THIS MEETING IS OFFICIALLY CALLED TO ORDER.

HE IS A PERSON LIKE THE FATHER AND THE SON.

I'M KAREN BACHMAN.

I RESIDE MORE FOR, I'M GOING TO READ FROM MY PAGES THIS EVENING SO I CAN STAY ON TRACK AND KEEP MY TIME TO A MINIMUM.

I'M HERE TONIGHT TO SPEAK ABOUT OUR CONCERNS WITH THE QUALITY OF WATER ISSUE THAT UNEXPECTEDLY PRESENTED ITSELF ON SEPTEMBER 22ND, 2021, I WENT TO TURN THE WATER ON IN OUR KITCHEN SINK TO DO DISHES.

AND AS I RUNNING, AS I WAS RUNNING THE WATER, I FELT I WAS FEELING FOR TEMPERATURE CONTROL.

WHEN I PULLED MY HAND BACK, I FELT THAT THERE WAS SOMETHING OILY IN THE WATER.

I ASKED MY HUSBAND WHO HAD JUST WALKED INTO THE KITCHEN TO TURN THE WATER ON AND SEE IF HE FELT ANYTHING.

HE SAID, IT FELT LIKE A FINE OIL THAT WAS IN THE WATER.

THIS LED US TO SUBMITTING A SAMPLE OF OUR WATER FOR OUR TESTING AT AN INDEPENDENT LAB THAT IS CERTIFIED IN THE STATE OF OHIO.

OUR THOUGHT THAT WAS MAYBE THAT IT WAS RELATED TO THE CURE IN PLACE, PIPING THE CIP DUE TO THE CHEMICAL MAKEUP AND HAVING OUR WATER SYSTEM OPEN TO POSSIBLE CONTAMINATION.

DURING RECENT PLACEMENT, SINCE WE ALL SHARE THE SAME WATER DURING THE TESTING PHASE, WE WERE ADVISED NOT TO INGEST, TO COOK OR BATHE IN THE WATER UNTIL WE HAD A DEFINITIVE RESULT OF WHAT WE WERE DEALING WITH.

SO WE HAD TO LET THE PROCESS RUN ITS COURSE DURING THAT TIME, IT WAS TRYING IT BEST WITH FIGURING OUT DAY-TO-DAY LIVING, NOT USING OUR MUNICIPAL WATER.

THE TOUGHEST PART THOUGH, WAS THE WAIT AND SEE GAME.

THE SAMPLE ACTUALLY GREW OUT A PATHOGEN, WHICH IS AN ORGANISM THAT CAN CAUSE AN ILLNESS.

THE PEOPLE WHO RUN THE GREATEST RISKS FOR GETTING SICK ARE PEOPLE WHO ARE IMMUNOCOMPROMISED.

IMMUNOSUPPRESSED ARE ELDERLY AND CHILDREN.

HAVEN'T SPOKEN WITH THE LAB DIRECTOR MULTIPLE TIMES THROUGH THE COURSE OF THIS SITUATION.

I HAD MANY QUESTIONS ANSWERED CONCERNING HOW CONTAMINANTS ENTER INTO OUR WATER SYSTEMS AND WHAT WE CAN DO TO PROTECT OURSELVES, QUOTING THE NATIONAL CENTER FOR BIOTECHNOLOGY, EXCUSE ME, FOR BIOTECHNOLOGY INFORMATION THROUGH THE U S NATIONAL LIBRARY OF MEDICINE STATES, THE INFRASTRUCTURE CHEMICAL GROWTH OF MICROORGANISMS, EVA, EVEN AS MICROBIAL COMMUNITIES AND DRINKING WATER SYSTEMS LEAD TO OUTBREAKS BREAKS OR LEAKS COULD LEAD TO LOW PRESSURE EVENTS.

WHEN REPAIRED PATHOGENS CAN ENTER OUR SYSTEMS WITH THIS BEING SAID, THE SIZE OF THE SCALE IS UNKNOWN.

DUE TO THE FACT OUR WATER SAMPLE WAS A SNAPSHOT IN TIME.

WE HAVE NO IDEA HOW LONG THIS HAS BEEN GOING ON HOW MANY THIS TRULY IS AFFECTED OR WILL AFFECT GOING FORWARD.

WHAT I DO KNOW FROM SPEAKING TO THE LAB DIRECTOR IS THAT THIS PATH THAT PATHOGEN SHOULD NOT BE IN OUR WATER PERIOD.

THE HUBER HEIGHTS DRINKING WATER QUALITY REPORT FOR 2020 IS THE MOST RECENT REPORT DUE TO EPA GUIDELINES.

THE REPORT STATES, THE EPA HAS COMPLETED A STUDY OF THE HUBER HEIGHTS, PUBLIC WATER SYSTEM, SOURCE OF DRINKING WATER TO IDENTIFY POTENTIAL CONTAMINANT SOURCES IN OUR DRINKING WATER SUPPLY.

ACCORDING TO THE STUDY, IT WAS DETERMINED THAT OUR RAW WATER SUPPLY HAS A HIGH SUSCEPTIBILITY TO CONTAMINATION.

THIS DETERMINATION IS BASED ON THE PRESENCE OF A RELATIVELY THIN LAYER OF CLAY OVERLAYING THE AQUIFER, THE SHALLOW DEPTH OF THE AQUIFER AND THE PRESENCE OF POTENTIAL CONTAMINANT SOURCES IN PROTECTION AREAS.

