UH, THE PROPERTY OWNER, NORMA J MOORE IS IN VIOLATION OF SECTION 13, 13 OF THE PROPERTY MAINTENANCE CODE AT PROPERTY LOCATED AT 56 56 BELL FELTON ROAD.

GOOD EVENING, EVERYONE.

OH, EVERYONE'S HEALTHY.

GLAD TO SEE ALL OUR FIRST CASE AT 56 56 AT BELL FOUND AND ROAD AS A VIOLATION OF THE MAINTENANCE STANDARD.

UM, 13, 13.05, THE NORMAL SERIES OF LETTERS HAS BEEN MAILED A STAFF REPORT READS AS FOLLOWS THE PROPERTY AT 56 56 BELL FOUNTAIN ROAD IS AND HAS BEEN VACANT FOR SOME TIME.

THERE ARE MANY DISCARDED ITEMS ON THE PROPERTY, AS WELL AS TREE DEBRIS THAT CAUSED A BLIGHTING INFLUENCE ON NEIGHBORING PROPERTIES.

THE OWNER HAS NOT CONTACTED THE INSPECTOR AT ANY TIME REGARDING THESE VIOLATIONS.

AND IT IS ASSUMED LETTERS ARE BEING RETRIEVED AT THE PROPERTY SINCE NONE HAVE BEEN RETURNED BY THE POST OFFICE.

THERE ARE ALSO UNLICENSED AND INOPERATIVE VEHICLES PARKED IN THE DRIVEWAY, BUT THESE WILL BE VIOLATIONS ARE PURSUED THROUGH THE COURT SYSTEM.

THE TAX RECORD I'VE SUPPLIED SHOWS, ALL TAXES ARE CURRENT AND HAVE HISTORICALLY BEEN PAID.

I BELIEVE IT IS SAFE TO ASSUME THAT ANY WORK, THIS BOARD ORDERS WILL BE PAID BY WHOMEVER PAYS THE PROPERTY TAXES OR THROUGH THE ASSESSMENT PROCESS.

UH, THE STAFF RECOMMENDATION IS AS FOLLOWS THE BOARD, DECLARED THE PROPERTY IN NUISANCE, THE BOARD ORDER STAFF.

THEY BEGIN AT BATEMAN PROCEEDINGS WITH THE CITY CONTRACTOR TO REMOVE ALL JUNK DISCARDED ITEMS AND TREE DEBRIS.

I'LL BE HAPPY TO ASK ANY QUESTIONS YOU MIGHT HAVE.

OKAY.

DO WE HAVE ANY QUESTIONS? NO, SIR.

NOTHING.

NO PROGRESS MADE BEYOND THE ORIGINAL A VIOLATION.

NO.

ANYONE ELSE ENTERTAIN A MOTION, PLEASE? I'LL MAKE A MOTION THAT WE DECLARE THIS PROPERTY A NUISANCE AND REMOVE THE JUNK.

HAVE A SECOND.

PERFECT.

OKAY.

HAVE A SECOND.

ALSO.

WE'D LIKE TO HAVE A VOTE, PLEASE.

ALL RIGHT, MR. AMBROSE.

YES.

MS. BALLARD.

YES.

MS. GRAY.

YES.

MS. HARRIS.

YES.

MR. ROBERTS, MR. WINKLER.

YES.

SO PMR B CASE NUMBER 20, THIS ZERO SEVEN MOTION CARRIES.

ALRIGHT.

NEXT CASE 20 DAYS, ZERO EIGHT HAS BECOME COMPLIANT.

DO I NEED TO READ OUT THE WHOLE, OKAY.

[00:05:01]

UH, THE PROPERTY OWNER BLAINE CLARK IS IN VIOLATION OF SECTION 13, 13 OF THE PROPERTY MAINTENANCE CODE AT PROPERTY LOCATED AT 54 75 79 NORTON DRIVE, AND THEY ARE COMPLIANT.

SO WE WANT THE NEXT CASE, UH, PMR B CASE 20 DASH ZERO NINE.

THE PROPERTY OWNER, JOHN E SLAVEN IS IN VIOLATION OF SECTION 13, 13 OF THE PROPERTY MAINTENANCE CODE LOCATED AT 50 74 TILBURY ROAD.

THAT CASE HAS ALSO BECOME COMPLIANCE.

MOVING ON TO THE NEXT CASE.

