OUR COMMUNITY, BUT THROUGHOUT THE REGION AND THE STATE.
UM, AND UNTIL WE TIGHTEN UP SOME LANGUAGE AND, AND GET MOVING ON THAT, I THINK, YOU KNOW, WE'RE MISSING AN OPPORTUNITY ON THAT.
SAME THING WITH BED AND BREAKFAST, UH, YOU KNOW, ESTABLISHMENTS.
UM, SO I, I PERSONALLY BELIEVE THAT'S SOMETHING THAT WE NEED TO DIG IN A LITTLE DEEPER ON.
UM, I, I KNOW SOME MAY ARGUE THAT THEY ARE SEPARATE ISSUES.
I BELIEVE THESE ARE ONE AND THE SAME, UM, YOU KNOW, ALLOWING THESE TYPES OF OPPORTUNITIES, UM, WITH OR WITHOUT THE, YOU KNOW, THE CITY NOTICING AS OF RIGHT NOW, AARON, CORRECT ME IF I'M WRONG, ANY PROPERTY WITHIN THE CITY OF HUBERT HEIGHTS CAN OPERATE AS AN AIRBNB OR A VRBO AND THE CITY NOT EVEN KNOW ABOUT IT? THAT'S CORRECT.
THE LAST TIME I LOOKED, THERE WERE ROUGHLY 12 TO 15 ON ANY GIVEN DAY OPERATING AS AN AIRBNB.
AND I, I KNOW FROM SOME ANNUAL CONFERENCES THAT I'VE BEEN TO AND SOME INFORMATION I'VE SHARED WITH THE CITY MANAGER, I SEE THAT NUMBER TO INCREASE, NOT ONLY BECAUSE OF WHERE WE SIT AT IN THE REGION, BUT WITH OUR GROWTH.
UM, I, I KNOW A LOT OF RESIDENTS AND CARRIAGE TRAILS THAT OPERATE AS WE SPEAK TODAY, UM, AS AIRBNB AND VERBOS, THESE ARE BRAND NEW HOMES THAT ARE BEING CONSTRUCTED.
UM, SO I I REALLY THINK THAT, YOU KNOW, BEFORE THIS COUNCIL, AND I KNOW I'M JUST ONE, ONE MEMBER, UM, BUT I, I THINK THAT'S SOMETHING THAT WE NEED TO DIG INTO A LITTLE BIT DEEPER.
UM, AND EITHER WE TIE IT INTO THIS OR, UH, WE ADD A SUBSECTION TO THAT, UM, BECAUSE I THINK THERE'S SOME CONFUSION, UH, ON WHAT CAN BE OPERATED TODAY AND WHAT CAN'T BE OPERATED TODAY.
AND ONE IS THIS COUNCIL'S INTENT, UM, WITH THE MAKEUP OF OUR COMMUNITY MOVING FORWARD.
SO THIS, THESE ARE, I WOULD SAY THAT THESE ARE SLIGHTLY DIFFERENT, UM, THAN YOUR AIRBNB OR VBRS AND, AND DEPENDING ON THE CITY, IT'S KIND OF SPLIT ON HOW THEY DO IT.
HALF OF THE CITY'S REGULATED THROUGH A BUSINESS LICENSE, THE OTHERS REGULATE IT THROUGH SOME QUASI ZONING.
I'M OF THE OPINION THAT IF WE'RE GONNA HEAD DOWN THAT PATH AND LOOK AT THAT, WE SHOULD LOOK AT IT THROUGH A BUSINESS LICENSING PERSPECTIVE AND NOT A LAND USE PERSPECTIVE.
UH, BUT WE CAN, IF THAT'S THE DIRECTION, WE CAN DO MORE RESEARCH FOR COUNCIL ON THAT, UH, ON THAT.
MA MAYOR, IS IT, UH, IS IT MY UNDERSTANDING THAT THIS MATTER IS GOING TO BE GOING TO A SECOND READING? YES.
THAT'S ALL I HAVE AT THIS TIME.
MAYOR, MAYBE SOMEBODY WOULD ANSWER THIS.
I'M NOT SURE WHOM WOULD WE BE TAXING THE BED AND BREAKFAST? SO AS TAXABLE INCOME SLASH AS
[01:05:01]
LIKE OTHER, WHEN I GO TO OTHER RESORTS, THEY HAVE RESORT FEES AND SUCH.UM, IN ALL OF OUR ZONING APPLICATIONS, UH, OUR ZONING PERMITS, THERE IS A, UM, SECTION THAT WE TURN TO THE FINANCE DEPARTMENT ON THE BUSINESS SIDE OF IT.