AS YOU HAVE JUST HEARD, WE HAVE A HIGH SUSCEPTIBILITY TO CONTAMINATION AT THE BEGINNING OF OUR WATER SOURCE, WHICH IS AT OUR AQUIFER, ADDING AN OPENING OUR WATER SYSTEM TO INTRODUCING OF CYPP THROUGH OUR CITY'S EXISTING AND THE HIGH NUMBER OF WATER MAIN BREAKS THAT FEED OUR HOME TAPS THIS YEAR IS A PERFECT STORM FOR THIS VERY THING TO OCCUR.

ACCORDING TO THE LAB DIRECTOR, EACH TIME THE SYSTEM IS OPENED AND OR BROKEN, THAT INCREASES THE CHANCES OF CONTAMINATION TO THAT SYSTEM.

THE HIGH NUMBER OF WATER MAIN BREAKS IS VERY CONCERNING TO US.

ONCE THERE IS A BREAK IN OUR SYSTEM THAT IS WASTED, TREATED WATER, ESCAPING, AND POSSIBLE CONTAMINANTS ENTERING IN THIS ISN'T JUST ABOUT OUR HOME AND OUR WATER.

SHOULDN'T ALL THE RESIDENTS HAVE SAFE, POTABLE WITHOUT HAVING TO BE CONCERNED USING OUR MUNICIPAL WATER THAT MIGHT MAKE THEM SICK.

THIS HAS BEEN A WELL LEARNED LESSON TO US PERSONALLY.

WE'VE TAKEN THE RECOMMENDATIONS SERIOUSLY AND IMPLEMENTED THEM AT OUR HOME.

I JUST WANT TO SAY, I APPRECIATE THE OPPORTUNITY TO SPEAK TO YOU THIS EVENING.

AND MY HOPE AND CONCERN IS THAT THIS RAISE, THIS RAISES AWARENESS ABOUT OUR WATER AND HUBER HEIGHTS AND HOW CONCERNING THIS IS FOR, FOR US

MY NAME IS JENELLE SMITH AND I AM A WARD, TWO RESIDENTS, AND I'M EXTREMELY CONCERNED ABOUT THE SITUATION WITH OUR WATER SUPPLY IN THIS CITY.

IN 2018, THERE WAS LEGISLATION PASSED BY THIS COUNCIL TO INCREASE THE WATER PRESSURE AND IMPLEMENT WATER SOFTENING THROUGHOUT OUR CITY.

IF I REMEMBER CORRECTLY, THOSE INITIATIVES NEVER WENT THROUGH OUR WATER AND SEWER BOARD.

I FOR ONE WAS OPPOSED TO THESE MEASURES FOR SEVERAL REASONS, OF COURSE, INDIVIDUALS ON THIS DIOCESE AT THE TIME AND IN THE COMMUNITY DECIDED TO MAKE ONE OF THOSE REASONS, A POLITICAL CAMPAIGN AGAINST ME, BUT THAT IS NOT WHY I SPEAK TO YOU THIS EVENING.

I BELIEVE THAT WE HAVE A MAJOR INFRASTRUCTURE CONCERNS IN THIS CITY THAT ARE NOT BEING ADDRESSED APPROPRIATELY IN JULY OF 2018 ASSISTANT CITY MANAGER, SCOTT BALL KOSKI SPOKE WITH COUNCIL REGARDING THE CITY, THE WATER STUDY, AND STATED THAT SOME OF OUR OLDER STREETS AND I HAVE, YOU KNOW, MOST OF YOU KNOW ME.

SO YOU KNOW THAT I'VE GOT MY DOCUMENTS AND I'M ALL TAPPED OUT HERE SO I CAN PULL THEM OUT AND READ THEM VERBATIM IF YOU NEED TO.

BUT FOR THE, FOR THE SAKE OF TIME, I'M GOING TO KNOW THAT YOU TRUST ME.

SO IN 2018 ASSISTANT CITY MANAGER, SCOTT, IF OUR KOSKI SPOKE TO COUNCIL REGARDING THE WATER STUDY AND STATED THAT SOME OF OUR OLDER STREETS HAVE OLDER WATER LINES, WHICH WILL NEED TO BE QUOTE, REPLACED, NOT REPAIRED, REPLACED, AND IN THIS OPPORTUNITY TO REPLACE THE WATER LINES AND THE STREETS AT THE SAME TIME.

NOW THAT'S VERY IMPORTANT.

THE STREETS AT THE SAME TIME, I DON'T BELIEVE THAT IS WHAT'S HAPPENING.

IT IS MY UNDERSTANDING THAT PORTIONS OF HUBBARD DRIVE OR RESURFACE LAST FALL, BUT THE WATER LINES WERE NOT REPLACED AS MR. FALKOWSKI RECOMMENDED THE SAME AREAS HAVE EXPERIENCED AT LEAST EIGHT WATER MAIN BREAKS SINCE THEN RESULTING IN EXCESSIVE TAXPAYERS' EXPENSE TO DIG UP AND REPATCH A BRAND NEW ROAD.

MORE IMPORTANTLY, EACH TIME THE WATER, THE WATER MAIN BREAKS.

IT IS MY UNDERSTANDING THAT THESE FAILURES INTRODUCE CONTAMINANTS AND PATHOGENS AND TO OUR WATER SUPPLY.

SOME OF THESE CONTAMINANTS, UM, ARE NOT EVEN BEING TESTED BY OUR CITY, FROM WHAT I'M BEING TOLD AS A RESULT, MANY OF OUR RESIDENTS ARE EXPOSED TO THIRD WARD, THIRD WORLD ISSUES REGARDING CLEAN WATER.