PMR B CASE 20 DASH 10, THE PROPERTY OWNER, PETER TEAGUE IS IN VIOLATION OF SECTION 13, 13 OF PROPERTY MAINTENANCE CODE AT PROPERTY LOCATED AT 49 84 CHESSUM DRIVE.

YEAH.

MR. CHAIRMAN, THANK YOU.

OKAY.

THE, UH, PROPERTY, UH, IS IN VIOLATION OF THE CITY OF HUMAN RIGHTS MAINTENANCE CODES, SECTION 13, 1305 B UH, THE SERIES OF LETTERS HAS BEEN SENT, AS YOU CAN SEE BY YOUR AGENDA.

THERE HAVE BEEN, UH, MORE THAN THE NORMAL COURSE OF LETTERS MADE, UH, AND SENT TO THE PROPERTY.

UH, THE PRO THE, THE INSPECTOR HAD BEEN WORKING WITH THE PROPERTY OWNER TO TRY TO HELP DUE TO SOME EXTENDED WAGE CIRCUMSTANCES.

NOW THAT STAFF REPORT IS AS FOLLOWS THE PROPERTY AT 49 84, CHESHAM HAS AN UNMAINTAINED PRIVACY FENCE LEANING INTO THE REAR YARD.

I WANT TO STRESS IT'S LEANING INTO THE PROPERTY'S YARD, NOT THE NEIGHBOR'S YARD.

SO I WANTED NO QUESTION.

THEIR ZONING CODE REQUIRES SPENDING IS AS FOLLOWS 13, 13.05 B ALL FENCES RETAINING WALLS OR SIMILAR STRUCTURES SHALL BE ANCHORED FIRMLY IN THE GROUND AND SHALL BE CONSTRUCTED IN ANY WORKMAN-LIKE MANNER IN MAINTAINED IN THAT SAME MANNER.

SO THAT SUCH FENCES RETAINING WALLS OR SIMILAR STRUCTURES SHALL ALWAYS BE IN A STATE OF GOOD STRUCTURE WHERE REPAIR OR IN THE ALTERNATIVE SUCH STRUCTURE ITSELF, IT REMOVED OR REPLACED THE PROPERTY CONTINUES TO BE OCCUPIED US.

WHEREAS WE CAN DETERMINE THE TAX RECORD I'VE SUPPLIED SHOWS, ALL TAXES ARE CURRENT AND HAVE A STORAGE BEEN PAID.

I BELIEVE IT IS SAFE TO ASSUME THAT ANY WORK, THIS BOARD ORDERS WILL BE PAID BY WHOM OR PAYS THE PROPERTY TAXES OR THROUGH THE ASSESSMENT PROCESS.

A STAFF RECOMMENDATION IS AS FOLLOWS THE BOARD, DECLARE THE PROPERTY IN NUISANCE, THE BOARD ORDER STAFF TO HAVE THE FENCING REPAIRED BY THE CITY CONTRACTOR WHEN PRACTICAL AND WITH WEATHER PERMITTING.

OKAY.

ALL RIGHT.

IS THERE ANY QUESTIONS FROM THE BOARD NO, I, UH, LET ME CLARIFY THAT.

I'M SORRY THAT I PROBABLY CONFUSED THAT THE INSPECTOR HAD BEEN IN CONTACT OVER THE COURSE OF SEVERAL WEEKS WITH THE PROPERTY OWNER, AS A RESULT OF THE PANDEMICS AND HARDSHIPS.

AND THERE WERE MORE THAN THE NORMAL THREE LETTERS THAT WERE SENT TO EXTEND THE PERIOD OF TIME.

IT NEEDED TO HELP THE OWNER BECOME COMPLIANT.

BUT AS WITH ANY VIOLATION, WE COME TO A TERMINATION POINT AT SOMETIME WHEN WE HAVE TO MOVE IT INTO THE NEXT STEP.

AND THAT'S WHAT WE'RE HERE.

UH, NOT THAT I'M AWARE OF.

I DROVE BY IT LAST WEEK.

I COULDN'T SEE ANY PROGRESS, ANYTHING DIFFERENT FROM THE PHOTO THAT WAS IN THE INSPECTOR'S REPORT.

SO I WOULD SAY AT LEAST WHAT I WAS ABLE TO VIEW IT DIDN'T APPEAR THERE HAD BEEN ANY CHANGE MADE.