UM, I CAN'T TELL YOU HERE OFF THE TOP OF OF MY HEAD IF THIS WOULD, UM, FIT UNDER THE HOTEL MOTEL TAX.
UH, WE CAN GET BACK TO YOU ON THAT.
I, MY GUESS IS IT DOES, BUT I DON'T KNOW OFF THE TOP OF MY HEAD IF THAT IS A FULLY 100% ACCURATE STATEMENT.
I WOULD LIKE TO FOLLOW UP BECAUSE LIKE WE'RE MISSING OPPORTUNITY TO, YEAH.
I, I DON'T KNOW HOW IT WOULD BEST BE COMPETITIVE, NOT CHARGE A TAX OR CHARGE A TAX BECAUSE THEY ARE COMING HERE AND STAYING AND USING OUR ROADS.
THIS IS GONNA GO TO A SECOND READING, SO, SO JUST A QUESTION.
SORRY, I HOPE IT DIDN'T CATCH UP.
I THINK IT'D BE APPROPRIATE IF WE ACTUALLY ADDED THIS TO THE NEXT WORK SESSION ITEM REGARDING, UM, YOU KNOW, I MEAN NOW IS JUST A GOOD TIME TO TALK ABOUT V RVOS AND AIRBNBS AS ANY, UM, BUT I THINK I ALSO AGREE WITH AARON AS AN OUTSIDE A SEPARATE ISSUE ON THE BED AND BREAKFAST SIDE.
I THINK I WOULD LIKE TO SEE SOME TYPE OF LANGUAGE, AND IT DOES MEAN THE OWNER HAS TO BE THERE WHILE THE BED AND BREAKFAST IS BEING USED RATHER THAN JUST LIVING FULL-TIME.
I THINK THAT IS SOMETHING NEEDS TO BE DELINEATED IN THE LANGUAGE.
UM, BUT AGAIN, THIS IS GONNA GO TO ANOTHER READING AND IN THE MEANTIME WE'LL ADD THE VRBO AND THE AIRBNB ONTO A WORK SESSION AGENDA SO WE CAN HAVE THAT DISCUSSION ABOUT HOW WE THINK THAT NEEDS TO, UM, AT LEAST HAVE THE DISCUSSION ON WHERE WE, ON, HOW WE MOVE THAT FORWARD.
OKAY, NATHAN, UM, AND, AND WE WILL ADD THAT AS A SEPARATE ITEM SO WE CAN DIG FURTHER INTO THE AIRBNB'S.
YES, THE AIR, THE AIRBNB VERBAL WILL BE A SEPARATE WORK SESSION AGENDA ITEM.
THIS ITEM IS GONNA MOVE TO A SECOND READING ANYWAY, AND WE'VE, UH, AARON HAS TAKEN THE NOTES ON, ON WHAT OUR CONCERNS ARE TO MAKE THOSE CHANGES PRIOR TO THIS BEING VOTED ON.
AND UNLESS I MISSED SOMETHING WHEN YOU ANSWERED DON'S QUESTION, WHAT WE DISCUSS IS AT THE, UH, WORK SESSION NEXT TIME.
COULD YOU PLEASE GIVE US AN EXAMPLE OF HOW AN ACCESSORY BUILDING WOULD BE USED AS A BED AND BREAKFAST? SURE.
OKAY, ANY OTHER QUESTIONS? OKAY, SO I THINK WE ARE AT ONE LAST TIME ASKING IF THERE'S ANYONE HERE PRESENT WHO WISHES TO SPEAK IN FAVOR OF OR AGAINST THE APPROVAL OF THIS PARTICULAR ZONING ISSUE.
PUBLIC HEARING BY THE CITY COUNCIL FOR TA CASE 22 DASH 42 2 IS HEREBY CLOSED.
[ A Public Hearing Scheduled For January 23, 2023 By The Huber Heights City Council For Case TA 22-42.3. The Applicant Is The City Of Huber Heights. The Applicant Is Requesting Approval Of An Amendment To Section 1142 Of The Huber Heights City Code Regarding Automotive/Vehicle Repair.]
UP, WE HAVE ITEM 12 F, ITEM 12 F A PUBLIC HEARING SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUBER RIGHTS CITY COUNCIL FOR CASE TA 22 DASH 42.3.THE APPLICANT IS THE CITY OF HUBER HEIGHTS.
THE APPLICANT IS REQUESTING APPROVAL OF AN AMENDMENT TO SECTION 1142 OF THE HUMAN RIGHTS CITY CODE REGARDING AUTOMOTIVE AND VEHICLE REPAIR.