IT IS MY UNDERSTANDING BOIL ADVISORIES DO NOT ALLEVIATE ALL OF THE BACTERIA THAT CAUSES SIGNIFICANT HEALTH ISSUES, ESPECIALLY THOSE WHO ARE IMMUNE COMPROMISED, LIKE DIALYSIS PATIENTS, CHEMOTHERAPY PATIENTS, THOSE WHO HAVE ESPA RESPIRATORY INFECTIONS AND EVEN COVID AND A GLOBAL PANDEMIC, THE LIVING ENVIRONMENT WITH THE GLOBAL PANDEMIC LOVING ENVIRONMENT, IT'S EVEN MORE CRUCIAL TO HAVE CLEAN WATER RELATED TO THIS.

I WANT TO EXPRESS MY CONCERNS ABOUT THE 2020 ANNUAL, UM, WATER, UH, WATER QUALITY REPORT THAT IS LOCATED ON THE HUBER HEIGHTS WEBSITE AND LOOKING THIS OVER THE FOLLOWING STATEMENTS STUCK OUT TO ME.

AND IT'S THE SAME THING THAT MS. BACHMAN JUST, JUST READ.

THE EPA HAS COMPLETED A STUDY OF HUBER HEIGHTS, DRINKING WATER TO IDENTIFY POTENTIAL CONTAMINANTS SOURCES IN OUR DRINKING WATER SUPPLY.

IT WAS DETERMINED THAT OUR RAW WATER SUPPLY HAS HIGH SUSCEPTIBILITY TO CONTAMINATION.

THE DETERMINATION IS BASED ON THE PRESENCE OF RELATIVELY THIN LAYER OF CLAY OVERLAYING THE AQUIFER, THE SHALLOW DEPTHS OF THE AQUIFER AND THE PRESENCE OF, UH, AND THE PRESENCE OF POTENTIAL CONTAMINANT SOURCES AND THE PROTECTED AREA, POTENTIAL CONTAMINANT SOURCES IN THE PROTECTION AREA.

I'M GOING TO READ THAT AGAIN, ARE THESE CONTAMINANT SOURCES RELATED TO DUMPING ON TAYLORSVILLE,

THE RIVER FLOODING OVER THE ROADS? CAUSE WE HAVE TO CLOSE RIP RAP OR THE HIGH PERCENTAGES OF THE WATER MAIN BREAKS.

AND I DID, UM, JUST WANT TO LET YOU KNOW, I DID A GRAPH CHART OF THE WATER MAIN BREAKS AND IT'S NOT PRETTY.

SO WHEN WE TALK ABOUT TRANSPARENCY, BUT THIS APPEARS TO ME TO BE A MAJOR CONCERN, ESPECIALLY AFTER HEARING ABOUT THE SITUATIONS SURROUNDING HUBBARD AND THE IMPACT TO THOSE RESIDENTS.

I'M ALSO CONCERNED THAT MEMBERS OF THIS COUNCIL ARE NOT ON THE SAME PAGE I HAVE HERE RIGHT HERE.

I HAVE, I HAVE SOCIAL MEDIA.

I HAVE TWO COMMENTS RELATED TO SOCIAL MEDIA POST REGARDING THE WATER MAIN BREAKS BY COUNCILWOMAN NANCY BERGE AND MAYOR, UH, GORE DIRECTLY CONTRADICTING EACH OTHER AS TO WHETHER THE CITY WAS AWARE OF THE POSSIBILITIES BEFORE WE IMPLEMENTED THE WATER PRESSURE AND THE WATER SOFTENING PROJECTS.

NOW I HAVE A UNIQUE PERSPECTIVE ABOUT THIS BECAUSE I SAT UP THERE ON THE DAYAS DURING SOME OF THESE DISCUSSIONS, ACTUALLY QUITE MOST OF THEM MOVE ALONG, PLEASE, EXCUSE ME.

WE ARE MADE AWARE THAT THERE MAY BE ISSUES, BUT I DON'T BELIEVE THAT THE PROPER COURSE OF ACTION WAS TAKEN IN PLACE AND THE INITIATIVES WERE IMPLEMENTED.

MY LAST CONCERN IS RELATED TO THE POTENTIAL ANNEXATION FROM THE LAND THAT BETHEL TOWNSHIP, AS EVERYONE IS PROBABLY AWARE BY NOW, THERE IS TALK ABOUT ANNEXES 233 ACRES FROM BETHEL TOWNSHIP REQUIRING HUBER HEIGHTS TO SUPPORT APPROXIMATELY 900 MORE HOMES.

YET WE APPEAR TO BE STRUGGLING TO MAINTAIN WHAT WE ALREADY HAVE.

OUR INFRASTRUCTURE SEEMS TO BE COLLAPSING AND OUR SAFETY SERVICES APPEAR TO BE STRESSED TO THE MAX.

HOW ARE WE SUPPOSED TO SUPPORT 900 MORE FAMILIES WITHOUT DRAMATICALLY INCREASING OUR TAXES? FROM WHAT I UNDERSTAND AND CORRECT ME IF I'M WRONG, THE RESIDENTS AT PARKTOWN AND CARRIAGE TRAILS ARE CURRENTLY PAYING FOR INFRASTRUCTURE AND UP TO FOUR DIFFERENT METHODS.