ALSO DIDN'T APPROVE IT.

DIDN'T APPEAR TO HAVE GOTTEN ANY WORSE.

DO I GET TO ASK AND YES, MY NAME IS PETER TIG.

IT'S P E T E R T E A G U E.

UM, COUPLE YEARS AGO, I WAS HOSPITALIZED OF NOT REALLY FULLY REGAINED MY STRENGTH AND IT'S BEEN HARD FOR ME TO GET OUT AND DO MY YARD WORK.

AND I HAVE A CONTRACT HERE AND I HAVE SOMEONE WHO'S GOING TO PAY FOR MY YARD TO BE CLEANED UP MY FENCE TO BE TORN DOWN, AND IT'S GOING TO BE TAKEN THAT WAY, BUT THIS IS JUST ONE OF A COUPLE OF CONTRACTS THAT SHE WANTS TO, TO LOOK IN ON.

AND THIS PERSON IS MY SISTER AND, UH,

[00:10:02]

IT'S JUST, SHE WANTS TO DO A COUPLE MORE BIDS BEFORE SHE TIES INTO ONE AND GETS IT ALL DONE.

AND SHE WAS SAYING SHE WANTS TO GET IT ALL DONE BY THE END OF THE MONTH, FIRST WEEK OF DECEMBER.

OKAY.

SO ARE YOU NEEDING AN EXTENSION? YES.

OKAY.

AND HOW MUCH OF AN EXTENSION DO YOU THINK YOU'LL MEET MAYBE A MONTH.

MONTH? YES.

SO IF WE, UH, BECAUSE I STARTED, I STARTED WORKING ON IT MYSELF.

I JUST, I DON'T, SINCE I'VE BEEN HOSPITALIZED, NOT ONLY TO HAVE THE STRENGTH ANYMORE TO DO IT.

OKAY.

OKAY.

SO IF WE GIVE YOU A, AN EXTENSION FOR 30 DAYS, UM, YOU THINK YOU CAN GET IT ALL TAKEN CARE OF? YES.

OKAY.

ALL RIGHT.

OKAY.

MR. CHAIRMAN, I'D LIKE YOU TO, TO DIRECT THE, THE APPLICANT.

IF HE'S GOING TO BE GO BEYOND THE 30 DAYS TO PLEASE GET IN TOUCH WITH ME AND LET ME KNOW THAT YOU NEED A CARD IN A PHONE NUMBER SO WE CAN ESCALATE GOOD WORK ON THAT.

ALL RIGHT.

SO HE'LL GET YOU HIS PHONE NUMBER AND HIS IN A CARD.

AND IF YOU HAVE ANY PROBLEMS BEFORE THE 30 DAYS IS UP, PLEASE CONTACT US.

AND WE'RE MORE THAN WILLING TO HELP WORK WITH YOU.

UH, WE JUST, JUST NEED TO BE IN CONTACT AND MAKE SURE.

AND, UM, YEAH, I SPENT LIKE A COUPLE OF WEEKS DOWN AT KETTERING AND I NEVER REALLY REGAINED ALL MY STRENGTH OR EVEN AT WORK.

THEY CALL ME OLD AND SLOW.

I EVEN AM FASTER THAN PEOPLE, 40 YEARS OLDER THAN I AM.

BUT THEN ONCE I'M SPENT SPAWN, I UNDERSTAND.

ALL RIGHT, WELL, I WOULD ENTERTAIN A MOTION.

I HAVE A COMMENT UNDER THE CIRCUMSTANCES, MAINLY BECAUSE WE'RE DEALING WITH COVID AND SO MANY OTHER THINGS.

WHAT DOES THE POSSIBILITY OF GIVING HIM A 60 DAYS THAT IS ENTIRELY UP TO YOU? YEAH.

YOU CAN PUT THAT IN THE FORM OF A MOTION.

I WOULD LIKE TO MAKE A MOTION.

I MOVE THAT BEYOND THE 30 DAYS, WE GIVE YOU AT LEAST A 60 DAY EXTENSION AND THAT WOULD BE FILED.

THANK YOU, MAN.

OKAY.

SO DO WE HAVE A SECOND ON THAT MOTION? OKAY.

OKAY.

60 DAYS TOTAL, CORRECT? YES.

RIGHT.

SO WE HAVE A MOTION AND WE HAVE A SECOND.

OKAY.