AND THE PUBLIC HEARING IS SCHEDULED FOR JANUARY 23RD, 2023 BY THE HUMAN RIGHTS CITY COUNCIL FOR CASE TA.
I WOULD CALL ON MR. CLL TO MAKE THE INITIAL PRESENTATION.
OKAY, SO THIS, UH, TEXT AMENDMENT WOULD ALSO BROADEN THE USES WITHIN THE AGRICULTURAL DISTRICT.
SO THIS WOULD PER, UH, PERMIT AS A SPECIAL USE, UH, AUTOMOTIVE VEHICLE REPAIR.
UH, THERE ARE LIMITED SPECIAL USES THAT ARE IN THE AGRICULTURAL DISTRICT.
THIS, UH, I BELIEVE WOULD PROVIDE APPROPRIATE STANDARDS, BUT DOES PROVIDE THE BZA WITH ADDITIONAL OPTIONS IF, UH, SOMEONE WERE TO COME FORWARD WITH, UH, WANTING TO DO THIS TYPE OF USE.
UM, UNLIKE A REZONING OR A VARIANCE, THE SPECIAL USE PERMIT DOES EXPIRE IF THAT, UH, INDIVIDUAL DISCONTINUES THAT USE FOR MORE THAN A YEAR.
UM, AS PART OF THE STANDARDS, THE, UH, WE'LL GO THROUGH THEM.
THE ACTIVITIES WOULD BE LIMITED TO SERVICING OF MOTOR VEHICLES WITH MINOR REPAIR WORK, INCLUDING ENGINE AND TRANSMISSION REPAIR WORK, UH, IN AN ENCLOSED BUILDING THAT IS, THAT IS KEY HERE FOR THE, WITHIN THE SPECIAL USE IS THIS IS A INTENDED TO BE A FULLY ENCLOSED OPERATION AND NOT PERFORMING WORK IN THE, IN THE YARD OR, OR IN THE REAR OF THE, OF THE, UM, LOT BODY WORK AND PAINTING WOULD BE PROHIBITED.
UH, STORAGE OF NON-OPERATIONAL VEHICLES FOR LONGER THAN A WEEK SHALL BE PROHIBITED.
UH, VEHICLES MUST BE ABLE TO MOVE A HUNDRED FEET, UM, UNDER THEIR OWN POWER WITHIN 24 HOURS NOTICE BY US.
UH, AND THEN ALL VEHICLES WOULD BE REQUIRED TO HAVE, UH, VALID, VALID LICENSES.
UM, PARKING STORAGE, UH, OR THE SALVAGING OF JUNK VEHICLES WOULD BE PROHIBITED.
UM, WE ALSO HAVE STANDARDS ON THE SETBACKS FROM BOTH THE ADJACENT, UH, PROPERTY LINE AND FROM THE RESIDENTIAL STRUCTURE.
SO IT'D BE SET BACK A MINIMUM OF 40 FEET FROM THE RESIDENTIAL LOT AND 200
[01:10:01]
FEET FROM UN ADJACENT RESIDENTIAL STRUCTURE.UM, THE PARKING AREA WOULD ALSO BE, UH, SET BACK FROM THE ADJACENT RESIDENTIAL LOT AND THEN SCREENED BY AT LEAST AN EIGHT FOOT, UH, SOLID FENCE OR DENSE, UH, DENSE HEDGE THAT WOULD OBTAIN A HEIGHT OF EIGHT FEET WITHIN TWO YEARS OF PLANTING.
THERE WAS SIGNIFICANT DISCUSSION ABOUT THIS, UH, AND WHETHER OR NOT THIS IS APPROPRIATE, UM, WITHIN THE, AS A SPECIAL USE WITHIN THE AGRICULTURAL DISTRICT BY THE PLANNING COMMISSION.
UM, THERE WERE ALSO DISCUSSIONS ABOUT UNINTENDED CONSEQUENCES TO, UH, SURROUNDING PROPERTIES IF THIS WERE PERMITTED.
UM, THERE WAS A MOTION TO RECOMMEND APPROVAL, UM, AND THAT BECAUSE THERE WERE ONLY THREE, UM, PLANNING COMMISSION MEMBERS, UH, WE NEEDED ALL OF THEM TO VOTE UNANIMOUSLY THEY DID NOT.
SO THE MO MOTION TO RECOMMEND APPROVAL, UH, FAILED BY A TWO TO ONE VOTE.
AND NEXT I'D CALL THE LAW DIRECTOR AND MAKE ANY COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION IF HE HAS ANY.
NO ADDITIONAL COMMENTS, YOUR MAYOR.