AND THAT WOULD BE HOA, MOA FEES, SPECIAL ASSESSMENTS, THEIR WATER BILLS AND REGULAR TAXES THERE HAVE BEEN HAVE THERE BEEN ANY TRAFFIC STUDIES OR ENVIRONMENTAL STUDIES IF THE DEVELOPER WANTS TO BUY THE PROPERTY SO THAT THEY CAN DEVELOP IT, WHY CAN'T THEY DEVELOP IT AS PART OF THE GROWTH AT BETHEL TOWNSHIP, AS OPPOSED TO REQUIRING IT TO BE ANNEXED INTO HUBER HEIGHTS? IT MS. SMITH, I'M GOING TO ASK YOU TO SIT DOWN, PLEASE.

SO AGAIN, SOMEBODY KNEW SOMETHING ABOUT THAT.

THEN AT THE OCTOBER 11TH MEETING, YOU DEBATED WHETHER OR NOT YOU COULD RESCIND THE RESOLUTION THAT YOU PASSED ON THE 13TH.

UM, SO, AND THEN AFTER SOME BACK AND FORTH, THE LEGAL COUNSEL, MR. MCDONALD, YOU DECIDED THAT MR. MCDONALD'S SHOULD RESEARCH IT FURTHER, WHICH HE DID ON TUESDAY 10, 19.

UM, WE RECEIVED IT ON THURSDAY, 10 21.

HE ISSUED A STATEMENT WHICH SAYS IN PART THAT HE QUOTE, FINDS NO LEGAL WAY TO STOP THE ANNEXATION PROCESS PRIOR TO THE APPROVAL OF THE ANNEXATION BY THE COUNTY.

BUT THEN HE GOES ON TO SAY THAT QUOTE, IT IS MY OPINION THAT THE CITY'S

SOLE OPTION TO STOP ANNEXATION FROM TAKING PLACE IS TO VOTE AGAINST THE ANNEXATION UNDER SECTION 7 0 9 0.04, AFTER THE COUNTY PROVIDES AN APPROVED ANNEXATION PETITION TO THE CITY FOR A FINAL DECISION.

SO I WOULD RESPECTFULLY REQUEST THAT YOU DENY THAT YOU WOULD VOTE AGAINST THAT ANNEXATION PETITION THAT YOU DENY IT THAT'S POINT NUMBER ONE, PLEASE.

OUR SCHOOL CAN NOT KEEP PACE WITH THE NUMBER OF NEW STUDENTS.

WE GET 120 TO 130 ADDITIONAL STUDENTS EVERY YEAR.

THIS IS FIVE CLASSROOMS OF KIDS.

EVERY SINGLE YEAR WE GET THIS.

SO IT TAKES THREE YEARS TO BUILD A NEW BUILDING.

AND PLUS WE HAVE TO HAVE A MEANS TO FINANCE IT.

AND AS YOU GUYS KNOW, DUE TO THE WAY OHIO COLLECTS TAXES AND DETERMINES THE VALUE OF THE PROPERTY, THE STUDENT ARRIVES ON THE SCHOOL DOORSTEP 18 TO 24 MONTHS PRIOR TO US RECEIVING ANY TAX DOLLARS TO EVEN THINK ABOUT BEGINNING TO BUILD THOSE ADDITIONAL CLASSROOMS. SECOND REASON IS WE ARE PRIMARILY U S 40 AND STATE ROUTE TWO, A ONE AND 2 0 2.

SO WE DON'T CONTROL THE ROADS.

UM, IN OUR TOWNSHIP ALSO STATE ROUTE 5 71.

SO, UM, THESE ARE OUR MAJOR ROUTES OF TRANSPORTATION AND THEY ARE CURRENTLY NOT DESIGNED TO HANDLE THE ADDITIONAL TRAFFIC THEY'VE YET TO BE MODIFIED, TO SUPPORT THE CURRENT CARRIAGE TRAILS TRAFFIC LET ALONE ANOTHER 700 TO A THOUSAND HOUSEHOLDS WERE LACKING, TURN LANES, TRAFFIC SIGNALS, AND WIDER ROADS THAT ARE NEEDED TO SAFELY TRANSPORT OUR CHILDREN TO AND FROM SCHOOL.

AND ALSO TO HANDLE THE NUMBER OF CARS THAT WE EXPECT FROM 700 TO A THOUSAND HOUSEHOLDS.

THE THIRD REASON IS WE CHOOSE TO LIVE IN BETHEL TOWNSHIP BECAUSE WE LIKE RURAL LIVING.

WE LIKE GREENSPACE LIVING A BIT FROM OUR NEIGHBORS.

WE'D LIKE THE FARMLAND AND THE SMALL SCHOOL FIELD THAT WE HAVE.

THEY'RE ALL IMPORTANT TO US.

SO I'M ASKING THAT YOU PLEASE DEVELOP THE LAND YOU ALREADY OWN, RATHER THAN TAKING OURS AND TURNING OUR COUNTRY LIFESTYLE TO A CITY LIFESTYLE.

AND ALSO, I KNOW IT'S A HUGE ADVANTAGE FOR HUBER HEIGHTS AND YOU'RE TRYING TO MAKE THE BEST DECISIONS FOR HUBER HEIGHTS.

YOU GET A LOT OF THE TAX MONEY, BUT WE CAN ALL OF THE BURDEN, THE ROAD PROBLEMS, THE NUMBER OF STUDENTS THAT ARE COMING AT THE PACE BECAUSE OF THE HIGH DENSITY HOUSING DEVELOPMENT.

SO, YOU KNOW, BE OUR NEIGHBOR AND CONSIDER NOT, NOT ANNEX ANY MORE PROPERTY.