I'D LIKE TO HAVE A VOTE PLEASE.

AND SO THIS VOTE IS FOR THE 60 DAY EXTENSION.

OKAY.

MR. AMBROSE, MS. BALLARD, MS. GRAY.

YES.

MS. HARRIS? YES.

MR. ROBERTS, MR. WINKLER.

YES.

SO MOTION CARRIES TO EXTEND THE PMR, BE CASE 20 DAYS, 10 FOR 60 DAYS.

AND PLEASE, IF YOU HAVE ANY PROBLEMS AT ALL, PLEASE CONTACT MR. MAILLARD AND STAY IN CONTACT WITH US.

IT WOULD BE A BIG HELP.

THANK YOU.

ALL RIGHT.

YOU'RE QUITE WELCOME.

THANK YOU.

ONE OF DON'S CARDS IS RIGHT THERE.

OKAY.

OKAY.

THANK YOU.

.

THANK YOU.

YOU TOO.

STAY HEALTHY, STAY SAFE.

ALL RIGHT.

MOVING ON.

SO THAT'S THE END OF OUR CASES FOR THIS EVENING, UM, FOR ADDITIONAL BUSINESS MOVING ON THE AGENDA.

UM, WE NEED TO APPROVE OUR, UM, WITHOUT OBJECTION OR I'M SORRY, UH, APPROVAL OF THE 20, 21 CALENDAR.

I THINK YOU ALL HAVE A COPY OF THAT IN FRONT OF YOU.

UM, AND AGAIN, IT'S THIS FOR THE SECOND AND FOURTH, THURSDAY OF EVERY MONTH, AS LONG AS THE, WE HAVE CASES READY, SO, OKAY.

AND SO WE WILL NEED A MOTION TO APPROVE THE, UH, 20, 21, UH, CALENDAR.

I'LL MAKE A MOTION.

WE HAVE A SECOND AND WE NEED TO VOTE ON THAT AS WELL.

OKAY.

AND WE'D LIKE TO HAVE A VOTE, PLEASE.

ALL RIGHT.

MR. AMBROSE, MS. BALLARD.

YES.

MS. GRAY.

YES.

MS. HESS? YES.

MR. ROBERTS? YES.

MR. WINKLER.

YES.

SO MOTION CARRIES FOR APPROVAL OF THE 2021 CALENDAR FOR THE BMR B BOARD.

UH, I'M SORRY.

[00:15:04]

YES.

SO I'M GOING TO GET ALL THESE DATES ON THE WEBSITE.

I WILL ALSO EMAIL YOU A COPY OF IT.

DO YOU HAVE A HARD COPY? AND THEN AS THE MEETINGS, AS WE APPROACH THEM, IF THERE ARE NO CASES, I'LL LET YOU KNOW THAT THE MEETING'S CANCELED.

OKAY.

ALL RIGHT.

UM, ALL RIGHT.

MOVING ON APPROVAL OF MINUTES, UH, WITHOUT OBJECTION, THE MINUTES FROM JULY 23RD, 2020 PROPERTY MAINTENANCE REVIEW BOARD MEETING, UM, ARE APPROVED.

IF THERE ARE NO OBJECTIONS, OKAY.

THERE ARE NO OBJECTIONS.

SO THE MEETING, THE MINUTES ARE APPROVED.

UM, NEXT MEETING APPARENTLY UPCOMING MEETING IS DECEMBER THE 10TH, 2020.

SO WE NEED TO TALK ABOUT THAT.

MR. MAILLARD, CURRENTLY WE HAVE NO CASES, UM, DUE TO THE INCREASING CONCERN WITH THE PUBLIC HEALTH SITUATION.

UH, I'M INCLINED NOT TO PUT ANYBODY UNDER ANY FINANCIAL, PHYSICAL, OR EMOTIONAL STRAIN AT THIS TIME TO BECOME COMPLIANT.

AND I'VE SEEN NOTHING FROM ANY OF MY OFFICERS THAT IS ANYTHING I EVER CONSIDERED IN ME IN AN EMERGENCY.

SO MY GUESS IS WE WILL NOT BE MEETING AGAIN UNTIL THE NEXT CALENDAR YEAR.

OKAY.

ALL RIGHT.

FAIR ENOUGH.

THANK YOU VERY MUCH.

ALL RIGHT.

WITH THAT, I WILL ENTERTAIN A MOTION TO ADJOURN.