IS THERE ANYONE PRESENT WHO WISHES TO SPEAK IN FAVOR OF THE APPROVAL OF THIS ISSUE? OKAY.
IS THERE, THERE ANYONE PRESENT WHO WISHES TO SPEAK AGAINST THE APPROVAL OF THIS ISSUE? OKAY.
AND TONY DOES BRING UP, THERE WAS A EMAIL THAT WAS SENT, UH, TO COUNSEL FROM MRS. UH, GODSPEED, I GUESS, RIGHT? GOOD SPEED.
SO, UH, COUNSEL HAS THAT EMAIL AND SHE WAS ALSO SO RATHER THAN SHE WAS ABLE TO MAKE IT THIS EVENING, SO SHE DID SEND AN EMAIL THAT SHE IS AGAINST, UM, THIS PARTICULAR ISSUE.
SO THIS IS THE TIME TO BRING THAT UP.
COUNSEL HAS RECEIVED THAT EMAIL, EMAIL FROM COUNSEL WISHED TO PROVIDE ANY INFORMATION OR MAKE ANY COMMENTS ON THIS PARTICULAR ZONING CASE.
OKAY, ONE LAST TIME IS ROMAN PRESENT, WHO WISHES TO SPEAK IN FAVOR OF OR AGAINST THE APPROVAL OF THIS PARTICULAR ZONING CASE? OKAY.
BARRING ANY FURTHER COMMENTS, PUBLIC HEARING BY THE CITY COUNCIL FOR TA CASE 22 DASH 42.3.

22 DASH 42 DOT FOUR IS NOW OPEN.
AND ONCE AGAIN, MR. CRELL TO MAKE THE INITIAL PRESENTATION ON BEHALF OF STAFF.
UM, WE HAVE THREE SEPARATE, WE REFER TO SELF STORAGE, UM, FACILITIES IN THE ZONING CODE, THREE DIFFERENT WAYS.
UH, THIS WOULD COMBINE AND UNIFY WHAT A SHELF STORAGE FACILITY IS CONSISTENT WITH THE OHIO REVISED CODE DEFINITION.
SECONDLY, THIS WOULD MOVE THE, UH, UM, PERMITTED USE FROM THE COMMERCIAL DISTRICTS AND PLANNED COMMERCIAL TO I ONE I TWO AND THE PLANNED INDUSTRIAL DISTRICTS.
WE WOULD ALLOW AS A SPECIAL USE INDOOR SELF STORAGE FACILITIES IN THE PLANNED COMMERCIAL DISTRICT WHEN THEY ARE A PART OF A BUILDING THAT IS BEING REPURPOSED.
THINK OF THE, UH, EXISTING U-HAUL FACILITY THAT IS, UM, HERE IN HUBER HEIGHTS.
IT WAS A FORMER, I BELIEVE, KMART.
THERE'S ALSO ONE IN, UH, DOWNTOWN DAYTON.
THERE ARE SOME BIG BOX STORES THAT MAY SEE THE END OF THEIR LIFE, UH, AT SOME POINT IN TIME.
AND THAT COULD BE AN INTERIM USE WHILE THE DEVELOPER FIGURES OUT WHAT TO DO WITH IT.
NEXT I WOULD CALL THE LAW DIRECTOR, MAKE ANY COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION? NOTHING BAD.
NEXT, ANYONE PRESIDENT WHO WISHES TO SPEAK IN FAVOR OF THE APPROVAL OF THIS ZONING ISSUE, IS THERE ANYONE PRESENT WHO WISHES TO SPEAK AGAINST THE APPROVAL OF THIS ZONING ISSUE? ANYONE CITY COUNCIL WISH TO MAKE ANY COMMENTS OR PROVIDE ANY ADDITIONAL INFORMATION? YES, KATE.
MAYOR AARON, COULD YOU CLARIFY, SO THIS WILL ONLY HAVE INDOOR STORAGE ALLOWED AND OUTDOORS, NO MORE OUTDOOR STORAGE UNITS ALLOW, COULD YOU CLARIFY THAT FOR ME? YEAH, SO, UH, THE OUTDOOR STORAGE UNITS, THE TYPE WHERE YOU ACCESS THEM FROM THE OUTSIDE WHERE THERE ARE 25 ROLLUP DOORS, THOSE WOULD MOVE FROM BEING PERMITTED IN THE COMMERCIAL DISTRICTS TO ONLY BEING PERMITTED IN THE I ONE I TWO AND PLANNED INDUSTRIAL DISTRICTS.
ANY OTHER QUESTIONS FROM COUNSEL? COMMENTS? OKAY.