UM, HOWEVER THINGS TOOK A DANGEROUS TURN LAST YEAR, UH, MARCH 9TH, 2020, WHEN GOVERNOR DEWINE SAID THE PANDEMIC HAD REACHED OHIO AND FOR SMALL BUSINESSES TO SHUT DOWN, IT WAS PROMISED FOR TWO WEEKS.

IT TURNED INTO TWO MONTHS.

THE BIG BOX STORES REMAINED OPEN BECAUSE THEY WERE CONSIDERED ESSENTIAL.

SOME SMALL BUSINESSES TRIED TO FIND EXEMPTIONS TO WORK AROUND OR TO BE ALLOWED TO REOPEN THEIR DOORS.

SLOWLY MORE GUIDANCE WAS PROVIDED ALLOWING BUSINESSES TO ONCE AGAIN, OPERATE OVER 90% OF OHIOANS WEARING MASKS, SOCIAL DISTANCING, AND FOLLOWING OTHER GUIDELINES TO REDUCE THE SPREAD OF COVID.

THESE GUIDELINES WERE TREATED LIKE LAW OVER THE SUMMER OF 2020 BUSINESS IMPLEMENTED POLICY, BUT WELCOME ALL CUSTOMERS.

AND PERSONALLY, I FELT LIKE I WAS EXCEEDING AND KEEPING THE ECONOMY AFLOAT DIDN'T SEEM LIKE TOO MANY PEOPLE WERE GOING OUT, UM, AS I WAS NOT CONSIDERED A HIGH RISK FOR COVID.

SO, UM, BUT AFTER GOVERNOR HIS MANDATE ON MASK ACROSS OHIO, I FOUND OUT FIRSTHAND WHAT DISCRIMINATION FELT LIKE.

I AM PERSONALLY EXEMPTED, MEDICALLY EXEMPTED FROM WEARING A MASK.

UM, AND, BUT I COULDN'T SEE A DOCTOR.

I CAN'T GO GET AN EYE EXAM.

I STILL CAN'T TAKE MY KIDS TO THE DENTIST.

MY KIDS CAN'T ATTEND SCHOOL.

WE COULDN'T RIDE A PUBLIC BUS.

WE CAN'T FLY A DAY IN THE AIRPORT.

I CAN'T GO THE AIR FORCE MUSEUM OR I FREELY VISIT ANY ESTABLISHMENT.

WHEN I WENT TO THE STORE, AS I HEARD THE PROPAGANDA ABOUT WEARING A MASK AND SOCIAL DISTANCING, PEOPLE WOULD GIVE ME DIRTY, LOOKS, DODGE ME.

LIKE I HAD THE PLAGUE ONE PER PLACE, EVEN TRYING TO CALL THE COPS.

I REDUCED MY OUTINGS AND EVERY TRIP I FELT LIKE WHAT WOULD BE THE LAST I SHOPPED LIKE TOMORROW WOULD BE THE LAST THOUGHT DAY I'LL BE ALLOWED IT.

I HAD ANXIETY GOING OUT AND I HAD DEPRESSION CAUSE I HAD TO STAY IN HOW ARE THE BIGGEST UPSET WHEN I BEGAN HOMESCHOOLING MY CHILDREN AND I WAS ABLE TO GO TO THE LIBRARY UPON THE REOPENING, BUT THEN I WAS DENIED SHORTLY THEREAFTER BECAUSE THE DATE AND METRO LIBRARY SAID THEIR POLICY CHANGED TO REFLECT THE CITY OF DAYTON.

SO HOW DID I FIND OUT? THEY DIDN'T EVEN HONOR THE EXEMPTIONS MEDICAL EXEMPTIONS THAT WERE IN THE ORDERS OR THE CIVIL RIGHTS THAT DISABILITY AND RELIGION.

BECAUSE WHEN I TRIED TO ENTER THE LIBRARY, ONE DAY I HAD ABOUT SEVEN PEOPLE STOP ME.

THEY WERE BLOCKING THE DOORWAY, SEVEN PEOPLE, ME AND MY CHILDREN TRY AND GO INTO THE LIBRARY.

THEY FORMED ME.

I WAS NO LONGER ALLOWED ENTRY INTO THE PUBLIC LIBRARY UPON NOT BEING ABLE TO ENTER.

WE MISS ALL BROWSING FOR NEW BOOKS AND MOVIES, MISS OUT ON INFORMATION BEING POSTED AND THE PROGRAMS AND TUTORING'S AVAILABLE.

INSTEAD THEY WANT ME TO USE CURBSIDE PICKUP, JUST LIKE THE AFRICAN-AMERICANS USED TO HAVE TO USE BACK DOORS OR ALTERNATIVE METHODS TO ENTER ESTABLISHMENTS.

LIKE I'M A SECOND CLASS CITIZEN IS THIS HISTORY REPEATING ITSELF.

DOES THE CITY OF HUBER HEIGHTS REALLY SUPPORT SEPARATE IS EQUAL OR THAT GOVERNMENT BUILDING THAT IS OPEN TO THE PUBLIC AND HAVE THE RIGHT MEAN ADULTS AND YOUNG CHILDREN BY HAVING USED CURBSIDE.

IT'S LIKE WE HAVE THE COOTIES.

I'VE TRIED WORKING WITH THEM TO ATTAIN SPECIAL HOURS THAT THEY GAVE TO SIT SORT OF PEOPLE WHO ARE MEDICALLY CONSIDERED HIGH RISK.

I EVEN POINTED IT OUT, VIOLATED THEIR OWN POLICIES WHEN NO FORM OF COMMUNICATION WITH THE LIBRARY PEER TO WORK, I HAD TO SIT DOWN WITH THE MAYOR AND I ADDRESSED THE MULTIPLE LAWS THAT WERE VIOLATED.

HE SAID THAT HE WOULD WORK WITH THE CITY LAWYER AND TO LOOK INTO IT.

I HAVE NOT HEARD OF THAT YET.

PERSONALLY, I DON'T GIVE THE AUTHORITY TO LIBRARY OR BUSINESSES TO MAKE MEDICAL DECISIONS FOR ME AND MY FAMILY.

SO WITH THIS MAPPING, THEY HAVE LOOKED AT, UH, WHERE THE MOST BREAKS ARE, AND THAT'S WHERE THE IMMEDIATE ATTENTION IS FOR THINGS LIKE THE WATER LINING PROJECT AND WATER MAIN

REPLACEMENT PROJECTS.

AND THIS IS COMMON THING THROUGH THE YEARS OF WHAT HAS BEEN DONE, UH, WHERE WE ARE SEEING THE MOST BREAKS ARE AN OLDER AREAS WHERE CAST IRON WITH USED AN AREA OF MORE CORROSIVE SOILS.

UH, WE CURRENTLY SPECIFY DUCTILE IRON PIPING, WHICH IS LESS CORROSIVE AND MORE FLEXIBLE.

SO THERE'S LESS OF A CHANCE OF DETERIORATION AND BREAKS IN THE NEWER TECHNOLOGY.

UH, SO, UH, THIS YEAR, UM, UNDER THE SUPPORT AND DIRECTION OF COUNCIL, UH, A PILOT PROGRAM WAS LAUNCHED, UH, FOR THE LINING OF WATER MAINS.

AND A PART OF THIS WAS DISCUSSION SOME INFORMATION THAT WAS PASSED ON BY MS. BAKER ABOUT SOME OF THE, THAT IS ONE OF THE AREAS THAT HAD THE, UH, MORE BREAKS THAN OTHERS WAS IN HER WARD.

AND THAT JUST HAPPENS TO BE WHERE WE STARTED THIS PILOT PROGRAM FOR THE WATER LINING.

SO WE PUT, UH, OUR, UH, UH, INFRASTRUCTURE MONEY INTO THE LINING, WHICH WITH THAT PRODUCE THE SAVINGS OF APPROX APPROXIMATELY 25% OVER WATER MAIN REPLACEMENT.

SO THAT WAY WE CAN GET MORE FOR OUR DOLLAR THEN ALSO, UM, BECAUSE OF THE SUCCESS WE ARE SEEING NOW THAT THE FIRST PART OF THAT HAS BEEN DONE CITY ENGINEER'S BUDGETING FOR MORE LINING NEXT YEAR AND BEYOND, UM, AT A PREVIOUS MEETING, COUNCILMAN CAMPBELL AND COUNCILMAN SHAWL ASKED FOR FASTER SOLUTION.

AND WE ARE LOOKING FOR THOSE EXPEDITED WAYS TO FUND EXPANDED PROJECTS.

ONE OF THOSE WAYS COMES FROM EARLIER IN THE YEAR, SINCE THE CITY COUNCIL VOTED TO EXTEND THE MONTGOMERY COUNTY TIFF, UH, WHICH ALLOWS FOR MILLIONS OF DOLLARS IN INFRASTRUCTURE SPENDING.

SO THAT IS ONE POSITIVE THING.

THAT'S, UH, WE HAVE TO BE ABLE TO, UH, PLAN OUT OUR CIP PROGRAM AND DO MORE OF THE INFRASTRUCTURE.

ALSO STAFF ANTICIPATES IN THE NEW YEAR TO TRY TO BRING IN STATE REPRESENTATIVE PHIL PLUMBER IN TO, UH, HELP WITH ASSISTANCE WITH STATE FUNDING IS THAT WHAT'S BROUGHT UP IS ABOUT TRYING TO GET MORE STATE FUNDING.

UM, AS I MENTIONED ON FROM THE TRI-CITIES END, THAT IS SOME STATES INFRASTRUCTURE FUNDING THAT WE GET FOR THE SANITARY END OF THINGS, WE DID APPLY AS JUST THE CITY FOR SOME OTHER WATER MAIN.

UM, BUT IT DIDN'T SCORE AS WELL AS SOME OF THE OTHERS.

SO, UM, FOR THAT LINE, AND WE'LL KEEP, UH, GOING FORWARD WITH APPLYING FOR THOSE GRANTS AS WELL.

NOW, THE, UH, SOME OF THE THINGS THAT WERE BROUGHT UP, UM, THAT DIDN'T HAVE READY FOR TONIGHT, UM, UH, I'LL EXPLAIN ABOUT HOW, WHAT HAPPENS WITH A WATER MAIN BREAK.

UM, SO SOMEBODY WILL CALL IN THAT THERE'S A WATER MAIN BREAK, AND IT'LL GO TO SUEZ SUEZ.

SOME SENDS SOMEBODY OUT TO LOOK AT IT.

UH, THEY WILL START REPAIR OR DIGGING UP THAT AREA REPAIR OF THAT WHEN THEY, THEY WILL SHUT DOWN THE, UH, VALVES ON BOTH SIDES.

SO THAT WATER IS NOT FLOWING THROUGH THAT AREA ANYMORE.

AND THEN REPAIR THAT PORTION WHEN THEY TURN THINGS BACK ON, THEY FLUSH THAT AREA.

SO YOU HAVE FIRE HYDRANTS IN THE AREA.

SO THE WATER GETS FLUSHED FROM THAT A PORTION THAT WAS REPAIRED, THEY DO SEND OUT FOR TESTING FOR EVERY WATER MAIN BREAK.

SO, AND THAT GOES OUT, THE EPA GETS COPIES OF THOSE.

AND WE ARE IN COMPLIANCE FROM, UH, THOSE SYSTEMS. THE QUESTION ABOUT THE WATER MAINS POTENTIALLY REPLACED WITH A STRAIGHT PROJECT.

WE HAVE DONE THAT, BUT WE HAVEN'T DONE THAT ON EVERY SINGLE STREET THAT WE REPLACE.

UM, IT'S FOR EXAMPLE, HUBBARD, UM, THERE WEREN'T AS MANY OF THE MAIN BREAKS PRIOR TO DOING THE STREET PROGRAM, SOMETIMES THAT HAPPENS THAT IT COMES AFTER THAT YOU CAN'T NECESSARILY ANTICIPATE THE, YEAH, WE DO HAVE AGING INFRASTRUCTURE.

THAT IS A, THE POINT OF TRYING TO DO MORE WITH LIKE THE LIGHTING PROJECTS.

UM, I'M THE CHEMICALS THAT ARE FOUND IN THE WATER, THE FOREVER CHEMICALS.

YOU'VE HEARD THAT IN THE NEWS, WE HAVE TESTED OUR AREA.

THEY ARE NOT IN THE HUBER HEIGHTS BROWNWATER AREA, THAT'S IN SOME OTHER AREAS AROUND HERE, DOWN AT THE TREATMENT PLANT.

ONE OF THE COMMENTS ABOUT THE, THAT THERE'S THE POTENTIAL FOR, UH, CHEMICALS GETTING INTO THE RAW WATER.

THE RAW WATER IS WHAT COMES DIRECTLY OUT OF THE AQUIFER THAT GOES UP.

WE TAKE IT UP THROUGH, UH, OUR WELLS.

IT GOES INTO OUR PLANT.

WE TREAT THAT WATER.

THEN IT GOES OUT TO THE PUBLIC.

SO THE CONTAMINATION THAT IF THERE WAS ANY CONTAMINATION THAT'S TAKEN OUT IN THAT PROCESS OF, UH, IN OUR PLANT, ALSO, WE ADD THE SOFTENING, THOSE KINDS OF THINGS AT THAT POINT IN TIME.

SO THAT, AND

UM, AND I WOULD ASSUME THAT WITH THE HEAVY EQUIPMENT THAT'S OUT THERE TO DIG UP THE ROAD, TAKE IT AWAY, YOU KNOW, LEVEL IT, REPAVE IT AND ALL THAT STUFF THAT COULD CAUSE SOME ISSUES.

IS THERE ANY WAY PRIOR TO THAT, DO WE HAVE ANY WAY TO INSPECT THOSE PIPES FOR THAT SECTION THAT WE'RE REPAVING TO SEE IF IT'S THERE, BUT WE'RE JUST NOT SEEING IT RIGHT NOW BECAUSE IT COULD BE DISTURBED WITH THAT HEAVY EQUIPMENT.

I WOULD THINK TOO WATERLINES ARE DIFFERENT THAN SAN ANTERIOR SEWER LINES SAY ANTERIOR SEWER LINES.

WE CAN PUT CAMERAS DOWN AND INSPECT, AND THAT'S HOW WE DO INSPECT THOSE, UM, WATER LINES THAT ARE UNDER PRESSURE.

UM, WE CAN'T PUT CAMERAS DOWN THROUGH THERE AS THEY'RE ACTIVE.

UM, SO CURRENTLY DIVERTED LIKE WE DO WHEN WE'RE DOING THE LINING AND RUNNING INSPECTION THROUGH THEM WHILE THEY'RE DIVERTED, AS WE'RE DOING THAT, I'LL HAVE TO LOOK INTO THAT.

UH, IT'S THE REC SOCCER LEAGUE REASON I'M HERE AND ASKED TO SPEAK ON THIS ITEM IN PARTICULAR IS BECAUSE, UH, WHEN THE ITEM WAS PUBLISHED, UH, FOR THE READ AHEAD, I TOOK A LOOK AT THE EXHIBIT A, UH, REGARDING THE FIELD LEASE AGREEMENT AND TALK TO FELLOWS OF MY, UH, BOARD.

OUR BOARD PRESIDENT IS BRIAN DADDY AND ANOTHER OF OUR BOARD MEMBERS, JEFF, YOURS HERE.

AND BASICALLY THE DISCUSSION WAS WHETHER WE HAD, UM, SEEN THIS AHEAD OF, UH, IT COMING PUBLISHED, AND WHETHER WE HAD ANY INPUT THAT WE WANTED TO PROVIDE, THE REASON WE WOULD LIKE TO PROVIDE INPUT IS BECAUSE HUBER HEIGHTS SOCCER LEAGUE USES THE CLOUD PARK FIELDS ALONG WITH THE SOFTBALL AND BASEBALL AND ALL OF THAT.

AND I REMEMBER THIS ISSUE FROM THE LONG AGO WHEN I WAS UP ON THAT DYESS, AND WE HAD TALKED ABOUT HOW TO ALLOW THE PARK TO BE CO USED.

AND ONE OF THE CONCERNS WHEN I WAS A COUNCIL MEMBER, I RECALL WAS ISSUES OF IF ONE OR MORE FIELD WOULD SUDDENLY BE EXCLUSIVELY TO ONE ORGANIZATION OVER THE OTHER, PARTICULARLY IF INFRASTRUCTURE, WHAT I REMEMBER FROM MY TIME WAS IF LIGHT POLES WOULD GO UP OR OUTFIELD FENCES WOULD GO UP THAT OBVIOUSLY THAT WOULD CREATE, UM, UNIQUE OBSTACLES FOR A SOCCER FIELD.

SO YOU COULD STILL HAVE GOALS, BUT NOT REALLY PLAY THE GAME QUITE THE SAME WHEN I LOOKED AT THE AGREEMENT.

UM, AND YOU ALL KNOW MY BACKGROUND.

SO I READ THE CONTRACT.

UM, I NOTICED THAT IT TALKED ABOUT ESSENTIALLY ALL OF THE FIELDS, WHICH OF COURSE WOULD INCLUDE THEIR OUTFIELDS.

AND WHAT CAUGHT MY ATTENTION IN PARTICULAR WAS THAT IT WOULD BE FOR BOTH SPRING AND FALL SEASON.

AND THAT CREATED A CONCERN BECAUSE OUR SOCCER ORGANIZATION ONLY USES THE FALL SEASON AND THE FIELDS THERE.

AND WE ARE CONCERNED THAT IF THIS WAS PASSED, THAT IT WOULD BE IMPOSSIBLE FOR OUR ORGANIZATION TO LEASE THE FIELDS AND USE THE GRASS.

WE TRY NOT TO DO ANYTHING ON THE DIRT.

UH, RESPECTING THOSE FIELDS ARE NOT OURS, UH, TO PLAY ON, BUT THE SOCCER, SO ULTIMATELY LOOKING AT THIS, UM, AND HOW QUICKLY IT CAME.

AND I READILY ADMIT, I DON'T PAY AS MUCH ATTENTION AS I USED TO.

DON'T SIT UP THERE LIKE I USED TO.

SO IT WAS ONE OF THOSE WHERE ULTIMATELY I STARTED TO ASK SOME QUESTIONS.

I APPRECIATE IF I'M NOT TOO OLD HERE, I HAD ASKED SCOTT, IF I GET ASKED SOME QUESTIONS JUST TO GET THIS.

CAUSE AGAIN, I, WHEN I WAS A YOUNG, I PLAYED BASEBALL AND ON PIRATE BASEBALL AND, AND VANDALIA WHERE I GREW UP, THE SPORTS COMPLEX, HAD THE DIAMONDS ON ONE SIDE AND THE BIG GRASS ON THE OTHER SIDE TO ALLOW BOTH LOCATIONS.

AND THAT WAS FINE BECAUSE THEY HAD A ROAD THAT BASICALLY SAID WHICH SIDE WAS, WHICH UNFORTUNATELY FOR CLOUD PARK, IT'S ONE THAT APPEARS THAT IT NEEDS TO BE SHARED.

AND THE CONCERN WAS AFTER READING THIS AGREEMENT, UM, IF IT WOULD EXCLUSIVELY ALLOW THAT, THAT, LIKE I SAID, IN PARTICULAR OFFENSES OR LIGHT POLES OR ANYTHING TO WHERE THERE WOULD BE AN ARGUMENT THAT REC SOCCER WOULD NOT BE ABLE TO USE THE OUTFIELDS BECAUSE THE INFIELDS ARE BEING USED BY THE ORGANIZATION.

IT CREATES A CONFLICT.

THERE HAS BEEN A COUPLE OF TIMES WHERE WE'VE ALL BEEN OUT THERE TRYING TO CO-EXIST AND TALK, AND WE RESPECT THAT.

BUT MY WORRY IS WITH A LEASE IN PLACE THAT'S UNLIKE WE COULD FACE BEING EVICTED.

SO I WOULD ASK THIS COUNCIL TO PERHAPS SET THIS OVER TO A SECOND READING, POSSIBLY ALLOW SOME TIME TO MEET WITH OUR ORGANIZATION AND THE SOFTWARE ORGANIZATION TOGETHER TO DISCUSS THIS.

THAT'S MR. UM, THE CITY MANAGER BEFORE TRIED TO DO THAT, BUT IT NEVER WORKED OUT AS THIS, BUT THAT'S WHAT I'M ASKING.

NOT THAT THIS BE DENIED, BUT IF THERE'S A CHANCE TO AMEND IT SO THAT WE CAN GET IT, I'VE TALKED TO MY BOARD,

UM, IT'S JUST NOW THAT KNOWING THAT THOSE FIELDS THEMSELVES, UM, WON'T GO TO A DIFFERENT BASEBALL GROUP, UM, NEXT YEAR OR SOMETHING LIKE THAT.

IT'S ABOUT HOW THE PAYMENTS WORK.

SO A CERTAIN FIELD THAT CURRENTLY HAS A SPRING SEASON, BUT CANNOT HAVE A FALL SEASON DUE TO WHAT'S LIKE SOCCER.

THEN THERE WOULDN'T BE A FALL SEASON ON THAT FIELD.

THERE ARE SOME FIELDS THAT THERE IS THE POTENTIAL OF HAVING A FALL SEASON, FOR EXAMPLE, OVER AT MANITA FIELD, UM, BECAUSE THERE'S NOT A CONFLICT WITH ANOTHER EXISTING USER GROUP.

SO, UH, THAT DISCUSSION THERE IS ABOUT HOW THE FEED STRUCTURE WORKED.
